live where you live, this is "abc 7 news." >> we ought to have this loud mouth removed. the confirmation hearing for supreme court nominee brett kavanaugh begins like a reality show. the protesters were not the only ones fired up. senator kamala harris of california voices the concerns of democrats. >> we cannot possibly move forward, mr. chairman. >> i extend a warm welcome to judge kavanaugh. >> we have not been given an opportunity to have a meaningful hearing on the nominee. i'm christen zee. thanks for joining us. the confirmation hearings start
11:01 am
more contentiously than expect. here is a live look at the proceedings on capitol hill. democrats are keeping up their objections to move forward with the hearing. you see kavanaugh writing there, as protesters in the audience keep interrupting. abc's janai norman is on capitol hill where the battl is playing out. >> reporter: chaos erupted on capitol hill during judge brett kavanaugh's confirmation hearing. >> mr. chairman, i move to adjourn. >> directly from judge kavanaugh. >> reporter: democrats making a motion to adjourn the hearing just as it was getting under way. they criticized the white house for blocking access to 100,000 of kavanaugh's documents and lambasted an 11th hour document vote. >> we've had more than enough time to review the documents. sir, we got a document dump last night of over 40,000 pages. i would venture to say not one senator here has had time to read through the 40,000 pages. >> reporter: republicans have the votes to confirm kavanaugh
11:02 am
by the target date of the first week of october, but democrats are questioning what they see as a rush to proceed. >> we waited for more than a year with a vacancy on the supreme court under the direction of your leader in the united states senate. >> what are we trying to hide? why are we rushing? >> reporter: the calls to adjourn and motion to postpone denied. >> motion is out of order. the motion is denied. >> reporter: and one big question is the role kavanaugh may play if the supreme court hears cases on the investigation into president like the mueller probe. he previously wrote that presidents shouldn't be distracted by civil litigation, criminal investigation and possible prosecution. janai norman, abc news, capitol hill. a familiar face will replace john mccain in the u.s. senate, but not for very long. this morning arizona's governor appointed former senator john kyle to replace mccain, who died on august 25th. kyle agreed to fill the seat but would not commit past january of next year, so he's making it
11:03 am
clear it is temporary. now, if kyle steps down at that point, doocy will have to name another replacement who will serve until the 2020 general election. kyle served in congress for 24 years, first in the house and then as senator from 1995 until he retired in 2013. democrats are hoping for a blue wave in the november midterm elections. this morning a new national poll shows house democratic candidates gaining ground. a just-released abc-"washington post" poll shows the widee democratic advantage for a midterm election since 2006. the poll shows a 52% to 38% preference for democrats over republicans. abc 7's morning afrverage yo ju spoke with rick klein. >> it seems there's a lot of good news for democrats whether talking about men who are not college educated, women, seniors. which to you is the most important indicator as we head into november? >> i think you look at independents and you also look at women.
11:04 am
white women in particular. that is really where the trump coalition was never particularly strong but where it is showing real signs of crumbling, and it is the motivation factor as much as anything else that to me tells the story. it is not just that people prefer democrats over republicans in their house races by 14 points, it is the intensity with which they're ready to demonstrate that preference. >> democrats need 23 seats to retake the house majority. new at 11:00, emergency crews had to rescue four people this morning from a boat in the richmond marina. someone called for help around 6:00 a.m. firefighters say there were four people on board the fishing boat. >> hit the break wall when getting out to the bay and they hit it at a high rate of speed, and as i can imagine it is probably a pretty violent, you know, incident for them. >> one person was hurt. the extent of their injuries is unclear, but firefighters say the person will be okay. they're now recovering at the

