what is hopefully improving the place we all call home. >> new rules could impact the time and cost of your commute. let's take a live look outside our emeryville camera at drivers heading along i-80. boy, it is a tough commute, especially going eastbound. >> the stretch of freeway has diamond lanes for carpools, buses, motorcycles and specific clean-air vehicles to help them avoid traffic. >> you know there are lanes like this all over the bay area and we put them on the map for you to see. the bay area also has express lanes highlighted in pink where drivers can pay to ride in a lane with less traffic. >> in two weeks cars that currently qualify for diamond and express lanes would be out of luck. that's because the excessing white and green decals that indicate qualifying clean air vehicles will expire. only red decals will be sufficient. "abc 7 news" reporter david louie explains what that difference means. >> reporter: yeah, an estimated 215,000 vehicles will be forced back into regular traffic lanes

in two weeks because they don't have red stickers like this one. hov or diamond lanes have become jammed as more drivers switch to clean air vehicles, so the state decided only 2017 and newer models qualify. justin saddlemyer laments he is losing access because he drives an older tesla. >> i have one of the earlier ones, no self-driving or cool features but it is still electric and good for the ecology and great on money and gas savings, but it is too old. it won't qualify anymore. >> reporter: while green and white stickers are out, another color will join red stickers. beginning next month the dmv will issue a brand-new light purple decal valid for five years through january 1, 2023. >> the change is stimulating last-minute sales of electric and hybrid vehicles at the chevrolet dealer in san jose. >> as long as they have the sticker, that's all they care about. >> reporter: most in demand are last year's models that qualify for the red sticker.

>> i think i had two or three of them. as soon as they hit our lot they're gone. >> reporter: we discovered replicas of the red decal are selling online labeled for off-road use only. a couple of drivers told "abc 7 news" they didn't bother to apply for the red sticker because they qualify because their lease is up soon so they will join regular traffic lanes soon. for anyone wondering whether there might be a grace period after the first of the year, the dmv says no. they will be enforcing the new sticker law. in san jose, david louie, "abc 7 news." now, here is a live look at three bay area bridges, the richmond bridge, the bay bridge and the san mateo bridge. starting on jan 1, tolls will go up by $1. a lawsuit has been filed to stop the increases, claiming the voter-approved toll hike should have needed two-thirds majority to pass, not a simple majority. the measure received 55% approval. the higher tolls still will be collected, so you have to pay, but the extra money will be held

in escrow until the lawsuit is resolved. the golden gate bridge is the only local bridge exempt from the toll hike. in just a few days there will be a new doctor boats at the san francisco ferry building. starting thursday, boats for oakland and alameda will board on the far east side of the building at the new gate g. docking locations for vallejo and harbor bay ferries will not change. in about three weeks, new ferry service will debut between richmond and san francisco. it starts on january 10th. now, starting january 1st, two transit agencies are raising prices. ac transit will increase the cross of trans bay bus rides, in the south bay vta will raise fares for adult, express and youth riders. you can find out if your commute changes next year. we checked with a dozen bay area transit agencies and put the list on our website. go to abc7news.com when you have a moment. what would help your commute? if you have an idea about building a better bay area,

"abc 7 news" reporter melanie woodrow joins us live. melanie, what happened in court? >> reporter: well, that sentencing was continued until january 8th. that's when we expect to hear from a couple of informants in this case. the courtroom was filled today with his friends and family, and much of the day we heard from a forensic psychiatrist who testified that he was exaggerating and joking in online chat rooms, that he was all talk but no action. he is known as the terrorist in jail according to his attorneys.

in july, he pled guilty to attempting to provide material support to a designated foreign terrorist organization and to identity theft charges. on day one of his sentencing hearing, his attorneys questioned a forensic psychiatrist who testified that he wasn't a terrorist but a troll who in online chat rooms was vulgar, often trolling women, and that his talk about bombs and detonators was filled with sexual innuendo and laughing emoji. the judge said if it was all a joke, why commit to the next step. he met with an undercover agent, but the forensic psychiatrist testified that he drew the line at pledging allegiance to a terrorist organization. during cross-examination of the forensic psychiatrist, prosecutors played audio from his meeting with the undercover agent. in it, he talked about bombing night clubs, including city nights in san francisco, saying, quote, they're all so crowded it doesn't matter which one we hit. you also named potential targets like at&t park, the japanese tea

