pg&e. amy hollyfield, abc 7 news. an appeals court rejected a move by former swimmer brock turner to overturn his sexual assault conviction. his lawyer argued turner wanted to have outercourse with the victim and never intended to rape her. the judge said the argument lacked merit. the case got national attention when the trial judge gave him a six-month sentence. the stanford professor who led a recall effort against the judge applauds the decision. >> brock turner is a lying, unrepentant sex predator who never showed real remorse for his crimes and this decision by the appellate court shows why he never deserved the light sentence that judge persky gave him. >> he can appeal to the state supreme court but the high court is considered unlikely to take up se. 4:30, just waking up, good morning. here's a quick update on your weather and traffic. we start with mike nicco.

>> reggie, thank you very much. alexis, nice seeing you both. hey, let's talk about what's happening our other big story, we mentioned the fire weather watch, probably upgraded to red flag warning because we're a little more than 24 hours away from it beginning or less than 24 hours away from it beginning. forget today is thursday. it's 2:00 this afternoon through 11:00. about 530,000 people including around lake tahoe. the bay bridge toll plaza as the backdrop for a 12-hour planner. see temperatures are going to be the hottest today as we're nearing the upper 90s inland, near 80 around the bay and 60 at the coast. >> we are off to a quiet start on the roads. no major incidents to talk about. slight delays out of the central valley. 580 tracy to castro valley not terrible. highway 85 to airport, 12 minutes, highway 1 and san francisco great route into the city no delays at ten minutes.

we have a dense fog advisory in effect for golden gate bridge. not looking terrible right but now but this will thicken throughout the morning. bart's board of directors will take up a new, expensive and controversial security plan aimed at protecting riders. the $28 million proposal includes increased transit police patrols and more fare inspectors. the district unveiled the plan monday after a number of high-profile violent attacks on riders including the stabbing death of nia wilson at the macarthur bart station. some of the people evacuated because of the mendocino complex fires now have something else to worry about this morning. there's a neuro virus outbreak. about 20 people became sick. a cleaning crew disinfected the shelter. than me than,000 homes are still threatened and

the fires combined cover more than 470 square miles. firefighters are slowly getting the upper hand. people who had to evacuate during the carr fire are returning to the lake redding neighborhood. what they are finding, though, is stunning. on one side of the street houses are burned to the ground and ashes are still smoldering. across the street homes are untouched. it's similar to what we saw in santa rosa after last year's north bay fires. the carr fire has burned 176,000 acres and 47% contained. the trump administration announced it's overriding protections for endangered species in california to give firefighters more access to water while battling the state's wildfires. critics say this is an unnecessary move designed to score political points. abc 7 news reporter lilian kim has that. >> reporter: firefighters are battling as many as 17 wildfire. now the trump administration says it wants to help by lifting limits on waterways. the secretary of commerce issued

a directive to federal agencies to prioritize protection of life and property ecs. spite the fact that the director of cal fire says water isn't an issue. >> we have plenty of water. we have many lakes that are directly accessing from helicopters to drop that water on the fires and our fire engines have access to water on the ground. >> reporter: the trump administration's directive follow tweets made by the president. on sunday he tweeted california wildfires are being magnified and made so much worse by the bad environmental laws which aren't allowing water to be properly utilized. critics say mr. trump is exploiting the wildfires for political gain. stirring up an ongoing water dispute between farmers and environmental groups. >> this isn't the right time for armchair fire chiefs in washington, d.c., to try to tell california how to fight fires. >> reporter: john mcmanus is president of the golden gate salmon association. the group's mission is to protect and restore habitat comprised of central

is increasing its legal defense fund by nearly $6 million over the next two years. the money will fund proposition f, which voters passed in june. the measure provides renters facing eviction with legal representation. the city's new budget injected nearly $2 million into the program right away. >> we know, sadly, that most tenantses can't afford a lawyer and don't know where to go in the first place. as a result, too many san franciscans face eviction without knowing what their full rights are. >> evictions in san francisco had jumped by 26% over the past eight years. the price of a hotel room could be going up in palo alto. the city is putting a measure on the november ballot that would raise the hotel tax from 14% to 15.5%. palo alto on-line reports it would bring in about $2.5 million in more revenue. that money would be earmarked for infrastructure projects including a new police headquarters, improvements to the city's animal shelter and

day. we don't have any significant issues to talk about here this morning and mass transit is looking good too. it is a spare the air again today. if you can carpool or use mass transit, that's definitely recommended. bart, 34 trains in service. no delays. that's looking good. ace one out on time on the central valley and normal service, no delays for san francisco bay ferry. a broken pipe that's been leaking thousands of gallons of water into a palo alto storm drain for weeks will take another week to fix. abc 7 news was at the intersection of georgia avenue where the leaky pipe is located. a city spokesperson says the contractor accidentally damaged the pipe july 11th. because it's an unusual size the replacement part needed to be specially ordered and won't arrive until monday. the city can't shut the water off completely because it's a large water main supplying water to several customers. the harlem globetrotters known for their on-court trickery but this basket takes their skills to new heights.
