with police. police were just called out to 24th and brian street in the mission district just after 11:00 last night. the suspect refused to come out. and the crisis hostage team was brought in. after several hours of negotiations the suspect eventually came out. he was brought into custody 3:30 this morning. so an hour and a half ago. more breaking news we are tracking in san francisco. one person is dead after an overnight fire in presidio heights. an active scene between cherry and maple streets. amy hollyfield is there now. amy. >> reporter: hi. good morning. we have learned that this was an older couple who lived here. firefighters say they were trapped up on the third floor, that it was just a huge fire. they happened been asleep in their bedroom. it had been burning for a while. they just couldn't get out. the call came just before 1:00 this morning on clay street between cherry and maple. firefighters say it was so big

that when it started heading in, the fire became quite a threat. one firefighter was hurt. >> once they got in, the fire rolled over them and actually knocked one of them over the porch area there. so that's where the one firefighter got burned. he also got transported, but he should be okay. >> reporter: the firefighter is okay. he has been released from the hospital. this fire is now out. firefighters are still here. they are hauling out large burned items so they don't spark another fire. i did ask if the christmas tree could be to blame for this fire. fifighters said this is still under investigation. but there was a christmas tree in the home. but the man who lived here was killed. the woman is in the hospital in critical condition. reporting live in san francisco, amy hollyfield, abc 7 news. okay.

amy, thank you. developing news on the partial government shutdown. the white house budget director now says it is possible the shutdown could last into the new year. president trump says he won't sign a bill that does not include funding for a border wall. the partial government shutdown means that there are a few closures in the bay area. san francisco's municipal pier, as well as the hyde street pier are off-limits. you can still get to alcatraz during the day, but nighttime tours are canceled. muir woods is still open thanks to funding from a separate source. the defense department officially signed the executive order to withdraw troops from syria. james mattis signed the order sunday. the order lays out the logistics of the withdrawal which involves removing roughly 2,000 troops. president trump announced the decision on wednesday. a day later mattis announced his resignation, citing policy

differences. it could begin within the next few weeks. the california highway patrol is out in full force for the holidays. the agency is in a maximum patrol period. they will pay special attention to drunk drives since alcohol plays such a large part of holiday events. last year they made 917 arrests for driving under the influence of alcohol and drugs. we are less than 24 hours away from christmas. not a lot of time left for people who still have the buy gifts. abc 7 news was at the store last night. the retail ser trying to attract last-minute shoppers with doors open through 6:00 p.m. tonight. over at union square, larger crowds fill the streets. >> we did nordstrom, nike, champs,er ban outfitters. champs,er ban outfitters. we're going to do

robin williams tunnel. i'll update that when we come back. now to breaking news. a deadly fire overnight at a house in san francisco in the presidio heights neighborhood. >> there is still an active scene on clay street between cherry and maple streets. amy hollyfield is there now. a amy. >> reporter: we have turned our cameras from the home right now because the coroner is here to retrieve the body of a man who was killed. we have turned the camera around for now. firefighters have wrapped up their work here. they were busy hauling out debris, items that have been burned to make sure another fire didn't start. they have wrapped up that work. two people were trapped in this fire. an elderly couple. the man was killed. the woman is in critical condition. >> the only thing i can surmise

from just what we saw when we got here is they were in bed. this had been going for some time. with the center court stairwell, if it gets that hot and smoky, the best thing you can do is shut your door. but that means you're not going to exit through your normal means of egress. so the windows would have been the only way for them to escape. that was just not possible this time. >> reporter: their bedroom is on the third floor. well, the call came in before 1:00 this morning to come to this home on clay street between cherry and maple. one firefighter was hurt. 6th suffered burns on his neck. he was treated and released from the hospital. the investigation is under way as to what caused this fire. i asked if possible the christmas tree could be to blame. they said the couple did have one. but this is all still under investigation. reporting live in san francisco, amy hollyfield, abc 7 news. thank you, amy. more breaking news out of san francisco this morning. police are investigating a homicide in the bay view.

police came out to evans and mendell for reports of gunshots. they found a crashed car and a driver inside with a gunshot wound. he was pronounced dead at the scene. no suspect is in custody. developing news out of indonesia. thousands of emergency workers are searching for survivors after a deadly tsunami. >> it hit saturday night after a volcanic eruption. within the last hour we have learned that 373 people have been killed. that is up from our earlier report of 281. nearly 1,500 people were hurt as well. 128 people are still missing. 600 homes and hotels were ripped from their foundations. soldiers right now are searching for any survivors that are trapped under that wreckage. the partial government shutdown could drag on into the new year. president trump wants at least $5 billion for a border wall. democrats are offering a lot less. and just for border security,

not for a wall. abc news reporter steph knee ramos has the latest developments from new york. >> reporter: president trump is skipping his 16-day florida vacation to stay in washington as the senate compromises on legislation to fund the government into the new year. so far no deal. on this christmas eve, a partial government shutdown is still in place after funding ebg paoeued 25 percent of the federal government at midnight saturday. and there is no end in sight. the president tweeting overnight, the most important ways to stop gangs, drugs, human trafficking and massive crime is the southern border. the white house backing down from its original demand of $5 billion for the president's border wall and possibly willing to accept a lower amount. but chuck schumer lowering his original offer of $1.6 billion to $1.3 billion.
