holiday, but everyone should be pack at work and school today. should be busy once we get a few hours in. westbound 580, tracy to dublin in the yellow at 37 minutes. westbound 4, antioch to concord in the green at 13. although i have heard about a disabled vehicle, and san rafael to san francisco, wide open at 15 minutes. >> happening this morning, in just about two hours, supreme court confirmation hearings set to begin for judge brett kavanaugh. >> the showdown over his seat has already started. abc news reporter emily rau is in washington with the latest on the outrage from democrats. >> good morning. the hearings start at 9:30 this morning on capitol hill. and a lot of senators are eager to start questioning this federal judge who could have a major impact on the nation's highest court for decades to come. as federal judge brett kavanaugh rounds out his intense preparation for this week's

hearings, senate democrats are already making their case that the white house is withholding key information about kavanaugh's record. already, some 400,000 documents have been released but it's the 100,000 from kavanaugh's time as a close aide to president george w. bush that democrats want. chuck schumer tweeting late monday, the senate was just given an additional 42,000 pages of kavanaugh documents the night before his hearing. this underscores just how absurd the process is. in response, republicans on the judiciary committee saying the team will be able to go through the latest batch in short order. >> he was very explicit in terms of what he wanted in a supreme court nominee. >> democrats are expected to grill the 53-year-old about his views on roe v. wade and whether kavanaugh would work to overturn it. democrats have also gone after kavanaugh for once writing that presidents should not be distracted by investigations while in office. some accusing president trump of picking kavanaugh to protect

himself. emily rau, abc news washington. >> a new poll released this morning finds the public is evenly divided on judge kavanaugh's nomination. more than 1,000 people who participated in the poll last week and 38% of people surveyed said the senate should confirm kavanaugh. 39% said the senate should not confirm him. 23% had no opinion. the controversial issue here is kavanaugh's ambiguous stance on abortion. 59% of people surveyed said the judge should publicly state his position. 31% said he should not. 10% had no opinion. >> san jose police hope surveillance video will lead them to the driver who hit two kids on their bikes. here's that video. you can see a white honda civic come up to the intersection. the driver hits the kids and then backs up and a moment later takes off. this happened last monday at

cotyl road in south san jose. one neighbor's gardener witnessed all of it. >> stop, stop. he was saying, trying to make him stop, but the boys did not stop. they just back up and make a quick left turn. >> police are still looking for the white four-door honda. witnesses say there were three people, possibly teenagers, inside. the two children were hurt. they are expected to recover. a bay area man who drowned while swimming in stanislas county was not wearing a life jacket. that's according to the sheriff's department. deputies say the 26-year-old man was trying to swim across the woodward reservoir with his brothers before noon. he started to struggle and went underwater. a dive team found his body around 5:00 last night. the sunnyvale man was on a holiday weekend camping trip with family. >> this morning, we're learning more about what led up to an ambulance patient getting hit and killed on an east bay freeway. >> medics were transferring the

woman from valley care medical center in pleasanton to a psychiatric fy in san leandro yesterday morning. we're told she got upset, jumped out of the ambulance. this happened on the connector ramp between 680 and 580. >> the patient got out of all of the restraints, overcome, and pushed out of the way the attendant in the back of the ambulance. and went and opened the locked doors of the ambulance and exited the ambulance. >> according to the chp, two cars swerved out of the way. a third car struck her and she died at the scene. san francisco leaders and health advocates are pushing for governor brown to sign a bill to allow san francisco to become the first city in the u.s. to open safe injection sites. last week, a state legislature passed the bill to create a three-year pilot program. also last week, a first look at what a safe injection site would

look like here. the site would provide supplies, education, and also resources, but not drugs. the governor has until the end of the month to sign the bill. also today, a north bay school district with a controversial name that some say references the confederacy will consider a name change. >> this is the dixie school district. it's located in san rafael. critics of the name say dixie is a reference to the confederacy and slavery. the board has previously declined to change the name. several community members pushing for the change plan to address the school board tonight. this morning there is new controversy swirling around former 49er colin kaepernick. >> he's back in the headlines and this time for being one of the faces for nike's latest ad campaign. reporter amy hollyfield is at the nike store in san francisco. hi, amy. >> hi, jessica. yeah, we have seen the reaction on social media. what will be interesting to see is what kind of reaction happens here in the stores to nike's bottom line.

they're down in stock trading pre-market trading, so we'll watch to see what happens when the markets open. here is the ad. it says believe in something even if it means sacrificing everything. we have seen plenty of reaction on social media. one man posted video of him burning his nike shoes. serena williams posted that she is proud of the ad. a professor at san francisco state thinks this will actually boost nike's image. >> it's, you know, a continuation of a really strong history of athlete activism that nike is now inserting itself into. >> you'll remember kaepernick was the first to kneel during the national anthem at a football game, and now he's been out of a job. a football job, for more than a year. and he is suing the nfl. this ad, though, is a multi-year deal for him. it is helping mark nike's 30th anniversary of its just do it

