president trump's former personal attorney michael cohen is sentenced to three years in prison for lying to congress and violating campaign finance laws. cohen's lawyers says he'll soon be able to tell congress even more about his actions on behalf of the president. thanks for joining us. i'm kristen zse. michael cohen broke down twice before the judge handed down his sentence this morning. he told the judge he felt it was his duty to cover up the president's, quote, dirty deeds. abc news reporter linda lopez is at the federal courthouse in new york city with more on the sentence and what this means fo longtime personal lawyer and fixer sten tensed to 36 months in federal prison this morning

at this new york federal courthouse. this after pleading guilty to charges, including tax evasion and campaign finance violation brought by the u.s. attorney in the southern district of new york and pleading guilty in a special case by special counsel robert mueller to lying to congress. the campaign finance violation charges stem from hush money payments cohen allegedly arranged to be made to stormy daniels and karen mcdouga mcdoua claimed to have affairs with president trump. president trump has denied the affairs. prosecutors say he tried to influence the 2016 campaign and asked for substantial prison time. president trump tried to paint a negative picture of cohen after pleading guilty and cooperating with prosecutors. >> he's a weak person and not a very smart person. dan abrams says president trump should be concerned. >> they are saying that it was done to subvert the campaign finance laws. it was done to impact the election, and it was done in coordination with and at the direction of donald trump. >> reporter: but in a new interview with reuters, president trump insists he's not

worried saying, quote, it wasn't a campaign contribution. if it were, it's only civil, and even if it's only civil, there was no violation based on what we did, presidenp waslso ask in that interview if he'st, but he says he's not saying he believes there would be a revolt in f that happened, but at least one top democrat says that president trump's alleged involvement in the two payments to women during the campaign are grounds for impeachment. linda lopez, abc news, new york. >> all right. our other big story, you can see blue skies now, the fog is gone for now, but rain is once again on the horizon. mike. >> we'll start turning our focus towards the weekend because that's when it all begins. storm impact scale is one up to a light rain. some areas like the east bay valley and the south bay may not receive any measurable rain. here's a time line as we watch light grown and then the moderate to yellows andon, move into the north bay. mendecino county during the lunch hour. notice the yellows kind of go

deadly hit and run. it happened around 3:30 this morning near bush and leavenworth streets. that's in the knob hill neighborhood. officials say the victim, a wok, was hit by a dark-colored vehicle. we don't know if she was crosswalk. she was rushed to a nearby hospital where she later died. if you have any information that could help san francisco police, please call them. we're following developing news in mountianview where dozens of people will have to relocate from their homes. after midnight the city council voted to demolish 20 rent-controlled apartments and build 15 new town homes or to allow the building of 15 new town homes by a developer. the new apartments will sell for $1.3 million each. mountianview's mayor was against the plan, but he was in the minority. >> what we found even in those situations is that it's hard for people who have bn in naraffordable units, units that are rent-control, it's really hard for them to stay in our community unless

they are living in a vehicle. >> 75 people, including 30 children, now have one year to move out. they will get about $26,000 in relocation assistance in addition to a 12-month rental subsidy. texting may soon be taxing. the california public utilities commission is set to vote next month on a proposal to add on a surcharge for text messages. abc 7 news is live in san jose with details. amanda? >> reporter: kristen, so many of us have our heads buried in our cell phones, and if we're not communicating through social media, then we're sending text messages. this is just one reason that proposed text tax could really take its toll. if you've ever reviewed your cell phone bill, recognizing exactly what you're being charged for can be a challenge. >> when hard working criminals are already feeling taxed and feed to death, that not every idea needs a new tax to fund it, and here's a great example.

