live where you live, this is abc 7 news. >> good santa or bad santa? jolly old st. nick and his legion of followers are taking over the streets tomorrow, but not everyone is feeling the holiday spirit. good evening. thanks for joining us. i'm dan ashley. >> and i'm ama daetz. the bay area is getting ready for an invasion of red. >> that's right. the 24th annual santa con is getting ready to hit the streets. thousands of santas will be out to party. >> yes. this is despite being denied a permit by the city of san francisco. cornell bernard is live in union square. cornell? >> reporter: hey, guys. definitely a love-hate relationship with this holiday tradition, but ready or not, here comes santa con.

♪ call it the calm before the storm, better known as santa con. santa con, are you ready? >> yes, sir. it's going to be a party tomorrow. >> reporter: dominic augustine works security at the golden gate tap room that's getting ready to welcome thousands of thirsty santas like joel. >> bringing back family traditions where you're coming out with friends, passing out candy, so santa con is a good year to come this year. because we need it right now. >> san francisco's rec and parks denied a permit for the event for union square because the holiday tree and ice rink attracts so many visitors already. despite that, the event is still on. >> it's definitely not worth the hassle. >> reporter: a sign tells them they're not welcome in north beach where santa con got ugly in years past, chasing regulars away. >> it's good for people in the

neighborhood to know they have a safe haven and a safe place they can come into that's not going to be full of crazy drunks. >> these barricade also soon go up on grant street to keep santa safe from traffic. >> you know what you're in for. >> tupelo bar is bracing for the crowds by clearing the decks. santa con is their busiest day of the year. >> it will at some point like the titanic sink, but we hope to ride it out long enough. >> and she plans to bring in extra bar tenders and security for the event. sfpd will have extra officers on duty to keep all of those santas safe, especially those who have overdone it with the holiday cheer. in san francisco, cornell bernard, abc 7 news. >> all right, cornell, thank you. santa con is a worldwide phenomenon. it's supposed to capture the holiday spirit while santas sip spirits. participants are urged to donate toys, usually at a central donation. in some city there's is an official list of bars that are

participating. new york city may be the biggest santa con event, but it's gotten to the point where trains have banned alcohol this weekend. meantime, first fridays return to oakland for first time since october. it was canceled last month because of a shoot-out. sky 7 using our exclusive sky map 7 technology shows you where it happens, right in the heart of the city, running down telegraph avenue from 27th street to west grand. abc 7 news reporter katie utehs is live. >> most organizers strive to bring people into their events. tonight it was more about the plan of getting them out, dispersing people from downtown. and there is an effort under way to that. now vendors tell me the crowds were smaller than usual, but smaller crowds are better than no customers at all. the roots of hope lehman's business run through oakland first fridays, where she has been selling since 2014. >> i love first friday because it's a great experience for

first-time entrepreneurs to test out their product, and it's very low entry. you need to get your licensing, of course be, the vending fees are affordable. >> so when a shooting at 19th and telegraph hours after the october event forced the closure for november, it was a hit for small business owners like hope. >> it's consistent income that we were mission out on for sure. >> organizers got right to work, trying to reinstate the street fair. >> we had some town hall meetings, and we listened to the community, and we took that feedback and we made changes for event. >> this month, security is more visible. >> there is more security. i appreciate it. it's good. >> with a more festive family vibe. organizers expect around 20,000 people. it's less than the usual crowds of 40,000 to 50,000, but once people realize their favorite vendors are back, the crowds will be too. >> oakland is different. there is nowhere else in california that's like this. and so the people embrace us and so we enjoy coming and doing first fridays.

>> the vendor you just heard from, brian heinz, he drives all the way from temecula for first fridays. so that shows you just how important this event for small business owners. live in downtown oakland, katie utehs, abc 7 news. >> katie, thank you so much. everything went very smoothly tonight. want to learn more about first fridays and future events? go to our website, abc7news.com and click on the story where you will find the link. uber has taken steps to go public, trying to beat ride sharing rival lyft to sharing stocks in an initial public offering. the "wall street journal" reporteds uber filed confidential documents with regulators yesterday. lyft also filed paperwork with the securities and exchange commission yesterday. some suggest unabom cory be worth up to $120 billion in an ipo. uber is likely shooting to go public during the first three months of next year. abc 7 news has obtained police body cam footage of a domestic dispute involving former 49er reuben foster. it happened a month before he

was released by the team. abc 7 news reporter matt keller has been reviewing the footage to explain what happened to lead up to that police encounter. >> police department. >> police were called to this santa clara apartment complex around 11:00 at night on october 12th of this year. >> i am a neighbor, and i'm hearing loud, somebody being banged to the wall or something. >> just an argument. >> officers were met at the door by 49ers linebacker reuben foster. his girlfriend came to the store crying and initially stated she was not okay. >> going through her phone? >> police attempted to interview them simply. >> let's go over here. >> i'm not listening to no conversation, brother. >> okay. i'm going to put you in handcuffs, man. >> and that's what happened. foster was detained in the back of a patrol car while ennis was interviewed. both foster and ennis told police nothing physical happened. police took photos of both of them to show what they say was a lack of injuries.

