good morning, bay area. let's get up and get going. >> this is "abc7 mornings." and good morning. thank you so much for joining us on this sunday october 7th. i'm kate larson and we will start with a quick look at the weather with meteorologist lisa ar jen who is here, and it is clear and warm but windy which is concerning. >> yes, absolutely kate. it is pretty out there and nice and clear and good visibility, and temperatures are mild and looking at the strongest winds of the fall season and already gusts up to 60 miles per hour on top of mt. diablo. and 67 downtown and a pacifica and 68 in san jose. and morgan hill checking in at 64 and the golden gate bridge is nice and clear. and low 70s in napa and novato and concord. east bay hills and east bay valley, sustained winds up to 20, 25p miles per hour, and the

excess of 50 miles per hour. and current winds right now, over 38-mile-an-hour wind gusts over napa and looking at fairfield, and the relative humidity increasing, and there are the hilltop gust, and certainly a concern out there today, and we will watch it for you and the numbers will climb above average reading and breezy and warm inland and we will talk about when the fog returns. kate? >> thank you, lisa. the country has a new supreme court justice this morning and brett kavanaugh has been sworn in and after a bitter and epic battle over the nomination. it transfixed the nation in deep divisions and raised questions about sex, power and gender relations. here is our correspondent johnathan karl. >> overnight in topeka, kansas, the president was ashe senate n brett kavanaugh as the newest justice of the united states supreme court.

christine blasey ford says that she believes she did the right thing by testifying and no regret regrets, and now that he is going to be sitting on the highest court, christine blasey ford does not want to impeach him. she accused him of sexually assaulting her while they were in high school, and two other women emerged from 1980s and kavanaugh denies all of the claims. joining us is professor rory little, professor of uc supreme court history rebuff. and so, now sh, the supreme cou has been divided before, but this is feeling a little bit different and little bit more personal and especially for the women who feel like the lawmakerses are not listening. >> yeah, it is a gut punch for a lot of women. it is some sort of idea that we won't pay attention to women who come forward and this is a shame. however, the coming forward is now more honor and appropriate,

but the supreme court, you know, it ist life tenure, and so he is going to be there whether we like it absent something unexpected and some justices have only served a couple of years and thenning something quite unexpected happens, but otherwise we could look at this for 30 years. justice thomas has an asterisk next to his name, and so they continue. >> and this is my question. how, and will he have an asterisk and when he rules on important cases will everyone in the public be thinking that he ruled that way or this way? >> well, inevidentt bli, he is go -- inevitably, he going to be followed by the the you should recuse for this or that because of the emotional statement to congress. it wears off over time, but he is also never going to forget that. >> and what about the other justices, because already justices elena kagan and

on this term, and maybe you can help us to explain or understand a little bit better, because if gamble wins, it may allow the president to pardon the campaign officials who are indicted or convicted in federal court. >> and the question in gamble is if there is a sovereignty exception, and that is can two separate sovereigns state and federal both pursue the same offen offense, and public law says you can't be charged for the same offense twice which might limit the power of the new york state oofficials to go after people and we know that a.g. office is inv invest gating, and so maybe the standards for the federal are different from the state, so we are not sure it will eliminate that chance. >> ro profess-- professor littl you. reaction has been pouring in on both sides of the aisle. dia dianne feinstein is obviously disappointed saying it undermines the legitimacy of the

new overnight, five people are recovering in the hospital and four others are display pl u displaced after a fire in antioch. it happened at 2:00 this morning in blue bell circle where a car crashed into the palm tree. the car and the tree caught on fire which sent to a attic of the home up in flames. fire officials say that one of the victims in the car has major injuries and the red cross is helping those who were affected by the fire and have no place to live. a post ufc brawl led to three arrests in las vegas last night. conor mcgregor lost tot and rit after khabib jumped over the
