there a couple hours trying to get this cleaned up. hopefully that will be soon before the commute gets going. in the meantime you can use silverado trail for an alternate. live look, walnut creek, 680 north of 24, around north main street that's starting to fill in as well. next traffic update coming up at 6:10. >> thank you. we've learned the city of oakland plans to file a lawsuit against the nfl and the raiders. it's over the team's move to las vegas. abc 7 news reporter amy hollyfield is live at the team's facility to why this could mean an early exit for the raiders. >> this could mean this is the last season we see the raiders play in the bay area. according to the "san francisco chronicle" the city of oakland is planning to file a lawsuit, an anti-trust lawsuit, against the raiders and the nfl because of the team's expected move to las vegas. the coliseum official told "the chronicle" if this happens the

team will likely go to vegas a year earlier than planned. the mayor's office had no comment and the raiders did not comment. the report says the lawsuit will be filed and announced in the next few days and could bring in $500 million in damages for the city. this is all happening as the team prepares to start its season, the home opener set for monday night, that's against the rams. but the teams big opponent could be the city of oakland. live in alameda, amy hollyfield, abc 7 news. >> thank you, amy. a landmark ruling affecting the homeless population, cities cannot prosecute people for sleeping on the streets if they have nowhere else to go. a federal appeals court sided with six homeless in boise, idaho who sued over an ordinance that banned them from sleeping in public places. punishing the homeless

and unusual punishment. the latest incident happened at crown state beach yesterday. another woman says the same thing happened to her on saturday. the alameda police department says an attempted sexual assault was reported on august 6th near the park. police believe all three incidents may be connected to one man. also in the east bay, berkeley police are looking for this man you see on the left, mark jacobson. investigators believe he stabbed a woman who is in her 70s. the video from the scene is on the right side. it happened on edith street around yesterday morning. police say he is clean shaven and known to visit live oak park and the solano avenue corridor. if you see him do not approach him and call 911 immediately. a controversial new ad sitting on top of san francisco's union square. as you can see from drone view 7. former 49ers player colin kaepernick struck a deal with nike and the ad's message messae

some good news, no spare the air, no air quality alert. we will have haze in the air due to the smoke, but our forecast for the air quality is going to be between good and moderate. here's reggie with more news. >> thanks. new this morning a study out of uc berkeley reveals one reason some of you are paying higher premiums for health insurance. according to researchers it has to do with hospitals merging and physician acquisitions practices. between 2010 and 2016 the percentage of doctors and medical practices owned by hospitals grew from 25 to 40%. there was a 12% increase in aaffordable care act insurance premiums in the time period. san francisco politicians and community members gathered to celebrate the fifth annual chinatown night out. mayor london breed and others gathered to show their commitment to public safety in san francisco's chinatown last night. the activities included dancing dragons, a raffle and warm meal for seniors passed out by san francisco police academy cadets.

happening today, the homeless veteran fighting a couple over a gofundme account will head to court. john bobbitt used his last $20 to help a driver stranded without gas in philadelphia. in return the driver and her boyfriend started a gofundme account that raised more than $400,000 in donations. now bobbitt says the couple has spent much of the money and he is back living on the street after some consideration, he decided to sue. >> i didn't want to be pressuring to get a lawyer or do anything because i didn't want to appear ungrateful. >> last week a judge sided with bobbitt in court and ordered all the money be returned. bobbitt's attorney says it still hasn't been transferred though. the couple's attorney said they held on to half of the money on fear he would spend it on drugs. bobbitt admits he has struggled with addiction in the past and yesterday gofundme said it will guarantee the funds raised for

unless you're using the carpool lanes. westbound 580 tracy to dublin in the red at 57 minutes. that's not quite as bad as yesterday either. southbound 680 dublin to mission boulevard in the yellow at 23 and northbound 85, 101 to cupertino still in the green at 19 minutes. >> thanks. a teenager and her mother are recovering in the hospital this morning they were hurt in a plane crash in palo alto. the pilot of that plane died. abc 7 news reporter matt keller live for us at stanford trauma center with what we're learning this morning. >> the mother and daughter are stable here at stanford hospital. they were able to survive this plane crash. however the pilot did not. this crash took place yesterday morning just after 11:00. the plane was on a mission for angel flight west, that's a volunteer pilot driven organization that ferries injured or sick kids and adults to distant hospitals for treatment. mother and daughter were identified by palo alto on-line as 49-year-old nancy delamaria and 16-year-old chloe king both from redding. they were rescued from the wreckage on their way to

stanford's children's hospital. the plane was registered out of placerville to a pilot often recognized for his volunteer work with the organization. he's yet to be identified. the ntsb is investigating the crash. >> the airplane bounced, the pilot opted to go around, to add power, clean up the landing gear and flaps, and come around for another circuit. >> reporter: >> angel flight west posted a statement to facebook, which read the director, staff, volunteer pilots and mission coordinators of angel flight west are sad this accident occurred and the thoughts and prayers are with those on board the aircraft and their loved ones. matt keller, abc 7 news. >> thank you. a man who survived a plane crash that killed his husband and the pilot is expected to head home from the hospital today. this is a picture and some vider thpl its way to pyramid lake when it experienced a pilot with the engine. the pilot and one passenger

to grab a woman. it happened on mt. diablo boulevard just before 4:30 yesterday morning. police say the woman was walking to the lafayette bart station when two people pulled up in a dark car, one got out and tried topull her in. she was able to get away. the two suspects took off. santa cruz police want to find a man. they say someone who looks like this followed a 14-year-old girl on the west side of town on friday. he tried to get her to go into his car twice. she ran away. a surveillance camera captured this picture of his car and police say it appears to be a nissan altima. tropical storm gordon in the last 90 minutes it was downgraded to a tropical depression. >> so far officials are blaming the storm for at least one death. a child killed in florida. abc news rter morning. magie? >> reggie and jessica, things are clearing up here in biloxi, but this storm started off as a

massive tropical storm. people here in biloxi took it seriously. authorities mandated a curfew overnight and shut down all of the casinos and hotels along the coast. for now, it seems like the worst of this storm is over for us here in the gulf. overnight a powerful tropical storm gordon slams into the gulf. packing sustained winds topping 70 miles per hour, heavy rains and the potential for life threatening storm surges. the space station capturing gordon as it gained strength before making landfall near the mississippi/alabama border near pascagoula. ginger zee was there. >> this is when the rain and winds start to prickle your skin. it's hard -- that hard. conditions have rapidly declined. >> reporter: the lopsided storm soaking everything east of center from biloxi, mississippi, to pensacola, florida. this man's windshield wipers no match for the rain in alabama.

could potentially come down in places north of where it hit yesterday. what's at stake here? >> exactly. the flooding the big issue. i will show you that in a second where all the flood watches are. gordon, 35 miles per hour, barely keeping its wind. it is unwinding, but it's sill moving to the northwest at 14 and that is starting to slow down and as maggie mentioned it is going to slow down. look at the moisture that it's pulling in off the gulf and wrapping around into alabama, mississippi, and eventually arkansas. nearly 2.5 million people in the green here, are under a flash flood warning for the next 48 to 72 hours. so it's going to be definitely tricky down there. the winds aren't the big deal. it's the flooding that's going to be created. all right. back at home, quiet in the south bay, mid to upper 50s, saratoga 60s, los gatos 70, san jose about 58. we have 51, one of the cool spots, novato, napa, san pablo at 55, lafayette, danville and brentwood at 57. alameda 589, san francisco about
