we're adjourned. >> so there you have it right there. this is in a process that has been filled with wide swings of both emotion and political momentum. another dramatic twist here in the senate judiciary committee. jeff flake who had been the deciding vote. the 11th republican to give the senate republicans a majority for judge kavanaugh came out this morning and said he was voting yes, but after a series of negotiations through the morning appears to have said now and he tried to explain it there that he'll agree to send the bill to the floor. we'll keep our ears on senator feinstein, grassley and leahy as well. but he appears -- flake appears to be saying that he will not vote to let this bill be passed on the floor. unless he can get some agreement for a one-week investigation.

flake is speaking for himself. we have not heard from senator susan jeff flake had been listening intently all through the testimony yesterday. the day before the testimony he took the senate floor and implored americans to pay attention to kavanaugh and think about the personal pain they were going through, what it was doing and he spoke again about the institution in the senate and how this delay with a proper investigation could also be good for the institution. he appears also to have been hit hard by protests. i want to show you an encounter he had on the senate floor earlier. it was in the senate chambers earlier today. >> you take responsibility for it and then you begin to repair

it. you're allowing someone who is unwilling to take responsibility for his own actions and willing to hold the hurt he has done to one woman actually three women and end and repair it. you're allowing someone who is unwilling to take responsibility to sit in the higher court of the country and to have the role of repairing the harm that has been done in this country to many people. no thank you. what do you think? >> you want to talk to -- >> no. i want to talk to him. don't talk to >> th >>. >> this is a very fluid situation right now. we don't flow what the white house knows, we don't know what senator mcconnell agreed to.

we know what he has said that he wants to work with democrats on a plan that senator chris for a one week investigation. that's senator patrick lehey of vermont. it appears he might be saying something. senator coons and senator flake have been working on this for quite a while. quite a number of us have been urging them along. this was kind of a surprise to all of us. senator flake expressed in his speech yesterday his concern about the divide in this country that is being exacerbated by what's happening here. of course we have been asking over and over again the

follow-ups on the evidence. so senator flake is basically saying to his leadership i want to see this additional investigation before i vote for this nominee. and if he is joined by one or two other republicans in that request they wouldn't have the votes unless the investigation occurred. >> it is one week given. one week is what senator flake was interested in and you can do a lot if you have the whole fbi looking at things in one week. >> reporter: [ inaudible question ] >> you should talk to senator flake about that. i think you have seen him to be quite independent in terms of what he says. he felt he had a very important role to play. >> again, first white house reaction. let's go now. >> george, the white house press corp. is here inside the oval

office. he is meeting with the president and he was asked about the latest of what is happening on the hill. he says i will read you some notes. it is just coming in. the president said he is deferring to gop senators. he spoke fondly about the ford testimony and the quote is of this delay that we just witnessed happened, whatever they think is necessary. so president trump in a pretty surprise move seems to be deferring to the gop, the republican senators on the judiciary committee to allow for the -- >> excuse me. he is coming out. let's see if he will explain. >> i don't expect any of them to vote for the if we you know, i don't know if

get kavanaugh confirmed without him. we were talking with linds lindsey graham. he says he doesn't know what he is going to do next. when asked if he would support this move he said i just know you need 50 votes. the question is he willing to give them? >> and it bha chris coons. they first put this on the table yesterday when he was questioning judge kavanaugh. we just heard him saying that coons insisted that flake only moved after having conversations and reassurances from others that could mean senator susan collins. >> exactly. those are the two other republican votes we are watching so carefully here. essentially the only way is if he does have the support of those republican votes and chris

coons was fascinating to watch the body language playing out in this meeting this morning. we saw him decline to take the opportunity to speak in this meeting and go over and motion and the two of them speaking for quite some time. it is where no one was able to see him. chris coons is the one that first floated this idea. i was speaking with him as he was walking in right when the news broke about the decision to support kavanaugh and coons aid he couldn't even comment. he is not someone who is known for playing a lot of politics. he is known for reaching across the aisle. he said it's like a game of where it has gotten so nasty neither wanted to shake the other team's hand. >> he does say flake approached him. they had numerous discussions in

recent days. we are seeing a a microphone. >> i'm not going into all of conversations taking place but the general appeal is we need to know the facts. this decision is too important to rush to judgment without an fbi investigation. senator flake wants to know more and he believes this delay is the responsible step to take. all of that said let me be very blunt. before we ended i was about to be recognized to make this point a motion, that this fbi investigation has to be real and penetrating so that the truth and facts and evidence are all