foster was released from custody and ennis was given a domestic violence resource card. >> so you feel safe if you came back in here? >> yeah. >> you don't think this is going to continue? >> no. >> no charges were filed, but in an interview on gma this week following foster's arrest in tampa, ennis said foster had gotten physical with her three times, including during the october incident. the d.a.'s office says they're exploring legal options. the 49ers say they didn't know about the october incident until after foster's arrest in tampa. >> an informational type of report does not necessitate notification of anybody. >> foster has signed with the washington redskins but has yet to be cleared to play. the nfl has contacted the santa clara police department for more information on the october incident. in santa clara, matt keller, abc 7 news. new at 11:00, tonight's performance of volta was cut short after a performer was injured. cirque du soleil tells abc 7 news a performer fell off a bmx bike during one of the stunts.

this is video of a previous performance. a witness says on social media that the performer fell on his neck or head and couldn't move. he was removed by stretcher and treated by volta's medical team. a cirque spokesperson says the performler be okay. tonight's second show was canceled. a surfer died despite a desperate attempt to revive him at san francisco's ocean beach. today's tragedy unfolded at the southern end of ocean beach near the san francisco zoo. firefighters and park rangers pulled him from the pacific about 12:30 this afternoon. paramedics worked frantically to revive him after he was found unconscious in the water. he died after being rushed to a hospital. a beach hazard warning of rough waves had been lifted just a few hours earlier. in the east bay now, the concord police department has become the latest law enforcement agency to produce a lip-synch video, but the price tag is hitting a sour note with some. ♪

the cost to produce this video is raising some eyebrows on social media, where it was posted. the east bay times is reporting the department paid $34,000. police say the money came from asset forfeiture, which allows police to collect cash and property from people they arrest or suspect of wrongdoing. california law requires law enforcement in most cases to wait until defendants are convicted before keeping their assets. the department defends the use of the money saying it helps with crime prevention by building relationships with the community. an update on the teacher arrested after forcibly cutting one of her students' hair. she got out of jail tonight. the charges she is now fact. plus -- >> free food done right. now a new san jose program is helping street vendors launch a business. and the picture says it all. a doug survives the camp fire, and this is what its owners returned home to. i'm meteorologist sandhya patel. live doppler 7 is tracking

effects of that spectacular sunset tonight, there you go. it was just absolutely gorgeous. those high clouds added a little more color as the sun went down. now tonight we are feeling the chill there isn't a heavy blanket of clouds to actually insulate us. so here we go. those temperatures are dropping. take a look at where they stand right now. san francisco, 53 degrees. oakland, mountain view, upper 40s. gilroy, you're already 46 degrees and 45 in half moon bay. low 40s from santa rosa to napa. look at novato, 39 degrees. you may be scraping a little bit of ice off the windshield if you park outside tomorrow. there might be frost. livermore 43 degrees. here is live picture from downtown san francisco. city hall, all visible. live doppler 7 showing you no rain here on our radar, but that will be changing. let's talk about the rainy season. how much rain have we received so far? santa rosa over 7 inches, putting it at 92% of average. san francisco, you're at 82%. oakland, 87%.

san jose, 78% of average. we still have a ways to go. but these numbers are definitely coming up as we have had some storms over the last couple of weeks. so that's a good thing. and it's certainly boosted our snowpack. statewide sierra snowpack is at 104% of average. higher than average for central and southern sierra. when you average all three, that's what you get. we're hoping for more snow there as well. look at this view from our emeryville marina. really nice and festive. chilly overnight and sunny and mild tomorrow. chance of light rain late sunday night. it is going to be wet for your sunday morning commute. tomorrow morning you have early plans. make sure you have your winter coat. ifts going to be a cold one. low 30s to the mid and up earth 40s for many of you. san francisco is the only place that will be about 50 degrees. tomorrow afternoon, 59 in the city. half moon bay, richmond. 61 in santa rosa, oakland, fremont, 64 in santa cruz. pretty nice looking day. level 1 system sunday night into

monday morning. rain spreads north to south. expecting about a tenth to half an inch and breezy at times. hour-by-hour we go. sunday afternoon into sunday night, it's around mendocino county. slipping south during the overnight hours, going into monday morning's commute, which will include some wet roadways. but this is not a big storm. it will be just enough to dampen the ground an bring some snow showers to the sierra nevada. a little bit. not a lot. in terms of your rainfall totals, you're looking at anywhere from a few 100s of an inch in the south bay to half an inch, santa rosa, calistoga. you can download the app and track doppler 7 any time you want. tomorrow you're going to be enjoying nice weather. sunday night into monday morning we get our much needed rain. dry tuesday through thursday, and then another chance of rain, level 1 system coming our way on friday. i think for all the christmas and hanukkah celebrations this weekend, weather looks good. >> thanks, sandhya. all right. take a look at loyalty personified.

dogs are said to be man's best friend. just look at this picture. a family returned home following the camp fire to find their dog madison watching over their property, just waiting for them. the owners couldn't find the dog as they evacuated last month, and he survived, waiting for their return. >> what a shot. and then there is this. strangers are coming to the rescue of a 4-year-old boy who lost his prized dinosaur toy collection in the camp fire. the boy's great aunt took a facebook asking for people to help replace the dinos. the post received an overwhelming response, and the boy named riley posted a video thanking everyone for replacing his collection.
