judiciary committee. it is not clear if ford will appear. her attorney says she wants to testify but thinks the fbi should investigate before the hearing is held. >> it reads in part, an fbi investigation should be the first step in addressing her allegations. a full investigation by law enforcement officials will ensure the crucial facts and witnesses in this matter are assessed in a non--partisan manner and that the committee is fully informed before conducting any hearing or making any decision. >> a man she has identified as a witness to the attack, mark judge, says he has no memory of the incident and will not testify. >> california senator dianne feinstein who was first to be sold of ford's allegations earlier this summer is reacting to this new development on twitter. >> in minutes ago tweeted, quote, the decision to come forward or not come forward has always been christine blasey ford's and that includes her participation in a hearing.

feinstein has faced criticism for not bringing forward ford's allegations to light including from the president earlier today. >> she had this letter. why didn't she bring it up? why didn't she bring it up them in w . >> why didn't the democrats bring it up them? because they obstruct and resist. >> we assigned a team of reporters to dig into the story from several tides. abc 7 reporter cornell barnard found out how a high school is turning into a teachable moment for teenagers. >> lesley brinkley looks how the current me too climate could affect the case. let's first hear from wayne freedman who spent today talking to a local judge who, wayne, has been in brett kavanaugh's position. >> reporter: good evening. he is james way, a retired chief judge of the 9th district federal court in california, a man who has been vetted. he admits that the process is never easy. he also says in a democracy it

is necessary. vet, it is a three-letter verb conduct by a three-letter agency, the fbi, with judge brett kavanaugh the center piece right now. >> the fbi is not investigating a crime here. what the fbi is doing is effectively a background check. >> the fbi went to my former neighborhood and interviewed my neighbors. >> is it nerve wracking? >> yes, very nerve wracking. >> reporter: locally we asked retired 9th district chief judge james ware about being vetted. he went through the process twice following presidential appointments. >> the process is designed to find out who you are at the core. >> this is a lifetime appointment to the supreme court. character matters. >> the bar should be higher than we can imagine because the job requires integrity beyond reproach. >> reporter: is it fair? >> i think it is -- it has proven itself to be worthy of being called a fair process over time. >> reporter: when the fbi investigated judge ware he says

they looked at everything, people through two, three, four degrees of separation and beyond. >> reporter: and if those people know people? >> they'll ask them. >> reporter: why would this matter? >> i have a seven year old, and she is defining herself right now. we all define ourselves throughout our lives as to who we are, and there is no reason to ignore any part of our background when it comes to examining whether or not we're fit for office. >> reporter: and then there are accusations now of politics in the kavanaugh confirmation. judge ware says they are to be expected, part of the design. >> well, you know, we go through the political process because that's how the process is set up. but i would like to think that on the other side of that appointment process, always is an individual who takes the oath to support and defend the constitution without political favor. >> reporter: and we thank judge ware for speaking with us today. in his opinion, the word "politics" is a description of

the process, not an indictment. in contra costa county, wayne freedman, "abc 7 news." >> very interesting. >> thank you, wayne. well, the current accusations against brett kavanaugh are bringing back memories of the clarence thomas hearings. anita hill accused him of workplace sexual harassment back in 1991. thomas was ultimately confirmed as a supreme court justice, but that was almost 30 years ago. >> "abc 7 news" reporter lesley brinkley continues our team coverage with a look at the similarities and the differences between then and now. lesley. >> reporter: well, history in the making perhaps again, but this time there will be four women sitting on that judiciary committee that hears testimony next week. today i spoke with three prominent and powerful women in california politics and the me too movement. >> reporter: what's your take on what's unfolding in washington? >> yeah, it is pretty extraordinary. even though we have seen it all before, i think this is a kind

of, a take two. >> reporter: take two of the anita hill hearings in 1991. according to the woman who exposed sexual harassment in the california government last year, she says congress has to tread carefully this time. >> depending on if they just do a perfunctory hearing, this woman is torn up, they decide she has no credibility and they do a quick vote and this guy ends up on the supreme court, i think that women might not forget that. >> reporter: what potential does the kavanaugh nomination have for the arc of history when it comes to the midterm elections? >> well, in terms of the arc of history i think it is very important to have the truth, because when a woman comes forward, that takes great courage. >> reporter: congress woman nancy pelosi spoke along the san francisco waterfront today as her daughter, the chair of the california democratic party women's caucus, emphasized the significance. >> i think millions of american women remember where they were during the anita hill hearings. this is a where were you moment now. women are going to look and say,

