were not hurt. thanks for joining us. i'm eric thomas. >> and i'm ama daetz. dan is off tonight. now to tonight's top story, a complaint filed against bart on behalf of nia wilson's family. >> it's been nearly a month since the 18-year-old was killed in an unprovoked attack. it happened while she and her sisters were transferring trains at bart's mack car their station. >> a man with a knife fatally stabbed nia and wounded her sister lau sister latifah. melanie woodrow is live with today's newly released information. melanie? >> ama and eric, the attorneys for nia wilson's family say there are 22,000 fare evaders. they say john cowell was one of them, and had bart stopped him wilson would still be alive. the attorneys for nia wilson's family said bart failed to provide the highest standard of care.

they filed a complaint against bart. >> nia's death is not some horrific anomaly that occurred in two seconds that nobody could do anything about. >> on sunday, july 22nd, john cowell is accused of stabbing nia wilson and her sister latifah in the neck at the macarthur bart station. there are 22,000 fare evaders on bart daily and cowell was one of them. >> the experts in this case will testify there is a correlation between a high incidence of fare evading and violent crime. >> he also said two witnesses will testify they had interaction was cowell in the weeks and days prior to the stack. one was a 72-year-old woman who said cowell accosted. >> and she said i'm not afraid of you and he motioned i'm going to solicit your throat. >> the other person was at macarthur bart. she saw him brandishing a knife.

both women attempted to report the incidents. >> there were no station agents. >> the woman at macarthur bart called police. bart writes we have not yet been served and we can't comment on pending litigation, but we can say that safety is our top priority, and reremain committed to do all we can to ensure a safe trip for our riders. the family's attorneys are demanding post up to date information about crime on bart both inside and outside the stations. >> we want this to be called the nia wilson crime statistics notice. >> they're also demanding bart catch fare evaders in the act and implement policies to deter crime. >> the attorneys did not specify today the amount of money that they are seeking. >> we apologize for the technical problems on melanie's story there. but we know there has been a lot of interest in this case, and you can have the newest information sent directly to you through the abc 7 news app.

it's free, and we have versions for both the app store and the play store. an update now on the crash in morgan hill that has traffic backed up for miles. sky 7 was above the scene on coyote creek road. two right lanes are blocked there. a motorcyclist crashed into the back of a semi. that motorcyclist was killed. the chp is warning drivers to stay out of the area. it could take hours to reopen all of those lanes. new developments now. a settlement has been reached in the lawsuit against the santa rosa senior care home that burned during last year's north bay wildfires. 17 elderly residents and their family members sued oakmont senior li a villa capri of not taking adequate precautions to evacuate the facility when flames swept through the complex. the case was to be go to trial. terms were not made public because the settlement has not yet been signed. deadly ghost ship warehouse fire appears to be headed to trial next year.

the fire broke out inside a warehouse in oakland in december of 2016. people had gathered for a concert. 36 of them died. investigators never determine how'd that fire started. two people have been criminally charged. derick almena, the g.o.a.t. ship's master tenant and max harris, the creative director. if one of the defendants' lawyers has his way, the trial won't be held in alameda county. abc 7 news laura anthony attended a brief hearing in oakland. she joins us outside the alameda superior county courthouse. laura? >> hi. no official date has been set yet for this trial there will be a hearing here next month. so try to work out the timing. in the meantime, though, despite this discarded plea deal, it now appears all parties are eager to take this case to trial. >> i'm a trial lawyer. i want to go to trial, which the prospect of a plea bargain now off the table, attorneys for derick almena and max harris are

gearing up for a trial. one, almena's attorney, tony serra will try to have moved out of alameda county. >> it probably will be another county if it's granted. it probably won't be san francisco. it could be something like san jose, redwood city, martinmarti. >> i never thought he should go to jail for one day. >> harris' attorneys will try to have his case separated from that of almena, the primary tenant and founder of the ghost ship. both men currently face the same charges, including 36 counts of involuntary manslaughter for the december 2016 fire. his attorney says much of harris' defense will involve diverting blame to the owner of the warehouse and the city of oakland. >> but now we have the opportunity to show that he is innocent. and we have the opportunity to show that the owner was not innocent. we have the opportunity to show that the city of oakland caused this by neglect. >> uc hastings college law

professor david levine believes it's highly unlikely that the g.o.a.t. ship defendants will be granted a change of venue. >> yes, it's a highly publicized case. yes, it's an awful, terrible case. but we're talk about a jury pool that consists of alameda county. there are many, many people who are perfectly capable of serving on this jury. >> now if this case does stay here in alameda county, it's expected jury selection could take much longer than in a normal case. several weeks, perhaps that is to make sure that the jurors who are seated haven't already made up their minds. in oakland, laura anthony, abc 7 news. >> all right, laura, thank you. a group of sacramento area college students helped detain a man suspected of stealing a chp cruiser and carjacking the students' bus. he was talking to a man and another driver after an accident. that man managed to get into the officer's vehicle and drive off. a few minutes later he ditched