garden and telegraph avenue next to uc berkley and suggested setting up a fake modelling agency to draw in and kill women. in an e-mailed statement, his family writes, quote, amer is not a terrorist or a violent person, although he said many terrible things on the internet and to the undercover agent. amer did not commit a violent act. he opened a small number of social media accounts for isis sympathizers. he knows now that this is wrong and is story to have spoken as he did and to have caused so much trouble. judge breyer said in his 21 years this will be the, quote, most dramatic sentence in terms of what was done, what was said and what the sentence could be. in san francisco, melanie woodrow, "abc 7 news". >> okay, melanie. thanks very much. moving on now, big waves are crashing on to bay area beaches. a dangerous high-surf warning remains in effect for the coastline. it is prompting a rare public alert to stay off the beach and stay away from the water.

urging people to stay off the beach where the water was getting close to the sea wall. the national weather service cut to the chase with its warning, tweeting, don't make the beach your grave. >> our rescue swimmers may not be able to go into the water for safety reasons. if we deem it is too unsafe to enter the water. >> reporter: many took their chances anyway. >> it is beautiful, yeah. and i'm not afraid of it. i do have my back to the waves right now, and they did tell you never put your back to the waves, but i'm brave. i'm doing it today. >> reporter: you better turn around. >> i'm all right. >> reporter: we asked the national park service why not close the beach. it responded saying, closing the beach would be a last resort. unfortunately, we don't have the resources to do that. he challenged the danger of the srf to take this selfie. >> reporter: they're asking people to stay off the beach. why did you want to come down? >> i think it is unreasonable, as long as you use your judgment, don't get in the water. >> reporter: we didn't see anybody in the water today but

we saw a few people make a run for it when the water suddenly rushed in. san francisco fire department responded to a surfer in distress this afternoon at china beach. the surfer was able to get out of the water but was understandably exhausted from the rough surf. live in san francisco, cornell barnard, "abc 7 news." >> not worth the risk obviously. let's bring in weather anchor spencer christian to talk about the high-surf warning still in effect. obviously you don't want to get in the water. if you stand on the beach you're probably okay. >> that's probably true, but the warning remains in effect until 9:00 tonight. you can see the wave heights are significantly elevated, 17 to 24 feet right now along bay area beach with breakers reaching a height of 40 feet. even over the next days as it reduces height gradually, we will see wave heights of 15 to 20 feet maybe, but towards the end of the week wave heights will be in the normal range for the bay area which is generally under ten feet high. dan and kristen.

>> thank you. high surf warning? what high-surf warning. in half moon bay, they waited for monster waves to ride. look at the boards waiting to catch the water there. because organizers decided not to hold the contest this week, it doesn't mean people won't head out to try to catch on wave or two as that guy did. the waves reached 30 feet or higher. some were too big to even try to ride. a few of them reached 60 feet. "abc 7 news" caught up with a teen celebrating his 17th birthday by being surfing at mavericks. >> i can describe it as surfing mavericks as your worst nightmare and a dream come true at the same time. it is awesome. >> organizers have three months to hold the competition. they say january is usually the best month nor the event. >> we have streamed sky 7 live ths afternoon as it flew above the big waves coming in at mavericks and sent out a push alert through the abc 7 app. all you had to do was tap the

we were there last month when the victim was loaded into an ambulance. he was working at a building in downtown san francisco when he was beaten. abc 7 reporter jobina fortson was in court when the suspect appeared and joins us live in the newsroom. >> the suspect's name is jesse bierra. you can tell he is not just a local skater. he is sponsored with a loyal following and is held in jail without bond. it was silent as the judge told this courtroom 24-year-old skateboarder jesse vierra would not get bail monday morning. >> it made me feel good because nothing will change what they did, but i don't want it to happen to somebody else. >> reporter: suzanne au andrews brother dan janson is in the hospital not speaking or recognizing loved ones. according to family, part of his brain and skull was removed after the long-time security guard was attacked by skateboarders outside the old bank of america building in late november. jansen is a guard for the

