thank you for joining us. i'm ama daetz. >> i'm larry beil in for dan ashley. derick spoke with us from santa clarita jail yesterday after a judge rejected his plea deal on friday. >> abc 7 news reporter melanie woodrow is in the newsroom with today's update to the story. >> ama and larry, attorney mary alexander says the families were very pleased with the judge's decision regarding almena, she says he continues to speak about himself instead of expressing remorse. one day before alameda county judge james cramer rejected derick's plea deal, almena says the judge told him not to worry. don't fight back. don't deflect. just apologize. >> but almena says it was hard for him to do that. >> to truly be sorry and apologetic, i feel i also have to offer up a somewhat of an explanation. >> it's that explanation he offered in a lengthy statement that resulted in judge cramer reject his plea deal. the deal was for almena to get nine years in jail while max harris would get six in exchange

for no contest pleas to involuntary manslaughter. the judge said almena ghost ship's master tenant didn't take adequate responsibility for the conditions that led to the 2016 fire. 36 people died. >> instead of being sorry and remorseful for these deaths, he is still thinking about himself. >> attorney mary alexander represents families of 12 victims. >> it was a surprise to all of us that the judge made that decision. >> but they were very pleads. >> almena says the judge took his words out of context by only reading part of what he wrote. >> he tricked me. he took away the truth of my statement, the truth of what i want to say. and then he still found me not remorseful enough. there. >> could be a new plea deal, or the case could go the trial. a lot of the families would like for to it go to trial because they want answers, and they want

to hear the evidence. >> alexander says she expects the civil case to go to trial, especially if the criminal case does not. there is a hearing this friday to determine next steps in the criminal case. in the newsroom, melanie woodrow, abc news. >> thank you, melanie. abc 7 news will be in the court friday as the case continues. you can follow the latest and look back at all of our stories of this tragedy. on developing news, capital corridor amtrak service is moving again tonight. it was delayed just within the past few hours while the alameda county bomb squad looked into a suspicious package. this was on shell mound street near the amtrak station. a loud boom was heard just before 5:00, and it was related to this investigation, but it's not clear yet what officials may have found. happening tonight, a vigil is set to begin in about an hour for a 17-year-old boy who died sunday when a car went off the side of highway 24 in walnut creek and landed below.

people will gather at the crash site to remember 17-year-old dakar dakarai. police arrested the driver on charges of manslaughter and dui. now to the latest on our california wildfires. we now know more about the firefighter who was killed on the front lines of the largest wildfire in state history. that's the mendocino complex. battalion chief matthew burchett, a firefighter from utah died yesterday after being injured the day before. details of exactly happen happened have not been released yet. news of his death devastated the small town of draper, 20 miles south of salt lake city. >> chief burchett became to the fire department in may of this year. prior for working for draper, he worked for unified fire authority for the past 20 years. chief burchett leaves behind a wife and a handsome young son. he was 42 years old. >> burchett was one of 40 utah firefighters from seven agencies

deployed to the fires burning across california. we have some good news, and that is firefighters making significant progress. one of two fires in the mendocino complex. the river fire is now 100% contained after burning nearly 49,000 acres. the ranch fire, that's burned 305,000 acres, currently at 68% containment. near redding, the carr fire has burned over 307,000 acres in three weeks. it's at 65% containment. firefighters don't know when they will have this fire fully contained. now today yosemite opened for the first time in nearly three weeks. it's been closed because of smoke from a nearby ferguson fire. it is now 86% contained after burning almost 100,000 acres. natalie granda from our sister station in fresno has the story. >> car after car is trickling back into yosemite national park. after nearly three weeks of being closed for the ferguson fire, the valley floor is reopened to visitors. >> it's really exciting to be able to come in to work today,

to be here in the valley, to take a walk in the valley, and to see not only a sense of normalcy, but to see the energy in the air. >> while the popular sights are still hidden in the smoke, john crestman says he came just in time. >> we booked this about three or four months ago, and were pretty disappointed that it didn't sound like it was going to be open. but we actually fly out tomorrow. pretty excited that we got to go on it yesterday and today. >> the valley floor closed in late july because of smoke and fire impacting the roads into the park. while the area's reopened, jamie richards says some food and lodging services are still unavailable, and the highway 41 entrance into the valley is still impacted by fire activity. >> the wawona road from just north of wawona to the wawona tunnel is closed. it will remain closed. i don't have a timeline yet on when we're going reopen that. >> along with visit, to mariposa community also celebrated the reopening of both the valley

