the suspects. good evening, i'm dan ashley. >> i'm kristin sze. thanks for joining us. the student who brought a gun to balboa high school yesterday is now facing eight felony charges. >> it went off in a classroom leading to a lockdown. we're glad to say no one was hurt. >> we have more from where police are outside. what are they saying about the investigation? >> reporter: detectives are getting help from federal investigators. the atf trying to determine how the 14-year-old freshman obtained the gun and where it came from. the student is a mariner so we're not naming him, but he's facing a long list of charges. >> hopefully things go normal. >> reporter: students at balboa high school looking for normal the day after their classmate brought a gun to class, and it discharged sending a shot through a chair. >> i'm still nervous as to what happened -- i feel like everyone's going to talk about it. >> it's only the second week. i feel so bad because i don't

want her to come here. shein? stoifts come. >> reporter: counselors were available. the staff played an early role in trying to find the 14-year-old freshman involved. this e-mail sent to abc7 news shows classrooms giving the all clear. the name of the suspected student is written, and the clothing description is a red hoodie. >> i work here, too, so it was okay. the staff was great. >> reporter: the student ran off campus. police say his mother turned him in. now he faces eight felony charges. >> including possession of a firearm on a campus. possession of live ammunition. and negligent discharge. >> reporter: the atf is helping san francisco police determine where the gun came from. the other three students detain a gunshot happened. >> the other three students who were involved were released to their parents pending further investigation. >> reporter: we asked san

starting this week, all that overtime is now voluntary. >> it's difficult to sustain that skult, working -- that schedule, working six days straight. >> reporter: there were ten to 20 officers riding trains on an average day with the mandatory overtime. now there will be four to ten officers. b.a.r.t. secured a fema safety and security grant for $6.8 million recently. they'll start spending that money in september. it's earmarked for anti-terrorism, not crime. still, it will provide for some upgrades in security cameras. >> people recognize if i commit a crime on b.a.r.t., my photo's going to be captured, i will be apprehended. that's a deterrent to crime. absolutely. >> security cameras will catch the crime being dmited, but it won't stop the crime. >> reporter: attorney bob arns represents nia wilson's family in a lawsuit against b.a.r.t. >> clearly the band-aids that they are applying now have

absolutely no effect. so thus, it is foreseeable that there will be violent crime continuing on b.a.r.t. >> reporter: b.a.r.t. is also short 21 officers right now. i'm leslie brinkley, abc7 news. new developments for the man wanted for stabbing a b.a.r.t. passage or a train over the weekend at the macarthur station. oakland police arrested the suspect identified as 59-year-old jamar coleman. investigators say surveillance shows coleman pulling a knife on the victim. that man suffered a cut on his thumb. if you take b.a.r.t., heads-up. major track work is planned again for this weekend. crews are working on the rails between the 19th street and west oakland stations, as well as between lake merritt and west oakland. this is the third week b.a.r.t. will work on the tracks. they have one more weekend planned in september. some riders have said the buses add a lot more time to their trip, so plan accordingli.

in the east bay, firefighters have con trained a grass fire near the tesoro refinery. the fire was reported around 2:15. a fire official says about 25 acres burned. firefighters originally had trouble getting to it because of gates at the refinery. no one was hurt. the fire did not interrupt work at the refinery. let's turn to the weather now. and the holiday weekend, of course, it's beautiful today. here's hay beautiful view from our sutro camera. remember what it was like a year ago? >> i don't exactly. we looked it up, though. it turns out we were sweating it out for a little friday flashback. l let's get to sandhya patel. >> you cannot forget, san francisco was sweltering a year ago, labor day weekend. 106 degrees. that was an all-time record. now, tomorrow, the expected high is a comfortable 68. let's hear it for the weather.

right now, in the 60s to 80s. really a warmer day for many parts. a live look from the east bay hills camera, a beautiful view. a sign of what's to come over the next three days. it's going to get a little bit warmer on sunday and on labor day. livermore will go from 87 to 91 to 89. san jose from 80 degrees to 83 to 84 on labor day. so really good-looking weather for grilling or any outdoor plans. full look at the accu-weather seven-day forecast is coming up. >> okay. thank you very much. package thefts have, unfortunately, become all too common here in the bay area, right? >> yeah. >> the way the crimes are being committed is volving all the ti. we have a new way you may not have thought of. there's a pattern, maybe a network of people. >> reporter: at first glance what you see in the images isn't anything we haven't seen before. suspected thieves in san francisco appear to take packages that aren't theirs. >> it happens more often than, say, in the suburbs. >> reporter: what's different this time -- how the suspected

crooks entered the building. >> the man was actually nice enough to deliver the food before he came back and took the packages. >> reporter: at least two residents say they've ordered food through delivery app caviar. surveillance images show who they believe is the male driver getting access to drop off food. later video shows him and a female accomplice leaving with packages. >> it's easy. you trust dwrooapps to let peop. it's not like it was ten years ago. >> reporter: there are two kind of delivery drivers. ones are independent contractors hired through apps and one hired by the restaurant like extreme pizza. viva goa uses its own drivers. >> most of the drivers have been here four or five years, and we know the customers personally. >> reporter: a caviar spokesperson says they're aware of the issues and said in part, "while this type of issue is not unique to caviar, we take incidents like this very seriously, and we'll end relationships with couriers who are found to be violating our

