she just might be the luckiest fan in the world. >> she is the sweetest one. that's for sure. we'll get to that later. first we begin with that supreme court standoff. republicans issuing a deadline telling judge brett kavanaugh's accuser, dr. christine blasey ford, that she has until friday to say whether she'll testify. her lawyers are now firing back. abc's senior national correspondent terry moran is at the supreme court and has the latest. good morning, terry. >> reporter: good morning, robin. the clock is ticking. senator chuck grassley who is the republican chairman of the judiciary committee set that friday deadline, not just for christine blasey ford to agree to testify, but to submit her statement in writing. grassley says that committee rules, and he's doing this, he says, because the constitution gives the senate the exclusive responsibility to advise and consent on nominations and it's the senate that will investigate. that's not good enough for christine blasey ford. and right now, there's no sign that anyone is budging.

it's turning into a high-stakes game of chicken, the standoff between republicans and the accuser of supreme court nominee brett kavanaugh. >> we're not going to cancel any hearing until the last minute. i don't know what the last minute is, but until the last minute in hopes that she'll take us up. >> reporter: but christine blasey ford insists she wants an fbi investigation before she'll testify. in a statement overnight, her lawyer saying a hearing that has only two witnesses is not a fair or good faith investigation adding, the rush to a hearing is unnecessary and contrary to the committee discovering the truth. blasey ford alleges brett kavanaugh sexually assaulted her when the two of them were high school students decades ago. kavanaugh denies the charges. president trump says he'd like to hear from blasey ford but patience could be running out. >> i really would want to see what she has to say. but i want to give it all the time they need. they've already given it time. if she shows up, that would be wonderful.

if she doesn't show up, that would be unfortunate. >> reporter: kavanaugh has interviewed under oath by republican committee staffers who said they have no reason to doubt the truthfulness of his testimony. this as his background has come under renewed scrutiny. even this old joke about his high school has resurfaced. >> the dean was reminding me before, before the talk, which is what happens at georgetown prep stays at georgetown prep. that's been a good thing for all of us, i think. >> reporter: republican lawmakers are moving ahead with a monday hearing offering blasey ford several ways to be questioned, publicly, in a private session, or by staffers at her home in california. the message from the gop to blasey ford, show up or we're heading for a vote. >> she said she wanted to appear. but if she changes her mind and refuses to appear there's not much we can do. and so nothing else really would

remain of the investigation and background of the judge, and we would vote on the nomination. >> reporter: even moderate republican senator susan collins of maine, a key swing vote, doesn't see why they shouldn't proceed. >> i don't think that she can reject all those options because otherwise, there are these very serious allegations hanging over the head of a nominee who has emphatically denied them. and that's just not a good way for us to end. >> reporter: democrats are standing by blasey ford and the call for an investigation before she's put in front of senators for a grilling. >> is this so the republicans have no sense -- have they never dealt with sexual assault victims? do they not read anything? do they not know how hard it is for someone to come forward? apparently not. >> reporter: but republicans like senator dean heller of nevada sound confident even before they've heard from blasey

ford. heller saying in a private conference call organized by the republican party wednesday -- we got a little hiccup here with the kavanaugh nomination. we'll get through this and we'll get off to the races. a little hiccup? well, that shows what's really going on. politics. the supreme court has been the crown jewel of republican politics for decades and kavanaugh's nomination represents the decisive opportunity to shift it to the right. but there is another kind of politics going on here. women voters, who are watching all this very closely. >> sure is. let's look at the law and politics with chris christie, former governor, and sunny hostin, also former prosecutor. sunny, let me begin with you. dr. blasey ford faces a big decision. there's not going to be an fbi investigation before monday. should she testify or not? >> well, i certainly think her story needs to be heard. i believe that she should testify, but only after an fbi investigation. what is shocking to me actually, george, there is no protocol in place for something like this. no protocol in place when a supreme court nominee or any

federal nominee has been accused of sexual assault or sexual harassment. this happened in 1991. there is a blueprint for this. when this anita hill situation happened, bottom line is by bipartisan agreement the fbi investigated. the fbi interviewed anita hill. they interviewed clarence thomas. they had sexual assault and harassment experts testify. some of the same members that are on the committee today were on the committee then. >> i think your analysis -- >> why are they confused about how to proceed? >> your analysis is spot on. it is what happened in the past. for whatever reason and when you have the voting -- votes, you have the power. the fbi investigation isn't going to happen. i go back to the question. do you think in that situation does dr. ford say yes or no? >> i think, absolutely, she has to say yes because i think there is a need for public confidence in the supreme court nominee. >> one of the things that they're looking at and concerned about is the structure of the hearing, the rushed nature of the hearing.

