you can't miss kap's face, several feet tall above the nike store in san francisco. >> we captured this billboard with droneview7 today. kaepernick was the first athlete to neil before the national anthem to protest police brutality against blacks back in 2016. he hasn't played since then. >> some say his protests cost him his career in the nfl. the new question is what could his campaign cost nike. >> let's begin our team coverage on the topic tonight with abc 7 news reporter david louie who is live in san jose with some expert advice. david? >> well, ama and dan, the early reaction from investors has been mostly negative. the stock took a 3% hit today, although we have to put in perspective the fact that the stock is up 27% for the year. still, the real test will come with consumers. consumers and whether they buy colin kaepernick's message about social justice. marketing expert says nike is taking a big gamble with colin kaepernick because he is polarizing. some embraced his national anthem protest while others said he was unpatriotic or worse, and

kaepernick seems intent on controlling the message. he announced the deal. nike didn't, but confirmed it. >> there is no telling what your branden endorser might do next if you can't control even the announcement that you've selected goes out. that's one of the risks of having someone that's a little bit, you know, hard to -- hard to control. >> howard comes is a professor of marketing. a celebrity endorsement can raise sales by an average of 4%. people in their 20s and 30s are more likely to be influenced. >> the problem with kaepernick is he has very high positives but very high negatives, very polarizing. that's not usually what brands want. >> mixing a popular brand with a controversial figure can lead to a losing proposition for one side but a winning her. >>he youer two thing o that nike, and one that people maybe don't like, kaepernick, people tend to kind of blend them together and they think less of nike and better of kaepernick.

>> president trump in the past has tweeted criticism of take agony, but so far he has not tweeted about the nike/kaepernick endorsement. >> when we see that tweet, that may drive more people toward nike, more people who are unhappy with the tweet may go out temporarily and buy nikes just in spite. >> now president trump did tell a conservative news site the daily caller that nike is sending out a terrible message, one that should not be sent out. now the nfl, on the other hand, is saying, quote, the social justice issues collin and other professional athletes have raised deserve our attention and action. in san jose, david louie, abc 7 news. >> okay, david. thanks very much. this is far from nike's first time in the spotlight of controversy, of course. last month it tweeted a picture of serena williams with the words "you can take the superhero out of her costume, but you can never take away her superpowers." that tweet came after the french opened banned williams' nike

branded black cat suit. the outfit was designed to protect her against blood clots. nike drew attention in 2017 when an ad for the company's new sport hijab went viral. kaepernick's protest against racial and social injustice began in august of 2016. he actually sat during the national anthem during the 49ers first preseason games that year, but went unnoticed until the third game. kaepernick knelt for the first time on september 1 with teammate eric reid by his side. he decided to kneel after meeting with nate boyer, agreeing that kneeling would be more respect areful to service members. in 2017 opted out of his contract. he hasn't played in the league since. in october 2017 he filed a grievance against the nfl accusing owners of colluding to keep him out. last week an arbitrator ruled the grievance could go to trial.

>> kaepernick is from the central valley city of turlock. turlock is a little more than 100 miles from san francisco. and tonight some residents say kaepernick isn't welcome there. abc 7 news reporter leslie brinkley spent the day in turlock. >> once upon a time before the 2013 super bowl, colin kaepernick was worshipped here in turlock. the local bakery crammed out cookies and restaurants, named sandwiches and hot dogs after him. >> very hot. the dog is very hot. >> things have cooled down a lot. the sandwich and cookie honors have vaporized. >> i don't think he would be the hero that he once was, like the hometown hero. >> he was the football star, but here they say the day he started taking a knee during the national anthem august 14th, 2016 is the day the wind shifted in turlock. >> he was our favorite son kind of thing. and then all of the sudden with the kneeling and everything, a lot of the conservative people that live in this area in the

valley decided that that wasn't something they wanted to support. >> it just seems like everybody was behind him. and now it's like he's -- it just seems like real letdown. i'm just like i said, i'm embarrassed for him. >> he caused a lot of trouble. i mean, you know, that's the united states flag, you know. that's what a lot of men went to -- back seas and fought in the war and died for. >> some say they wish kaepernick would come home and face the people here, but then again, they admit with this level of animosity, he might not be welcome here. >> well, he probably would get the cold shoulder from a lot of people. i don't think he would have a lot of supporters running up to him for an autograph. >> we did find one restaurant that had a kaepernick jersey still up, but they declined an on camera interview. >> the backlash is definitely stronger, but i still have my love for him. i'll be honest. i wasn't the biggest fan when he was a football player. but now that he has so much more than a football player and so much more than all of that.