floor and highway 1406789 since the fire started, the city's businesses have taken a hit during what is usually their busiest season. county officials say they're applying for some loans in hopes of helping businesses stay afloat. >> we're going to claim economic injury with the closure of the park for over a month. it is ten times worse than it was last year. >> but mariposa business owners are hoping to see some revenue soon. meanwhile, yosemite range sayers they're just glad visitors can once again enjoy the sights and wildlife from inside the national park. park rangers say that there are still fire crews and fire activity inside the national park so they do ask that visitors slow down when driving on the road waist. in yosemite, natalie granda, abc 7 news. a report out of sacramento says the state already has burned through, pun intended, more than half of its annual firefighting budget and we're only two months into the fiscal year. already wildfires in 2018 have burn lead times more land than what burned in all of 2017.

governor brown says firefighters will still get all the resources they need, even if it means dipping into california state surplus. the fbi is warning of a potential atm bank heist that could steal millions of dollars globally, and authorities now have good reason to believe the attack could be carried out within the coming days. abc 7 news reporter chris nguyen is live in san jose to explain how you can help derail their efforts. chris? >> ama, the fraud scheme is typically referred to as an atm cashout. experts say it's important to monitor your online statements. and if you plan on using an atm, be on the lookout for any skimming devices. a massive threat against financial institutions around the world. the fbi now warning about the possibility of cybercriminals carrying out a scheme using malware to access personal bank card information. >> the bank has to do a lot of things from their side to upgrade their firewall, to upgrade their policies of dealing with transactions.

>> these atm cashouts are more likely to happen at small to medium-sized institutions because the securities aren't as strong. copies are created by sending stolen date to the masterminds who transfer it on to a usable card with a stripe. >> once they are into the system, they go to the administrative account and remove any kind of limitations. so whatever in the bank at this tme, they can cash that. and they do it at a predetermined time all over the world. >> the fbi declined to go into greater detail about the warning, but said in a statement the fbi routinely advises private industry of various cyberthreat indicators observed during the course of our investigation. this data is provided in order to help systems administrators guard against the actions of persistent cybercriminals. despite the threat, officials at technology credit union in san jose are confident their systems are good to go. >> it is quite common in the financial industry to get alerts like these.

and whenever we do, we automatically trigger to our fail-safe possession where we increase our monitoring and heighten our alert system to make sure that we are covered. >> experts say you should change your password or pin number in the coming days. they also believe that this attack could happen on a saturday, more likely to happen on a saturday, which is when more of the smaller banks tend to be closed for the weekend. we're live in san jose, i'm chris nguyen, abc 7 news. >> all right, chris, thank you. on abc 7 news at fourth quarter, i sat down with c/net executive editor ian sher to talk about the most effective way to prevent this and future atake, most important thing and we've written it on c/net, to have a unique password for every website. so that's super annoying. so there are password managers that you can download that will help you manage all the different pass words for the

proactive. we're going to have a crew that's going to roam around and look for these locations. we actually have data for these neighborhoods where we get frequent calls. >> the department of public works will try to spot the mess before you do and steam clean it away. >> it's a great idea. could we get rid of the poopers as well? >> mayor london breed has been taking unannounced tours, checking out the city streets and knows all too well this icky issue. >> i've had to deal with it myself in front of my home. and it is not a pleasant feeling. i want to change san francisco for the better. i want to clean up the city. >> the poop patrol will have a staff of six and two trucks for a cost of about $750,000. they'll give it a try this week with an ol s september. the city will also expand the hours at some of its 22 public toilets called pit stops so that those who have to go can do so with dignity and not in the

