partner says that will mean the bart extension to berryessa will open three years after. they hope to have a more accurate timeline by the beginning of 2019. live in san jose, matt keller, abc 7 news. >> matt, thank you. in the east bay, a trial date is expected to be set today for the two ghost ship fire departments. last month an alameda judge threw out the plea deal for derrick almena and max harris setting the stage for a lengthy trial and they agreed to plead no contest to 36 counts of involuntary manslaughterer in exchange for prison sentences many families said were too lenient. they are now scheduled to appear in court at 9:15 this morning. the san francisco police department says the five officers who shot mario woods acted in accordance with department policy. woods was killed by police in the bayview in december 2015. his death recorded by onlookers

and it sparked national outrage. the department's decision ends a nearly three-year investigation into the shooting. the district attorney said in may his office would not file carges against the five thwos to go before the november election, two of california's biggest races are tightening and that's according to a new poll just out this week. former san francisco mayor gavin newsom, running for governor, and dianne feinstein, who is seeking re-election to the senate, are seeing their leads cut to single digits. look at this. newsom leads republican businessman john cox 44% to just 39%. 17% of those who responded to the poll say they are undecided. in comment, dianne feinstein leads kevin deleon 37% to 29%. 34% responded they were still undecided in this race. the research poll was taken

between august 29th and september 2nd. that's the most recent numbers we have. gavin newsom responding to president trump for calling him out during a rally in montana. the president talked about to have the state pay for universal health care. mr. trump also predicted that the california population would grow to 500 million people if health care were free. newsom responded to the president on twitter and he says, quote, next time you call me and my policies out, have the guts to at me and we can have a chat. the fallout from the op-ed in "the new york times" and the guessing game that's playing out about who wrote it. top white house officials are denying they authored the letter while president trump is calling on the "times" to reveal its source. here's emmy law with more. >> reporter: good morning. at least ten top officials have publicly denied penning the op-ed and president trump is demanding "the new york times" reveal the author.
