my family as a victim in this. and that i'm a victim and a witness. >> those were the words almena said judge james kramer had a problem with. the plea deal was for him to get nine years in jail while co-defendant makts harris would get six for pleas of involuntary manslaughter, but the judge stunned the courtroom by rejecting the deal. he said almena did not take adequate responsibility for the unsafe conditions that led to the 2016 fire in which 36 people died. almena says the judge's decision was horrifying. legal analyst steven clark says almena has a point for moving the trial out of alameda county. >> how do you have a fair trial now that everyone in alameda county knows you already pled guilty. how can you now say i'm not guilty in trial? >> it's impossible to get a fair trial. they misquoted me. i mean, this has -- this is like orchestrated to the highest degree. >> a hearing in the case is set

for this friday. almena's attorney said it's possible a new deal could be made. otherwise, a trial date will be scheduled. reporting live in dublin, matt dublin. >> thank you. the case will be back in court on friday. we'll be there. you can look back at all the stories we have done on social media and our abc 7 news app. >> oakland police are expected to release the name of the officer seriously injured in a crash. he was responding to a call yesterday in the port of oakland early in the morning when his patrol car hit another car. the patrol car then veered into a parked semi truck. the officer had to be extricated from the vehicle. he remains in critical condition. no one else was hurt. the department says the officer is fairly new to the force and is the son of a lieutenant. >> a san jose firefighter is recovering from a dog bite he suffered while trying to rescue a canine from a burning house. the fire started at a home on raven's place way just before 8:00 last night.

the flames then spread to a home next door. both houses were heavily dama d damaged. considered serious. >> omarosa's tell-all book about her time in the white house is released and she's released another tape that she claims is a recording of a phone call she had with president trump. >> the war of words between president trump and the woman he once called a loyal friend, omarosa manigualt newman, is escalating. on msnbc, she claims she's been contacted by the special counsel and if they reach out again, she's willing to share her secret recordings. >> anything mueller would like to see? >> if his office calls again -- >> would you be a good witness? >> she's released two recordings to nbc news. a conversation she had with john kelly as he fired her in the situation room, and another she claims is a phone call with the president himself. >> omarosa, what's going on? i just saw on the news you're

thinking about leaving. what happened? >> general kelly -- general kelly came to me and said that you guys wanted me to leave. >> no, nobody even told me tubt. >> in her new book "unhinged" she alleged trump was recorded using the n-word in a taping of "the apprentice." the president is pushing back, saying he spoke with the show's creator who told her there's no tapes where i used a terrible and disgusting word. i don't have that word in my vocabulary. she made it up. she claimed several aides have taking money for silence since leaving their post. some former aides have received roughly $15,000 in payments each month from the campaign or party accounts. but those filings don't disclose that the payments are tied to any nondisclosure agreements. abc news, washington. happening today, discussions over how much water is used to grow cannabis.

and they're taking place in the south bay. take up the issue ley at its board directors meeting this morning. they looked into whether the district can charge an excessive use fee to cannabis growers. they found the direct must charge the same rate regardless of crop. >> the lafayette city council is reviewing a proposal to save a historic theater. it's one of the last remaining single screen theaters in the state. in oakland developer wants to create more parking spots to expand a neighboring apartment complex. a community group has proposed transferring some of the thoeter's land to the developer in exchange for preserving this theater. a decision has not been reached. >> good morning. time, 4:36. we're looking at temperatures in the south bay, most of us right now in the upper 50s to lower 60s. 61 this morning in san jose. 59, though, in santa theresa.

the water picture, a similar temperature spread. sglts tocohe bay and inland ato thisrlan out your day later on. by 7:00 in the morning, a lot of us waking up to fog, early morning cloud cover. very gradual is that clearing of the cloud cover back to the coast. by 10:00 in the morning, still cloudy over san francisco, oakland, parts of the east bay, alameda, san leandro. by 1:00 in the afternoon, most spots are seeing sunshine. the only exception, it look like san francisco. we'll be stuck in the cloud cover for much of the day. some peeks and pokes of sunshine here and there later on today. the three-day forecast, it's comfortable out there. look at that, 70s and 80s. that's below average for this time of the year. as we go into your wednesday and thursday, we will gradually see those numbers climb. but even by thursday, our warmest spots only in the low 90s. so for right now, the heat taking a little bit of a break in the month of august with the fog certainly overhead right now. >> yeah, sounds pretty good.

i know. i'm sure folks inland are definitely loving it. >> they love the 80s this time of the year. >> unfortunately, i don't have as good of news as drew does. we have a sig alert already in the north bay. let's take you up to lakeville highway. a full closure due to a crash just north of state route 37. this happened around 2:00 this morning. a truck, a big truck hauling a lot of dirt flipped over, so there's dirt all over the roadway. diesel fuel is leaking, and we have a full closure of both lanes. both directions are closed between state route 37 and 116. you can just stick to the 101 corridor. that's light at this hour, or 121 if you want to head north through that area or south. in either direction, that would work. no new information. i'll pass it along as soon as we get an estimate on when the roadway will reopen. we'll take a look at mass transit in a few minutes. aretha franklin's family asks for prayers and privacy amid reports she's gravely ill. beyonce pays a special tribute

