>> that breaks news tonight a surprising announcement from comedian kevin hart. he says he'll step down as host of this year's academy awards. >> hart is refusing to apologize for anti-gay comments he made years ago. the comedian refused. hart says he did not want to let, quote, internet trolls win by apologizing. in an instagram video he told fans he's addressed this controversy before and won't do it again. >> i've spoken on it, i've said where the rights and wrongs were. i've done it, i've done it. i'm not going to continue to go back and tap into the days of old when i've moved on and i'm in a completely different space in my life. >> and hart tweeted tonight, quote, i'm sorry that i hurt people, i am evolving and want to continue to do so. my goal is to bring people

together not tear us apart. much love and appreciation to the academy. i hope we can meet again. the oscars will air here on abc 7 on february 24th. >> without kevin hart, evidently. well, we're taking a closer look tonight at the homeless crisis and it's affecting so many communities including places you might not expect people to be living in the streets. >> we begin with abc 7 news reporter in oakland where women and children were kicked out of a place they considered a save haven. >> reporter: good evening. the moms say that the city guaranteed they wouldn't evict everybody until after meeting with all the families. the city says they gave the families 72 hours to leave. tonight most did, and the city went in and forced the rest out. before their personal belongings emrs held the leloing city thi w sy

for women. >> reporter: the moms and their kids 15 in all occupied the land in october, cleaned it up, made makeshift homes, made it a drug free zone but tonight it was demolished. >> the city of oakland just destroyed the only. >> reporter: she said the city targeted them for being a voice for the homeless. >> we were in crisis, selling drugs, if we were prostitutes, robbing our neighbors, done with they did with everyone else, neglect them and leave them alone. but we took care of ourselves and the community and we're being punished for it. >> reporter: they were even offered hotel vouchers and beds at other shelters but nina

parker says the shelters aren't safe and are too far from the school. >> we have kids that go to kid oakland. how are they going to get all the way from alameda county to east oakland on time? >> reporter: they said even though they've been evicted they'll continue the fight. abc 7 news. >> all right, thank you. in the south bay about one in ten students at san jose state is homeless. abc news reporter carlos is showing us what their classmates ae doing tonight to call attention to the problem. >> reporter: they setup tents here on campus as part of an event called poverty under the stars. there's a few dozen people right now, they are camped out hoping to raise awareness on the housing crisis. tents went up near sjsu's famous statues, the raised fists symbolic of what these students are demanding. that change related to the

housing crisis impacting college students. 13.2% of san jose state students are either homeless are have dealt with it while in school, the highest of any csu campus. >> of one of 4,000 students here. >> reporter: dahlia was living out of her car for a month not being able to pay rent and tuition. >> it was very hard for me to concentrate on my academics when all i could think about was how am i going to get home, how am i going to heat up food? >> reporter: they want them to provide more assistance for those in need. school administrators have met with the group and are looking at ways to improve services, but they say this issue is part of a larger problem. >> this is one of those kind of challenges that we've got to be partnering with the city, the county, community based organizations to really figure out how you begin to create a web, so we address this.

>> reporter: for dahlia her situation has improved but other students are still struggling. >> it's already expensive to be a college student in the silicon valley but more expensive to survive out here. >> reporter: as a way of improving communication administrators say they will issue a campus wide message tomorrow to all students informing them of the resources available. that's something these students say is a step in the right direction, but they will remain here until tomorrow morning. reporting live in san jose, abc 7 news. >> thank you, carlos. and there are a lot of ways we can make things better in the bay area. so what are your ideas? we want to know. when you tweet, facebook orm at. fast moving mud slides have chased 2,800 people out of their homes in lake elsinore in riverside county tonight. a raging river full of mud and debris is flowing downhill sides

and near 800 homes. mud has already buried the front yards of some houses down stream tonight. residents are digging through several feet of debris to get to their homes. this area was the same spot ravaged by the holy fire in august. tonight president george h.w. bush has been laid to rest in his adopted home state of texas next to his wife barbara and their daughter robin. >> the burial concludes a four' day tribute to our nation's 41st president. abc 7 reporter elizabeth hur hur with the send-off. >> reporter: a special train named bush 41, at the time hundreds of people were here to they say witness history. president george h.w. bush took his final trip on this train named in his honor. with thousands lining the entire 70-mile route from houston to college station pausing to pay

more inclusive. a central california high school chemistry teacher is in jail and without a job tonight after she forcibly gave students haircuts while singing the star-spangled the scene inside margaret's first period class was captured by students on their cellphones. students ran out of the classroom not sure what to make of what was going on. family members say she may have suffered a mental break down. she was arrested at her home and could make her first court appearance tomorrow. starting in 2020 california will become the first state in the country to require new homes have solar panels. the voter commission voted unanimously to mandate solar panels atop new single family homes. the rule will add about $10,000 to the cost of new homes. but officials believe the energy

costs will offset the high price for a house. sandhya patel is here with the forecast as we hit the weekend. >> and we're going to be seeing plenty of sunshine tomorrow into saturday if you're going to be thinking about outdoor plans. you will notice skies are clear over the bay area. there are a few passing clouds, but that's about it. remember the rain we recently had, that same system has been dumping on parts of southern california. getting 2 to almost 5 inches of rain. some high elevation snow, you may have heard the great vine was shutdown earlier today because of this storm. 30 reports of stormy conditions from that area from debris flows to flooding and even a funnel cloud reported. that storm is starting to ease up a bit. and meanwhile while they were dealing with the stormy conditions look at what we were dealing with. as mentioned there was plenty of sunshine out there as you look

across there and we see the blue skies and looking towards the east. we will see sunshine. there were only four days with sunshine. the grays indicating smoky cloudy days. we had quite a few of those as you know from the fires burning and the greens were rainy days. we're hoping for more rainy days. but if you're hoping for sunshine, you got it. let's check out the weekend. it's never too early to talk about the weekend. saturday, sunshine, bright and beautiful. 50s, 60s. level one system, chance of showers sunday night. so most of your day during sunday is going to be just fine. look at this view. it's starting to feel like the holidays from our santa cruz camera. temperatures right now 38 at clear lake, 40s, 50s elsewhere. it's going to be a cold one. so chilly first thing in the morning. temperatures near or below freezing around lake port, ucaya. there may be some patchy frost
