live breaking news. breaking news, windy conditions are fueling a wildfire burning right now in san ramon. sky7 is live over the scene over the charred areas. the flames threatened homes, burning up against the backyards of several. but now it appears sort of burning away from the homes. all right we'll show you the fire burning on this location. and east of interstate 680 as we pull out wider from sky7. you can see the homes arndt the corner areas. there is an aerial drop right now dropping water on the flames. by the way, this burned about 10 to 15 acres, east of interstate 680. >> we've seen smoke blowing in developments. fire c called for air support. and we saw one of the aerial drops, water and fire retardant. you can see the retardant at the edge of the screen, the red. we'll keep an eye on the fire and have updates as we continue. as well as the 5 with

you can see bullet holes in a car as well as a police van, a major investigation is now under way. it started around 11:30 last night near e street. now the evidence field stretches for blocks. more than 100 physical evidence markers. abc 7 news reporter vic lee joins us with the latest details on the investigation. vic. >> reporter: police opened this rail crossing about 2 and a half years ago. this is about all that's left of the crime scene tape. dozens of investigators were here all night and all day, looking at all the physical evidence. one suspect was hit in that shooting. he is being treated at a hospital. fortunately no officer was shot. around 11:35 last night here in union city, a shoot out. >> i thought it was fireworks. after that you semiautomatic. and it was over like 20, 30

shots. >> juanita lives across the tracks. >> i was scared. too close to home. >> >> reporter: at mid-afternoon the rail crossing cordened off. evidence markers littering the crime scene. officers tried to stop a car with three juveniles. >> two suspects got out of the vehicle once it stopped. and exchanged gunfire with our officers. >> one of them was hit. both ran into the neighborhood where they were captured. the suspect shot was arrested here on a front lawn stained with blood. part of the evidence an officers medical bag and shield. the third suspect drove the car a few blocks away to railroad avenue and whipple road. here we found a toyota camry with more than 20 bullet holes. in this police van, also with bullet holes in the windshield. police arrested the driver here. lieutenant steve menendez says the three suspects $suspects are

overnight. mainly mild to warm the next two days. then the heat spikes as we get to the end of the week. friday through sunday look for very hot weather inland up to triple digits in some locations. right now we're looking at gusty conditions, gusting to 35-mile-per-hour in san francisco. 20 up north at yukia. and in the inland areas we have wind speeds of 15 to 25-mile-per-hour. so that of course adds to the risk of fire. overnight, lack for a little bit of low cloudiness and fog pushing locally across the bay and inland. overnight lows mainly in the mid-50s. and then tomorrow look at our microclimates we see a high of 60 dree are degrees at half moon. 66 in downtown san francisco. got stuck there a second. across the bay inoakland, high of 72. 88 in walnut creek. 88 over in antioch. quit a warm jum coming toward the end of the we can. generally we'll upper 80s inland tomorrow. look at thursday. we'll see highs into the 90s.

ones under which circumstances you target. >> absolutely. we represent for free, legal representation, survivors of abuse and their children to help them overturn trial court decisions that put them in danger of further abuse. unfortunately all too often trial courts actually award custody of children to an abusive parent which really puts them in grave risk of physical harm and serious emotional and mental harm from being exposed to violence in the home. we try to overturn those decisions. >> the need for that was surprising to me, as i researched this, because i thought under california law the courts really need to keep the children's safety as a priority as they decide on custody and where to place them. >> you're right. but california law does say that. unfortunately we just see the trial carts not applying that all the so an example is one of our clients is now an immigrant from iraq who came here and married a man who unfortunately turned out to be quite abusive.

and was physically abusive to her, strangled her and wouldn't let her learn english. now, when they were divorcing and she asked the trial court for custody of their 1-year-old son, the skort awarded joint custody to her and the abuser and one reason whys spoke better english even though he had not allowed her to learn english as part of the abuse. so it's unjust and puts the child at real risk of being exposed to more abuse in the future. >> and sometimes survivors also face the threat of retaliatory litigation from the abuser. >> that can happen. and we call that litigation abuse. it is a tactic designed to sort of, you know, train them out of money and resources. >> you'll help the ladies with all that. ishld say survivors. >> yes. >> i want to know with the battle of the bands what format it takes? is it an american idol style. >> the public is welcome. doors are open. come buy tickets at the door tomorrow night at 6:00. the audience chooses the winners