dronevew7 was in the east bay today, giving us a view over a traffic circle in berkeley. this is at delaware street. you can see that big tree planted right in the middle. apparently that is an issue when it comes to safety and line of sight issues. the city has even had to settle a lawsuit over this. abc news reporter leslie brinkley joining us live now to explain the controversy. leslie? >> that's right, larry. three years ago a woman was seriously injured in the crosswalk behind me. the tree you see in the middle of the traffic circle is what the driver claimed obstructed their line of sight. the city, as you said, reportedly has settled that lawsuit and is now embashing on a campaign to analyze what's growing in all 60 traffic circles. driving through many berkeley neighborhoods is an odyssey of sorts. every block or two, cars have to navigate around traffic circles in the intersections, some with

two-way stop, some with four-way stops. it can get confusing. among the 60 traffic circles here, half have trees. palm tree, oak trees and redwoods, as you can see from droneview7. some have full-on gardens lavished with attention by neighborhood volunteer caretakers. >> it seems like a badge of pride to have their traffic circle looking that cool. >> but others look abandoned with weeds and what the city thinks potentially could block line of sight. some may need to come down. >> there is a lot of circles where nobody is maintaining, nobody is taking care of. each circle needs to be evaluated on a case by case bicyclist. >> i saw a bic list almost get nailed. she had the right of way. i think they have to monitor the vegetation and the sight lines, absolutely. that's a step in the right direction. >> the city has yet to decide if they will take over maintenance of the traffic circles, or if they'll let neighbors continue to care for them. >> it's hard to believe they will do a better job than what you see right here. isoingo tak

an and evaluate each of these 60 traffic circles and collaborate with residents on what they're going to do going forward. in berkeley, i'm leslie brinkley, abc 7 news. >> thank you, leslie. the hardest to adopt shelter animals are feral cats because they're distrustful of humans and shy away from petting. many face euthanasia because of that. a unique program in the south bay is preparing them to be adopted. david louie shows us how hundreds are now adopted thanks to some gentle coaxing. >> don't be scared. don't be scared. it's okay. you're a good girl. i know. >> lorrie sprain is a cat whisperer. she is trying to become a trysted friend to these litter mates who are part of a special program to socialize feral felines for adoption. feral cats can be difficult to place. they lack trust in humans. yet there are hundreds of

thousand of them foraging on their own and facing danger in the wild. >> these interest cats that needed a different solution, that trying to put them through our adoption program wasn't a fit for them. so we're always looking for innovative ways to save lives and finding alternatives that make sense for the individual animal. >> the humane society of silicon valley has been operating the marilyn and fred anderson community cat garden for four years. here feral cats can learn to be sociable with humans as the photos show, some can become loving house cats. others will be outdoor cats but will respond to adoptive families for food and care. some are so-called fakers. they're formally domesticated cats that joined feral colonies for the free food left by cat lovers. they might have been abandoned or lost. >> they play shy, but all they want is someone to really spend time with them. and then they come out of their shell. they're like people. once they do and they love you and trust you, it's the most amazing transformation. >> the community cat garden has

been so successful, the humane society of silicon valley has again additional funding to expand it from a capacity of 12 to 24. 260 formally feral cats have found adoptive homes as a result of this unique program, and the patience of people like lorrie sprain who has a knack to win them over. david louie, abc 7 news. >> those two little guys are so cute. >> sweet faces. >> somebody's got to adopt them. >> hopefully. much cooler weather today. >> yeah, big change. >> surprisingly. spencer christian is here with the latest. >> we've had below average temperatures the last couple of days. but warm-up is right around the corner. here is a look at live doppler 7. we have still mainly sunny skies inland. but fog from the coast is moving over the bay locally. it will push inland tonight. and it's still pretty windy. we have gusts up to 33 miles per hour at fairfield right now. and all around the bay and near the coast we have wind speeds of 15 to 20 miles per hour. so the breeze goes -- blows on. here is a live view from the

rooftop. abc 7 looking across the embarcadero. it's 62 degrees at san francisco right now. oakland 65. 6 at mountain view. and 59 degrees half moon bay. this is a stunning view of the western sky from the emeryville camera. the sunlight reflecting off the bay waters. 71 degrees right now at santa rosa and napa. 70 at novato. concord 75 and 69 at livermore. and a live view at the golden gate showing the low clouds descending on the traffic there and out over the bay. these are the forecast features. it will be gray and grizzly overnight -- drizzly. grizzly too perhaps! cooler than average again tomorrow, and hot days inland by the end of the week. here is our forecast animation starting at 7:00 p.m. and as i pointed out earlier, the fog will be reaching out over the bay and locally inland. we may see some spotty drizzle mainly near the coastline. 5:00 tomorrow morning as the commute gets under way, there may be some reduced visibility in some spots because of the fog.