if dr. ford asks for a few more days, asks for other expert witnesses to testify, would that be reasonable? >> i don't think so, george. it's been 36 years and we're talking about a much different situation than clarence thomas and anita hill for a few reasons. one, that was a much more recent event and much easier to investigate. secondly, you had two adults -- >> just because something's hard is not a reason not to do it. >> but george, what are you going to get in the end of this? this guy has gone through six background investigations in his career, including one that just happened three months ago. and none of this was ever revealed in these background investigations ever. what that tells you is there are not witnesses who will be able to talk about this one way or the other and so what's an investigation going to prove? in the end what we need to hear is to hear from the professor we need to hear from her, hear her story. people need to judge her credibility, not only the senators sitting on that panel but the other senators in the entire body and the american

people need to judge her credibility against judge kavanaugh's credibility. an investigation won't do anything that it hasn't done already. they did a full field background investigation, george. you know how extensive that is and he's gone through it six times in his career. >> i think that's really intellectually dishonest. we've both been through background checks when we were appointed as federal prosecutors. and the bottom line is they need to reopen the background investigation. when you conduct one, some things don't come up. when the fbi learns about things that haven't come up they re-open up the investigation and they continue. that is the protocol. and the notion somehow that this happened 36 years ago, that it doesn't matter, well, he was 17 years old. and the bottom line is -- >> i didn't say it doesn't matter. you said it doesn't matter. i didn't say it doesn't matter. >> what did you say? >> i said it's more difficult to investigate something that happened allegedly 36 years ago and when no witnesses have come forward when they've done full backgrounds on him starting as long ago -- zblu they missed this. they missed this. >> they didn't miss this. she hasn't spoken to anybody about it, nor is there anybody

who has come forward who said that they witnessed it or had ever heard about it. >> they haven't come forward because the fbi hasn't investigated it yet. >> you don't know who the fbi spoke to or who they didn't. >> obviously they didn't speak to professor ford. >> you don't know that either. you don't know that professor ford didn't refuse to be spoken to. up to this time, professor -- >> oh, come on. there's no evidence of that. >> george, we don't know that they didn't speak to her either. we don't know that they didn't ask any questions before. >> i think it's pretty clear they haven't spoken to her. >> how do you know that? this is a woman who, up until six weeks ago, was demanding of senator feinstein and her own local congress person that they keep her identity secret. >> if she had been asked and refused, we would know that. they would tell us. >> of course we would. >> who would tell us, george? >> the fbi would tell us. republican senators would tell us. that news would get out if she had been interviewed. >> it's not about being interviewed. >> it's about being asked. >> i don't know that we would know that information. >> i got to move on to something else before we go. president trump yesterday

continued his unprecedented assault on his own attorney general, gave this interview to "the hill" magazine and said i don't even have an attorney general and led to an impromptu press conference on the lawyer. >> what do you mean when you said you don't have an attorney general? what do you mean by that? >> i'm disappointed in the attorney general for numerous reasons. but we have an attorney general. i'm disappointed in the attorney general for many reasons and you understand that. >> are you going to fire jeff sessions? >> we are looking at lots of different things. >> isn't this situation getting untenable? >> well, it's been untenable for a long time. it's been untenable for a long time. but it's untenable for a bunch of reasons. one, because of the president's feelings towards the attorney general which are obvious. but also because we're in the midst of a very serious investigation that's being conducted by the justice department. and i don't think the president has an option to fire jeff sessions right now because if he did, it would create a political and a legal firestorm that he wouldn't be able to endure. so it's the combination of those two things, george. their inability to work

together -- >> damned if you do, damned if you don't. >> right. and so he's -- i think he's stuck -- until bob mueller is done, i think that the president is stuck with jeff sessions and jeff sessions obviously wants to continue to be attorney general. so when you have those two things going on this is what you see. >> crazy. thank you both very much. >> thanks. >> to michael. >> thank you, george. as the battle in our studio cools off, the supreme court battle rages on capitol hill. president trump visited the carolinas wednesday to see the devastation from hurricane florence. thousands of people still waiting to go home days after the storm hit the region, killing at least 37. abc's marcus moore is in north carolina with the latest. good morning, marcus. >> reporter: well, michael, good morning. take a look behind me here. you can see what the storm did to those docks there, damaging them and really leaving people here enduring dangerously high water. and with many communities still cut off by the flooding, president trump traveled to the carolinas trying to bring a message of hope to those impacted. president trump landed in the

