orlando vilchez lat zo will be in court facing charges stemming from the alleged attacks on four women. abc 7 news reporter amanda del castillo is live at the hall of justice. amanda? >> reporter: in just about four hours we know that la zo will be answering to the rape charges. in court documents obtained by abc 7 news they detail some of the chilling accounts. we want to get you to video of lazo when in court for a previous appearance when know that orlando vilchez lazo is accused of posing as a ride share driver picking up women from san francisco night clubs and bars and taking them to a secluded location and raping them. the attacks happened over a five-year period dating back to november 2013. it was dna evidence that linked each case. most victims were threatened with a knife. one described what happened as he dozed off during her ride. quote, he began to threaten her and held a knife to her neck.

she realized that the wetness on her hand was her blood and she had been trying to fend off the knife with her hands. we know that lazo is an undocumented immigrant from peru. lyft says lazo is a former driver and investigating how he passed its security checks. lyft announced wednesday it was beefing up those checks and specifically those checks will apply to those who are currently driving and future drivers for lyft. for now reporting live in san francisco, amanda del castillo, abc 7 news. >> the whole thing is horrifying. thank you. a local couple is taking legal action against the air force. they say their 5-year-old daughter was sexually assaulted twice at a day care on travis air force base. the couple says fellow students were responsible. they're taking the first steps toward a lawsuit. their attorney filed a claim accusing day care staff of negligence and accuses the base of failing to contact police or child protective servicenes in

timely manner. >> no child should have to go through what our daughter went through. >> this is as bad a situation one could happen and in terms of sending your child to school and that child being sexually abused by another child. >> a base spokesperson responded to the claim saying upon notification immediate action was taken to inaffected families and engage agencies on and off the base to investigate and review procedures. a setback for the controversial plan to split california into three states. the state supreme court took the initiative off the ballot yesterday. >> what's next in the fight. >> reporter: the chance at a golden state triple threat suffered a setback. the state supreme court blocked prop 9 from appearing on the november ballot preventing voters from having a say. >> if they pulled it from the ballot they're probably thinking this is a huge red flag.

>> reporter: the bay area would have been part of northern california. the proposal qualifed for the november ballot after its author and backer tim draper gathered over 400,000 valid signatures, but opponents argue the measure would abolish the state constitution and all state laws. the court ruling says the potential harm in permitting the measure to remain on the ballot outweighs the potential harm in delaying the proposition to a future election. >> this is a really big change that can't just be put on the ballot by, you know, a citizen initiative. >> reporter: san jose state university political science professor melinda jackson goes on to say the proposal could come up in a future election after a further review. >> it's unlikely we would see the proposal be successful in the future because there doesn't seem to be a lot of popular support behind it. >> reporter: this isn't the first go around at splitting up the state. draper's plan to break up california into six states also

failed. and chances, it won't be the last. >> maybe i'll start running a campaign to bring it back. >> reporter: carlos al sado, abc 7 news. immigration officials did not ask his department to sweep a protest in the city. >> according to the examiner, the arrest of several protesters who are camping outside i.c.e. last week raised concerns that sfpd was helping immigration authorities and suppressing free speech. the protesters were calling for i.c.e. to be abolished. in this video from july 9th shows police officers at washington streets ordering people to leave. the police chief says the encampment was a public nuisance. i.c.e. officials appear to be detaining and deporting more immigrants who have applied for visas. the u visa allows victims of crimes to get a visa and green card before applying for citizenship. immigration attorneys say applications can take years to process so many immigrants are

being deported while waiting for the visas. the recently retired i.c.e. acting director says there have been no changes to u visa protocol. and time now approaching 5:07 on thursday morning. live doppler 7 with satellite showing you the low cloud cover has descended across the region. that's the gray shading you see on your screen. we'll flip it over to visibility, certainly having issues with fog. santa rosa, visibility down to 1 mile at this hour, three miles for both half moon bay and petaluma. dense fog certainly an issue for the early morning commute. temperature wise, mid 50s to mid 60s out there. inland we're mild in the 60s along the coast a little cooler in the mid 50s. light jacket needed this morning. future weather showing you by 9:00 we expect as we go hour by hour the cloud cover to pull right back to the coastline and into the afternoon, one difference you'll notice in the sky compared to yesterday, high clouds streaming in thanks to a

looking better. a few more of those cash booths open and no metering lights yet if you are using fastrack you're moving through fine. we should about a ten minutes to go until those are turned on. >> speaking of the roads, we have new video of the stretch of highway 1 that was closed for 14 months along the big sur coastline. take a look here. vehicles driving along the new pavement in the fog. this stretch of highway opened yesterday at 10:00 a.m. heavy rain caused a mudslide that buried the roadway under tons of debris in the mud creek area. caltrans says it was the biggest slide in its history. soil slid into the oceans creating 15 acres of new coastline. caltrains says there's more work to do and may be traffic delays through the end of the summer as the crews finish the drainage features along the highway. santa rosa is in financial trouble following the north bay wildfires. today city officials plan to discuss how to close the widest budget gap in years. the press democrat reports the