uncovered. this fbi investigation cannot be a show or sher raid. it must be real and go to the witnesses that are likely to produce facts and evidence. >> reporter: [ inaudible question ] >> that was senator blumenthal right there. he said jeff flake already said he wanted to vote in the senate judiciary committee appears on the idea there should be some sort of time perhaps one week investigation into the allegations made against judge kavanaugh. it had been an idea floated by democrats in the day before. this is something that he was negotiating with democrat chris coons of delaware and talking in discussions with other democrats. it's unclear how much he has from other republican leaders

although just reported from the white house and we are waiting for the tape of what the president said exactly. he seems to be deferring to republican leaders for whatever it takes. if it takes a delay of a week then he is willing to accept that. i want to bring in terry as well. terry, one of the things i think we are seeing here is a reaction to the toxic situation that was revealed in that senate hearing room yesterday. >> absolutely. the emotions and the cultural wave this whole incident has touched off around the country. i think in particular there were problems for him becoming justice brett

democracy you could think members of the united states senate would say wait a minute. there's enough here to push pause. >> it has been another tense day on capitol hill. democrats at one point even walking out. republicans fiercely defending brett kavanaugh. thank you for joining us. we want to begin with developing news in washington which you just saw in a special report. voting to advance to the full senate but it wasn't without some drama. jeff flake came in and said he would vote to advance to nomination but only if there was a one week pause for annnnnn investigation. it is up to them to delay the floor vote. today's developments follow yesterday's nine hour hearing with testimonies from dr. blasey

ford and kavanaugh. here is some of the dramatic sound from senators earlier this morning. >> i have never seen a nominee for any position behave in that manner. judge kavanaugh used as much political rhetoric as my republican colleagues and he went on the attack. >> i have never heard a more compelling defense of one's honor and integrity than i did from brett kavanaugh. he looked me in the eye and everybody in the eye and he was mad and he should have been mad. >> as we mentioned democratic lawmakers staged multiple protesters for the confirmation as republican-lead committee began the crucial meeting to debate and vote. a number of democrats walked out. here is what senator harris said after she walked out. >> this is a sham what's going on in there right now.

>> i was sexually assaulted. nobody believes me. i didn't tell anyone and you're telling all women they don't matter. >> take a look at this confrontation that played out minutes after arizona senator jeff flake announced he would vote in favor of a confirmation. two women confronted flake as he got onto an elevator telling him they are survivors of rape and sexual assault. this is before he came back and said he wanted the fbi investigation in exchange for his vote. we don't know but it may have played a factor in him changing his tune a bit. his coverage always continues online. you can read much more of what happened again. the nomination going through in the committee but being called for an entire fbi investigation with the time frame of one week. it is before it goes to a full senate floor

featur features. facebook reset some log-ins. about 90 million have been logged out. they don't know who is behind the attacks but it is working with law enforcement. the economic and home forclosure crisis ten years ago sparked a big increase in copper thefts. law enforcement battled back by increasing reporting requirements but the problem is not gone. in campbell police have just arrested three people they think have been targeting businesses. matt joins us live now with a story you'll see only on 7, matt. >> reporter: hi. yeah. they are crediting good old fashioned police work for these arrests. you have three accused thieves in jail and businesses here in campbell relieved. this is the crew, 54-year-old tony alvarez all from san jose

were booked into jail on several felonies including attempted grand theft and other drug related charges. campbell police say they are copper thieves. we are not talking small pieces. they were in position of one of these huge valves taken from a business on campbell avenue. they were arrested on september 8th at the campbell technology parkway businesses where six valves were taken. >> these individuals were right near one of the areas where the devices were stolen. based on the fact they had tools and another stolen device it appeared they had been responsible for the prior thefts. >> one like this costs more than a thousand dollars. if you recycle it it will only get you from 40 to $100. >> for the business owners it's a huge headache and the return on the part of the thieves is fairly minimal. so that creates a lot of

frustration. >> police captain says businesses in secluded areas can be prime targets but regulations put in place have helped. they require people to give their identification. >> we have seen a decrease in theft since that time but they are still occurrng and obviously once a location is identified that the thefts seem to occur more often. >> campbell police say there's a way for people and businesses to keep their copper plumbing safe. we put those tips on our web site. >> thank you. bart riders are demanding changing in the wake of recent violent attacks. they packed a special kplcommuny meeting. it adds ten new positions so that nights and weekends are covered. it includes the stabbing death of nia wilson in july. riders say they are concerned
