court appearance, a case now fueling the flames of the immigration debate. good evening, i'm dan ashley. >> i'm kristen sze. thanks for joining us. take a look at video from the iowa courtroom today where we got our first look at 24-year-old cristhian rivera. a judge increased his bond from $1 million to $5 million after prosecutors argued rivera was a potential flight risk. >> a court document filed today by rivera's lawyer claims he was working here legally. that's something in dispute with immigration officials. >> tibbetts spent part of her childhood here in the bay area before moving to iowa. her family released a statement. >> it reads in part our hearts are broken. on behalf of mollie's entire family, we thank all of those from around the world who have sent their thoughts and prayers for our girl. >> now, the immigration status of the man accused of killing tibbetts has president trump and house democratic leader nancy pelosi in a twitter war. >> melanie woodrow attended an event with pelosi at the public

policy institute of california today. she's in the newsroom with the story. >> reporter: in her remarks on stage, leader pelosi didn't specifically talk about mollie tibbetts, but she did speak about immigration, quoting the president she said might surprise -- she quotes most ap with an interpreter next to him. his attorney disputes he's undocumented, president trump tweeting this video today. >> a person came in from mexico illegally and killed her. we need the wall, we need our immigration laws changed. >> reporter: meantime today in san francisco house democratic leader nancy pelosi speaking at the public policy institute of california, emphasized the importance of respecting the newcomers play, quoting president ronald reagan. >> if we ever close the door to new americans, our leadership in

the world would be lost. >> reporter: president trump calling out pelosi today in an earlier video tweet. >> nancy pelosi and the democrats want to abolish the brave men and women of i.c.e. what i want to do is abolish the killers in isis. >> pelosi responding over twitter that, quote, the president is hallucinating when he characterizes democrats' position on protecting the borders and defeating isis. she told abc 7 news that comprehensive immigration reform is necessary and had this to say about tibbetts. >> any death is a sad thing. but the person that is accused of killing her worked for a republican employer. >> the owners of that family farm speaking out today. >> there will be plenty of time to discuss immigration. but, however, now is not the time. now is a time to grieve and remember mollie. >> a tragic death sparking new debate about immigrationlo

disappearance and everything we know about the suspect who was again in court today. that's at abc7news.com and on the abc 7 news app. a big story we're following for you, developing news, hurricane lane is closing in on hawaii as a major storm. the first rain bands could his the big island tonight. airlines have warned passengers about the coming storm. many are waiving reservation change fees. abc news spoke to some people making the trip today. the hurricane didn't seem to phase them. >> at first i was nervous, but i'm still excited to go to hawaii. it's okay. just going for school. so we have an appointment, a guided tour and also meeting with a counselor. california is already sending help to hawaii, a task force if menlo park is heading there, as well as a group from san diego. let's get to drew tuma tracking the hurricane. in the past 90 seconds, we

just got the latest information from the central pacific hurricane center, it continues to be a major storm. still 50 miles an hour, a category four storm, 275 miles south of the big island of hawaii. so the latest track we just got this in moments ago, you still see off the coast of hawaii, 130-mile-per-hour winds as it approaches the coast of maui friday morning. it does weaken, but winds still 100 miles an hour certainly bringing heavy rain to the region and then what will be key, when does the storm make that left turn? sooner would be better. right now saturday morning it weakens during that turn. but still, oahu would see heavy rain before the storm pulls out of here by the end of the weekend. so certainly the time to watch would be tonight into saturday morning as lane approaches, guys. >> okay. thanks, very much, drew, and oakland police officer is still in critical condition. a week and a half after a car crash while on patrol. >> and today the oakland police department announced a fund to help with his recovery.

>> at around 2:45 a.m. last monday jordan wingate was heading to a call on middle harbor road in west oakland. >> on the way he was involved in an accident with an suv and a parked semi truck. no one else was hurt. but officer wingate was critically injured. >> set up for jordan wingate in case he needs long-term care. >> now, you can find a link to donate if you'd like on our website, abc7news.com. we have a health alert for you. tonight, a case of measles in contra costa county. >> health officials are warning you may have been exposed if you visited these two places on the map last week, the john muir medical center in walnut creek, and chow restaurant in lafayette. >> abc 7 news anchor eric thomas is live in walnut creek with the story tonight. eric? >> reporter: and dan, the person who had the measles has

recovered and is no longer contagious, while he or she was, they visited sedona, arizona and los angeles county where the health departments are notifying people. when they person came home to contra costa county they also visited, as you mentioned, and may have exposed people here, at john muir medical center. measles is rare these days because most but not all people have been vaccinated. >> red eyes, fever, sore throat, rash that starts on the head and moves down the body. someone who get measles could potentially get much more serious complications, pneumonia, swelling of the brain, permanent disability. >> reporter: a contra costa county resident with the measles visited john muir hospital's emergency department on august 11th from 11:00 in the morning until 2:00 in the afternoon. the same person also had a meal at chow restaurant in lafayette on august 14th from 9:00 in the morning until 11:00 in the morning. >> anyone who is not vaccinated or had past disease could have been exposed if they were there

