in november of 2009 when he slammed into a car carrying the xavier family near the intersection of willow road and bayfront expressway in menlo park. 6-year-old lisa xavier was killed. fox was identified as the suspect. police say he fled the area and the country. he was never caught until now. people in the community were wondering if this hit-and-run case would be solved. >> i'm glad they're getting him. after nine years. justice will be served. >> that won't bring back lisa but it will hopefully provide closure for the families. >> reporter: lisa xavier was a first grader at laura elementary school when she was killed. a tree hon campus is lit once a year in her honor. a news conference at 9:00 a.m. is expected to shed light on fox's arrest. reporting live here in menlo park, matt keller, abc 7 news. breaking news from the abc 7 live desk.

>> we continue following breaking news at our live desk out of florida. federal investigators are on the scene of a deadly scaffolding collapse that happened earlier this morning a short time ago at a hotel under construction outside disney world. workers were preparing to pour concrete when the platform they were on gave way. two workers fell six stories to the ground. unfortunately they died on the scene. a third was able to hold on to . we will stay on top of the story as it develops and bring you any updates. california is now the first state to end cash bail. under the new law decisions will be based on risk assessment rather than if the defendant can come up with a certain amount of cash. assemblyman co-authored a bill that governor brown signed yesterday. hundreds of california businesses with thousands of employees say it's going to put them out of business.

w've got low to mid 80s, san diego, los angeles, chico, 91 fresno, monterey 68, breezy in yosemite 86, mid to upper 70s in tahoe through friday and flirt with the 80s starting saturday. walnut creek police trying to track down the thieves seen in these surveillance photos. they're accused of stealing merchandise from the apple store in a matter of seconds. >> this isn't an isolated thing. it's happened six other times this month in california. abc 7 news reporter amy hollyfield is live in walnut creek with more. amy? >> jessica, i just heard from someone on twitter who was here at the store when it happened and he saw a security guard outside the store when he walked in, but during the robbery didn't see any security officers, didn't see them doing anything. this is a brand new store here in walnut creek. it's been open just for a month. already, though, targeted by thieves. here are some still pictures from the store surveillance

camera released by police. saturday afternoon at 5:40. the man on twitter told me it was crowded, very busy, but no one got hurt. no weapons were involved. police say they got away with about $30,000 worth of merchandise they ripped from the security tethers. police have a license plate they want you to be on the lookout for a black mercedes with a license plate 5xrs835. license plate 5xrs835. investigators say there were four people involved. this is the second hit in the bay area in a week. check out this video from last wednesday when thieves targeted the apple store this happened at noon. five people grabbed electronics and got away, they drove away in a black honda. the license plate covered with black tape and got away with $19,000 worth of merchandise. no arrests have been made. police haven't said if they think the two are connected but this is a trend in california. there have been at least six apple store theftsz in california in the last month.