budget passed last month includes a $14.2 million deficit. the city manager says this is unsustainable and will require significant cuts or tax hikes. a center in santa rosa will serve nearly 600 people impacted by the north bay wildfires. abc 7 news was at the new branch of the committee on the shelter list or cos in santa rosa last night. the organization provides assistance for people struggling financially by paying their rent or security deposits and helping them become self-sufficient. >> santa rosa there were thousands of homes that were lost and people that really need support that have lost those homes. >> if you are in need of help or want to donate to help others we've posted a link with how you can get involved on our website, abc7news.com. of an emergency. lawmakers have a plan to make sure you know what's going on. >> comic-con kicks off in san diego today.

thunderstorms in southern california. yesterday authorities had to close beaches in santa monica and malibu because of strikes. the beaches are back open but heavy downpours and strong winds are possible again today and tomorrer its newest tools to monitor fire danger in california. >> weather stations going up across the bay area and northern california and they measure wind speed, wind direction, temperature and humidity. pg&e says they can use that data they collect to make critical decisions like shutting down electricity in areas deemed to be a high fire danger. >> that's a last resort but if conditions are right and we feel it would be safer to turn offer power, having some of this weather data will allow us to do that. we will give customers as much notice as we can, hopefully 48 hours notice. >> it's part of the utility's community wildfire safety program launched after the wildfires to try to prevent a repeat. pg&e has installed 50 of these

so far. they plan to put up 150 more by the end of the year. the u.s. senate may consider a bill to add emergency alerts to on-line streaming services like netflix and spotify. it's part of changes proposed to the emergency alert system by senators in hawaii and south dakota. the state of hawaii's investigation. >> january's false missile alert that caused panic in the state found shortcomings in the exist system. other proposals include perhaps taking away the option of disabling federal alerts on your cell phone and building a better system to prevent false alarms. a lawsuit against betsy devos and the department of education could possibly be dismissed today. several groups filed the lawsuit earlier this year offer new rules that impact how colleges should manage sexual assault investigations. the groups say the new rules discriminate against students who report sexual assault. devos has called the old obama era guidance a, quote, failed

investigation, contra costa sheriff's deputies responded just before 11:00 last night. not clear what happened but one person found dead. you can see investigators detaining one person putting them in the back of a patrol car. roads were closed during the investigation. we have a call right now in to the contra costa sheriff's office and bring you more information as soon as we get it. facebook ceo mark zuckerberg trying to clarify comments he made about holocaust deniers that have drawn sharp criticism. >> he said he thinks comments from deniers should not beform abc 7 news reporteratt keller aceboosrts with more on this controversy. matt? >> this is getting a strong reaction and people disagreeing with mark zuckerberg. this comes from an interview with recode that was published yesterday. zuckerberg told the reporter cara swisher that he's jewish and there's a set of people who

afterwards. you see it there. employees and patients had to evacuate because the fire department says there was potential for another explosion. >> in this building there's outpatient surgeries so people who were recovering from surgery and people on ivs hooked up still, some people in beds. >> authorities had to shut down highway 101 in both directions because the explosion caused a small brush fire and gas leak that was later secured. berkley police need help identifying the men who attacked a senior citizen. the surveillance video you're about to see may be difficult to watch. here's the thing it happened right across the street from a police station. see the group of men knock the 72-year-old to the ground. that's not all. they start to kick him. this happened about two weeks ago on martin luther king way near university avenue and police say there's no apparent motive. >> no money taken, no demands made. >> the lighting isn't ideal.

so we're hoping that somebody will maybe recognize a piece of clothing or perhaps the way the suspects walk. >> police say there may have been up to eight attackers in their late teens or early 20s. you can see at the top right-hand side of your screen there's a vehicle there. that vehicle is a newer model silver or white minivan. berkley police warning about a suspected peeping tom. this surveillance video shows the suspect lurking outside a house on prospect street at channing way. police say a woman inside spotted the man through a window exposing himself as she alerted her roommates the man left. if you have any information that might help berkley police give them a call. and palo alto police need your help in identifying this man who peeped through a bedroom window of a home last week. it happened just before midnight last wednesday on waverly street. video shows the man going through the backyard through a closed gate, looked through a

window for several minutes before leaving. officer arrived and tried to track the man with a k9 but unable to locate him. thunderstorms posing a harm near yosemite. it is still only 5% contained. smoke from the fire has led to an air quality warning for visitors. so they're saying you're supposed to avoid heavy exertion that includes hiking. the concern is that thunderstorms in the sierra could produce erratic winds and lightning and that could start new fires. on the other hand the storms could bring some muchd rain. drew? >> we still have some issues with that air quality around that fire. still an air quality alert for a wide area near that fire. the areas shaded in gray right now near fresno as well. the air quality because of the smoke is turning unhealthy. back at home no issues with air quality. our air quality is good. fog is an issue this morning.
