there's always tomorrow's powerball drawing. the jackpot is $620 million. not a bad consolation prize. >> we're still in the game. moving on, developing news tonight, firefighters, oakland police, and private security are still on the scene of a massive fire in oakland. flames destroyed nearly half of a new housing complex on west grand avenue early this morning. oakland fire department officials say they only have two investigators so they've called in the atf. the team will arrive tomorrow. as abc reports, it's being investigated as the latest suspicious fire in that area. >> reporter: frank showed us what he capture from the his home overnight. >> the hugest fire i have ever seen in my life, and there was embers and fireballs raining down. >> reporter: the glowing ball of red and orange billowing from the ice house apartments and town homes. it was under construction along grand avenue. there was a small fire here in april, but tuesday, it became

the sixth major construction site in oakland to go up in flames since 2012. >> and we had our hoses on, and we were just praying that the embers wouldn't catch our houses on fire. >> reporter: he didn't lose his home. >> i thought i could see it burnt down. >> reporter: but jerry did. >> i was using igt to sleep in, because i was homeless. >> reporter: as we looked at his totaled truck, only one thing came to mind as he thought about the fire. >> kind of fishy, you know, they go in these expensive buildings, people are homeless out here, it's no telling what somebody did. >> reporter: we do not know whether this fire was caused by an arsonist, but we do know that arsonists have been trying to burn down housing projects in oakland. >> reporter: mayor libby schaaf calling it an attack on new housing. ice house consisted of 126 town homes, more than 52 units already sold at prices starting at $600,000. in daylight, drone view 7

shows us what's left.extent of damage as fire crews continue to spray water on the charred ruins. the developer says they will be working with every family that purchased a unit there and for the parts of the complex that were not impacted by the fire, work will resume on monday. you're looking at the dangers oakland firefighters faced after flying embers ignited two homes several blocks from the burning apartment construction site. sky7 fle above isabella street moments after firefighters arrived this morning. neighbors describe the embers as raining down on them and as you heard from the gentleman a few moments ago, while they escaped their homes. today's fire on west grand avenue is the sixth major construction site in oakland to burn in six years. in july of 2017, this seven-story apartment building on valdez street burned down. the cause of the fire was not determined but arson wasn't ruled out. twice in ten months, this development on the oakland emeryville border burned in july of 2016 and in may of 2017. the atf ruled both cases arson.

about two years ago, on halloween, a five alarm fire woke people up near lake merit. the atf investigated but couldn't determine a cause for that fire. back in 2012, a construction site for a senior housing complex b.t. it's confirmed that one was arson. it's happened again. another cracked window has appeared in san francisco's leaning and sinking millennium tower. building inspectors say that window washers first detected the crack two years ago. it's located between the 9th and the 10th floors above fremont street but the millennium tower's management team didn't tell city officials about this latest crack until yesterday. >> the actual report that they gave the city yesterday says that they've known about this broken window for a few years. quote, unquote. which is even more disturbing. >> another window cracked on the 36th floor last month as we reported extensively.

the millennium tower says it was caused by an impact like perhaps a bird strike and not by the building sinking or leaning. san francisco police have made an arrest in an assault that left an alameda man with a traumatic brain injury. 25-year-old jiacheng fang was arrested. he's facing two felony charges. take a look at surveillance video from last month's attack. chris mitsubisatthews was waitia ride share. a man police say is fang got out and punched matthews in the face, calling him to fall to the ground. abc7 news is committed to building a better bay area, which means we're investing more time into looking into issues that affect our quality of life. for example, construction. small businesses along san francisco's van ness corridor are suffering because of a major city road project. abc7 news reporter kate larsen is there live to explain. >> reporter: well, dan, a lot o because as you can see, they're

behind schedule but mta spokesm spokesman paul rose says the agency is trying to help merchants. >> we put up promotional materials on our construction sites and fences to make sure people know the businesses are open. >> reporter: but a sign is clearly not keeping customers inside this family restaurant. he says they were unable to accommodate a large wedding party on tuesday. >> they come in, they're asking, where am i going to park? do you have valet? can i park on the left side? epte wa tls me struction. ed t cityan a many times includ with this letter to mayor london breed and supervisors. i've read it. there seem to be 15 very common sense suggestions like pick up zones in front of the restaurants so they can, you know, have deliveries for people and a liaison at city hall to communicate with.

rushed to stanford medical center for treatment. >> reporter: ron elliot has always considered himself a lucky man because he's been diving, swimming among the sharks for over 30 years, always without the protection of a cage but his luck changed today. sky7 was already here at stanford medical center when the veteran diver arrived. he was bitten by a white shark on the right hand. elliot was air lifted by the coast guard after the shark encounter that happened at 11:00 this morning. you see his hand bandaged and elevated to reduce bleeding. he was able to walk on his own with someone at his side, an indication that he had enough strength to get medical care without using a gurney. now, ron elliot is well known for diving for sea urchin. marine biologists tell abc7 news that this is prime season for sharks with a population sma estimated at 100. elliot is featured in a film called "near miss" in which he talks about his love of diving

with sharks and never being attacked. this time he was while he filmed under water. he was able to control the bleeding and was picked up by a boat that happened to be nearby. that boat took him closer to shore. the coast guard then transferred him to stanford medical center, a process that took about 1 hour and 43 minutes. marine biologists do a lot of research out there, although i'm told they tend to stay aboard boats and don't dive into the ocean as ron elliot routinely did. now, elliot has been treated here at stanford medical center. he's being released. and he has declined to do any interviews. at stanford, david louie, abc7 news. >> thank goodness he's okay. look at this. just a gorgeous day and sunset around the bay area. take a look at the amazing sunset we saw from our east bay hills camera. >> let's get on to our meteorologist for a check on our weather. >> double the delight. i want to show you the time lapse after the sunset of the full moon rising from our kgo