you know what? unless the republicans do something radically different from what they're doing today, unless they do something radically respectful of christine blasey ford, you're going to sweep in female and feminist candidates who won't put up with this. >> reporter: the year after the anita hill hearings the number of women elected to the house of representatives doubled to 47 and the women elected to the senate tripled to six. >> this is a matter that has nothing to do with politics but everything to do with our society, our sense of community, and our respect for women. >> reporter: and they all emphasize it has everything to do with how testimony next week plays to women voters. in san francisco, i'm leslie brinkley, "abc 7 news." >> thank you very much. peninsula congresswoman jackie spears agrees there needs to be an investigation. we spoke with her live on "abc 7 news" at 4:00. >> if all this is, is a charade to once again do what they did

with anita hill, which is basically give each party the opportunity to speak and then move forward with their vote, then they haven't done an investigation and they had no intentions of doing anything but doing -- going through the motions. >> the congress woman also says mark judge, the man blasey ford says witnessed the assault should be subpoenaed to testify. also harsh words from the senator from hawaii. >> we all signed on to this letter to demand an fbi investigation, but really guess who is perpetuating all of these kinds of actions? it is the men in this country. i want to say to the men in this country to shut up and step up. do the right thing. >> "the washington post" has been at the forefront of reporting on the accusations against kavanaugh. one of its articles today argues this is not a case of he said/she said in which nothing can be proven. senior political reporter aaron blake talked with kristen zine.

>> aaron blake, thanks for joining us. you write it is more than a case of he said/she said, why? >> you have evidence in a way. there are claims that are made. there are prior statements that are made. in this case it is christine blasey ford having talked to her therapist about a similar incident six years ago, and in the case of brett kavanaugh we have a new denial in which he says that he doesn't remember being at a similar party. >> can you give us a sense of what is happening in washington right now in the days leading up to this big hearing? >> no question there's a lot of information gathering going on by both sides right now. there is also the negotiation process about exactly what this hearing is going to look like. >> should kavanaugh get through the nomination process and get on the bench, to what extent do you think his work and legacy will have been touched or tainted by these accusations? >> there may be a situation in which they can get the votes to confirm this supreme court nominee, but do you want this to be the person who is going to impact the balance of power on

the supreme court for years or decades to come? >> now, the bombshell accusation surrounding the judge kavanaugh case has created a teachable moment for one east bay school when it comes to behavior and also social skills. >> "abc 7 news" reporter cornell bernard continues our team coverage. he's live in berkley with the story. >> reporter: ama, dan, there's been a lot to talk about bay hill high school, a sexual assault accusation against judge kavanaugh from when he was in high school creating lots of talking points. >> but i think that there should be an investigation before he's given one of the highest positions in our country. >> opinions are everywhere on the streets of berkley. >> so if we are taking our 45 meters next -- >> reporter: at bay hill high school students are learning about physics and talking country events with the judge kavanaugh case. >> we were discussing it at dinner actually, about what could be done and what should be done. >> reporter: zoe is a junior at this private high school where respect among students isn't expected, it is required. >> the staff here teach us to be

respectful and to be wary of strangers and good to our friends. >> i think it is important not only that they have a sounding board but they know what's right and wrong and what a good role model is. >> reporter: bay hill's executive director shellie labelle says kavanaugh and his accuser have created a teachable moment at school. labelle says it begins with learning responsibility. >> i think that someone has to be responsible for their behavior no matter how old they are. to me it doesn't matter when it happened. it matters that it did happen. >> i've made many mistakes in my life. >> reporter: near the cal campus, freshman martin says kvanaugh has been a topic in his classes but he believes in second chances. >> just because someone did something 30, 40 years ago which was wrong, doesn't mean that that reflects who that person is today. >> reporter: zoe says students at bay hill know any bad ehavior could go on your school record. >> everyone should have strong moral compass and be kind and compassionate to others. >> reporter: now, the director

repealed parts of a federal rule that fined companies that did this. he said it eliminated the equivalent of three million passenger worth of emissions in a single year. look behind me here. today drone view 7 flew over what audie calls the service station of the future. near the embarcadero in san francisco, it is a giant advertisement for audie's new e-tron electric cars. governor brown wants california to have 5 million electric vehicles by 2030 out on the road, a goal that some say can only really be achieved if such cars are made more affordable for low income communities. "abc 7 news" reporter lyanne melendez is live to explain how it might happen. >> reporter: dan, don't you wish you had one of these in if you attended the climate action summit here in san francisco last week -- and of course we did -- this is exactly what governor jerry brown talked about, california leading the nation. but he said we cannot exclude