the cpuc is sitting on $is billion for this purpose. >> reporter: carl guardno with the silicon valley leadership group is referring to the public purpose program. the federal government and states put the program in place charge customers a fee for telephone service that. money helps fund programs for the poor. this new proposal would extend the existing tax to include text messages. >> i don't actually use my text messaging a lot unless i'm texting someone with an android or something like that. not often am i using my known for text messaging. >> reporter: the way it's written this wouldn't be a tax for services like apple imessages or facebook messenger, but for text messages on your cell phone. >> this is the grinch that is stealing christmas by stealig the texts for taxes on your phones. we can do better than this. >> reporter: in a statement to abc 7 news, the cpuc says some wireless carriers assess surcharges for texting. other carriers don't. in proceeding seeks to clarify

the rules on whether texting ref news are surchargeable or not. the cpuc says the money needs to come from somewhere. if it doesn't come in the form of a text tax, you may see higher charges elsewhere. the fcc is expected to meet today on the issue. the puc tells me that the proposal will go to vote january 10th. >> amanda, thank you. a group of retired judges is calling on immigration officers to stop making arrests at courthouses of people suspected of being in the country illegally. some 70 former judges from 23 states say immigrants should be able to be free to visit halls of justice without fearing they will be detained. they made their appeal in a letter to the acting director of i.c.e. telling him that the arrests disrupt the criminal justice system. i.c.e. defends the practice saying courthouse arrest are the safer because most have metal detectors that keep weapons out.

former santa clara county superior court justice or judge aaron perksy is asking supporters to help him pay for $135,000 of debt. our media partner, "the mercury news," reports perksy sent an e-mail to his supporters asking him to donate to his failed campaign by december 31st. he's under court order to cover the legal bills of the critics who headed the campaign to recall perksy. following the controversial sentence he handed down to a former stanfor swimmer in a sexual assault case. perksy became the first california judge to be recalled in nearly a century in the june election. the 21-year-old women caught on video trashing a san francisco restaurant during santacon turned themselves in. natalie alcantar and hanna bowman were booked for felony battery. they turned themselves in after seeing footage on tv. the massive manhunt under way to catch a suspected

all-out effort to find the gunman. >> reporter: i'm standing this morning in the middle of one of the areas where the shootings took place. the first shots apparently rang out about 120 yards in that direction. more shots were fired about 120 yards down there. let me just paint the picture for you a little bit this morning. you can see there's two truckloads there of heavily armed french they stopped and searched bags. this is part of the christmas market on the side there. it's not the main square but because strasbourg is famous for christmas, calls itself the home of business. this area would have been busy with locals and tourists enjig themselves when the attack happened. we're learning that french police had raided the home of the suspected gunman before the attack was carried out. this was part of a separate homicide investigation. we're also being told the suspect had been to prison many times and was radicalized there. still, no official word on a motive for the attack, but we

are told the man shouted allahu akbar which means god is great before the attack began. meanwhile the search conditions. a vote for secret ballot is coming in the next hour that could out of british prime minister theresa may from power. members of parliament who belong to may's conservative party are taking the no confidence vote today. some of her allies are upset about brexit negotiations. they accuse her of giving in too much to the european union. if may lose the confidence vote, her party would choose a new leader. if she's wins, but by a close vote. that means may could decide to resign her leadership anyway, so we'll see. now we're learning new details about a high schoolteacher who forcibly cut her student's hair. the teacher was arrested after this video surfaced. according to the police report she told police she intended to give another student a haircut because he had been acting, quote, like a ding dong.

the atmosphere. so it will be a little hazy once again and milder, and we'll see a little bit of fog return tonight. same areas. just about the same density also. i don't think we'll as much in the way of mist and drizzle and a better chance of rain monday through friday. temperatures anywhere from 2:00 cooler in brentwood and the rest us are warmer. where does that put us as we head towards the lunch hour, mainly mid to upper 30s. owl quickly catch up with the rest us in los gatos. upper 50s and low 60s. 58 to 62 degrees. here's the what i it breaks down. temperatures hanging how the in the low to mid-50s at noon, and then you can see we're flirting with 60 at 4:00 with all the sunshine. back down to around 50 at 8:00 and low to mid-50s at midnight. in fact the yo-yo of temperatures we've had or the roller coaster, if you will, it drops back down tonight. we'll be a little bit cooler in our valleys. 30s there and 39 redwood city while the rest of the bay is in the low to mid-40s. except for san francisco. you'll be in the upper 40s.