campaign. reporting live in san francisco, amy hollyfield, abc 7 news. >> thank you, amy. you may want to set your car vents or air conditioner to recirculate today, and air quality advisory is in effect because of wildfire smoke. meteorologist mike nicco, is this still an improvement from yesterday, though? >> yeah, no spare the air alert. here's a look at your air quality forecast. where the confusion comes in is our summer spare the airs are usually for smog. the winter spare the airs are for smoke and fine particulate matter from wood burning we do in our fireplaces. the case is, we still have that fire to our north that's still pumping in a little bit of fine particulate matter but not enough to trigger a spare the air. just to let you know there's an air alert advisory. here's a look at what's going on as far as our commute. the south beach looking back towards the bay bridge. there's spotty fog developing in the north bay and along the coast. keep an eye on that. lighter breezes today, and for

mass transit, a summer spread from 60s in san francisco to 90s inland. in fact, we'll be in the 50s in san francisco up until about 1:00 and then the low to mid 60s for the rest of the afternoon hours. for the east bay valleys, we start off at 58 degrees with increasing clouds. sunny and 77 at noon. by 2:00, the mid to upper 80s. a comfortable evening on the way. 72 at 8:00, and our last stop, let's head to the south bay where we're starting off with inyei increasing cloud, but turn to sunshine. and low to mid 80s in the afternoon hours. pretty comfortable weather there. also, it's funny what a difference a day makes traffic wise. >> oh, yeah, and you know, we passed the point now, everyone is back at school. summer vacation is over. so yes, back to reality, i guess. like you said earlier, certainly going to be a busy commute today. much, much busier than the holiday yesterday when i think we were the only people working. we're looking at the south bay on the traffic maps and we have a lot of green here.

hollywood walk of fame star. you can see now the words serial rapist over his name. police say it happened some time last night. in april, cosby was found guilty of sexually assaulting a woman in his home in 2004. dozens of women have also accused him of sexual misconduct. cosby's star has been vandalized before. that was four years ago. >> a bay area priest who took part in all three memorials for senator john mccain is back home this morning. >> you can see father edward reese in this video from saturday's memorial. he's on the far left with the glasses. father reese became friends with mccain while serving as the head of a private school that mccain's two sons attended in arizona. the priest said he was honored to be involved. >> knowing that, you chose and wanted me to be part of it was extraordinarily moving for me. and then just being with the family, seeing how strong they were, and how much it meant to

him is just dawning on me the larger scale of the thing. >> reese is currently the president of st. ignatius college prep in san francisco. an east bay dress barn is cleaning up a big mess. a 1988 cadillac drove right through the front window. this happened at the store in the elsurita plaza after yesterday morning. it hit display racks and mannequins. nobody got hurt. it's not clear what caused that crash. police helped the driver get a ride home. >> video of an annual labor day tradition in san francisco. hundreds of competitive cyclists whipped around the street corners during the 44th annual bike race. and this course took cyclists of all ages and experience leveled around levi plaza and surrounding streets. >> tiger woods fans were seeing double at the pga tour in boson. >> this is a tiger woods

fool us again. a little bit this morning. a little fog out there. we'll keep an eye on it. i'll show you that in the south bay, just seeing an increase in clouds. over 87 in san jose. you'll need the sunglasses quicker today. that will boost our temperatures a little over yesterday's levels. we'll have a little cooler. minor through the middle part the week and a quiet pattern through the weekend. we're into the dry season firmly right now. supposed to be in the warm season, especially for places like san francisco. first, let's look at petaluma at 3 and half moon bay at 3. your visibility okay, but it could decrease. so we'll watch that. all right, 78, milpitas. low to mid 80s for most of the south bay. 90s in los gatos, morgan hill, and gilroy. mainly mid to upper 70s on the peninsula. we'll be in the low to mid 60s along the coast today. mid to upper 60s in downtown and south san francisco and sausalito. you can see the fog rolling across the golden gate as we head into the afternoon hours.

islands. out over the open water, on rlec ohe big island is some dangerous surf. >> mike, thank you. an iraq war veteran and her comfort dog are back together this morning. >> they were reunited last night after the dog escaped its fairfield home over the weekend. fairfield police gave u.s. army veteran dana martinez the good news. they called her to say a woman found her german shepherd after seeing reports on the news. the woman says she found the dog wandering on a busy street, so she brought her home and called police. when martinez got to the house to pick her up, she said nala was ready to go. >> she doesn't like the car, but as soon as he opened the car door, she jumped in the trunk. we were trying to get her in the car. >> martinez says she's thankful for everyone who helped bring nala home. abc's new brand is sharing inspiring stories, and it's a new weekly digital series called more in common.

minutes away from your accuweather forecast. let's kick things off with mike nicco. >> good morning. hi, everybody. look at the gray, the cloud cover out there. notice the breeze is light until you get on 80, especially up towards fairfield where it's 29-mile-per-hour wind if you're coming to the west. here's a look at my 12-hour planner. temperatures pretty much the same as yesterday. mid to upper 50s. faster sunshino a little warmer in the noon hour. a little haze also. in the 60s except for inland in the upper 70s. we'll stay in the 60s at the coast. mid 70s around the bay, and upper 80s to low 90s, so warmer at 4:00. pretty nice evening on the way. jacket weather at the coast, 58. the rest of us, 58 to 76. how about the commute? >> other than things filling in much more quickly than yesterday ad really all the summer months, we're pretty quiet. we don't have any major issues to talk about. let's check out some of the speeds getting out of the tracy area, all the way down to 10 miles per hour, westbound 205, and 16 miles per hour on
