good evening and thanks for joining us. tonight, newly released officer body cam footage reigniting debate over a police shooting and the justification for deadly force. officials deciding the armed suspect in the video posed enough of a threat to justify his killing. but his family watching the video ediamsagrees. here's abc's alex perez. >> he's got a gun. >> reporter: the unfortunate scene unfolding in a matter of minutes. this man, 31-year-old thurman blevins, armed and evading police, leading officers through this residential minneapolis neighborhood. those police officers eventually open fire, fatally shooting blevins. >> put your hds -- [ gunshots ] >> reporter: the entire interaction caught on these police body cams is the latestt

enforcement and the use of deadly force. >> put your [ bleep ] hands up! >> reporter: on the one side, officers who say they were protecting themselves. >> before i pulled the trigger, when the gun came out, i feared for my life. i feared for my partner's life. >> black lives matter! >> reporter: on the other side, a community angry and searching for answers, weary and distrustful of authorities. the incident took place on june 23rd. officers justin schmidt and ryan kelly responding to this 911 call -- >> there's a guy walking around shooting off his gun. he looks intoxicated. thus j's t here. >> all right, what's your description? >> black male in his 30s -- >> reporter: officers arrived on the scene and noticed blevins with a gun in his waistband. >> he's got a gun. police department since 2013. officer justin schmidt sin 2014. both were placed on administrative leave while at the request tfhe minneapolis police department an investigation was carried out by the minnesota department of blpuic anything on the video that's inappropriate. >> reporter: as part of the investigation, the bureau of criminal apprehension conducted interviews with several of the officers involved. including officer schmidt. >> to me, he had every bit of intent on shooting my partner and i. i gave him numerous chances to give up. and he continued to escalate the situation by first grabbing on to his firearm, then clearing it from his pocket. >> reporter: yesterday the county attorney's office held a press conference to discuss the findings of the investigation. >> these cases tear our community apart. no one wins today. a young man is dead. our officers face increasing criticism and scrutiny.

and the community is devastated. >> reporter: but before freeman could announce the department's decision, blevins'meers rushed . >> we want the cops arrested within the next 48 hours. and prosecuted. >> reporter: freeman later ng the officercis wilanlun notno face charges. >> mr. bvileeprenssented a danger to the lives of officers schmidt and kelly and other members of the community. heere is no basis to issue e it r officer. >> we have seen wh so ereny tmahe officers are g things the right way. but in this case, we see office training and tragically had to take a life. but only because this suspect refused to follow the commands of the officers. >> reporter: but still, tonight in mylinneapolis, many have tak to the street to protest the lack of charges. >> there is a lack of trust between the african-american

community and the police departments all over the country. and that is because we over and over and over again are seeing this sort of trigger shooting of unarmed young black men. there's a lot of work to be done with the police department to foster a better relationship with people in the african-american community. >> reporter: chief brown suggests perhaps in this case, transparency on behalf of the police didn't come fast enough for this community. >> you have to release the video immediately. because people start forming their owned on rumor, conjecture, gossip. >> hands up! >> the incident happened the end of june. it's the end of july. that's one month. that is actually not a long time in terms of investigating a case. >> reporter: the state implemented the widespread use of body cameras in their police departments after the deadly shooting of philando castille during a traffic stop in july of 2016. >> stay with me. >> reporter: which his girlfriend, diamond reynolds, livestreamed on facebook.

[ screaming ] >> it's okay, i'm right here with you. >> reporter: the officer of minnesota's st. anthony police department was charges with manslaughter and two counts of endangering reynolds and her young child. the case went to trial but a jury acquitted the officer. that verdict left the community reeling. >> and i am so very,, ,ryry, very t he system her e minnesota. the city killed my son. and the murderer gets away. >> reporter: chief brown believes it's a story like castille's that leaves of family of blevins to be suspicious of minneapolis police. >> many people's mind in the

community, particularly in this family's mind, was how unjust that case was. >> reporter: more recently the minneapolis police department came after fire after the death of justin damond, a yoga teacher originally from australia, shot and killed by an officer and their department after calling 911 to report a possible assault. >> the death of jnetius is a loss to everyone who knew her. she touched so many people. a loving and generous heart. >> reporter: after the shooting, prosecutorsha crg officer, mohammad noor, with third degree murder and manslaughter. >> officer noor did not act reasonably and abused his authority to use deadly force. >> reporter: noor plans to plead not guilty. if convicted he faces up to 25 years behind bars. all of these incidents are likely on the minds of protesters searching for justice to night. >> where do you see things right now?