>> still, it's a hard sell here for the new face of nike. in turlock, i'm leslie brinkley, abc 7 news. >> among the people excited about the nike campaign featuring colin kaepernick are bay area nonprofits that have benefitted from his support. kristen sze is here with that part of the story. >> ama, shortly after the anthem controversy began, kaepernick made the million dollar pledge. he was going to give away one million of his own money. >> i'll be donating 10 k a day for the next ten days. >> friends like steph curry and celtics jaylen brown joined the campaign. together, they donated $30,000 to united playaz for menning for at risk youth. this is from gun buyback event. they're thrilled to see nike embrace kaepernick's message >> and we're excited that this new support will bring extra light and attention to those individuals who work every day to keep our country safe and make our country a better place. it takes a hood to save the

this. we used the news app to send out this push alert. offcial says one dead two, hurt in small plane crash near palo alto airport. and in just the past 45 minutes, we got an update from federal investigators. the crash happened about 11:00 this morning. the plane from redding crashed into a pond near the palo alto airport. the pilot was killed. his two passengers survived and climbed out of the plane on their own. investigators now say they have a slightly better idea of what went wrong. >> the airplane reportedly bounced during the landing. the pilot then opted to go around, which is to add power, clean up the landing gear and the flaps, and come around for another circuit. >> investigators say it was during that second lap in the air that the plane crashed. the pilot was on a mission for paent and her mr tolucille ckar hospital. both managed, as i said, to get out of the plane. investigators say it could take up to a year to figure out exactly why the plane crashed.

thieves recently hit six local apple stores, but stores in san francisco may have come up with a way the keep those thieves at bay. abc 7 news reporter melanie woodrow is live at the store on chester street with the story. melanie? >> well, dan, you can see over my shoulder there is a uniformed san francisco police officer. apple is one of several retailers here in san francisco that is now hiring uniformed police officers. it's a move that seems to be working. thieves targeting apple stores in santa rosa. the berkeley apple store also hit. and just this past sunday burlingame as well. san francisco police officers association president tony montoya says it's statewide. >> but these things are happening from pasadena to pittsbu pittsburg. >> he doesn't think it's a coincidence that the apple stores in the marina and union square haven't been targeted recently. both have uniformed police officers on site. >> i think it's an overall

deterrent for these -- when they are casing these locations whether or not they're going to go in and steal the products. >> in san francisco, retailers contract with the city, which in turn pays officers overtime for working these assignments outside of their regularly scheduled shifts. montoya says smaller cities likely don't have enough officers to fill the assignments. hood thieves hit the store grabbing $13,000 in merchandise. the man who took this video asked not to identify him. he said you could tell they were going in and out of the store. something wasn't right. >> i realize that these guys were coming to do something. >> he says the private security guards on-site watched. >> basically, they were just standing, there looking at their cell phone. >> police say it's unclear if the same suspects are responsible in all of these cases. it's not just apple. thieves have also been targeting lululemon stores around the bay area too, stuffing thousands of dollars of yoga pants into bags.

the san francisco lululemon stores also contract with the city to hire san francisco police officers for overtime shifts. and we reached out to both apple and lululemon. apple told abc 7 news it had no comment. lululemon had this to say, telling us that it takes theft seriously and makes sure its stores have appropriate security. the brand also said that it is working with local authorities. in san francisco, melanie woodrow, abc 7 news. >> all right, melanie, thank you. the search continues for the one person who remains missing after two boats crashed head-on in southern california over the weekend. also here, you're going hear from a young woman who was on one of those boats, went overboard after the crash and managed to survive. i'm spencer christian. a sharp warpum but it won't be long lasting. coming up at 6:30, a new law could require california companies to hire more women on their boards. it's a requirement some say is smart and illegal.

here's the latest on the north fire burning in the tahoe national forest. it's burned 500 acres and it's 10% contained. right now winds are not a problem, so it's remained relatively calm. last night deputies started evacuating campgrounds near emigrant gap. deputies say just an hour ago there are no plans at this time to expand the evacuations. there is still much healing and rebuilding to go in sonoma county following last october's wildfires. but now another fire survivor has a new place to call home. abc 7 news reporter wayne freedman took a tour today. and has a story of resilience.