storm zone wednesday. first in north carolina, meeting with rescue crews and survivors who face a long road to recovery. one homeowner telling him insurance won't cover the damage to their property. >> that's not good. the insurance company doesn't want to pay. >> reporter: the president handing out hot meals. >> how is the house? >> reporter: and seen here embracing a young boy at a relief center. the president also visiting the town of conway, south carolina, walking through neighborhoods, greeting residents and local officials. >> anything i can do, you all know where to call me. and we will be there for south carolina. >> reporter: that is a message they hope will resonate with the thousands of people impacted by this storm. the troubles though are expected to deepen as the rivers are going to rise even higher. there have already been 2,000 rescues here across the region since florence hit nearly one week ago. robin? >> all right, marcus. thank you very much. we're continuing to think of all

those in that area. now to the release of one of elizabeth smart's captors, wanda barzee walking free after 15 years behind bars. new images show her hours after her release. abc's david wright is here with more. good morning, david. >> reporter: good morning, robin. wanda barzee was part of the husband and wife couple who committed a crime that's probably every parent's worst nightmare, the kidnapping of a child. these are the first glimpses of wanda barzee as a free woman. >> there's no reliable evidence to support speculation that miss barzee presently poses a threat of any kind to the community. >> reporter: barzee, who helped kidnap elizabeth smart, spent 15 years in custody. elizabeth smart speaking out overnight about her release. >> it certainly has been a roller coaster of emotion and at the same time i received an outpouring of love. >> reporter: barzee was supposed to be locked up until 2024. but a new ruling by the utah

board of pardons said she deserved credit for time served in federal prison. in the past few weeks, elizabeth smart has opposed barzee's release. >> i believe that she is a danger and a threat to any vulnerable person in our community. >> reporter: barzee and her husband, brian david mitchell, were convicted of kidnapping smart, then 14, in 2002. taken at knifepoint from her utah home. for nine months, smart endured the horror of daily sexual assaults before she was rescued. >> it feels like you're losing control of everything. you just feel like the world is coming to an end. >> reporter: now, mitchell, the husband in this couple, is still in custody serving two life sentences. bottom line, he won't be getting out anytime soon. >> yes, but she is out. all right. thank you, david. we'll move on to a new report on sexual harassment in the dallas mavericks basketball team. investigators have found a hostile culture for women at the team owned by billionaire mark cuban. cuban already taking action to address the wrongdoing.

and espn's ryan smith has the story. >> the dallas mavericks are nba champions. >> reporter: they're one of the nba's most valuable franchises. >> as mark cuban gets to celebrate. >> reporter: the dallas mavericks, led by charismatic owner mark cuban, known for his business skills and sharp tongue on abc's "shark tank." >> your marketing sucks. >> reporter: but this morning cuban and his mavericks facing the bite of a bombshell report, revealing multiple instances of sexual harassment and workplace misconduct over two decades. nearly all under cuban's watch. >> in hindsight, it was staring me right in the face, and i missed it. you know, i think -- you know, i wasn't as focused on the business as i should have been. >> reporter: the seven-month-long investigation commissioned by the team after more than a dozen current and former mavericks employees told "sports illustrated" the mavericks hostile work environment was an open secret. the magazine saying a pattern emerged of corporate culture rife with misogyny and predatory

sexual behavior. among the findings, misconduct allegations by over a dozen women against former team ceo terdema ussery, and while cuban himself was not accused of any wrongdoing, the report stating cuban's decisions not to fire one employee accused of sexual misconduct and another of domestic violence represented significant errors in judgment. >> i don't have any excuses. i'm not trying to justify it. it's just -- i made a -- i made a bad mistake. and it's not the only one obviously that i made. >> reporter: cuban now agreeing to donate $10 million to women's groups as a result of the report and committing to change. >> the goal even more than the money is for me to get out there and teach others from my experiences. >> reporter: when the "sports illustrated" story surfaced, ussery denied allegations of misconduct, calling them, quote, outright false and inflammatory accusations. now, as for cuban when asked by espn if the possibility of selling the team was ever

