court farther to the right. abc's lynda lopez joins us with the latest. good morning, lynda. >> reporter: kendis and diane, justice kennedy's retirement setting the stage for an epic battle between democrats and republicans on his replacement and president trump beginning that battle at a campaign rally wednesday night. at a rally in north dakota for republican senate candidate kevin cramer, president trump wasting no time addressing the upcoming vacancy on the supreme court. >> justice kennedy's retirement makes the issue of senate control one of the vital issues of our time. >> reporter: the president making it clear he's aware his choice could reshape the court for decades to come. >> we have to pick one that's going to be there for 40 years, 45 years. >> reporter: justice anthony kennedy who was appointed by ronald reagan and served for six administrations often sided with conservatives but also wasn't afraid to side with liberals to be the deciding vote in landmark cases upholding affirmative action. on abortion, reaffirming roe v.

wade and ruling for marriage equality. his decisions making him the crucial swing vote on the court. senate majority leader mitch mcconnell promising to confirm kennedy's successor before november's midterm elections. >> the senate stands ready to fulfill its constitutional rule. >> reporter: but mcconnell blocked a vote on obama nominee. >> reporter: but mcconnell blocked a vote on obama nominee merrick garland until after the 2016 presidential election, and senate minority leader chuck schumer insisting there should be no vote before the midterms. >> millions of people are just months away from determining the senators who should vote to confirm or reject the president's nominee. anything but that would be the absolute height of hypocrisy. >> reporter: schumer saying the fate of health care, reproductive rights for women and other protections for the middle class are at stake. now, republicans have just a one-vote majority in the senate so all eyes in this battle will be on democrats to see if they'll try to sway a handful of pro-abortion rights republicans to vote with them. kendis, diane.

hailed this opportunity as, quote, the moment conservative women have been waiting for, the chance to return justice to the nation's highest court, and as advocacy groups hunker down for what they say will be a battle for the heart of this country, the president and congress are gearing up for a grueling confirmation process. >> the democrats shot themselves in the foot. they were the people who argued for eliminating the filibuster on justices and they got their way, and the bottom line is that all that a nominee will need is 50 votes plus the vice president, and that nominee will win. >> reporter: terry moran in washington, d.c. >> now, legal experts say a conservative appointee to the court does not necessarily mean that roe versus wade will be overturned because justices tend to be deferential to previous decisions. well, the full details about an upcoming summit between president trump and vladimir putin are expected to be announced today. the two leaders haven't met

since their brief discussion at a foreign summit last year. national security adviser john bolton worked out the details of the summit during a meeting in moscow with putin himself. the summit is expected to take place next month in europe. now to the crisis at the border. a government watchdog is launching an investigation into conditions at shelters for migrant children. the inspector general of the health and human services department will look into accusations of mistreatment and abuse. investigators will also examine training and qualifications of those caring for children in federal custody. meanwhile, on capitol hill house lawmakers have rejected a so-called compromise immigration bill. nearly half of republicans oppose the measure. overseas a u.s. military special operations team is now joining the effort to rescue a boys soccer team trapped inside a cave in thailand. heavy rainfall is hampering the search causing muddy water to rise inside the cave. rescuers believe the boys and their coach are sheltering inside a flooded chamber of the cave. now they've been missing since

saturday when they went on a side trip after a game. divers have been pumping water from the cave, but water levels are rising at a rate of six inches an hour. now, crews do admit time may be running out to save the boys and the coach. >> time now for a look at your weather for this thursday morning. we have a new look at the damage after a tornado with winds of up to 165 miles per hour tore through eureka, kansas, on tuesday night. nearly 200 buildings were damaged, and 8 people were hurt. looking at the radar right now, the hot spot is in the northeast. heavy downpours are stretching from philadelphia up into maine this morning. temperaturewise it looks like summer has arrived in nearly every part of the country with highs today mostly in the 80s, the 90s and into the triple digits in the southwest. 108 in phoenix, 100 in albuquerque, 101 in dallas.

slam. the suv's grill got hurt a little bit, i guess. that man has still not been identified. i'm sure his hand is hurting. >> geez. all right, well, authorities in southern california are now investigating whether a serial shooter is targeting a popular campsite. tristan beaudette was shot in the head and killed last friday while camping with his two young daughters at malibu creek state park. investigators are now looking at five other shootings in that same area including the case of james rogers, who says he was sleeping in a hammock when he was hit in the arm. >> i was in and out of the hospital for a couple of weeks. eventually a bb, a little bb started coming out of my arm. when you think about going hiking or backpacking or out into the wilderness, i never used to think about humans as being part of the danger out there, and that definitely ge v. >> yeah, you bet.of fivshootingn and around that campground. the most recent was five days before he was killed. an east pittsburgh police officer is free on bond after being charged in the death of a black teenager.

michael rosfeld is facing a criminal homicide charge for shooting 17-year-old antwon rose as rose, you see here, ran away. now, prosecutors say the officer changed his story about whether he saw a gun in rose's hand, and they've now released video of an earlier shooting that shows a different teen firing from the backseat of the vehicle. rose was in the front seat at that time. the alleged shooter has been arrested. in the meantime, a similar case in georgia where an officer is facing charges for the death of another black man. authorities say officer zechariah presley shot tony green after green ran from a traffic stop. reports say presley has had nine complaints against him since joining the kingsland, georgia, police force only a year ago. turning now to the economy, there's some new evidence of just how tight the job market is. kohl's is already hiring for the holiday season. the department store is now accepting applications for seasonal positions. the current job market has made it hard for companies to find workers.

