overnight a stunning new memo from special counsel robert mueller requesting zero jail time for president trump's former national security adviser, michael flynn. >> lock him up. >> reporter: in the memo, mueller acknowledging flynn's cooperation and substantial assistance in the russia investigation. according to the heavily redacted documents, the former general sat for 19 interviews and provided firsthand information about the content and context of interactions between trump's transition team and russian government officials. it also states that flynn is assisting the special counsel with information on another unknown criminal investigation. >> we do not need a reckless president who believes she is above the law. >> reporter: it was flynn who lambasted hillary clinton at the republican national convention in 2016 leading chants of "lock her up." ouhis convsaiabaa arflynnhe fir plead guilty in mueller's investigation that could avoid jail time altogether. well, it's now up to a judge whether to go easy on flynn. under federal guidelines he could get up to six months in prison. but mueller's recommendation is likely to influence the judge. the sentencing is scheduled for december 18th. and one more development from the russia investigation, trump confidant roger stone is pleading the fifth. stone is refusing to testify before the senate judiciary committee. and stone has also refused to share documents with the panel. days ago president trump praised him for having, quote, guts. well, we're going to turn now to the national day of mourning for former president george h.w. bush. dignitaries from around the world are set to gather for a state funeral that's just hours away from now. >> the bush family made an unexpected return visit to the capitol last night placing their hands on the casket and the lines outside have not let up. even at 2:00 a.m.,

president bush for signing the landmark americans with disabilities act. >> if there's any president that i want to pay my respects to, the law that ensures that i have the same freedoms as everyone else. >> reporter: and this poignant moment. fellow world war ii hero bob dole helped to his feet to deliver a touching salute to his formal political rival. earlier in the day, president trump and first lady melania stopping by blair house where the bush family is staying to personally share their condolences. at the state funeral set for today at the national cathedral, president trump will join all living presidents and first ladies along with a host of world leaders putting aside politics to honor a president and a patriarch before he makes his final journey home to houston. president george w. bush will eulogize his father at today a service. an interesting fact about sully the service dog, well, sully

could be at that service in the cathedral today because of that americans with disabilities act that the elder bush signed into law in 1990. maggie, terrell. >> we certainly have fallen in love with sully. emily, thank you so much. abc news will bring you live coverage of this morning's state funeral beginning at 10:00 a.m. eastern on air and online. >> stock market is closed today in honor of former president bush and follows a sharp plunge on wall street on tuesday. the dow dropped more than 3%. investors are worried about trade negotiations right now between the u.s. and china, especially after president trump called himself, quote, a tariff man. last night he was back on twitter saying he believes there will be a deal with the chinese either now or into the future and his treasury secretary is trying to reassure anxious investors. >> it was very specific. this was a three-hour dinner that went through very, very specific issues that are agreed and now it's our team -- our turn to turn it into a document

on the two teams. now, again, there could be a phased in approach. so, this is not about kicking the can down the road. >> asian stocks also lost ground overnight. meanwhile, in addition to u.s. markets being closed today, there's also no mail delivery out of respect for former president bush and the national day of mourning. well, some senators now say they're more convinced than ever that saudi arabia's crown prince was involved in the murder of "washington post" columnist jamal khashoggi. the cia says khashoggi was killed by a saudi hit squad at the direction of the crown prince known as mbs. senate leaders reacted angrily after a briefing about the case from cia director gina haspel. >> there's not a smoking gun. there's a smoking saw. you have to be willfully blind not to come to the conclusion that this was orchestrated and organized by people in -- under the command of mbs. >> i have zero question in my mind that the crown prince mbs

ordered the killing. if he was in front of a jury, he would be convicted in 30 minutes guilty. >> a pretty powerful statement. senator graham there was referring to reports that saudi agents used a bone saw after khashoggi was killed. president trump and members of the administration have wavered on whether the crown prince was involved saying there's no conclusive evidence. let's take a look at your weather now on this wednesday morning. good morning. we're looking for the rain to continue to advance throughout all of california from sacramento down to san diego. snow showers in northern portions of nevada as well as utah towards salt lake city. now, we're going to stay a bit on the cool side without the northwest corner of the country. cold and dry air staying dominant there. not as cold throughout the north central part of the country but much colder air on the way by thursday/friday. we're looking for snow showers throughout the northeast and

back now with a big announcement in cuba. tomorrow for the first time, citizens can sign up for full internet access on their cell phones. up until now cubans have only had access to state-run email accounts on their phones. they didn't have home internet access until just last year.

