there on the moun right now and coming down and having breakfast and a briefing in just a little while here. in about an hour. now they are getting a lot of help from firefighters. 250 fire personnel on the lines. they also have a lot of help from the air. cal fire deployed two helicopters and four air tankers, able to drop flame retardant on the hillside. grass fire in the area of c country club road. sky map 7 shows where the fire spread near weller road. two ranchers and fire people were evacuated the area. one structure was lost. >> especially as the fires move into the heavier fuels the heavier fuels are burning very actively when we get fire in there, and so it's just, again, a byproduct of several years of drought. >> reporter: now the fire also threatened some radio and tv towers. neighbors say the remote looking hill is popular with hand gliders. last update by cal fire has it at 322 acres and 40% contained. we're expecting an update on

those numbers at 7:00 a.m. reporting live here in milpitas, matt keller, abc 7 news. >> thank you. meanwhile, a final good-bye today to a firefighter who died while fighting the ferguson fire. that's the fire burning near yosemite national park. 36-year-old braden varney died last saturday while operating a bulldozer near the fire line. today friends and family will say good-bye at a memorial service in modesto. varney served in the cal fire's merced units for a decade and leaves behind a wife and two young children. also this morning the same fire proving to be tough for fire crews. the ferguson fire has now burned more than 50 square miles in just ten days. apart from varney, four others have been hurt fighting thees. theircontaid. eveling news out o missouri, the coast guard is going to try to retrieve the sunken duck boat today after an accident left 17 people dead. this comes as the community gathered to mourn those who lost their lives. ♪ o lord my god

he was arrested less than 24 hours later and pleaded not guilty in court two weeks ago and again he will be in court again today. in a san francisco courtroom this morning, lee johnson scheduled to begin testimony in his lawsuit against monsanto that makes round up. the 46-year-old johnson from ven knee shah claims using dozens of gallons of round up in his job gave him terminal cancer. monsanto's attorneys say scientific evidence is overbheming the weed killer does not cause cancer. what the jury decides could set a precedent for hundreds of future cases. six people are in custody following a police pursuit in oakland. opd tweeting this last night, they were asking residents to stay in their homes. ra few blocks north of the fruitvale bart station. police say a pursuit ended in that area and the suspects ran into a home. they ended up surrendering to officers an hour later. an east bay congressman

>> it's happened again, strong winds picked up an umbrella and impaled a woman in ocean city maryland, yesterday, when the umbrella struck her in the chest. video of her getting a helicopter ride to a nearby hospital. baltimore abc affiliate wmar reports she's expected to make a fuel recovery. last week we told you about another woman hurt by a flying umbrella in new jersey. survivors of the las vegas mass shooting expected to speak this morning about a lawsuit filed by mgm. the company owns mandalay bay hotel where the gunman staged his attack on a country music concert last october. mgm is suing 1,000 victims in hopes of avoiding liability claims citing a 2002 law established after the 9/11 terrorist attacks. the survivors feel like mandalay bay didn't do enough to protect them. houston police have released this sketch of a suspect in the murder of a prominent cardiologist there.

and westbound 84 dumbarton bridge decent alternate in the green at 9 minutes. >> thank you. now on to developing news at that bart stabbing, it killed a young woman last night at macarthur station. police are still looking for the suspect. >> bart police say the stabbing appears to be random. abc 7 news reporter cornell barnard live for us in oakland. cornell? >> this morning bart officials calling the crime that happened here [ inaudible ] the suspect we can tell you the bart station has now reopened after it closed last night about 9:45 following what appears to be a random, double stabbing. there were a lot of police here last night investigating. bart officials say two young women believed to be sisters were getting off the train here at the station to meet their father when they were attacked by a man with a knife. one woman was stabbed in the neck and died. the other woman badly wounded. the suspect took off running. >> they are searching for a suspect who is described as a

california. >> four women coming forward publicly for the first time and they are accusing u.s. doctor of sexual misconduct. this morning more than 50 women are suing the gynecologist and the university. dr. george tindall treated thousands of women since the late '80s before he was forced to retire last year. four women now talking about the ordeal saying the school knew about the abuse but failed to protect them. usc says it is conducting a thorough investigation. >> did it seem odd a doctor is asking to take a naked photo of you? >> having been raised from a small town and grew up very trusting, that's not something you question. >> the doctor's lawyer issued this statement to abc news that says dr. tindall is confident when all the facts are known this will be clear his practice of medicine was consistent with the standard of care for such examinations. abc will have a full report on "good morning america" and tonight on nightline.