>>let's check in on a sonoma county firestorm survivor. tom francois still living in a rental duplex, but not for long, and without complaints. >> it's all candy bars and ice cream, man. >> joe is the most optimistic and grateful person we've met. he is 77 years old, a widower. >> this here is a picture of my wife and me. >> carol passed at age 70 after 52 years together. her memory and how she dealt with cancer is one reason that tom has never felt sorry for himself. >> you know, you think about some of the stuff in your life like this, this is a first world problem, man. my house burned down. i'm getting it fixed. oh, yeah, baby. >> let's rephrase that. has gotten fixed. from ashes to move-in ready, in 11 months, the first. >> i just love it. i absolutely love it. >> when the tubbs fire burned through fountaingrove, it didn't spare. for months we marvelled at the pace of reconstruction here. it's the work of one contractor, sonoma county builders.

they built this neighborhood initially. they've gone back to the original plans in doing so again there may be a lesson there for victims of future wildfires. >> get these decisions made early if you're going to rebuild. if you're in another area that's been hit by fire, get your plans in early so that you can get your contractor and get started. >> or restarted. the fire just a hiccup to go along with a leg lost to a blood clot that tom hardly talks about and a wife lost to cancer who he always talks about. this house he says carol would have wanted. >> i don't want to use the word miraculous there, but is intervention here, you know, divine intervention. >> don't try to tell tom it happened any other way. in fountaingrove, wayne freedman, abc 7 news. for the first time we're hearing from the family of a woman who was held hostage and killed at a los angeles trader joe's. today los angeles police released video of the pursuit and shoot-out from july, but it does not contain any new

information or footage. employee melita corrado was hit by a police bullet in the shoot-out. she was killed. corrado's family wants to see the entire unedited version of the video, but says police will not release it. >> yes here to ask the los angeles police department to turn out all evidence so we can move on with our lives. >> the gunman has been charged with murder for the death of his girlfriend who was critically injured inside his car. crews today recovered two more bodies in colorado in the river following the collision of two boats. brian grabowski and cara drury of ventura were found in the colorado river along the california/arizona border. a woman's body was pulled from the water yesterday. one person is still missing. abc news spoke exclusively with taylor corbino, who survived the crash. >> i see the boat, the other boat. and the next thing you know, time in the water. the current was so strong. it was moving me around, and all i could think about is get air. we shouldn't be alive because it

was that bad. >> the three victims are among more than a dozen people ejected from the boats in saturday's crash. none of the boaters were wearing life jackets. all right. we need to turn our attention now to the weather and the air quality out there. >> abc 7 news weather anchor spencer christian tracking that. >> for most of today the air quality has been moderate. so that's not bad. we were under an air quality advisory today. tomorrow we expect some improvement. mainly clear skies right now over the inland areas around the bay is sort of iffy because the low clouds are beginning to push out locally over parts of the bay right now. and it's breezy once again all across the region. we have wind speeds of 21 miles per hour here in san francisco. and far inland at fairfield. right around the bay, actually through much of the central portion of the bay area, we have wind speeds of 14, 5 miles per hour. so, again, quite breezy out there. here is the view from our abc 7

exploratorium camera at pier 15 in san francisco. looking back at the skyline, the low clouds rolling in. 60 degrees in san francisco. 63 at oakland. morgan hill 76. 57 at half moon bay. and that is the view of the western sky, what we can see of it looking westward from emeryville. the fog is just low clouds rolling in. it is 67 degrees in santa rosa right now. napa 69. 72 at novey ratto. low to mid-80s at fairfield, concord and livermore. and the view from the top of mount tam looking down on the clouds rolling in. it looks like a big wave of whipped cream there. and these are our forecast features. coastal low clouds continuing to expand overnight. it will be mild to warm again tomorrow and turning warmer by the end of the week. in fact, we'll have quite a sharp increase in temperatures by the end of the week. here is our forecast animation starting at 7:00 this evening, taking us into the late night and overnight hours. notice how the low clouds fill in moving across the bay and locally inland.

early morning commuters will be greeted by perhaps some reduced visibility where the low clouds are lingering. around that time, 5:00 a.m. or so, overnight lows will be mainly in the mid- to upper 50s, a although a little cooler up in the north bay where we'll see lows in the low 50s at santa rosa, napa, cloverdale and ukiah. highs tomorrow under mostly sunny skies. we'll range from 62 to 65 in the city. 70 across the bay in oakland. the inland east bay will have highs in the mid to upper 80s. 80 degrees up north at santa rosa and high of 81 expected down south at san jose. the high temperature trend in livermore over the next seven days is indicative of what much of the bay area can expect in terms of the overall trend. it will be an upward trend through friday. inland highs in the low 90s in some spots, certainly in livermore on friday. and then temperatures will gradually taper off going through the weekend and into early next week. here is the accuweather seven-day forecast. we'll see highs around 88 or so in our inland areas tomorrow. up to about 90, slightly warmer

