former "laverne & shirley" star died of heart failure and complications from diabetes. >> the document also says marshall was cremated last week. she passed away on december 17th at the age of 75. a massachusetts judge says actor kevin spacey must appear in a nantucket courtroom next week on charges that he groped a young man in a bar two years ago. the judge rejected spacey's argument that he should be allowed to skip the arraignment because his presence would amplify negative publicity and risk contaminating the jury pool. spacey plans to plead not guilty. turning now to that urgent manhunt for a gunman who shot and killed a 7-year-old girl. she was in her family's car and this happened in houston, texas. >> police say the shooter opened fire from his own vehicle, and now we're hearing from that girl's mother. here is abc's marci gonzalez. >> reporter: police near houston searching for the driver of the truck seen in this surveillance photo. they say opened fire into a family's car, killing this 7-year-old girl. >> he took away an innocent child.

she did not deserve this at all. >> reporter: laporsha washington says she was driving to a grocery store with her four daughters sunday morning when out of nowhere that truck pulled up next to them. >> i heard shots start firing, and they came through my window, broke my glass, hit me in my arm. and the truck slowed down and continued to fire as he was in front of us. >> reporter: her children horrified, realizing a bullet hit their sister, jazmine barnes. >> she say mama, jazmine's not moving, she is not talking. i turned around, and my 7-year-old was shot in the head. >> reporter: investigators now looking for this red or maroon four-door pickup and the driver they describe as white, in his 40s with a beard. they say he was wearing a red hoodie. >> we want to seek justice for jazmine, and bring this killer to justice and get him off the street. >> reporter: jazmine's mother said they had no interaction with the driver before the shooting. the motive still under investigation.

good morning. i'm janai norman. >> and i'm marcus moore. here are some of the top headlines we're following this morning on "world news now." along with cold rain in new york times square, it did not dampen too many spirits as 2019 got under way across the u.s. we have some highlights from other celebrations coming up as we say happy new year. >> happy new year. an american citizen is under arrest in moscow, accused of spying. russian officials say paul whelan was detained during an act of espionage, but offered no further details. it comes just weeks after russian agent maria butina pleaded guilty to conspiracy here in the u.s. new year's day means college football bowl games kicks off at

flying, as the clock hit midnight. >> we have to keep something in mind here. many people in that massive crowd stood there for hours. >> brave. >> and it was raining, sometimes very hard all through last night. but some good news here for you. police did not report any major problems. >> another big crowd was on hand in the french quarter of new orleans. the confetti raining down on them as well. a lot of those people getting ready for tonight's sugar bowl between texas and georgia. and on the other side of the pond in london, just after 10:00 struck midnight, big ben there letting everybody know the new year had started. fireworks got started around the london eye right beside the river thames. about 100,000 people were treated to europe's largest annual fireworks display. >> you have no idea how much i love when people say across the pond. people across the country and across the pond celebrated the new year with a bitter blast of winter. today it is drying out in the northeast, but gusty winds are moving in the southeast. we'll see some severe storms and possible flooding. in alabama, dozens of

families were forced to evacuate their homes after flooding caused a road to collapse near tuscaloosa. heavy rain caused flooding across central tennessee as well. this tree fell on to a house there, and then drivers in carlsbad, california, they got a view of this funnel cloud there. yeah, that will get your attention. let's get over to paul williams for the day's forecast. good morning, paul. >> good morning, marcus, janai. it's the widespread cold, and old man winter really just thumping the entire midwest and down into albuquerque as well. slick roads, travel disruptions, blowing and drifting snow. we're looking at 6 inches to 12 inches going into wednesday just as an example. for the southeast, wet weather throughout the carolinas and the southeast right down towards new orleans. and for the northeast, colder behind it along the great lakes region. marcus, janai? >> all right, paul, thank you. president trump sent out a

new year's wishes, a video. this was a message and included a pitch for his border wall. earlier, he called on democrats to come back to washington to strike a deal on the government shutdown. but the democrats, they're poised to introduce their own solution. abc's kenneth moton has the details. >> reporter: both the senate and the house were briefly in session on the last day of 2018. most of congress is still out of town. no deal in sight to end the partial government shutdown. president trump on fox business -- >> a lot of people are looking to get their paycheck. and so i'm ready to go any time they want. >> reporter: once democrats take control thursday, they'll move to approve two bills, one that will fund all agencies except homeland security. democratic leaders said in a statement, quote, the president is using the government shutdown to try and force an expensive and ineffective wall upon the american people, but democrats have offered two bills which separate the arguments over the wall from the government

shutdown. >> no, we are not giving up. we have to have border security, and a wall is a big part of border security, the biggest part. >> reporter: from twitter to phone calls, sources say the president has been working to reassure political allies and conservative pundits he is not backing down. gop ally lindsey graham says he and trump discussed making deals. >> i know there are some democrats out there who would be willing to provide money for wall border security if we could deal with the daca population. >> reporter: for now the stalemate continues. >> the president has to move. interestingly, when you look back at past presidents who have lost badly in midterms, all of them understood that their base wasn't enough, and they decided to go towards consensus and go towards compromise. >> reporter: the union representing more than 400,000 federal workers is now suing the federal government. the lawsuit alleges the government is violating the law by forcing the employees to work without pay. marcus, janai? >> the battle wages on there in washington. our thanks to kenneth. james mattis is now the former defense secretary. deputy secretary patrick shanahan became acting secretary at midnight.

