we have gotten a lot more information about what happened there. >> this incident involved this truck holding oxygen. highway oking at a sky 7 101 now. and also old redwood highway alongside, also open in both directions. i should tell you one person is injured. that is new information. it is not clear the extent of their injuries though. just a few minutes ago we spoke with paulnt of an explosion and fire in the vegetation. the fire was quickly extinguished. the focus was on getting the liquid oxygen secure itself. >> the type of liquid oxygen as you just heard, cryogenic oxygen released is no longer a danger. officials were afraid a cloud could blow away and onto the surrounding highway.

fortunately that did not happen. >> buildings on the north campus of kaiser permanente remain closed. officials are trying to work to get employees back to their cars. now, once again, this incident is no longer a danger to the surrounding community. but one person is injured. highway 101 reopened. >> good evening, i'm dan ashley. >> i'm kristen sze. thanks for joining us. a fiery situation on interstate 80. traffic backed up for miles. a big rig ignited at cherry glen road. flames spread causing a small grass fire. the right lane and exit rafrm are still closed right now. drivers are being urjd to avoid the area. the ferguson fire burning west of yosemite national park is 5% contained tonight. burned more than 17,000 acres since friday. no structures destroyed, but hundreds are threatened. firefighters say the area hasn't burned in years, and is full of dense and dry fuel. today, clearer skies allowed helicopters to take off and

directly attack the fire. >> the visibility has increased for us earlier in the day. so as soon as we are able to get aircraft up in the air, as you can see behind you, we've been able to do so, utilizing as much as we can. >> one firefighters was killed over the weekend. two others have been hurt. yosemite is open and fully operational. air quality is poor. gusty winds could be a problem for battling the fire. for more on that, let's bring in sandhya patel. it is gusty right now. take a look, out of the west, 16 miles an hour, a hot 97 degrees, relative humidity is low, 20%. the winds will remain on the gusty side. but the biggest thing here is the wind is going to switch direction from northwest, eventually going south as we head towards tomorrow. that's going to make it tough for the firefighters. air quality alert for smokey and unhealthful air conditions due to the ferguson fire, the alert expanding to cover a wider area

from yosemite's half dome, very tough to see in that area. because of the smoke. dan? >> sandhya, thanks very much. there has been a remarkable outpouring of moral and financial support for surfers and friends of a santa cruz man seriously injured while riding the waves on saturday. they're boosting his morale and helping financial. the well-known santa cruz surf spot where this happened, david louie is. >> reporter: the accident happened here on saturday afternoon when conditions were a lot different than right now. brian hart is paralyzed, a condition everyone is hoping is temporary. yet the -- unlike the conditions you see here there were swells running. when brian hart was surfing, as he's done his entire adult life. this is video his wife posted on instagram. he crashed into the cliff

apparently head first. it opened a gash in his head and rendered him unconscious. >> i heard he was pitched into the white water and the white water pushed him into the cliff unfortunately. it's really sad. >> reporter: you have no control at that point. >> you have no control at that point. >> witnesses are calling for help. >> numerous calls from the public, we have him out of the water at this time. they have cpr in progress. 45-year-old male, not conscious, not breathing. >> hart was really 53, and is in serious condition at valley medical center where his wife recalled what happened. >> i didn't recognize him when they were bringing him in because he literally looked gray, black almost. so i didn't recognize him. >> their 15-year-old son santiago administered cpr and revived him. however, hart sustained damage to his cervical spine, arms and legs paralyzed. friends set up a gofundme page, that's raised close to $40,000 to help the family.

six to eight men left the scene in a newer model silver or white mini van, possibly a nissan quest. anyone with information should contact berkeley police. a blocked ballot measure to divide the state into three. the court today ruled prop 9 should not be on the november 6th ballot because the potential harm of permitting the vote in a few months outweighs the potential harm of delaying it. the planning and conservation league filed a lawsuit last month arguing the state constitution requires a two-thirds vote of both chambers before a proposal this significant can be put to voters. even if voters had approved prop 9, it still would have needed approval from the state legislature and the u.s. congress as well. mgm resorts international is feeling the heat following an announcement that the company has taken legal action against some of the victims of the route 91 harvest festival shooting in las vegas. some are calling for a boycott of their resorts.