>> thank you. new details emerging about how much it will cost to fix the damaged caused when a ferry rammed into its dock in san francisco. the u.s. coast guard says this mishap, which happened on black friday, cost $325,000 in damage to both the golden gate ferry and the dock. two passengers were hurt. investigators say the ferry's crew tested negative for drugs and alcohol. they're still working to find out what exactly went wrong. crews fixed the dock last month. the ferry is being repaired in alameda. the largest muslim civil liberties organization in the country is pushing back tonight against president trump's travel ban. the group says the policy is keeping a mother in egypt from seeing her dying two-year-old son in oakland, here in the bay area. who put out a statement late today, saying they support the family's efforts to bring the mother here to say a final goodbye. in the meantime, doctors and nurses are doing what they can to keep this boy comfortable. >> my wife is calling me everyday, wanting to kiss and hold her son. >> reporter: ali hassan knows there's little time left for his young son who turned two years old two days ago while on life support at benioff hospital. all he wants now is for his wife to be able to say goodbye to their son. >> time is running out. please help us get my family together again. >> reporter: ali hassan is originally from stockton but returned from egypt to the bay area in august to seek medical care for his son. ali and abdullah are both naturalized u.s. citizens, along with ali's father, fasi hassan. >> mr. president, you are a father, you are having a family. imagine if you are separated from your children or from your wife, how do you feel.

>> reporter: the boy's mother is a yemeni national currently living in egypt. so far because of president trump's muslim travel ban the u.s. state department has not granted her a waiver. >> when abdullah left his mother's arms a few months ago, she never thought to give him a final farewell. she deserves to be with her dying son in his final moments. >> reporter: a state department official would not comment on the specific case, but in a written statement told "abc 7 news", the department of state makes every effort to facilitate legitimate travel by international visitors. applicants who are ineligible to receive a visitor visa under u.s. immigration law may apply for humanitarian parole from the department of homeland security. while they wait, the family has been able to work with doctors at children's hospital to keep abdullah on life support for at least a little while longer. >> as a family, as any one family, we want to be together. also, i want her to see her son for the last time, just to tell

we are still living on nothing. >> reporter: after the meeting, all residents signed up for individual appointments. another step in a drawn-out, lingering uncertainty. >> i wish they would hurry up and just get this over with. >> reporter: in short, an ending for journey's end. in santa rosa, wayne freedman, "abc 7 news." pg&e is facing another lawsuit over the deadly camp fire. dozens of families are accusing the utility of failing to properly maintain its power lines and equipment. the lawsuit cites the letter pg&e sent to california public utilities commission last week where it noted damage to one of its towers near where the wildfire started. pg&e has not commented on this latest suit. the contra costa county sheriff's office flew a drone in paradise and released this video showing it going into burned-out building to see what is left behind. watch now. you just slip right inside. the camp fire that burned through butte county destroyed

more than 18,000 buildings. most of them were people's homes. the fire also led to 86 deaths. butte county has created a before and after view of some parts of the town of paradise. you can see neighborhood that were filled with green trees before and now are mostly burned-out shells of homes. jut a tragic depiction of exactly how serious this damage was. you can get a closer look at this online. we have posted a link on our website, abc7news.com. there's confusion over health care right now. on friday, a federal judge in texas struck down the affordable care act, ruling it unconstitutional with the individual mandate part taken out. this move jeopardizes the health care of 20 million americans. the government is scrambling to explain what the ruling means. abc news reporter kenneth moton helps sort it out. >> reporter: an attempt by the federal government to reassure millions of americans that for their health care nothing will change for now. a texas judge ruled obamacare was unconstitutional friday,

striking down the individual mandate. monday in a statement, the department of health and human services said the judgment is not final, so it will continue administering and enforcing all aspects of the aca. >> if the republicans and the democrats get together, we are going to end up with incredible health care. >> reporter: the president attacked obamacare deductibles saying, quote, a confirming supreme court decision will lead to great health care results for americans. a group of democratic state attorneys general plan to appeal the lower court's ruling, which could take months. ultimately, the case is expected to land at the high court within the next couple of years. hhs says the trump administration stands ready to work with congress on policy solutions, including prospecting people with preexisting conditions. >> you have to look at the history of this president. for two years he has done everything in his power to put an end to the protections included. >> reporter: after more than 60 attempts to get rid of or undermine obamacare, last year the gop-led congress eliminated the individual mandate after

the national retail federation says americans will spend just shy of $30 billion on gift cards this holiday season. it is up a couple of billion from last year. >> is that all? that's not the only change. the types of cards we're buying is changing as well. "7 on your side's" michael finney is looking into that for us. interesting trend here, michael. >> are you guys buying gift cards? >> yes, i do every year. >> i have to tell you, almost all of us have. we keep reporting millennials are more interested in experiences than they are in consumer goods. well, that's showing up in gift card sales. holiday shoppers were out in force at shopping malls and on their computers, too. the big items being gifted this year, as in the recent past, gift cards. a recent study shows shoppers plan to purchase an average of four gift cards this holiday