hospit. firefighters were not sure why the boat crashed, but they guess the person driving it may have been distracted by their gps. shares in nike are down this morning after the release of a new ad starring former 49ers qarterback colin kaepernick. critics of his national anthem protest are making their displeasure known, but supporters say nike's bold move to feature kaepernick will only deepen their loyalty to the company. abc 7 reporter amy hollyfield is live at the nike leandro. >> reporter: hi. there's a nike boycott hashtag online, but here only happy customers. there were protests on social media, the burning of nike shoes and promises to never shop at nike again, but the store in san leandro is doing fine with people waiting to get in before the even opened this morning. they don't understand why people are getting rid of their nike clothing. >> that's the people that don't got good sense, but i love it
11:06 am
all the way through. i won't be burning nothing, that's why i'm here early. >> reporter: harold has kinls say it is about time colin kaepernick was featured in an ad for what he did two years ago on the sidelines. kaepernick took a knee during the national anthem to protest police brutality against african-american. he hasn't had a job in the nfl for the past year. the new nike ad says, "believe in something even if it means sacrificing everything." >> i mean he sacrificed his whole career for what he believed in. he believed in social equality and social injustice, and he took a knee for it. he's been black balled out of the nfl because of it. >> reporter: paul fifi of oakland was so excited when he saw the ad he posted it on his facebook page. he's not sure though if nike should be considered brave for taking a stance or if the company is just double-dipping. >> nike sponsored the nfl, their whole apparel. also, they are like kind of standing behind colin kaepernick on what he said. so i guess they're in between on
11:07 am
it. >> reporter: haskins says he wanted to be here first thing this morning to show support for the new campaign. >> as soon as i saw that ad i was very proud because he still was an ex-49ers because i'm a die-hard 49er. the statement that he made and then making it finally come forth, he will finally get his justice is what i believe. >> reporter: analysts this morning are saying controversies like this usually blow over quickly for a retail. kaepernick is not only featured for the ad, the deal includes shoes and apparel. >> amy, thank you. the search is on for the driver who hit a teenager and a 12 year old in san jose and then just took off. take a look at this surveillance video. officials say the driver of the white four-door honda civic rolled through a crosswalk -- oh, right there. last monday and hit a 13-year-old boy and 12-year-old girl on their bikes. a neighbor witnessed what

happened and tried to stop the driver. >> i heard him. was saying, stop, stop, trying to make them stop, but the boys did not stop. they just back up and make a quick left turn. >> well, the boy suffered a broken wrist, sprained fingers, bumps and bruises. the girl suffered a concussion, but all things considered not as bad as it could have been. so thankful for that. both were wearing helmets, very importantly. police say three people were inside the car. no descriptions have been released. all right. you can see it is another grayish day, right? the fog has kind of gone, but still the sun is not with us. what is going on? >> not yet. the calendar has changed but the pattern hasn't changed yet. you can see by looking at the winds, we still have an onshore wind, kristen. hi, everybody. as long as we have the onshore wind the sea breeze will dominate the forecast. in fact, look at the clouds being a little more stubborn across the bay and in the north bay than they with this time. that's why temperatures are

11:19 am
that's a good clip. you notice where all of the moisture is still not wrapping around the storm and not seeing the classic eye yet. when i put it into motion over the last three hours, notice how the center of the circulation is starting to head a little more to the north than it is to the west. that would put the panhandle, mobile and the southern parts of mississippi around biloxi in the crosshairs for when it surges to a one right before hitting tonight. 75-miles-per-hour winds, a storm surge of about five feet and then it rolls up towards jackson, mississippi and goes into arkansas where it could potentially flood parts of the state there. we could get about seven to ten inches of rain, where you are seeing the magenta, especially in southern alabama, mississippi and then to the eastern parts of arkansas. so we'll keep an eye on that. back here at home, let's go down to the south bay where some of the sun broke out quickest, and we'll see a lot of sunshine away from the coast. nearly average highs, pretty close, within three degrees. middle of the week cooling as the sea breeze ramps up once

degrees. you see the temperatures warming up to the 60 degree mark around the bay. if you are heading back, we are mainly in the 50s and 60s by 8:00 on our way to low to upper 50s for tomorrow. you can see the cloud cover pretty extensive there. let's look at what is going on in the tropics. olivia is category two, ramping up, but norman is down to one. it gets close to the big island, takes a right turn and it weakens. there will be rough surf on the big island and maybe a few thunderstorms here and there, but that's about all normal will do for the islands. back here at home, you can see away from the coast about two to four degrees cooler for wednesday and thursday and 90s pop up once again on saturday, sunday and monday. >> listen to this one. federal authorities recovered a pair of ruby slippers worn by judy garland in the wizard of oz. they were stolen from the museum in her minnesota hometown 13 years ago. they were insured for $1