>> give me one move. shoulder. there you go. take what you can get. >> what you can get now is the headlines. we have a lot of headlines to get to as well right now including new developments in the supreme court standoff. republicans now telling brett kavanaugh's accuser, christine blasey ford, they need to know by tomorrow whether she's going to testify in front of congress on monday. today marks one year since hurricane maria made landfall in puerto rico. the storm so devastating the death toll estimated at nearly 3,000. so many still in need of help. >> the u.s. virgin islands were also impacted by maria. we'll have more on that later. take a look at this dramatic rescue. a major fire broke out at a senior housing complex in washington, d.c., quickly spreading. marines, who happened to be nearby, jumped into action, helping firefighters and other good samaritans rescue those trapped. thankfully we can say all tenants were able to escape with no major injuries. >> thanks to all those heros. >> mm-hmm. >> all right. thank you, robin. now to that urgent manhunt under way in the nation's capital after a woman was killed while jogging. this possible suspect caught on

surveillance video and, amy, this just happened in a very popular area. >> that's right, michael. i used to liver in that area of d.c. i used to run there all the time. i used to live in the area so this is a very frightening story for everyone who lives there. karina martinez was killed in what is typically known as a very safe part of town and now news of aj an arrest. this video shows wendy karina martinez on her evening jog. moments later she staggered into a chinese take-out restaurant after she was stabbed in the neck. >> stab wounds were very serious in nature. >> reporter: in front of a full restaurant police say the 35-year-old software executive rushed in and collapsed. >> they tried to provide medical assistance to her. unfortunately she was taken to a local hospital where she was pronounced dead. >> reporter: this morning, d.c. police they have arrested a suspect. they were zeroing in on this man, caught on this surveillance joid running away from the scene, holding what looks to be a knife. police are saying it was likely

a random attack. according to the victim's family, martinez, an avid runner, was engaged just last week. in a statement the victim's mother said wendy karina martinez was the light of our lives. not only was she an avid runner but she was a devout christian, a wonderful friend, and a driven professional. everything you hope that a daughter could be. tuesday's murder is just the latest in a string of killings targeting female joggers in recent years. 20-year-old mollie tibbetts abducted and murdered while running in july. the man accused of killing the university of iowa student pleaded not guilty this week. in 2016, 30-year-old karina vetrano was brutally beaten to death while jogging near her home in new york city. that same month, 27-year-old vanessa marcotte was found strong told death after going for a run on a rural rode near her mother's home in massachusetts. but this woman survived. 36-year-old kelly heron was running when she stopped to use a public bathroom.

>> as i was drying my hands, i became aware that something was wrong. >> reporter: that's when police say this man, a 40-year-old sex offender, assaulted her. herron says self-defense lessons saved her life. >> i learned you put hard bones in soft, fleshy places. so i just started beating the side of his head with the side of my hand. >> now, police say they have recovered what they believe is the knife used in the attack in washington, d.c. but for those of us who are avid runners, these are frightening stories. and i try to run with friends. because it really does feel scary to run by yourself these days. >> at any time. >> any time, anywhere. >> you're more aware now when you're running? >> i'm much more aware. >> we move to new developments for that california surgeon and his girlfriend accused of drugging and assaulting women. several new accusers have come forward and police think there may be hundreds of victims. and one woman who went on a date with that doctor last year now

telling her story. abc's kayna whitworth has the details. >> reporter: this morning, more than six women coming to authorities saying they were sexually assaulted by dr. grant robicheaux and his girlfriend, cerissa riley. robicheaux once named "orange coast" magazine's bachelor of the year, and appeared to be great catch on this bravo tv show. >> you seem too perfect. what's wrong with you? >> reporter: but this morning, former patients of his are shocked. authorities saying the couple used drugs and alcohol to incapacitate potential victims including two women who reported attacks to authorities in 2016. you said that it was their m.o. that they would send her out first to meet the women. >> that's what we've seen, yes. usually with m.o.s, if they work, they maintain those consistently. >> reporter: lauren hayden who matched with robicheaux on tinder in 2017 says he didn't understand the meaning of the word no. >> i was in the pool with him or jacuzzi and he started trying to tear my top off.