details now about a strange scene on a highway in florida. >> yeah, a man was seen clinging to the hood of a car speeding down interstate 95. well, this morning we are hearing from that man and from the woman who was behind the wheel. this morning the unbelievable 911 call made by this man seen here riding on a hood of a speeding car in south florida. >> you're on top of the car right now? >> yes, i'm top of a speeding vehicle. could you please help me? >> reporter: junior francis, the human hood ornament, says it started with an argument with his on again, off again girlfriend patresha isidore. isidore is the one behind the wheel. francis says that he wanted to use the car that they share, but she got to it first. >> she turned the engine on, dropped it in reverse and started driving out. >> i had to go get my child, so i wasn't going to deal with any fool. he had plenty of time to get off the car. he didn't want to stop. >> reporter: francis says he jumped on the hood outside their home to keep isidore from leaving and then moments later after hitting speeds of 70 miles

an hour, francis called 911. >> i'm top of a speeding vehicle. someone's trying to steal my car. >> okay, what's the address? >> i don't even know where i'm at. >> it was with one hand and the other hand i'm holding the phone. >> reporter: for 15 miles francis hung on like this before isidore finally stopped. video of the incident mesmerizing people online, but police say the danger cannot be overstated. >> i understand that it's gone viral, but a lot of people need to understand the dangers that this suspect put everyone in, not just the victim that was on the hood of the car. >> reporter: the couple says they still live together for now while isidore faces charges because of the incident. >> that guy is crazy. he won't leave me alone. we broke up about eight months ago. he popped up at my job. i no longer have a job now, and he just won't leave me alone. >> just watch yourself, and be careful who you love. >> well, thank you for the advice. well, isidore has been charged with culpable negligence, which is putting another person at risk of injury for death. she says that she's in the

process of getting a restaining order. and this morning we're remembering the patriarch of one of the most successful families in modern music. joe jackson, who launched the jackson 5 and spearheaded the solo careers of son michael and daughter janet, has died of pancreatic cancer at age 89. a strict and physical disciplinarian, jackson often feuded with his children and was accused of both emotional and physical abuse. but overnight on instagram, michael jackson's daughter paris paid tribute saying your life's work will go down in history as will you to be known as one of the greatest patriarchs to ever live. music industry observers say jackson leaves a complicated legacy. >> they had innumerable number one hits from motown, but they did more than that. they put motown back on the map at the end of the '60s and the beginning of the '70s. all that goes back to joe pushing his kids to perform perfectly. >> joe jackson died just one day after the ninth anniversary of his son michael's death. the brother of new york giants player janoris jenkins

has been charged in the death of a music producer. 34-year-old william jenkins jr. is charged with aggravated manslaughter in the death of roosevelt rene, who was a family friend. his body was found in janoris' home in new jersey on tuesday. both men were living in that house. some homeowners in tennessee can say their cats may have been targeted by someone shooting off fireworks. a surveillance system at their home near nashville caught the firework coming through the window and sparking a fire. the couple living in the house say that it may have been an attack on their 11 cats. but all of the cats survived. meanwhile, the government is warning everyone about the danger of fireworks ahead of july 4th. fireworks destroyed several mannequins in a matter of seconds during this annual demonstration on the national mall. officials say 13,000 people were injured by fireworks last year. up next in "the pulse," a change at dunkin' donuts. and also ahead, one woman's secret to healing sunburns in just one day. does it work?

let's get a check on the commute. alexis? good morning, mike. no major issues to talk about. we do have some residual delays for the central valley commute but it's not terrib, andapped u schedule. 21 miles an hour and 30 miles an hour. that's a lot better than it was even 15, 20 minutes ago and all that paving work wrapped early as you head through the altamont pass area. also southbound 680 through walnut creek nice and light. next traffic update in a couple minutes. we're tracking breaking news in san jose. a bad crash with a truck in a person's front yard. >> and firefight hers to cut a driver out of one of the vehicles involved. matt keller live for us on vine street this morning. matt? >> reporter: good morning, reggie and natasha. what a mess out here on vine street at edwards avenue. you can see they had one of the vehicles on the back of a tow truck.

they have three other vehicles here that were damaged overnight and they are working to get all these cars removed or at least out of the way so they can open back up vine street here in downtown san jose. seven vehicles involved in this. it happened just before 1:00 this morning. police say a pickup truck crashed into another car causing a chain reaction that led to three parked vehicles being hit there. the victim's vehicle, a black lexus, was heavily damaged. firefighters had to extricate him from the car. they were able to take him away on a stretcher. a block away the suspect's vehicle crashed into two more parked cars. the driver was arrested for hit-and-run. another passenger took off. police say they know who he is. a female passenger was also injured. the injuries of the two people are considered serious but not life threatening. a lot of work still needs to be done on vine street. reporting live, matt keller, abc 7 news. firefighters are making good progress against the pawnee