the chp cruiser for a shuttle bus to sacramento state. but he didn't get far. ten students the bus subdued him. police arrived and took him into custody. today hundreds mourned a chp officer who died on the job. chp helicopters, motorcycles and officers in uniform formed a procession in vacaville to honor fallen officer kirk greiss. he was killed during a traffic stop a week ago on interstate 80 near fairfield. he leaves behind a wife and three children. the ceremony was packed with emotion. one of greiss' fathers, following in the foot steps of her father, soon to graduate from the police academy. >> now that i have 29 days until ie, n stay strong. if he were here, he would be holding my face and telling me i need to finish. >> and he will never be forgotten. love you, brother. >> a civilian driver was also killed in the accident. the chp says the suspect driver was distracted by his phone in

the lead-up to the crash. the chp credit union has set up a memorial fund for officer greiss and his family. you can find a link to donate in the online version of this story on our website at abc7news.com. today we learned aretha franklin's funeral will be held at the end of this month. a public viewing is scheduled in two weeks. the funeral itself will be limited to family and friends. it will take place on august 31st in her hometown of detroit. the queen of soul passed away from yesterday if pancreatic cancer at the age of 76. in san francisco today, renewed arguments for and against establishing safe injection centers for homeless addicts in the city. abc news reporter wayne freedman is live outside san francisco city hall. wayne? >> this is about san francisco doing something revolutionary if you haven't seen her specifically, you've no doubt seen someone like her.

amits to a witches brew of addicts beyond her control. >> things happen in between, and it's quite hard. >> on paper, doris might have help on the way if glide church opens a safe injection center inside these walls. it would be the first in the nation, similar to this one in vancouver, canada, where addicts inject with supervision and support in a safe place that might help break their habits. but not everyone in san francisco wants them. >> we are embarrassed that california has been leading the way in drug addiction. >> today a coalition of opponents launched a full-scale assault. >> our job is not to exacerbate the addiction. our job is to deliver them from this madness. >> pastor ron allen, a former crack addict himself just one of many who spoke out against safe injection centers today.

>> we're afraid that this will only worsen the problem because it will only attract more homeless people and addicts to come to san francisco. >> to establish such centers would violate state and federal law. supporters claim safe injection centers in other countries do work. >> drugs are not a criminal problem. drugs are a health problem. and people are going to do what they're going to do. you can't just berate people or criminalize people into not being addicted to drugs. when someone is addicted, what they need is help. >> when they say that injection centers have helped save lives, they point to lower spread of hepatitis c and hiv. opponents of this plan say they simply want more police in san francisco and stronger laws. live outside san francisco city hall, wayne freedman, abc 7 news. >> all right, wayne, thank you. california's home to silicon valley. the state's dmv is plagued with computer problems. >> tonight find out how often

new at 6:00, san francisco police announced today the arrest of 12 auto burglary suspects. take a look at the booking photos of those 12 suspects. the burglaries all took place in the japan town area between july 26th and august 15th. the arrests are part of an

ongoing effort to bring down property crime. sfpd says auto burglaries are down 20% compared to last year. there has been steady progress this afternoon in containing some of california's largest and most destructive wildfires. the carr fire has burned more than 218,000 acres and is 75% contained. the mendocino complex fire has cumulatively burned more than 329,000 acres and is now 76% contained, and the holy fire in orange county has burned nearly 23,000 acres and is 85% contained. the man accused of setting the holy fire has been ordered to undergo a mental examination after yet another bizarre court appearance today. 51-year-old forrest gordon clark loudly rambled, stood on a bench and was in cooperative in what was supposed to be his arraignment today. here is some of what he said to the judge. >> i used to be recorded because that's my live energy that's being transmitted and it acts as

a secure party, i test -- >> clark's court appearance came after two previous attempts were postponed, one because he refused to leave his jail cell, and the other after his bizarre behavior in court. climate scientists in san jose are working hard to provide more tools to help firefighters deal with the erratic nature of wildfires. a team from san jose state is gathering weather data from burn zones to make future fire forecasts accurate. abc 7 news reporter david louie looks at what they're doing. >> while the carr fire continues to burn, fire weather scientist dr. craig clements moved in with ru in search of data. the instruments on board are a mobile atmospheric profiling system. they gather weather data to help forecast wildfires under type mick conditions. >> our goal is to better measure and observe the wildland fire environment, take those data to basically tune the models. >> he is talking about computer