we're following serious new allegations this morning against the man once considered the most powerful executive in the tv industry. lawyers at cbs have reportedly found evidence that former ceo les moonves destroyed evidence and misled investigators looking into sexual misconduct claims against him. "the new york times" says the accusations are part of a report prepared for the cbs board and include claims that a network employee was on call to perform sexual acts for moonves. the report could jeopardize his $120 million severance. moonves denies any sexual misconduct. now, cbs has issued a statement saying, no findings have been reported. anyone who may have disclosed draft information to "the times" did so without authority. this is so sad. the family of an american tourist who vanished in costa rica two weeks ago now says they have identified her body. carla stefaniak's father says that authorities allowed him to view the body found near the

airbnb where his daughter was staying and he has confirmed her death. police have arrested a security guard who lives nearby. they say his story didn't match up with what they found on security cameras. new questions surrounding the election fraud investigation in north carolina. republican mark harris is holding a slim lead in the congressional race as officials look into possible tampering with absentee ballots. a man who worked for harris is a focus of the investigation. and now the incoming house majority leader steny hoyer says democrats may refuse to seat harris until those questions are resolved. new protests overnight as republican lawmakers in wisconsin debate whether to weaken the authority of the incoming governor who is a democrat. demonstrators chanted slogans like respect my vote. the outgoing governor scott walker was heckled during a christmas tree lighting ceremony. so the force was not with this man from tennessee. police arrested a man named luke sky walker for violating his probation.

colorado. police discovered too late that gary black was the homeowner, not the suspect in a home invasion. he had just killed the intruder while trying to protect his family. officials say the vietnam veteran was hard of hearing and never aimed his gun at police. we've now learned the officer responsible will not face charges. we're going to turn now to a major hotel chain that's facing a $100 million lawsuit. >> yeah, a woman claims that an employee at the hilton hotel group secretly recorded her in the shower and then blackmailed her. here's abc's paula faris. >> reporter: hilton is facing a $100 million lawsuit after a woman claims one of its unidentified employees filmed her in the shower in order to blackmail and extort her. the woman whose face abc news is not showing says she was recorded without her consent while taking a shower in hilton's hampton inn & suites in albany, new york, back in 2015. in a newly filed lawsuit, the jane doe alleges she did not

realize she was recorded until this september when the alleged perpetrator tried extorting her over email. >> all i could think was my life is over. you know, if this gets out, my life is absolutely over. >> reporter: according to the complaint, he even created an email address using her name and sent that shower video to her friends and family. >> it was just absolutely traumatizing because these were people i went to law school with. they're friends. they're co-workers. >> reporter: the hotel tells abc news the safety and security of our guests is our highest priority. we will continue to work with the authorities to discover the perpetrator and see that she/he is held accountable. jane doe also alleging in this complaint she is not the only vialim, bubanyaythey reny underwent a renovation, and they did not find any recording devices. paula faris, abc news, new york. police in baltimore are searching for suspects this morning. an engineer was killed giving money to a panhandler on the

street. jacquelyn smith's husband says they were driving home when they saw a woman holding a baby and a sign asking for money. he says when jacquelyn rolled down her window to hand the woman money a man came up and stabbed her. the man and woman then took off with jacqueline's bag and necklace. >> the 911 operator, he was a beautiful person. >> yeah. >> he told me to put pressure on her wounds and i got her to the hospital and two hours later they said she didn't survive her wounds. >> always be aware of your surroundings, and it doesn't matter if it's the middle of the day or the middle of the night. if you're driving, if you're walking, if you see something or someone that's suspicious, call 911. >> panhandlers in that area say donations are down since that stabbing. the trump administration's recommending an overhaul of the postal service. president trump ordered a review of the system after complaining that amazon isn't paying enough for deliveries.

this neighborhood. i talked to officers from the coroner's office who were on the scene. take a look at the video that was shot overnight. the car crashed into a house. they were not able to tell me if the driver was shot and that's why there was a crash. we still need to talk to investigators about that. we are awaiting information from free mont police. chaucer drive at torington place. this is still an active investigation. they are working the scene. the sergeant from fremont police, is inside that crime tape. officers here have radioed in and let that sergeant know we are here. we would like to get more information to get it out to you. he is tied up right now. very busy. knows we want some information. so we will work the scene for you.