at the same time. >> reporter: the county health department found and interviewed everyone who could have been exposed at the hospital, tracking down people who ate at the restaurant is more difficult. someone with a virus is contagious four days before and four days after the rash appears. folks who've been exposed to measles in contra costa county won't be completely in the clear until september 5th. >> and they should check their immunization status or disease history and call their doctor if they feel like they're having any symptoms of measles. >> reporter: so far no other reports of any measles here in contra costa county. but again, won't know for sure until september 5th. if you're wondering when the last case of the measles was here in contra costa, they had one in 2015. they had one the year before in 2014. both those cases were tougher to handle because in both those cases the person who had the virus rode bart. they had to track down a lot of people, and there were a lot of people they couldn't track down because of that.

this time it's a bit easier. in walnut creek, eric thomas, abc 7 news. >> thanks, eric. well, it is no secret, the drivers are fed up with the california dnv, as they face long lines at the local field offices. >> the director says relief is on the way. chris nguyen is live in san jose with more. >> reporter: we spoke to the director today about some of the issues facing the dmv. we learned more details about her plans to reduce wait times across the state. inside the dmv's driver license processing center in san jose, many customers were somewhat shocked by the ease of their experience this afternoon. some who came here without an appointment were expecting to wait for most of the day. but ended up getting in and out in just under two hours. >> they're welcoming you, right when you get in the door. they're like have you been helped? this is what you need. >> dmv director gene shiamoto visited with staff today in ongoing efforts to -- she was

grilled by lawmakers who questioned by the agency's wait times skyrocketed over the past year. she blamed the delays on the high volume of customers coming in to apply for a real id, but also acknowledged problems with the department's decades old computer system. she hopes to modernize it within the next four years. >> we're looking to see if we can offer more transactions online so you don't have to come to our field office, working to see how long that would take, any policy concerns on that. >> reporter: as we've seen, not all dmv field offices are equal. in santa clara, customers reported wait times of up to five hours. many came prepared, saying they expected it to be much worse. >> sure, it's frustrating. >> reporter: the dmv just redid its website to make it more user friendly. officials are also encouraging customers to use self-servi

self-servicekiosk for items such as vehicle registration. the wait times should start dropping by mid-september, and hopefully become more reasonable by the end of the year. reporting live in san jose tonight, i'm chris nguyen, abc 7 news. >> chris, thank you. you probably know you can book dmv appointments online, and we wanted to see how long that would actually take. we checked a few offices. you only have to wait a month to get into the oakland coliseum office, an appointment available there on september 26th. i say only. but that's still a long wait. walnut creek's earliest appointment is october 9th. santa rosa's is october 11th. san jose, october 25th. and you'll have to wait until november 13th to get into the daly city office. again, this is just a sampling of available appointments at the dmv. >> tired of the gray? we're getting a little blue right now. just coming out, the sun. that's all we seem to be getting when we look across the san francisco skyline recently is gray. it's not going to get any better

anytime soon. meteorologists say we should expect morning fog until september. that's, of course, bumming out some tourists. >> a little bit sad. but, you know, what can you do? still going to try and get the most out of it we can. >> we came out to get pictures. we're still enjoying it. it would be much better with blue skies. >> we natives know this is kind of what we get in late summer. let's get a closer look at what we're dealing with right now. here's drew tuma. >> it must be august if the cloud cover is tough to break. that cloud cover has taken a hit for our temperatures. look at this, only four days this month has san francisco exceeded its average afternoon high of 68 degrees. it certainly has been a cool month. if you're a fan of this cool weather, you're certainly in luck. take a look at how we round out the month, next week, cool temperatures will still take hold of much of the western half of the u.s. as we head towards september, we're calling it a september

swap. remember last year on the 1st of september, we had a record high of 106 degrees in san francisco. this year, coming up, we're forecasting only a high of 64. so certainly a tale of two septembers headed our way. take a much closer took at the accuweather forecast in a few minutes, guys. the end of an era, a business closing all of its stores after nearly nine decades. >> felt like the individuals were always really knowledgeable. >> what led the decision, and when closing sales will get under way. and start saving, the high price, the average couple, is playing to get married in california. and a high tech way to get your coffee, how it could be you could generate your own energy, at home. or to save energy, unplug unused appliances. do your thing, with energy upgrade california.