simulation models that will help to predict how fast fires will move and how intense they will be. the carr fire created a tornado rarely captured on video that is an important case study. it was created by unusual conditions, triple-digit temperatures and single digit humidity. the tornado generated hurricane-force winds up to 165 miles an hour. and temperatures topping 2700 degrees fahrenheit. he is amazed the extent of the damage the tornado created, wrapping utility poles around trees while sheering off trunks. >> it's moving in multiple directions because of the circulation. that's why fire whirls and fire tornadoes and rotating columns are dangerous. >> it may take five years clements believes before they have enough data to pduce reliable fire forecast. >> we're on the verge of developing these tools, but we need more observations at fires, wildfires

>> dr. clemens says fire behavior is influenced by three factor, climate, topography and fuel load. they have fuel moisture sticks to monitor how fast trees and other combustible matter will burn. conditions are at severe levels in much of the state, including parts of the santa cruz mountains. clements is hoping in the future fire rings will carry weather instruments to provide additional research data. with the amount of research still to be done, he has received a grant from the national science foundation to build a second vehicle like this, but that will be equipped with radar to do more of his groundbreaking research. at san jose state, david louie, abc news. >> and tomorrow is a spare the air day in the bay area because of smoke from wildfires as well as pollution from cars. here is a live look at thenow in the middle and san francisco on the right. the bay area air quality management district warns that air quality will be worse during day tomorrow. it's healthier to be outside during the early morning.

this is the seventh spare the air alert of the year. well, let's find out the forecast for the early morning, afternoon and the rest of the day. >> spencer here with that. >> i happen to have that for you. it is going to be a spare the air day tomorrow. some regions will have moderate air quality. i'll show you where it's going to be poor in just a moment. here is live doppler 7. we have sunny skies with a little shall low marine layer developing along the coastline, and our 24-hour temperature change shows most bay area locations are experiencing temperatures that are 5 to 12 degrees higher than they were at this time yesterday. the exceptions san francisco, half moon bay, oakland and napa. looking over san francisco, it's a lovely early evening. 62 degrees here in san francisco. oakland, 67. 72 in mountain view. 80 in san jose. 89 at morgan hill. and 57 at half moon bay. this is a lovely view from mount tam. you can see that finger of fog beginning to push over the bay. 5 in santa rosa and napa.

82 in novato. fairfield 90. 94 concord and 91 in livermore. from the east bay hills camera, we give you this hazy view, and these are our forecast features. it will be mild at the coast tomorrow, but hot inland. the heat will ease up slightly on sunday, but it's still going to be a very warm day. we'll have a cooler pattern developing early next week. the forecast animation starting at 7:00 this evening shows the marine layer expanding a little bit, or what's left of it along the coastline. probably will not push out over the bay or inland. we'll start the day tomorrow mainly sunny skies and it's really going to warm up nicely by afternoon. in fact, inland areas are going to be downright hot. overnight clear skies inland and even near the bay. overnight lows will range from low 50s at the coast and from the north bay valleys to mid and upper 50s elsewhere. tomorrow's highs south bay, 88. and san jose, 97. at morgan hilton peninsula, we'll see highs up to 82 in redwood city. 83 in mountain view. on the coast, low to mid 60s

from pacifica to half moon bay. san francisco will top out at 68 degrees tomorrow. the north bay, look for highs of 90 at novato. 98 cloverdale. 102 at youskaya. east bay highs 76 and oakland 72. the inland east bay will be our warmest region overall with highs in the upper 90s just about everywhere, up to 100 at brentwood. i wouldn't be surprised if maybe antioch or fairfield tops out at 100. here is a view of haze developing over oakland and tomorrow's spare the air day. moderate day expected in the north bay. the coast and central bay and the south central bay. but air quality will be poor tomorrow in the inland east bay and the santa clara valley. let's move along to the accuweather seven-day forecast, and here it is. tomorrow will be a warm one. warm to hot, i should say. heat eases up a few degrees, about 4 degrees or so in our inland areas and around the bay on sunday. and it will be much cooler on monday. in fact, maybe even a little bit of early morning drizzle, below average temperatures on tuesday, and the temperatures bounce back

wobbly start and ended broadly higher on hopes that u.s. and china were making progress on resolving their trade dispute. the dow rose 110 points. the s&p added about 9. stock in palo alto-based tesla closed at its lowest point this month, dropping about $30, about 9% to close at $305 per share. the dive happened after a "new york times" story last night revealed stress is taking a heavy toll on elon musk, saying he is working 120 hours a week, sometimes three to four days straight at a time. musk is also taking the prescription drug ambien to help with sleep. c/net's ian sherr told us about the crisis musk is experiencing now. >> this is a tough time for him. and look, i've seen ceos go through really tough times. he is definitely one of the people who clearly is having a really rough year. and some of that is self-imposed, right? the stuff he has done on