on mattis' last day, he sent pentagon employees a letter urging them to hold fast. he resigned after president trump announced the u.s. would leave syria. mattis planned to stay through february, but the president tweeted he would be replaced on new year's day. investors can hope for a better 2019 following a dismal stock market performance last year. the major wall street averages wrapped up 2018 by eking out small gains yesterday, but for the year, the dow, nasdaq and the s&p 500 all lost ground. the worst year for stocks since 2008 during the financial crisis. analysts say investors can expect more market volatility ahead. a week after the second reported death of a migrant child in u.s. custody, new video is raising more questions about how those children are treated. images appear to show staffers abusing kids at a now-closed shelter in arizona. here is abc's david kerley. >> reporter: this case, including a male staffer dragging a migrant boy into a room, slapping him and pushing

the boy against the wall, is referred to prosecutors for possible criminal charges. these videos of children dragged and put into a room also part of the maricopa county, arizona, case. >> they're just concerned about lodging these kids and getting the per diem payment by the government. >> reporter: back in september when these incidents happened, arizona moved to revoke all 13 licenses of the operator southwest key, but only two licenses were taken, including the facility where these videos were recorded, hacienda del sol. it was shut down in october. in a statement, the company organized as a nonprofit said it wholeheartedly welcomed shutting down that facility, adding, it's doing a top to bottom review of its arizona shelters. while the sheriff's office investigated this case back in september, including interviewing the child victims, it is just now referring the case to prosecutors for possible criminal charges. david kerley, abc news, washington. the organizers of sydney, australia's, new year's celebration had one job, to hand

get away after not paying for a $35 manicure. when the worker confronted her in the parking lot, police say she ran over that manicurist with a stolen car and took off. and now to the new development in the murder of a young mother from colorado. >> kelsey berreth has been missing since thanksgiving. her fiance was arraigned yesterday, but now he is facing new charges. here is abc's clayton sandell. >> reporter: patrick frazee facing two charges of first-degree murder, and in a new twist, a second count alleging frazee killed his fiance, 29-year-old kelsey berreth during a robbery. >> in the case as set out in the charge is that when you rob somebody and they die during the robbery, that is also first-degree murder. >> reporter: berreth vanished on thanksgiving, last seen shopping with the couple's 14-month-old daughter kaylee. frazee was arrested ten days ago. >> you see him? he's in cuffs. >> reporter: now facing

but the experts at border patrol prefer a wall that is see-through. democrats are still puzzled over what type of funding package the president will accept. senate minority leader chuck schumer's office telling abc news one official says the white house is open to compromise. another says they want $5 billion for the wall. the president's allies say no matter what form the wall takes, the real issue is tougher border policy. >> the wall has become a metaphor for border security. and what we're talking about is a physical barrier where it makes sense. in the past, every democrat has voted for these physical barriers. it can't just be about because trump wants it, we no longer agree with it. >> how democrats filed two bills to reopen the government but they don't include funding for a border. and senate majority leader mitch mcconnell said he will not hold a vote on a bill the president won't sign. tara palmeri, abc news, the white house. and federal workers are now suing the government over the shutdown saying it's not fair to be forced to work without pay.

more than 400,000 employees are affected, and they're considered essential and are required to report to work. the suit was filed by one of the largest unions representing federal workers. north korean leader kim jong-un used his new year's message to look forward to another summit with president trump. during his annual televised address, kim said he is ready to meet with trump at any time. he also warned the u.s. not to test north korea's patience with sanctions and pressure tactics. kim used his new year's message last year to signal he was ready to commit to pursuing peace on the korean peninsula. massachusetts senator elizabeth warren has taken a big step towards a white house run. the democrat whose focus has been on onomic inequality has announced a formal exploratory committee, and that allows her to begin raising campaign funds. warren plans to announce a formal campaign plan early this year. she is expected to be among at least a dozen democratic hopefuls. as 2018 has wrapped up, college football bowl season wraps up with a flourish. a total of 11 games yesterday and today.

former "laverne & shirley" star died of heart failure and complications from diabetes. >> the document also says marshall was cremated last week. she passed away on december 17th at the age of 75. a massachusetts judge says actor kevin spacey must appear in a nantucket courtroom next week on charges that he groped a young man in a bar two years ago. the judge rejected spacey's argument that he should be allowed to skip the arraignment because his presence would amplify negative publicity and risk contaminating the jury pool. spacey plans to plead not guilty. turning now to that urgent manhunt for a gunman who shot and killed a 7-year-old girl. she was in her family's car and this happened in houston, texas. >> police say the shooter opened fire from his own vehicle, and now we're hearing from that girl's mother. here is abc's marci gonzalez. >> reporter: police near houston searching for the driver of the truck seen in this surveillance photo. they say opened fire into a family's car, killing this 7-year-old girl. >> he took away an innocent child.

she did not deserve this at all. >> reporter: laporsha washington says she was driving to a grocery store with her four daughters sunday morning when out of nowhere that truck pulled up next to them. >> i heard shots start firing, and they came through my window, broke my glass, hit me in my arm. and the truck slowed down and continued to fire as he was in front of us. >> reporter: her children horrified, realizing a bullet hit their sister, jazmine barnes. >> she say mama, jazmine's not moving, she is not talking. i turned around, and my 7-year-old was shot in the head. >> reporter: investigators now looking for this red or maroon four-door pickup and the driver they describe as white, in his 40s with a beard. they say he was wearing a red hoodie. >> we want to seek justice for jazmine, and bring this killer to justice and get him off the street. >> reporter: jazmine's mother said they had no interaction with the driver before the shooting. the motive still under investigation.