but it will pull back to the coastline and away from the coast at some locations and mainly sunny skies by afternoon tomorrow. overnight lows will be mainly in the mid- to upper 50s, and then tomorrow's highs will range from upper 50s to about 60 on the coast to mainly low 70s, low to mid-70s around the bay shoreline as we move into the inland east bay, we can expect mid-80s as highs. south bay upper 70s to about 80 in san jose. north bay highs mainly low 80s. but farther south 91 at cloverdale. 92 at lake pointe. and 93 at ukiah. here is the accuweather seven-day forecast. and notice we get a pretty quick warm-up after one more cooler tha average day tomorrow. we'll see highs up to about 90 inland on thursday. and then mid-90s on friday. and then up to about 100 in the warmest or hottest spots i should say on saturday. mid-90s again inland on sunday. so the weekend is going to be quite warm, even around the bay we'll see highs in the high to mid 60s on the coast. and next week the gradual cooling taking temperatures back down to a more seasonal range.

his car right into a group of people. this happened during a morning rush hour in london's westminster district that is right outside the houses of parliament. >> it's not far from the site of another attack just last year. abc news molly hunter has the details of today's incident. >> the bbc caught the car on camera speeding up right there before deliberately crashing. moments before, plowing through cyclists and pedestrians. two people have been hospitalized. >> maybe holding to 50 miles per hour. maybe more. and contributing right outside of the house of parliament. >> s.w.a.t. team surrounded the car immediately, leaping across the barriers, arresting the driver of the silver ford fiesta on suspicion of terrorism. >> given this appears to be a deliberate act, the method and this being an iconic site, we are treating it as a terrorist incident. >> the counterterrorism police are leading the investigation. police say the suspect in his late 20s is not cooperating. no weapons were found, and there

were no additional passengers in the car. the entire area is still part of the investigation. british prime minister theresa may tweeting my thoughts are with those injured, adding her thanks to the emergency services for their immediate response. president trump also weighed in. another terrorist attack in london. these animals are crazy and must be dealt with through toughness and strength. this is still very much an active scene. the actual crash happened just over there. the investigation still being treated as a terror investigation, though police have said that this suspect was not on their radar. molly hunter, abc news, london. last year another driver in london sped into crowds on the westminster bridge, killing four people. he also stabbed and killed a police officer before he was shot outside parliament. british authorities say they have foiled 13 islamic extremist plots and four far right plots since last year, and they currently have 676 live

counterterrorism investigations going on. rescuers in italy are searching for survivors following this bridge collapse. at least 26 people were killed. more than a dozen others were hurt when the highway came crashing down. let's take a live look at the scene now where crews are still at work, going through the debris. one witness captured the moment it happened. this was the mirandi bridge in genoa. at least 30 cars were on it at the time. the driver of a green truck hit the brakes with just moments to spare. you see the green truck there. that vehicle was stopped just feet from the edge. let's take a look at a map showing exactly where this happened. it's a main highway that connects italy to france. the bridge is about 50 years old. the mayor says he wants answers and to rebuild as soon as possible. >> our main goal is to make sure we have the correct infrastructure for city, and make sure that from the government we get the right amount of money in order to be

able to set up the new infrastructure as soon as possible. >> officials say it's still too early to know exactly why that bridge collapsed. nearly 11 months after hurricane maria hit puerto rico, all powcustomers who had their power knocked out now have it restored. it designated the power grid. today puerto rico's electric power authority confirmed the last two customers who live in a mountainous region were brought back on the power grid. former reality star omarosa manigault newman said late this afternoon she will not be silenced or bullied by the white house. her statement came after the white house announced it would fi an arbitration for violating a nondisclosure agreement. she recently released a book calling the president a racist. she then released audio recordings from inside the white house. omarosa claims to have a recording of president trump saying the "n" word on the set of "the apprentice." today the president's press

