york city police. facebook employees gathered in the parking lot while police search the building. >> it is interesting it is coming from new york. we will stay on top of this and keep you updated as soon as we get any new information. good evening. thank you for joining us. i'm ama daetz. >> i'm dan ashley. now to tonight's top story. a lawsuit and federal investigation into the san francisco district attorney's office. >> yes. we first told you about this last week, that a former senior investigator says he was fired in retaliation for whistle blowing. >> well, today his lawyer talked exclusively with "abc 7 news" reporter vic lee about the allegation against d.a. george gas cone. >> he is in the newsroom with the story. >> reporter: ama, dan, this is the lawsuit that the former district attorney's investigator filed charging wrongful termination of a whistleblower. tonight we are learning more about this federal inquiry that was launched as a result of the allegations. >> while he was the district attorney he was flying while armed in violation of federal

law. >> the lawyer represents former senior district attorney investigator henry mackenzie. he is suing his boss, d.a. george gascon, saying he was the target of retaliation and harassment and was fired in october of last year because gascone heard he and other investigators were blowing the whistle on him. mackenzie was an executive of the district attorney's investigator's union. >> the union had grave concerns about this allegation that the district attorney had been flying while armed in violation of federal law. >> reporter: under federal law, only sworn peace officers can legally carry a firearm on to a plane and only under strict circumstances. >> the district attorney is not a peace officer, number one. number two, there's no reason why he would need to carry a weapon on a flight. >> reporter: even as a former police chief of san francisco, gascone is not eligible to carry a gun while flying. peace officers who are eligible have to fill out tsa forms

stating that they're on official business, have had firearms training and passed a special armed-while-flying program. at least one investigator did go to the tsa with the allegation that gascone violated the law not once but regularly. >> it was not a one-time event. it happened multiple, multiple times, and even after there had been warning within the department against doing so. >> reporter: the lawsuit says that months after the tsa was notified mackenzie and most of the investigators associations governing board were punished or fire. the lawyer says homeland security and the tsa launched an investigation. >> i confirmed there is a federal investigation and it is my understanding that now the investigation is with the assistant united states attorney. >> reporter: now, sources with knowledge of the case tell "abc 7 news" that a focus of the investigation was whether d.a. gascone perjured himself on tsa forms he had to fill. another source tells us gascone

legally carried a gun aboard flights but stopped when tsa rules changed. homeland security, tsa and the da's office declined to comment, but the city attorney issued a written statement saying this case has no merit and that the henry mackenzie was fired because he spread false information about the da's office. vic lee, "abc 7 news." >> all right, vic, thank you. new developments today in the ghost ship warehouse fire case. attorneys for the two defendants filed a request to have the property's landlords and 11 oakland city officials arrested, claiming they are actually the ones responsible for the deadly december 2016 fire. the 11 city officials named including building inspector, cps agent, six members of the fire department and three from the police department. the defendants claim those named visited, spent time at and attended parties at ghost ship. the defendants claim those officials were aware of the dangerous living conditions, including fire hazards, but took no action.

>> we believe that a jury needs to hear all of the facts, see all of the faces of the people that are involved. >> all contributing factors are relevant to whether or not there's culpability. we want to bring all of that out. you know, we want justice. we don't want to be scapegoated. >> they face 36 counts of involuntary manslaughter. their trial is set to begin april 2nd. the alameda county da's office had no comment about the arrest request. oakland is fighting back. tonight the city says it is suing the raiders and the nfl to recover damages from the team's move to las vegas. the suit claims that oakland never had a chance, despite bending over backwards to try to convince raiders' owner mark davis to stay. "abc 7 news" reporter lyanne melendez is on the story. >> reporter: when the raiders leave oakland, the city will lose revenue and taxpayers will be left with an $80 million stadium debt from 1995, back when the team moved from los

angeles. >> the city of oakland made a huge investment in the raiders over the years, and we're going to try to get that investment back. >> reporter: the suit argues the nfl and team owners acted in concert with raiders' owner mark davis to disregard the city's effort to keep the team in oakland. it is what fan groups like forever oakland have argued. >> oakland never had a chance. as soon as al davis died, probably a week after, from people i know on the inside, mark davis was talking to roger goodell about going to l.a. with his dad's body still warm in the ground. >> reporter: goodell is the commissioner of the nfl. in 1984 a california federal court forced the nfl to adopt relocation policies to make sure teams follow very specific rules when determining if they should move to a new city. >> how is the fan base, are you making money, what is the size of the market. in each instance allowing oakland to move to las vegas violates those criteria.