fraternity brother sentenced today in the death of a young pledge during a hazing ritual. the punishment, just a small step in one family's fight to get justice for their son. and save the lives of others like him. turning their grief into a campaign to put an end to fraternity hazing. here's my "nightline" coanchor dan harris. >> future fraternity members, organization members, they need to know that there will be consequences if you haze. >> reporter: tonight a grief-stricken family sending a message. >> hopefully this sentence is a deterrent to other people. that's really what it needs to be. >> reporter: earlier today the first sentence handed down in the case related to the death of their 19-year-old son, penn state student timothy piazza, in

what has become one of the largest hazing prosecutions ever. >> new details about that penn state sophomore who died during an alcohol-fueled hazing ritual -- >> tonight the deadly campus mystery at a fraternity at penn state -- >> the alleged details of timothy piazza's final hours are beyond disturbing -- >> reporter: 21-year-old former penn state fraternity member ryan burke, who pleaded guilty to hazing last month, sentenced to three months house arrest, 27 months probation, community service, and a fine. he will not spend any time behind bars. >> we stand here with our shoulders back and our chin up. accept responsibility. >> reporter: after today's sentencing, 25 former a still a the case, most allegedly of ngvigi alcohol during a hazing ritual he eventually fell down a flight of stairs. >> some people are going to say, this sounds like a slap on the wrist. considering what the charges were here, this is actually a

fairly stiff sentence. >> reporter: but the sentence today does not come as a complete comfort to the piazza family, who have been hoping for justice in their son's death for over a year now. >> i think it's really the first step in getting justice for the killing of our son. there's a long road ahead of us with a lot more time to go. >> reporter: today,oref tehe sentencing, tim's father telling the court, quote, i spend holidays, father's day, and his birthday at the cemetery. before i close my eyes every night, i have the vision of tim lying in the hospital bed all battered and bruised on life support. last year the piazzas spoke to me about the last time they saw their son. >> he was all covered up with warming blankets. we were trying to find a spot of skin to touch. >> reporter: the heartbreaking final moments between a mother and her child. >> the nurse brought me forward,

told me to kiss him good-bye. >> it looked like he got hit by a car. he was in bad shape. he was on full life support. his eyes were half open. he wasn't there. >> reporter: piazza's death raised serious questions across the country about the dangers of hazing in the greek system. tim's older brother mike was also a student at penn state. >> were you specifically worried about the hazing and drinking? >> i knew there was a culture of partying with penn state greek life, but i didn't expect anything like what happened. i had no expectation for any of that. >> reporter: his girlfriend at the time of his death, kaitlin tempolski, told us she met tim in a prevention program that among other thingsduen eerdstecd he wanted to join a fraternity in the first place i was a little bit. i think he was looking for that brotherhood. but unfortunately that's not what he got. >> reporter: on the night of february 2nd, 2017, prosecutors say tim and 13 other beta thet

that pi pledges participated in a hazing ritual called the gauntlet, consuming five drinks in two minutes. >> they had to go from station to station and chug alcohol. >> reporter: tim reportedly had a troeflk fall. one brother allegedly texting another, he fell 15 feet down a flight of stairs hair first, going to need help. onhe sirep ry ordl telanding, t carried to a couch. h erft etrea gted him like a rag doll, like road kill. they slapped him, threw water in his face, punched him, sat on him. >> reporter: kordell davis, who was in the room and has not been charged in tim's death, says he did everything in his power to get somebody to help his friend. >> i lost it. i was screaming and yelling. i was saying, we need to take him to the hospital, we should call an ambulance, dial 911. >> it's nice that he had good intentions at the time. but i don't know why anybody didn't pick up a phone. >> reporter: a grand jury report

last year shed light on what allegedly happened inside that fraternity house. detailing surveillance video that the reportsay s nearly eight hours of the sophomore's increasing distress. an injured piazza trying to get up, repeatedly falling over again. four men seen dragging his limp body upstairs, trying to rouse him by slapping his face and pouring water over him. after 10:00 a.m. the following morning, tim was reportedly found lying on the couch, it wthing hey,ilavh his face. >> this was the worst possible debauchery and depravity that you could possibly have. the acts of callousness towards a young man who was horribly wounded and was left todie. >> reporter: instead of dialing 911, the report says the brothers were using their phones to search for phrases such as "falling asleep after head injury." and a few minutes later binge drinking, alcohol, bruising or discoloration, cold feet, cold hands.

12 hours after piazza's fall, the first call for help. >> what's going on today? >> uh, we have -- we have a friend who's unconscious. he hasn't moved, probably going to need an ambulance. >> reporter: tim died the next day in intensive care. his blood alcohol level was.40, five times the legal limit, according to the report. >> of course it's a tragedy. but that doesn't mean there was any intent involved in any of this. >> reporter: eight members of the fraternity were initially charged with involuntary manslaughter, but in march a none of the members have pleaded guilty to the other charges, and they still await trial. >> prosecutors wanted more serious crimes here. in particular based on the inaction of certain fraternity members. despite trying again and again, were not successful in getting the court to apply a more serious charge. >> reporter: in the meantime, tim's family is pushing forward. >> the timothy j. piazza law -- >> reporter: they were