families in communities who live in low income areas. just a little more than $74,000 will get you into the new audie e-tron, the company's new electric vehicle. >> we have a luxury car i think will speak to luxury buyers and it makes going electric easier for them. >> reporter: audie will eventually unveil two more electric cars, but clearly they won't be affordable to people in low income communities. >> we want to make sure that everyone can access electric cars regardless of race, income, zip code. we want everyone to benefit. >> reporter: but two bills signed into law by governor brown will hopefully start to change that. one would create outreach to low-income communities to increase awareness while prioritizing rebate payments. the green lighting institute is a research and policy development nonprofit in oakland. they helped craft the second bill which includes, among other

things, more rebates for low-income residents who scrap old, polluting cars. >> they'll scrap it, throw it away and you get a voucher for up to $9,500 that you can then use to buy a new or used ev. >> reporter: that has been successful in the central valley and greater los angeles area. it will soon come to the bay area. that will all take time. in the meantime, scott mora, an assist ant professor of civil and environmental engineering says there are other ways to put the concept of green energy in low-income communities. >> even a model for which they can use mobility as a service affordably, in a way that decarbonizes transport. >> reporter: sharing? >> exactly, sharing. exactly, sharing. >> reporter: california has already agreed to help provide assistance to car sharing programs in these communities. and charging stations, important to make those a priority, and part of that bill also includes installing these charging stations at apartment buildings in low-income communities.

initially, remember, called a hoax. convicted kidnaper matthew muller faces new state charges. >> he likely will cross-examine his victims next week during a preliminary hearing. "abc 7 news" reporter melanie woodrow has the story. >> reporter: kidnapping victim denese husband kienzle come face-to-face with her convicted abductor matthew muller again. he is representing himself on six new felony counts, kidnapping for ransom, two counts of forcible rape, robbery, burglary and false imprisonment in connection with the 2015 vallejo kidnapping. when husband kins and her fiance and her fiance take the stand during the preliminary hearing, muller will cross-examine them. chief deputy attorney sharon henry. >> we are preparing as if they will be testifying. >> reporter: proposition 15 protects victims from being revictimized by allowing hearsay testimony at preliminary

hearings. subpoenas have been issued for law enforcement officials however -- >> if the district attorney is subpoenaing and denese and aaron to be there as well, that tells me the district attorney isn't so sure law enforcement will show up and/or do a good job. so let's hope this isn't another time where law enforcement, the vallejo police department, the fbi let denise and aaron down. >> reporter: vallejo police initially called the couple liars and said they made the whole thing up. because muller is representing himself and has a right to review all of the evidence in the case, he also will be allowed to view the videotapes he made of huskins alleged two rapes. >> it is disgusting he could watch a videotape of his own crime, but at the same time we have something called the constitution which allows him to do it. >> reporter: on monday, muller pleaded not guilty to the new charges, but said he would be willing to plead guilty if huskins and quinn donated half of that $2.5 million settlement against the vallejo police department to the innocence project, a group that works to exonerate those who have been wrongly convicted.

>> there will be no pleas in this case for what he is offering. that is in my opinion absurd. >> he is asking for a ransom yet again, and, quite frankly, they didn't pay it the first time and they're not going to pay it the second time. >> reporter: muller is already serving a 40-year federal prison sentence for the kidnapping of huskins. melanie woodrow, "abc 7 news." >> new at 6:00, rodney halbower has been convicted of raping and murdering two teenage girls in san mateo county. the jury reached the verdict after deliberating an hour and 20 minutes. authorities believe he killed six young women in 1976. prosecutors charged him with the murders with the strongest evidence. two bay area lawmakers are hoping to make the work of police departments more transparent to the public. "abc 7 news" was in san francisco when the senators called on governor brown to sign

two new bills. one would require departments the release body camera footage in officer-involved shootings within 45 days unless there's an impact on an investigation. skinner's legislation would give the public access to internal police records in similar cases. >> california is the only state that has denied any and all public access to investigative records related to police shootings, related to any number of incidents that really the public has the right to know about. >> both bills were supported by the american civil liberties union and are now on governor brown's desk. pro and anti law enforcement protesters squared off in sacramento today. law enforcement supporters organized a gathering to honor a fallen sheriff's deputy, mark stasiak, killed in the line of duty yesterday. activists representing the black lives matter movement held a counterprotest about police brutality against people of color, demanding justice for