trying to anticipate what's to come in. san francisc, chris nguyen, abc 7 news. >> juries will resume dlib racing on monday in the trial of trump's former campaign chairman paul manafort. manafort faces 18 federal charges. the judge revealed today that he is receiving protection from u.s. marshals after being threatened. he won't publicly disclose the names of jurors due to concerns foretheir safety. today stanley won an extension on a restraining order against his former business manager. lee, who 195 years old is in a power struggle over the control of his empire. at one point, lee's attorneys argued elder abuse against the former manager. no charges have been filed. lee is the creator of spider-man, the incredible hulk and other iconic super heroes. a younges criminal charges for pushing her friend off a bridge in washington state. taylor said on good morning america she would accept the consequences of her action.

16-year-old friend jordan holgersson receive ared injuries. she did not think about what might happen before she pushed holgersson. facing more criticism from lawmakers following numerous computer outages. dmv officials admit their system has crashed 34 times since january of last year. the agency's website has gone down five times. senate democrats recently rejected a call to audit the dmv. and now one gop assemblyman has renewed his calls to examine the dmv. turkey, have a 40-year-old technology that fails dozens and dozens of times is utterly inexcusable. the dmv has made excuses that these wait times and the problems they're having is because of real id. that's just not true. at thethey actively working to replace their aging computer system.

smart trains in the north bay will be free this weekend to celebrate the first anniversary of service. tomorrow smart will also hold a festival at the novato hamilton station with music, food trucks, beer and wine. they run between san rafael and the sonoma county airport with plans to add more starting with larks spur. this amazing video of a mountain lion mother and her cubs inside their den is giving new hope for the species' survival in sonoma county. the video was taken by researchers trying to teach bay area residents how to live safely with lions in their midst. abc 7 news is the first to share these rare images with the public. >> these mountain lion kittens are 11 days old, snuggled in a cave in the glen ellyn/kenwood area. their mother is movements. researchers have been following her for three years three two

video camera inside her den. quinton martins is an expert line tracker. he waited until the gps showed the mother off hunting and then went looking for the lion cave. >> crawling into holes and roots and trees. finally i found this cave with the two little kittens in it. and it's just amazing. >> quinten rons living with lions for audubon canyon ranch. so far they've put gps collars on nine wild mountain lions in sonoma county, tracking them as they share their habitat with humans. the project had a major setback when the nuns fire burned their office and thousands of dollars of high-tech equipment. >> everything was destroyed. >> private donations got them back in action, and all the research lions survived the fire. but the animals still face serious threat, often from people trying to protect livestock. if a mountain lion kills livestock or a pet, california

law allows the owner to get a depredation permit to have the lion killed. remember the mother we showed you earlier? no kittens from her two past litters are still alive. three cubs died from natural causes. two other made it to young adulthood but were killed after they killed livestock. quinton and his team are hoping to stop that cycle with the new litter. the way to save lions is to protect livestock. >> they need to be locked in a predator-proof enclosure at night. >> quinton says most problems here from hobby farms with just a few animals and no protection from lions. he showed us this property, which actually has a small barn, buhewn stilleft their goats outside at night and a lion attacked. he came back the next night, but gave up quickly because now the goats are safely inside. >> they're out at night, it's not a question of if they're going to get taken by a mountain lion or a predator of some type, it's a question of when. >> the living with lions project barnyard and fencing set up to

today marks one year since a terrorist attack in barcelona, spain. a van plowed through the crowd along the popular walkway, kill mortgage then a dozen people, including a man from lafayette, 42-year-old jared tucker who was on vacation with his wife. memorial ceremony today took place along la rambla. the attack claimed 14 lives and left 120 people injured. ⌞>> a mayor in southern italy has ordered the closure of a bridge designed by the same architect who created the failed genoa bridge t morani bridge left 15 people injured and possibly 20 missing. the death toll is expected to rise. today some of the first funerals were held and a state funeral is scheduled for tomorrow. they're focusing their investigation into the cause of the bridge collapse on a possible design flaw or

new at 6:00, firefighters worked quickly to put out a smoky fire in san francisco. abc 7 news was at makeda restaurant on green street and in north beach. the fire started in a kitchen ventilation shaft called a flue. investigators believe it was an accident and nobody was hurt. it took about a half hour to put out and the restaurant is closed for the weekend. how many pass words do you have? how would you like to trade them all for just one ultra secure
