organize labor lost a major supreme court case today. the court ruled workers can no longer be forced to give money to unions that represent them in collective bargaining. in a 5-4 decision justices ruled mandatory fees violate the free speech rights of workers who don't want to contribute. the ruling could cost unions tens of millions of dollars and over a million members. in addition to the supreme court decision, dan. >> right that's right, kristen in addition to that decision on union another big story today of course. major story, the announcement that justice anthony kennedy will be retiring. joining me today is an old friend of mine professor david levine from uc hayesings law

school. >> of course pleasure. >> let's talk about the decision regarding unions in a big blow it is but not unexpected preponderate the reason why this has been a projects of justice alto for a long time we have to go back to a case from 40 years airing called abudp if you are a public employee union member and don't want to support the political party of what a union does and don't want to be a union enemy that's fine. but tough pay the portion of the twos goes to representation. it's not fair for somebody to be not a uneyen member to have the union go out and get you say a 3% raze and then say great i get the goodies and don't have to pay. that was the compromise. now what justice alito by signaling he wanted cases to come forward onto challenge this he dents like the compromise it's way to challenge the unions. he almost had it except justice scalia died on him there was a 4-4 split. but today justice alito prevailed.

even cases on apportion he votewood the liberals. one thing that happens is chief justice roberts will become the swing vote we can assume that president trump is going to pick somebody as much as he can in will in the mold of justice gorsuch. so the balance of power will swing to the right. that will mean several different things. one is that you won't have somebody who sometimes goes to the liberal side. except justice roberts might but not as often. that's one. >> sure. >> the other is the way cases are constructed opinions are constructed will shift masterpiece cake from a couple much weeks ago the baker who didn't want to serve the gay couple, that opinion came out from justice kennedy but it's a very narrowly drawn opinion. and while it gives a nod to gay rights and nod to religious rights it's very much specific have blown a huge mole in gay right protection. >> interesting. so the way the decisions are written is likely to change.

gusts. 22-mile-per-hour at novato. 28 at san francisco. in fairfield gusts up to 31-mile-per-hour and all around the bay area looking at wind speeds near 20-mile-per-hour or above. that pattern remains with us. it's been breezy like this the last several day processes overnight a little bit of increase in low clouds and fog moving over the beau and locally inland. overnight lows in the same range all week long. mainly low to mid-50s. tomorrow sunny skies breezy at the coast. a patch or two of lingering fog. highs range from low 60s at the coast to upper 60s and low 70s near the southerlien. inland areas warming up to 80s process. warmer farther north in lake port and clover dale 88. 92 at ukiah. and warmer still on friday. and here is why we get the big warm-up. a huge area of high pressure area is just positioned offshore here. that's the controlling factor in the weather the next several days. circulation around that center