>> reporter: oakland, he says, came up with the offer that davis wanted, but in the end was never considered. the team did not respond to the lawsuit but davis has said he would not sign a lease extension to play the 2020 season in oakland if a suit was filed. the raiders new las vegas stadium may not be completed by then. >> what we want in this, not is the team to stay. if they want to go to las vegas, the name, the colors, the history, everything stays here. >> reporter: most fans express their satisfaction over the lawsuit, but they acknowledge that the road is long before they can claim victory. in oakland, lyanne melendez, "abc 7 news." google's ceo endured more than three hours of questioning in front of a house judiciary committee today where he was addressing complaints of political bias, sensored searches in china and consumer privacy. today google's ceo found himself in the hot seat testifying before the house judiciary committee. >> i lead this company without political bias and work to ensure products continue to operate that way. to do otherwise would be against our core principles and our business interests. >> reporter: in addition to concerns over privacy and data collection, a partisan battle also played out today over whether google's search and other products are biassed against conservatives. >> google is compiling information about virtually every movement an individual with a smartphone is making every hour of every day. >> reporter: questions about the inner workings of the search engine also followed. >> if you google the word "idiot" under images, a picture of donald trump comes up. i just did that. how would that happen? how does such search work so that that would occur? >> reporter: the ceo basically giving members of the committee a lesson on algorithms. >> relevance, freshness,

popularity, how other people are using it, and based on that, you know, at any given time we tried to rank and find the best results for that query. >> reporter: he side stepped questions regarding the entry into the chinese market but for the most part remained calm and collected. >> the internet and internet companies have been unregulated because we have a faith in this country in freedom of speech and freedom of information, so we left them alone. >> reporter: as congress debates a federal privacy bill, cybersecurity experts say some sort of regulation should eventually come. >> dismore than a wake-up call. it is shaking every single tech company about how they deal with the data. they cannot just do with it whatever they want. there are consequences for that. >> it is concerning, but i feel like there's nothing that i can do about it. so i just accept it. i still need to use google, i still need to search for the product that i'm looking for. so i just accept it. >> reporter: consumers getting caught in the middle. in the south bay, chris wynn,

"abc 7 news." and now back to that breaking news at facebook. a bomb threat that forced the evacuation of one of the company's buildings in menlo park. this is another look from sky 7 live. you can see all of the police officers there. now, this is not the main campus. this is actually the building that's on jefferson drive at constitution drive near the approach to the dunbarton bridge. apparently new york police are the ones that called and let them know about a potential threat, so we are keeping tuned to this. we will bring you any of the latest information as soon as we get it. the economy is booming in silicon valley and that means the number of commuters traversing highway 17 through the santa cruz mountains is rising. you know what else is on the rise on that dangerous stretch of road? crashes. "abc 7 news" reporter matt keller tells us how emergency workers are trying to lower those numbers >> reporter: when you think of highway 17, you might think of this, a crash. the chp said the driver of this suv may have had a medical issue

when he lost control and crashed into the overpass of blossom hill road in los gatos. he was speaking with medics at the scene and taken to the hospital. this is not uncommon. even when it is dry, the chp reported seven crashes on 17 by 3:00 today. >> in recent years we have seen a steady increase of traffic accidents on highway 17. >> reporter: today santa clara county emergency workers held a news conference for the safe on 17 campaign. they want to help the 63,000 drivers who travel over the santa cruz mountains every day to make it home safely. the biggest reasons for crashes? >> those things are typically speed, distracted driving, following too close, unsafe lane changes. >> reporter: emergency workers are also at risk while helping people in crashes. medics and firefighters are sometimes exposed to danger in the middle of the highway. >> and our first responders rely upon the public to drive safely past so that we don't become injured or have any other people get injured in the process.

it would be charged to enter and exit treasure island. the highest would be $3.50 during peak times on weekdays, $2 during the weekendpeak and free all other times. treasure island is home to fewer than 2,000 people now, but there are plans to add 20,000 residents in the next 20 years along with hotels, shops and stores. here are renderings of what the development would look like. there are plans to add ferry service from the island to san francisco, increase muni bus service and launch transit bus service to oakland. money from the tolls would help pay for the projects and discourage people from driving. the toll policy will be revisited by supervisors next year. here is a look at three bridges where drivers pay tolls, the richmond, san mateo in the middle and bay bridge on the right. starting on january 1st tolls will go up $1 because in june

voters approved measure 3 to increase bridge tolls by $3 over the next seven years to play for transit improvements. a lawsuit has been filed to stop those increases claiming it is a tax, not a fee, and needs two-thirds to pass, not a simple majority. the measure received 55% approval. the higher tolls will be collected but the extra money will be held in escrow until the lawsuit is resolved. the golden gate bridge is the only local bridge exempt from this toll hike. starting in january, some transit agencies are raising prices. ac transit will increase the cost of bus rides. in the transit, fares will be raised for adults. new service to rich monday will launch on january 10th. the cash price is $9. clipper card riders pay $6.75. a lot of information i know but it is important as you will

optimism but -- >> frankly, you don't know. there's a lot of unpredictability and we're early in the season. >> reporter: water agencies point out you can't take a start like this for granted. they point out the last big drought began with a late fall like this and january came and the rain stopped. need we remind you of 2014, the rationing, the worry, the mindset? >> i just think we live in a desert and i think it always will be a drought. >> reporter: hence what has become a perpetual call for conservation even in times of plenty. >> on average the marin water district has -- at capacity has about 25 billion gallons of water. so that's about a two-year supply. if you conserve water, that turns into maybe a three-year supply, on and on. >> reporter: so to play on an old cliche about chickens, don't count raindrops before they fall. even if we're not in a drought, best to pretend there might be one. >> if the toilet is leaking, i will fix it. >> reporter: that's like saving for the opposite of a rainy day. in ross, marin county, wayne