good morning. time now, 4:41 a.m. we're looking at visibility on live doppler 7 because we do have dense fog along the coast. and in the north bay, so folks right now in santa rosa, even half moon bay, visibility is down to two miles. we're dealing with a lot of low cloud cover early on. hour by hour, future weather, 7:00 in the morning on your tuesday, cloud cover over much of the bay area. and then it slowly retreats back to the coast. only exception, i think san francisco will be stuck in the clouds. later today, our warmest spots going into the 70s and 80s. >> drew, thank you. i want to show you this just in to our abc 7 newsroom. president trump continuing the war of words with omarosa, sending out this very sharply worded tweet, saying, quote, when you give a crazed crying lowlife a break and give her a job at the white house, i guess it just didn't work out. good work by general kelly for quickly firing that dog. and again, i'm quoting there. so far, no response from omarosa. but in light of this explosive

tweet, we expect this story to develop throughout the day. >> celebrities and fans are offering prayers and well wishes to aretha franklin, who we're now learning is in hospice care at her home. we reported yesterday that sources close to the family say the singer is gravely ill. the queen of soul is 76. last night in franklin's home town of detroit, beyonce and jay-z dedicated their concert to the music legend. they said we love you and thanked her for her beautiful music. >> investigators in iowa have launched a new website asking for tips to lead them to mollie tibbetts, the iowa college student with bay area ties who has been missing for nearly a month now. officials are still trying to find anyone who may have seen tibbetts in the area where she went out running on july 18th. investigators say they're looking into all possibilities. >> it is possible that mollie came into contact with someone who caused her harm. this person may not be a member

of our community but likely has some familiarity with the area. >> the reward to find her is now more than $366,000. tibbetts grew up in the east bay before moving to iowa. >> the a's want to offer scholarships to community college students. that's the same college system that broke off discussions with the team about a new stadium last year. the ar's community established n endowment for students at berkeley college, college of alameda and two other. the peralta board of trustees decided not to move forward with negotiations. the team is now looking at building on the current coliseum site or jack london square. >> steph curry proving he's as great off the court as he is on it. he finished last in a weekend golf tournament, but he won with a winning gesture. he and his wife donated $25,000

to help a golfer's wife battling cancer. scott harrington skipped tournament so he could care for his wife. jen pledged one day to pay forward the generosity. >> a raging fire, animals howling and officers scrambling to save them. this was the scene in vacaville captured on police body cameras. abc 7 news spoke with one of those brave officers. >> vacaville police body camera shows the horrifying moments as officers and volunteers rush to save animals from flames inching towards the spca of solano county. the body cam is that of officer carly stone. you can hear her, out of breath, running to grab cats and dogs. >> between the smoke running this way, f dhe hithe helicoptec itas azy. >> total of 67 pets in the path, including this python. many of animals were loaded on

crates and placed in cars. officer stone realized time was running out and put some dogs into her patrol car. >> i had nowhere to put the dogs. they seemed happy to be with me, so we went to work and started evacuating houses for a few hours. >> the fire scorched more than 2,000 acres and burned one home after starting near interstate 80 and fairfield friday afternoon. nearby residents have been dropping off supplies throughout the day. cleanup could take days. no animals were injured and all are back at the shelter. some in the process of being adopted. >> we'll probably end up with a total of 12 to 15 animals that are with their rescuers. >> officer stone is one of those reschiers considering adopting a furry pet. a happy ending to a scary situation. in vacaville, carlos, abc 7 news. >> could you love that story any more? if you would like to make a

luck, boys and gir. ur first d of yo >> fog across san francisco right now,hopping the skyline in half. we have the typical foggy start. we're used to this in the month of august. temperature wise, when you have the fog overhead t keeps the temperatures uniform. 50s to low 60s as you get out the door early on this tuesday morning. a light jacket certainly needed. highs later on today in the south bay, 81. for san jose, 78. along the peninsula, a lot of sunshine later on. 76. for palo alto. redwood city. much cooler on the coast, pacifica, only 57. downtown san francisco, hard pressed to find sun. 63. 57 and cloudy in daly city. petaluma, 81. in the east bay, 60s and 70s. 75 in fremont, and inland, we're sitting comfortably in the 80s. 87 for brentwood. seven-day forecast will show you you're cool for august. today, we stay below average tomorrow as well. a warming trend gets under way

good morning. time, 4:53 a.m. we're taking a look at highs across the state today. if you're traveling here locally, only 63 in san francisco. but to the south, we have some heat. l.a. at 84 later on today. even fresno near 100. if you're heading to sacramento, it will be warm. a high of 87 degrees. >> thanks. >> a typhoon is hitting china heart. more than 200,000 people have had to be evacuated south of shanghai because of strong winds and heavy rain.

ten cities are now virtual ghost towns. this is the 14th typhoon to make landfall in china this year. quick evacuations and advanced planning have kept casualties to a minimum. a wildfire burning in central california is threatening the oldest and largest known juniper tree. the save the redwoods league say the tree is at least 2,000 years old. it's 80 feet tall and the trunk is 14 feet in diameter. the u.s. forest service says the donnell fire burning in the national forest is less than a half mile away from the juniper. crews have created a containment line to try to protect that tree. elon musk's spacex is preparing to send nasa astronauts into space. media members got a sneak peek at the company's headquarters near los angeles yesterday. it included a look at the flight simulator, a mock-up of the actual capsule and the space suits they'll be wearing. spacex's dragon spacecraft already carrying cargo to rnatis
