lyanne melendez is in the news room with more. >> it went from the ninth circuit to the supreme court. the supreme court chose to not take the case. which means the ninth circuitinr supreme court found that there was no immediate threat to the sheriff and the jury should decide if the deputy used excessive force. hoping the high court would support their argument that officers don't need to wait for a gun being pointed at them before responding with deadly force to protect themselves and the public. >> we are trying to find out what that balance is. >> reporter: in 2013, andy lopez was carrying a plastic pellet gun that looked like

a new scheme aimed at mandarin speakers across the country have hit residents in san francisco big time. one person lost nearly $3 million. calling it the chinese embassy phone scam. callers from overseas use software to mask their numbers. callers get a call with automated message in mandarin. >> there is not going to be any government entity that is going to ask for your personal information over the phone. >> millions have been wired from victims across the country. a death in the middle of the night during a camping trip.

carlos cau carlos saucedo has the story. >> reporter: southern california chemist was camping with his two daughters this morning when he was shot in the upper body and killed. neighbors say he saw the family before they left on their trip. >> they had bikes on top of the car and ready to roll and i thought this is great, this is family time. investigators confirm he was shot in the tent while his 2 and 4-year-old daughter was inside. they described tristan as an avid outdoorsman who loved to camp. relatives say the family was about to move to the bay area at the end of the month for new jobs. gofundme page to support wife and the two young girls.

livermore is 76. looking out over the bay. we will see foggy areas near the coast and overnight. seasonal patterns in terms of temperature range. another serious warm up at the end of the day. let's look at surface wind. it is still breezy to windy all around the bay area. we see wind speeds up to 15 miles per hour. gusts to 35 miles per hour. clear lake, 20 miles per hour. we will see the winds taper off. most locations we will see wind speeds around four, five, six miles per hour. later on in the day, the winds will increase once again. over night lows, under mainly clear skies will be in the mid-50s. reduced visibility for the

morning commute in some spots. highs tomorrow range from low 60s to be the coast. we will see mid to upper eighth generally inland. ukiah, a high of 93 likely tomorrow. let me give you a look at the high temperature trend. temperatures dropping offer gradually going into midweek. at the end of the week, inaccuracy increase humidity is low. temperatures high, and with the windy conditions, this is not friendly firefighting weather. here is the accuweather seven-day forecast. all locations will see a warm up on friday and especially on saturday. triple digits in our warmest inland locations. further cooling likely on monday. the wind and be the low humidity are a big concern.

stocks sank today amid trade worries. there are reports that trump administration will limit technology exports to china. dropping 328 points. to end trading at 24,252. the nasdaq sank 160 points. netflix worst day in two years. lawyers for san francisco based uber were today. reasons given were uber's poor approach to reporting serious cr offenses. uber has since apologized and changed its busy models. the judge will have a decision on the case tomorrow. the end is in sight for toys

a federal judge said the lawsuit goes too far. new details on a double stabbing that happened near the pride celebration. police tell abc news they arrested a 19-year-old man and are looking for a second suspect. one of the victims has life-threatening injuries after being stabbed in the stomach and leg. the other victim is expected to recover. a 77-year-old resident has been arrested in connection with the murder of a fire captain and a shooting of another firefighter. captain david rosa was transported to the hospital to the l.a. county coroners office. he was shot to death after