freedman, "abc 7 news." when is our next rainy dray? >> drew is tracking that for us. drew. >> guys, we will finish out the week with showers, but the big concern overnight and tomorrow morning once again will be some dense fog redeveloping for the wednesday morning commute, similar to what we experienced earlier today. live doppler 7 giving the active sweep across the region. we are dry tonight. temperature wise we have fallen into the 40s and 50s at this hour. 52 for livermore and oakland. 54 in san mateo. 56 the current temperature in san francisco. overnight tonight, numbers continue to fall. in our coolest spot, we'll drop into the 30s in the north bay in a few select cities inland as well. most spots fall into the mid to upper 50s over the next 12 hours. let's show you the fog forecast. you are looking at visibility early tomorrow morning, and this is in terms of miles, how far you can see in front of you. by 2:00 in the morning, already starting to see the fog reduce

that visibility. by 6:00, 7:00 in the morning, you can see inland and in the south bay especially, san ramon, fremont, down to zero miles visibility. that fog will be thick once again for the morning commute. the highest concern we have is really for the south bay and the east bay valleys. remember though, where you are doing counter fog, don't dry with your high beams. keep your low beams on and lower your speed. the fog lifts midday. sunshine into the afternoon. 58 for san francisco and oakland. about 60 for san jose. 61 for santa rosa. 62 the high in concord. then we will track the rain coming in late in the day on friday. on the storm impact scale, level one system, light in nature. we'll track those scattered, light showers to end out the week. less than half an inch where we find the rainfall. the winds will pick up, close to 15 to 30 miles per hour at times. future weather, we'll get you into 4:30 in the afternoon, some light showers beginning to move in. i think the steadiest of the rain will come after the sun

goes down, late in the day on friday. 10:00, 11:00, there are some steady, light showers moving through the region. then this storm kind of fizzles out as we head into saturday morning. however, sunday an even stronger storm moves in here, ranking a two on the storm impact scale. so sunday evening, looks like soaking showers do work into the picture from north to south and just intensify late sunday into early monday morning. by midnight, 1:00 a.m. monday morning we will be tracking some downpours moving through the region. not only the rain we're tracking, this system could also bring some high waves as well. as we get you into sunday night, into early monday morning, we could see a long period swell along much of the california coastline of 20-foot waves. that's something we will track on the coastline. also, the world's surf league is watching this very closely because these conditions could be ripe for the mavericks challenge early next week. we'll keep you ip dated on that. here is the accuweather

it's been 20 years since we first introduced "abc 7 news" viewers to the bay area woman some call the mother teresa of nepal. >> olga murray, now 93 years old, is helping rescue and

educate desperately poor children. once again she is heading to nepal and this time bringing a success story along with her. >> reporter: it is another wonderful day for a couple of unlikely friends, born a world apart, now celebrating their 25-year bond and the arrival of a new baby. >> good morning to you. >> i just gush with happiness. >> reporter: this is durga tappa, 34 years old and a new mother. we first met her when she was a teenager sitting in the same sausalito living room with her guardian angel, olga murray. she was badly burned in an accident when she was a baby in nepal. her parents were too poor to get her the plastic surgery she needed and society shunned her. >> we're not human beings in nepal if we're disabled or disfigured. >> reporter:ology olga was a lawyer foor the california supreme court. when she retired she started helping children in nepal with

donations she raised from friends and colleagues. >> the core, the heart of the program are people in the bay area. they're the ones who gave us our start. >> reporter: olga found durga in a hospital in katmandu when she was eight years old. she was badly scarred with no nose. local doctors tried to help but didn't have the training they needed. >> they took skin from her scalp and there was a huge bubble that went from her scalp to here to build her nose. she was happy as could be. she had no idea what she looked like. >> reporter: durga truly needed a miracle and, boy, did she get it. olga brought her to the bay area for free medical treatment at shriners hospital. >> this was going to be a long, long process. she had surgeries from the time she was eight until she was 21, 13 years, and she needed somebody to live with. >> reporter: olga was constantly traveling to over see her foundation's groundbreaking rescue perhaps, including freeing young girls from slavery and providing homes and education for some of the world's poorest children.

so back in san francisco, olga's friends, joan and todd heffelinger brought her to live with them. >> they treated me like their own. we did everything a family would do, you know, school, and when school was out vacation, and every break i had an operation. so they were there for every single operation. >> reporter: durga was showered with love and a critical life message. >> we're only disfigured outside because of our accidents. we're not disfigured inside. >> reporter: she graduated from college, started working with people with special needs, and got married. >> i performed the wedding, her wedding here two years ago. then they had another wedding at my house in katmandu. >> reporter: sadly, the heffelinger passed away recently, but olga is reveling in her role to unofficial grandmother to the baby boy. on this night they're at the international airport to nepal