policies." >> as a woman living alone, a building with 60-some residents, it's scary that they have easy access. >> reporter: while megan and her neighbors may never get their packages back, she has a message for the possible suspects in the surveillance video. >> it's unfair and unfortunate, and you know, i hope -- i hope you get what's coming to you. >> reporter: in san francisco, abc7 news. >> remarkable. the caviar spokesperson told us there are even instances where crooks will buy or steal trademark orange bags so they can pretend to be delivery drivers. they're back. rat. at the sun valley shopping -- rats. at the sun valley shopping center food court. a seafood restaurant closed for the second time in two weeks and will stay closed at least through tonight. the buffet was one of six restaurants closed temporarily because of rodent infestations earlier this month. health department officials say the problem is not with the restaurants but with the mall. mall owners issued a statement saying they're continuing to work with the health department.

iowa authorities say a white supremacist group is using the murder of mollie tim totes promote its views through row -- mollie tibbetts to promote its views through robo calls. she spent her childhood in oakland. she was found dead in iowa in a co cornfield ten days ago. a man has been charged in the murder, and it is believed that he's in the country illegally. officials say the robo calls about tibbetts are being paid for by the road to power, an idaho-based group with a website and neo-nazi podcast. the calls describe rivera as, quote, as invader from mexico. a south bay assemblyman has pulled his bill banning the practice of conversion therapy because of pressure from religious groups. evan lowe's legislation would have made it illegal to sell any service intended to change an individual's sexuality or identity. it's considered an attack on first amendment freedoms. he will try against next year.

has declared bankruptcy. it operates four hospitals including daly city, o'connor hospital in san jose, and st. luis hospital in gilroy. the hospitals were originally part of the not-for-profit daughters of charity health system which was taken over by blue mountain capital in 2015 before billionaire patrick sun-shon acquired a majority share last year. we figure we've got to bail out. we've got this millionaire turning things around. >> reporter: critics are asking was the purchase a temporary bailout of the change to further his own financial interests. >> we believe this is all, you know, a financially engineered thing to maximum value before destroying this not-for-profit hospital system. >> reporter: verite's statement said, "we can no longer swim against the tide of our operating reality which includes a legacy burden of more than $1 billion of bond debt and unfunded pension liabilities, an inability to renegotiate

burdensome contracts." the continuing need for capital expenditures for seismic and aging infrastructure. local officials upset over how the billionaire could walk away from the responsibility of ensuring these hospitals remain as community assets. a condition that was required by the attorney general's office when the original sale was completed. >> we had so much hope for him in terms of what he wanted to do to turn these into consider centers and to be at the forefront of innovation and to be a leader. it's a slap in the face. >> reporter: the future of verity now in question. abc7 news. a hearing was held today in a lawsuit democratic the release -- demanding the release of ten gremts who have been transferred state. tis he earlier, 200 people at the west county detention center in richmond were moved to other facilities after contra costa county terminated its contract with i.c.e. lawyers argued the transfers

violated the immigrants' due process rights. >> i cannot imagine their heartache knowing that now they are hundreds of miles away from their loved ones. some cannot even go out to see them, whether it's financial, lack of resources or other resources. it breaks my heart for them. we're here to continue supporting them. we will keep advocating for them as much as we need to. >> the judge is expected to make a decision next week. express lanes are coming to highway 101 along the peninsula. the project will convert the existing carpool lanes from the highway 85 interchange all the way up to near the san mateo county line. construction is likely to begin next year and wrap up in the summer of 2021. the santa clara valley transportation authority says the project was made possible by a state grant of $47.5 million. quite a scare for an uber driver in san diego. authorities say the man came up to an intersection moving fast. he lost control of the car which plunged into san diego bay and started sinking.

the stunned driver says by the time he got his seat belt unbuckled, he couldn't get his door open. he finally got out through a broken w w w w self pe self people helped the man until police arrived. he was not hurt. another car company could be rolling out a self-driving vehicle. valve so posted a brief video on its facebook page showing a concept model called the 360c. there's not a lot visible, but that's a tease. volvo asks could time spent traveling become time well spent. there's another video that passengers will have lots of free time putting two and two together, experts say this points toward a self-driving feature. there's at least one person against the idea of apple and tesla teaming up, billionaire investor warren buffett. he said it would be a poor idea.

in gas and electric is pg&e. we run about 2,500/2,800 fire calls a year and on almost every one of those calls pg&e is responding to that call as well. and so when we show up to a fire and pg&e shows up with us it makes a tremendous team during a moment of crisis. i rely on them, the firefighters in this department rely on them, and so we have to practice safety everyday. utilizing pg&e's talent and expertise in that area trains our firefighters on the gas or electric aspect of a fire and when we have an emergency situation we are going to be much more skilled and prepared to mitigate that emergency for all concerned. the things we do every single day that puts ourselves in harm's way, and to have a partner that is so skilled at what they do is indispensable, and i couldn't ask for a better partner.
