tracy, altamont pass, light to moderate rain. it extends to the south bay, monterey bay. that's where our best chanc steady rain will be. scattered showers at 4:00 through 7:00. heavier storms coming in tonight. we'll talk about that in a second. mid-50s this afternoon. alexis tracking a lot of wrecks readthis morning. i know. we are up to four rollover crashes and two solo vehicle spinout crashes. folks not driving for conditions today. our fourth rollover is on the san bruno ramp to northbound 280. three people in the vehicle. they are all out now and it is on the shoulder. i don't think it will cause any significant delays since it is just a ramp. and everything seemed to be contained to the right side.

the teacher in charge got distracted by his phone. abc 7 news reporter live in danville. amy. >> reporter: hi. good morning, reggie. yeah, the attorney for the family says there is surveillance video of the pool that day. they say it shows the teacher looking at something in his hand that looks like a cell phone. this happened back in may. it happened here at san ramon valley high school in danville. 15-year-old benjamin curry drowned in p.e. class. they had been told to tread water three and a half minutes. the lawsuit says there were 57 students in the pool and no lifeguards. and that the p.e. teacher's lifeguard certification had expired. >> there's not one expert in this field who has ever heard of a ratio 57 to 1. this wasn't the swim team or

water polo team. it was a p.e. class, a required class for everybody. >> reporter: district officials can't comment on pending litigation. they say the district also instituted a requirement that every time district pools are in use, dedicated and decide lifeguards will be present. the teacher, aaron becker, still works here. the family says they have filed this lawsuit because they want to make sure this never happens again and they want to get to the bottom of what happened. reporting live in danvill, amy hollyfield, abc 7 news. amy, thank you. new details in the east bay. contra costa sheriff's office has identified a man who died in a crash in san pablo. 29-year-old marion sanwall flipped near el portal drive. we showed you the scene yesterday on abc 7 morning.

they tried to pull him over for running a red light. in today's gma first look, officials have released their findings on the deadly crash of lion air 610 after preliminary information shows the flight crew informs a life and death struggle with a new 737 safety system. >> reporter:? this morning's gma first look, the data from this black box that this morning in telling the story of a battle in the sky between an indonesian crew and a new jetliner's safety system. right after takeoff of the boeing 737 max 8, warning alarms of something wrong. it was apparently a bad sensor in data telling the flight computer there was a possibility of a dangerous stall. so the computer put the jet nose down. the pilot is correcting it, pulling the nose up. ar.s happening more than two nose down, then pulled up, until the jet fell out of the sky.

upper 40s. here's a look at our rain. heaviest around monterey bay and big sur coast as we head throughout the morning hours. >> here you can clearly see at 7:00 on future radar, staying down there, even reds, downpours for them. for us, a couple of chances of showers getting a little more impressive towards 4:00. yellows developing in the north bay and along the peninsula. 7:00, it spreads in coverage. then the big stuff comes in right after midnight. the red, that's going to be heavy downpours, ponding on the roadways, reduced visibility because of the rain coming down so heavily. we will have moderate showers during the morning commute. the heaviest will be moving on until we get to 10:00 to noon. then another chance of heavy storms rolling through. most of friday is going to be dry until late during the evening hours and through saturday morning. we get a break sunday. more rain monday and tuesday. here's alexis. all right.

earlier. a lot of collisions, including a slow low vehicle spinout crash in the north bay. southbound 101 before spencer avenue, sausalito, two lanes blocked. maybe they are blocking the two lanes to get it back on the roadway and get it towed out. carpool lanes are open, but metering lights on quite early today. 5:18 the official time. so plan ahead. commute likely going to take you a little longer today. the rain and wet roads are particularly a concern in the santa cruz mountains where there is potential for flooding and mudslides. >> as mike has been telling us, a bigger storm is on the way. matt keller is live on highway 17. matt? >> reporter: good morning, reggie and jessica. we have drizzle up here, foggy conditions as well at the summit. i checked the chp website.

you know there will be trouble on days like this, and there is. there was an accident reported just north of the summit here. right now they are saying there are no injuries. that's the good news. public works will be here as well. they are still doing work on storm damage from two years ago. a team of only 45 to repair and maintain miles of county roads. they have delivered sand and sandbags across the county. residents must fill them on their own. construction crews are also preparing. >> we don't want any sudden surprises. we're getting as ready as we can with the tarps here. >> reporter: yeah. emergency personnel will be monitoring the creek and river levels, responding to mudslides and downed trees. they have been busy dredging creeks to prevent flooding. we have a semi truck that pulled over. you can expect delays this morning here as the rain always

causes problems for this road in the santa cruz mountains. matt keller, abc 7 news. be safe out there, matt. thank you. caltrans crews have worked quickly to fill in a sizable pothole on highway 101. it started crumbling 1:00 yesterday afternoon. it took crews almost six hours to repair the damage. the concrete patch took longer than usual to dry because of the cold, damp weather. caltrans plans to close part of highway 1 because of today's storm. it involves the 12-mile stretch between mud creek and paul slide. it say precaution against a possible rockslide like the one that hit the area in may of last year. six million tons of rock and mud buried the road. highway 1 just reopened in july after $54 million in repairs. in san francisco, members of the fire department are

patrolling ocean beach, where powerful waves were crashing into the shore yesterday. crews are concerned some people don't take the high surf seriously. >> if that gets a hold of you, that basically pulls you out into the ocean. and then also of course the currents, you have three to four different currents that occur here at any given time. you could be pulled left, right, any which way depending on the forces that are out there. >> surfers should stay out until friday morning when the high surf advisory ends. surf advisory ends. >> and crews will be busy in francisco. it is hard to keep water out of low-lying areas and doorways. you can get the forecast on your phone by tapping the weather

button. watch live doppler 7 and customize the forecast so you can get weather where you live. in the east police have made an arrest in a series of hate graffiti. the department released this mug shot of 18-year-old lawrence phipps. evidence inside his home linked him to the crews. we first told you monday on abc 7 news. anti-semitic graffiti was scrawled on buildings over the weekend. 20 buildings in downtown antioch were vandalized as well. tips from the community led to their arrest. the family of a young man stabbed to death at a bart station wants the man to receive the death penalty. the suspect john cowell. it happened in july. the wilson family says the case is taking a toll. >> just the process is going too