closing sales at orchard hardware stores begin tomorrow. >> the chain announced its shutting down all 99 stores

because it's losing money. >> david louie is live at the landmark store in downtown san jose with reaction from customers and what this means for employees who work there, david. >> reporter: well, dan and kristen, orchard supply has been losing a lot of money, in the millions of dollars. now, the decision to close the store made by the home improvement store chain lowe's, which both owns it and competes against it. thousands of employees will be losing their jobs. many customers are bemoaning the fact they're going to be losing great customer service. orchard supply got its name because it was originally a farmer's cooperative started by 30 prune growers in 1931 in san jose. but after world war ii, as the post-war baby and housing boom unfolded, it became a hardware store appealing the homeowners. the customers have been loyal for decades. it's the customer service that keeps them coming. >> we bought moss for plants. the individuals are always really knowledgeable in their

departments. it's just not the same feeling or shopping experience you get at the big box stores. >> reporter: in recent years big box stores like lowe's and home depot popped up. last year orchard supply or osh did $65 million in sales -- lowe's thought it could grow as a small box specialty chain. lowe's paid $205 million for it in 2013. but the decision to close will have an immediate $230 million impact on earnings. additional expenses by the time all 99 stores shut down in california, oregon and florida by year's end. osh has 4,000 employees. >> we're concerned about the people. we know hundreds of employees are out of jobs. through our work future nonprofit partner we work on job retraining. >> executives say osh employees

will be given -- customers are grumbling. >> i always get the, this isn't my department, let's look for it together. not a good sign. >> reporter: as dan mentioned, the closing sales will begin tomorrow, and will last for about ten weeks. the closing of the stores will happen about the end of the year. live in san jose, david louie, abc 7 news. >> hate to see it go. >> i know, thank you, david. well, we have a recall to tell you about, involving space heaters. >> "7 on your side's" michael knee is here with that. >> it's caused some big problems. let me show you what this thing looks like. it's the vornado, it is recalling 350,000 personal vortex space heater, officials say it can overheat and catch fire. the company has received reports of nearly 20 fires, including one that turned deadly. if you have one of these

heaters, you should stop using it roigt away, contact vornado to get a refund or replacement. start saving now if you plan to tie the knot in california. knew research for the wedding report inc., we're the ninth most expensive state to get married. it costs about $32,000 to get married here. about $7,000 more than the national average. the least expensive state to get married, mississippi. the average wedding there costs $15,000. a drone could be delivering your coffee one day, ivm secured a patent for something pretty unique. here's a look. the patent is for drone coffee delivery based on a person's cognitive state. the filing says the drone would fly over a crowd of people and deliver coffee to those requesting it. sensors could determine whether someone simply needs another cup. the sensors would look for pupil dilation, facial expression or

how tough your current or work schedule would be. in the newsroom, there would be drones everywhere. >> that patent is not making it to the marketplace. following breaking news out of san jose. police are investigating a report of a kidnapping and robbery of san jose state student according to partners at the mercury knews. >> an abduction at 7-eleven, and forced to withdraw money from several locations. the victim was later released and then called police. we should tell you that person was not hurt. >> announcer: now your accuweather forecast with drew tuma. we continue the trend of cool temperatures this afternoon. really hard pressed to see a lot of cities even reach where they should be this time of year. live doppler 7, along with satellite right now, is showing you, still have that fog bank right along the coastline, but away from the coast we do have sunnier skies. outside we go, a live look from our east bay hills camera.

it's not only cloud cover, that haze in our atmosphere. once again we have moderate air quality across the entire region right now that will continue once again tomorrow, we do have an air quality alert lasting through sunday because smoke continues to move into our atmosphere from fires to the north. we continue to track hurricane lane right now because it is very close to hawaii at this hour. take this a little bit bigger for you, show the current watches and warnings we have at this hour. a hurricane warning in effect for the big island, as well as maui, a warning means that hurricane conditions are imminent, within the next 24 hours. a hurricane watch that encompasses kauai and also oahu, that means hurricane conditions are possible. but what we're looking to for hurricane lane, and what we expect, the peak time will be tomorrow evening through saturday morning, where we could see damaging surf, especially along our south-facing beaches, rainfall 10 to 15 inches. there could be some isolated spots where we see more than

20 inches of rain. and certainly winds will be a big issue with this system, anywhere from 39 to 74-mile-per-hour winds, possibly higher than that. good idea, download the accuweather app, track the hurricane as it gets closer to hawaii at this hour. right now, back here at home, 60s and 70s, the name of the game, if you like cool weather, you love today. 77 in concord, 74 in san jose. right now, san francisco is 66 degrees. so here's a call from accuweather, overnight tonight, stuck in this pattern for several days now, that cloud cover, that marine layer will expand overcast skies across much of the region, could see coastal drizzle first thing tomorrow morning, mid to upper 50s as we get you out the door on your thursday morning. the big picture, the pattern in the atmosphere has not changed much. we have this onshore flow keeping us cool for the month, but keeps the cloud cover rather intact along the coastline. 12-hour day planner, here's the