[ closing bell ] markets dipped a little on the first trading day of the week following yesterday's holiday. the dow lost 12 points. the nasdaq dropped 18, and the s&p lost almost five points. amazon made history today, becoming the second publicly traded u.s. company to reach a trillion dollars in market value. amazon's stock rose nearly 2% in morning trading to put it over the top, although it closed a little under the trillion dollar valuation. the seattle-based company follows apple, which climbed past the trillion dollar threshold early last month. amazon's increase also made founder and ceo jeff bezos number one on forbes' billionaires list this year. a milestone for google. it became incorporated 20 years ago today. the search engine had humble beginnings, founded in a garage by larry page and sergey brin on

on personal or policy preferences. a judge must be independent, not swayed by public pressure. >> today's hearing almost serves as a microcosm for the deep political divide around the country and the chaos that can lead to. a new abc news/"washington post" poll shows americans are split on whether cavanaugh can be confirmed. janai norman, abc news, capitol hill. >> we talked with professor roy little from uc hastings college of law about what could happen next in the hearing process. he said as much as democrats may want to delay the nomination, he thinks republicans will be able to push it across the finish line. >> putting it off until the mueller investigation, putting it off until the midterms, i think doing it carefully is important because it's such an important vote. he is going to change the 5-4 majority on some things. but i don't think numerically they have the votes, and i don't think legally there is an argument to stop it. >> senator chuck grassley tweeted that tomorrow he expects judge kavanaugh to answer

to replace mccain who died on august 25th. kyl, a republican agreed to fill the seat temporarily. >> i'm accepting this appointment to fill the seat vacated by the passing of my dear friend because of my sense of duty to the state i love and the institution of the senate in which i served for 18 years. and because the governor asked for my help. and because i'm putting my country first. >> kyl could be sworn in as early as tomorrow. the u.s. naval academy is changing its rules for women's hair styles. female midshipmen will now be allowed to wear their hair in ponytails and braids. the goal is to make the navy more inclusive. the incoming class of the academy is one of the most diverse. 28% of the class is made up of women. well, companies that are based in california may soon have to hire more women on their boards. >> that's right. a bill passed by the state senate is now sitting on the governor's desk waitings for his signature. >> lyanne melendez has more on the controversy this proposed requirement draws.

>> williams-sonoma is based in san francisco. it has equal number of men and women in top executive positions, including at the board level. their ceo said it's not about gender. it's not about race. it's not about sexual orientation or age. it's about performance and that's really very simple. but in reality, few women occupy leadership positions in the united states, even here in progressive california. the russell 3000 index which tracks the biggest companies in the u.s. found only one in six board seats is filled by a woman. senate bill a 826 would force companies with headquarters in california to put at least one women on their boards by the end of 2019. and by 2021, companies with five board of directors must have two women. companies with six or more must have three women. >> when you have a critical mass of 30% or more who are women, then you start to have better decisions and it's better for the bottom line.

cash call has now shut down its personal loan business and borrows want their money back. eddie de la torre boils up a quick lunch in his east palo alto home. he has an hour before heading back to work as a teacher's aide. it's a simple life, but a far cry from his college days. eddie got tangled up in a high interest loan agreement he couldn't possibly pay off. >> i was living in fear. >> it happened when eddie was a student at uc davis. he ran low on funds, and he heard the ad, just make the cash call. >> i was that target audience. i was a 21-year-old kid. >> cash call told eddie he had to borrow at least $2600. that's an interesting amount because state law limits interest only for loans less than $2500. eddie didn't need that much, but he took the loan and cash call charged an extraordinary rate. 96%. >> interest like just kept on adding on and on and on.

>> cash call also took payments right out of eddie's bank account. soon he couldn't keep up. >> it made me very scared for what i was going to do. >> his account went in the red. cash call kept demanding money. finally eddie stopped paying. now ten years later, eddie is a lead plaintiff in a class action lawsuit claiming cash call deliberately targeted desperate consumers and charged unreasonably high rates. >> this involves hundreds of millions of dollars that cash call collected from these borrowers. >> class action attorney james sturdivant just won an important victory. the state supreme court ruled loans can be illegal even if they're over $2500 if they come with very high interest and harsh terms, like taking money right out of a bank account. >> no longer will these companies make loans at these outrageous interest rates. >> cash call's owner, and attorneys did not respond to our numerous calls and e-mails, but in court briefs, cashcall said

which makes this week's series with the bronx bombers all the more intriguing. and the a's are doing that bullpening thing again. starting a reliever followed by another and another and so on and so forth. you hope to you get to the end of the game with a win. mindi bach has more on the a's late season experiment. >> it's pretty remarkable what the a's are doing when you consider they have used 14 different starters this season. that's third most in the majors. now with brett anderson on the disabled list, bob melvin is turning to that strategy called buning. with the expanded roster, the a's have 33 active players. 14 of them are relievers. not all will be available tonight. melvin won't say which ones, and he also won't say which pitcher he is going to pitch for how long. he may use nine different pitchers over nine innings, and his players so no matter, they have the mentality for it. >> we set our goals to dog pile at the end of the year. when you see that we're a month