secretary did not deny its existence. >> i can't guarantee anything, but iy tell you that the president addressed this question directly. i can tell you that i've never heard it. >> the president is also being criticized for his response in which he calls her a dog. former state senator quinton cobb is suing to get information about the president's son, donald trump jr. he has asked records from the secret service about a trip trump took to india earlier this year with a full compliment of security. trump argues it was actually a private trip subsidized with taxpayer money. >> he was selling condos and inviting people to invest in other trump property. and they're tricksters, in my book. he did it under the guise of some meeting on an issue of state. >> cobb and his legal team say

they have already filed an open records request, but the secret service didn't comply. abc 7 contacted the secret service today, which said it is aware of the suit but cannot comment on pending litigation. the los angeles subway system has become the first in the nation to use portable body scanners to screen passengers for weapons and explosive s sid garcia from our sister station in los angeles showing us how it works. >> it is called through vision. this is the newest technology that is going to be used to detect weapons. l.a. county, metro, it's the first public transportation system in the country to use this. this is going to be the extra layer of protection to make sure you're safer in public transportation. here's how it works. commuters walk by the small mobile machine and they're scanned for weapons. this new technology was tested and tweaked by the tsa for more than a year. then metro jumped on the opportunity to bring it to southern california. >> this is a completely

nonevasive and portable screening system that passively scans weapons or individuals for weapons and explosive devices. >> at union station, commuters came down the escalator and passed by the machine. there was no delay. we still don't know how many of these machines will be purchased or the cost i'm told that's all being worked out with the tsa. the scanners are mobile. they can be rolled into place where needed. it's another layer of protect for commuters. >> anything that we can do that will add even a little bit of security to make sure that people feel safe and are safe when they're riding on public transportation, i think it's so important that we do it. >> sid garcia, abc 7 news. remember months ago somebody tried to bring an emotional support peacock on board a plane? >> united denied them boarding and changed their policies. and now mother and more airlines

[ closing bell ] stocks rallied today. green across the board. the dow added more than 100 points, closing just shy of 25,300. the nasdaq was up by more than 50 points. and the s&p gained 18. draftkings is opening up a san francisco office. it's their first on the west coast. the online fantasy sports betting shop is based in boston. they do have three other offices on the east coast. according to the boston business journal, it's also planning a new office in las vegas, which makes sense. expansion comes just a few months after the supreme court struck down a federal ban on sports betting. a lot more sports betting coming your way for sure. misdemeanor putting up almost $400 million into modernizing hundreds of restaurants in california. you'll see these upgrades happening this year or next year, including new furniture, new designs inside and out, and new technology, including digital menu boards and digital self-service kiosks. the plan is also to add more

park spaces to pick up mobile orders. mcdonald's says it wants to modernize most of its restaurants by the year 2020. southwest is changing the rules about what kind of support or service animals passengers can bring on board. the new rules take effect in about a month. an emotional support animal will be limited to a single cat or dog, and must be kept in a carrier or on a leash. passengers must bring medical proof that the animal is necessary. as for service animals, southwest says it will only accept the most common ones, which are dogs, cats and miniature horses. exotic animals will not be allowed to travel. southwest will also allow what they're calling psychiatric support animals as service animals. in the past few months, united, dealt tax, american and jetblue all revised their animal policies. earlier this year, passengers made headlines for being denied emotional support animals like hamsters and even a peacock, trying to bring it on the plane. >> have you ever seen? i've never seen a miniature horse. i've never even seen a picture

today stevie wonder and jesse jackson stopped by aretha franklin's home to visit. franklin's health has been failing for years and she is now in hospice care at her home, but is reportedly breathing on her own. last night beyonce and jay-z dedicated their concert in detroit to aretha. they said we love her and thanked her for her beautiful music. many homeowners are spending hundreds of dollars to ensure their homes are safe from burglars. >> 7 on your side's michael finney is looking at the latest in home security systems. >> do it yourself. that's what we're really looking at now. yeah, you drive through almost any neighborhood, and you likely see a camera spotting out, looking for any intruder. well, here is some of what's available if you want to just do it yourself. >> downstairs door is open.