to know by tomorrow if she's going to testify. terry moran has more from the supreme court. good morning, terry. >> reporter: good morning, george. the moment of truth is approaching for christine blasey ford, not only does she have to decide by friday to testify before the senate judiciary committee on monday, but she has to submit on friday her written testimony to committee staff. she has reportedly told friends this is an incident that has haunted her entire life and so now the clock is ticking and she has to decide quickly whether to share it with the entire country. it's turning into a high-stakes game of chicken. the standoff between republicans and the accuser of supreme court nominee brett kavanaugh. >> we're not going to cancel any hearing until the last minute. i don't know what the last minute is, but until the last minute in hopes that she'll take us up. >> reporter: but christine blasey ford insists she wants an fbi investigation before she'll testify. in a statement overnight her lawyer saying a hearing that has

only two witnesses is not a fair or good faith investigation, adding, the rush to a hearing is unnecessary and contrary to the committee discovering the truth. president trump says he'd like to hear from blasey ford but patience could be running out. >> i really would want to see what she has to say, but i want to give it all the time they need. they've already given it time. >> reporter: kavanaugh has already been preliminarily interviewed under oath by republican committee staffers who said they have no reason to doubt the truthfulness of his testimony. the message from the gop to blasey ford, show up or we're heading for a vote. >> she said she wanted to appear but if she changes her mind and refuses to appear there's not much we can do. >> reporter: even moderate republican senator susan collins of maine, a key swing vote, doesn't see why they shouldn't proceed. >> i don't think that she can reject all those options because otherwise there are these very serious allegations hanging over the head of a nominee who has

we have jen ashton here to explain. >> good morning, george. >> good morning. now we've known it's a good diet, can lower the risk of strokes, heart attack and things like that. we have new information. >> score another for the greeks. we've heard it again and again about the mediterranean diet that appeared in the journal of the american heart association, stroke, number two killer worldwide, so again, getting a lot of interest. and basically they gave people a one-week questionnaire really followed their diets closely and sought to be more accurate than the others used in a lot of nutritional science. and take a look at the numbers. they found overall people who followed a mediterranean diet lowered their risk of stroke by 17%. for women it was huge. 22%. >> 22-6. >> for men it's about 6%. that could be due to chance. that's why you see the hashmark there. what's interesting about this, it's one of the first big studies that showed gender difference for diet. we see that again and again in medicine. we don't see it enough being studied male versus female. >> any idea why? >> no. so here are the interesting things with this diet. number one, there are different causes of strokes for men and

for women, for both of them, and this might act differently based on what type of stroke someone has. also, just like in anything else in medicine, we may see differences in men versus women. not just with diet but with exercise and other interventions so very, very hot area of research right now. >> got a mediterranean day here. >> this is a day out of the stephanopoulos diet. here's the key thing with stroke. you want to lower your risk whether you're male or female any way you can. diet, this is a typical mediterranean diet, high in fruit, vegetables, red wine in immediate ra moderation with exercise, lowering blood pressure, do not smoke. if you smoke, stop by any means necessary. very, very important. >> excellent advice. thanks very much. robin. >> all right, george. this morning marks one year since hurricane maria ravaged puerto rico and the u.s. virgin

along with irma, the storms left a trial of destruction in their wake. when we visited the area weeks later, we saw firsthand the power of community and resilience. as the island still worked to recover, we wanted to check in with our friends in st. thomas to see how they are moving forward one year later. looking around the recovery effort in the u.s. virgin islands is significant but there is still a long way to go. the damage from the storms was catastrophic. 22,000 buildings were damaged and $625 million of aid have gone to the people of the islands to help rebuild their new normal. >> i think the recovery is like one of the most amazing things to watch because everyone just dusts themselves off but it's the caribbean. you can't take that charm away. >> reporter: the storms could not crush the resilient spirit of the u.s. virgin islands like the phillips family who we met last year. >> how are you? >> oh, good morning. >> i heard so much about you. >> reporter: after the storm, the family of 14 took matters into their own hands, feeding their community day and night, providing over 3500 meals. >> i cook for 25 people normally. that's just us.

so it's not too much extra to share with the community. >> so it was out of necessity that you came up with this idea? >> yes. >> reporter: and today just like the rest of their beloved community, the phillips family are getting back on their feet. >> i trust you had a good trip. >> reporter: recently starting a new venture as a roofing and renovation company. >> there are a lot of people misplaced by the hurricane that still actually don't have a place to live and still in shelters. we kind of switched from doing the cooking to actually the rebuilding. >> the funniest thing, our house has not been touched and we're building other people's houses. >> we got windows. just got these in this week. >> reporter: like the turn of the tide, a growing phillips family recently welcoming their own little sign of hope. >> this is the newest member. say hi. >> i love this family. the phillips family and all the

people in that area, the islands, puerto rico and the virgin islands and you think about it, it was one year ago todays. one week ago today felt the first effects of hurricane florence and so for them to see the progress that has been made in the other places and just to give them hope that, hang in there and there are people that want to just lift them up and help them through their time of need. >> yeah.