stephon clark, an unarmed black man killed by sacramento police six months ago. >> because a couple of cops don't do right doesn't mean they're all bad. i'm here for the good ones. >> he was a young man. i feel for his spouse, too. but the thing is that -- that they hope they're going to -- they're going to hold that person accountable. but what about my grandson? >> today sacramento sheriff identified 38-year old anton moore as the suspect in the death of the deputy. san francisco police have a new state of the art training simulator which the department is integrating into its use of force classes. it is so realistic recruits and officers training on it say it is almost like actually being out there on the streets. scenarios san francisco police are using in their new virtual training simulator. scenarios that require split-second decisions. >> we just really deter from excessive force and we also deter from not using enough force so there's a happy medium that we're looking for. >> reporter: the old simulator had only one large screen in front. this one has five screens that project a 300-degree virtual world. ambient noise blairs out from six speakers. >> so i can do a courthouse scenario or critical incident scenario, a school shooting where i have a constant bell in the back, i have cellphones going on, i have kids screaming. >> which you didn't have in the old one? >> i didn't have it in the old one. >> reporter: now it is my turn to try the simulator. >> see, it is made for you. >> reporter: i'm having a hard time getting the gun out of the holster. >> you basically hit that button and pull it back. there's a button right there. see it? perfect. >> reporter: this scenario, a homeowner is upset that his neighbor is in his house.

it has been the site of several high-profile intrusions including a 2014 incident where a teen stow away flew from san jose to hawaii. what is expected to be a very long hearing tonight is under way right now in cupertino. the focus is the proposed redevelopment of the old mall. >> residents are concerned about the traffic impact from the thousands of housing units to be built. "abc 7 news" reporter david louie tells us the developer has a new state law as a backup plan. >> reporter: the 42-year-old velco mall is ripe for redevelopment. it sits mostly vacant. it's three anchor stores closed years ago. it is part of a revitalized part of cupertino. developer sand hill property company plans a mixed use project with an estimated 2400 residential units to help with the bay area's housing crunch. opponents are worried about traffic impact. congestion is common at times along stevens creek boulevard. these are concept drawings of

the project. a city council hearing tuesday evening is allowing the public to weigh in. sand hill says it wants to work with the public on an alternative plan, but if it doesn't happen it has a new state law which fast tracks developments with affordable units that comply with specific criteria and the city's general plan. >> if they decide they're not able to come to a decision tonight, we know we have sb-35 project application and we will move forward with that at full speed. >> reporter: they represent better cupertino. they claim the sb-35 plan cannot proceed. >> it is not compliant with the state law. it is not compliant with our general plan. some residents have already filed a lawsuit to -- to the sb-35 plan. >> reporter: the developer disagrees. >> not only do we and our team believe so, but the city of cupertino weighed in on the issue in june and deemed it con plient as women. >> reporter: they acquired the property four years ago and would like to get started on the big development. that sets up the potential for a legal challenge. it also is having an impact on

a local franchise of the blow dry salon blo has closed its doors for good. >> and it has worried some consumers. "7 on your side's" michael finney has been investigating. he is here to explain what's up. >> the closing of the san francisco blo franchise came as a surprise to many of its customers and a concern to those who had prepaid for services. this is the former location of blo, a styling salon on union street in san francisco. here is the corporate website. on the location's page, you can see there's no longer a san francisco address. that has caused concern among customers like jolene litner who tells us she has nearly $250 in unused prepaid blow outs. >> i got a call on the weekend prior saying they suddenly shut

here is what they would expect you to say today. one way or another we're going to make our customers whole. will you say that? silence. >> reporter: he reiterated he is working towards getting consumers what they paid for. so where do customers stand? i asked nationally-known gift card expert shelly hunter what should consumers do? >> to be honest with you, i'm not sure there's much they can do. when a store starts their going out of business process and they start to close and you can see something going on, you should be using those gift cards immediately. >> so who owes the money to consumers legally? well, without seeing all of the contracts between blo and the former franchisee i can't know for sure. but as a consumer advocate i expect both parties to do the stand-up thing so i will be keeping close track of this and will report back hopefully within a work. >> great work.