58 people were killed, and more than 500 wounded that horrible night. abc 7 news reporter >> reporter: kim sugar cuubube rooms was used to commit the deadliest mass shooting in u.s. history. mgm announced it was trying to shield itself from anyone trying to sue them. >> i literally felt sick to my stomach. i don't -- i'm not a lawyer, obviously. soleilly i don't know what ways they can do to try and defend themselves. >> reporter: here's how. mgm wants the federal court to rule it can't be held liable for what happened last october 1st based on the homeland safety act of 2002. after 9/11, congress passed a law sate stating that private security companies are protected even if they fail to prevent a terrorist attack. >> mgm was not a certified security provider.

but i understand that their outsourced security vendor was. >> that security vendor was hired by live nation entertainment and mgm. here's part of mgm's statement. congress provided that the federal courts were the correct place for such litigation relating to incidents of mass violence like the one where security services approved by the department of homeland security were provided. mgm also claims this was an act of terrorism. therefore the company is also protected under the security act. >> to me, it triggered that night again. it triggered ptsd again. it triggered lack of respect. >> reporter: this is the first time the company uses the homeland security act claiming immunity. legal experts say mgm faces an uphill battle. in the newsroom, lyanne melendez, abc 7 news. authorities are releasing new information today on a deadly crash between a car and a light rail train earlier this

month. investigators now believe the car drove through the crossing arms, not around them as previously reported. two men were killed in the accident. that took place on lincoln avenue near ozuray avenue on july 8th. new information on the man san francisco police arrested last week nicknamed the ride share rapist. he drove for lyft. tonight you may be wondering how he passed the background checks. abc 7 news reporter vic lee has answers for us. >> reporter: san francisco police arrested 37-year-old orlando vilchez lazo. he posed as a ridesharing driver who picked up women outside bars and clubs, then raping them. ride share says he's a former driver and it's investigating how he passed security checks. there's a driving record check.

the background check looks for criminal record including sexual offenses. you have to have a valid driver's license and insurance on a car that's registered. lyft says its drivers must be eligible to work in the u.s. that means being a citizen, having a green card, work visa, or a student visa, and a social security number, which means you have to be a legal u.s. resident and provide documents. but lazo fraudulently represented himself. there's another reason why he passed the background checks. >> this defendant, as far as i can tell, has no criminal history. >> one footnote, neither lyft nor uber requires drivers to get fingerprinted. they cited in a ruling last fall it was unnecessary. vic lee, abc 7 news. a different kind of chop shop for ebay, a mass layoff happening at a critical time for theo recalls to tell you about.

week ebay will have cut nearly 300 bay area employees with the majority of those layoffs coming in san jose. industry analysts say although the loss of jobs can be sobering the silicon valley economy is strong isser than it's ever bee >> the hope is that those employees affected will be able to be reabsorbed back into the silicon valley ecosystem that has a record unemployment rate of 2.8%. >> reporter: a spokesperson told abc 7 news that all affected employees were notified the end of june. it's trying to align its workforce with new initiatives, a recent push to rebrand the platform as a place for shoppers to discover new products. according to fortune, while the company success revenue is up to $9.6 billion last year from 9 billion the prior year, it took a loss of 1 billion. >> the competition has gone up. now you have lots of places online you can get stuff. so part of, i think, the challenge for ebay, if it does not evolve to what the next

moving right along. temperatures hour by hour will be going up very quickly. trust me on this one, up into the mid-90s. live picture right now from the south beach camera, showing the sutro tower surrounded by fog. there's a slight chance of thunder and a typical summer pattern returns for the weekend. getting rid of some humidity. but overnight, there will be changes, 5:00 a.m., fog for the commute, and then we start to see that monsoon moisture increasing, best chance of thunderstorms tomorrow will be in the sierra nevada as you will notice. but there is a slight possibility that between tomorrow afternoon and friday evening we may see a little bit of that moisture creeping into our area. so this is just one of the weather computer models. we'll put in a slight chance of thunderstorms with some showers here locally. if there is dry lightning, could trigger fires spreading rapidly. fog first in the morning, temperatures in the 50s around the coast and bay.

california voters in counties where they had to pay for postage for their mail-in ballot won't have to anymore starting next year. the governor is requiring them to provide pre-paid ballots. it doesn't cover the november election. for the second year in a row, fremont is named the least stressed city in the u.s. that's according to wall let hub. four criteria, stress at work, with finances, family and health and safety. sa santa rosa are only a few steps behind. the most stressed city on the survey was detroit. >> well, a bit of stress for a resident in berkeley's elmwood neighborhood, his cleaning crew called him on vacation telling him a stranger answered the door
