here you are, you're never more than seven minutes away. this will morning up in our hills, that's where the gusty winds are. right now at least mee that criteria. excuse me. 38, st. helena. everybody else around 20 to 15. you can see we're in the upper 30s around east bay hills. let me tell you what's going to happen today, your accuweather 12-hour. planner. 30s inland, 30s at the coast and sunshine and winds won't be quite as brisk as it was yesterday. let's get to the breaking news. cro crews are battling a house fire. amy hollyfield just got to the scene and she joins us with the latest. >> reporter: happy to report the fire is out. now firefighters are working on mopup. let's get to the video so we can show you what's left of the this hd on avenue msves outokay.

two people did have to be treated on the scene for smoke inhalation. they are doing okay. investigators at this point believe it started in a bedroom, but they don't know what started the fire. >> there's nothing left of the room. it's pretty much burned out. i can't identify any objects except the wire that remains from the mattress. that's why we have our investigator here trying to sift through everything and determine what the cause may have been. >> reporter: they're still looking for the fire's cause. they say they did bring in the red cross to help the three people who are living here get situated. as of now, all the firefig the okay. the actually have a flu bug

going through the fire department and they'll get them out of here as soon as they can. live in vallejo, amy holly field, abc7 news. we're following breaking news in san jose. matt keller just got to the scene of an apartment fire there. he is joining us live now. matt? >> reporter: firefighters on the scene. a lot of firefighters making sure this building is secure. the first report came in of smoke at 3:20. when firefighters arrived they found flames and escalated it to first alarm. because of how close it was to adjacent buildings, firefighters called tore a second alarm. firefighters say there were no injuries. the red cross has been called out. we're told two of their people will need their services. as for the investigation, a fire cause on the scene, en deterne yet.

my photographer looking here, there's evidence of fireworks on the ground. the fire captain says that's one of the things they're looking at as a possibility. they'll be here for a while. they have north fifth blocked on between julian and empire. matt keller, abc7 news. >> thank you. happening now, clean-up is . hundreds lined the embarcadero to get a good view of the midnight fireworks. many made the trek despite those chilly temperatures. families came prepared with blankets and one woman shared her new year's wish. >> i want more people to be finding happiness with each other and goodness in each other. if we do that, everybody is going to have a better year. >> san francisco hosted are more than 100 new year's eve events. the celebrations drew clouds in the south bay as well.

happy new year! >> reporter: it's 2019. not even pouring rain can dampen the festivities. ♪ glorious a chance to start again ♪ >> reporter: more than a million partiers packed into times square for the country's biggest new year's eve celebration. billions of people across the globe happily welcomed the fresh start with confetti, bonfires and fireworks. new zealand and australia were the first to kick off the new year. sydney exploding into pyrotechnic display at midnight. in north korea citizens of the reclusive country marked the occasion by joining hands and dancing. and a record-breaking display

good morning. i want to show you some surface winds because out around fairfield and headed to places like antioch, discovery bay, brentwood, could be breezy through the morning hours. these will relax as we head towards 8:00 and 9:00. we have 50 in excelsior and chrissy field. let's take a look at the rest of our neighborhood. it's freezing cold in palo alto. it's 32 degrees. 36 in union city. 42 in walnut creek. american canyon, 43. richmond, 46 right now. if you're out on the bay and want to do a little play on the water, do it after 9:00, especially if you're north of the bay bridge and east of the golden gate. that's where we have a small craft advisory for gusty breezes through 9:00. in the north bay, 30s and 40s at 10:00 and 50s throughout the afternoon hours but down to 41 by 8:00 in evening.

we're five hours and 13 minutes into the new year and i found a weekend trending weather. we'll talk more about that coming up in the accuweather forecast. here's jessica. a vigil will be held today in oakland to mark the tenth anniversary of oscar grant. it will be held at noon to 4:00 at the fruit veil b.a.r.t. station where a police officer shot the hayward man on new

year's day in 2009. the officer said he meant to use his taser to subdue grant, not the service revolver that killed him. heas cvicted of involuntary manslaughter and sentenced to two years in prison and released in 2011. one man is dead after a small boat capsized off the waters in sausalito. rescue crews reported to two dk theyulle the people out and they did not survive. neither was wearing a life jacket. fur clothing or accessories in san francisco is officially illegal today. san francisco is the largest city in the country to implement a fur ban. berkeley has a similar ban in place. san francisco's chamber of commerce says fur sales brought in about $40 million a year but that is not enough to have a major impact on the city's economy. retailers will have until next

january to sell all of their inventory. another new law means a change at pet stores and abc7 news anchor deon lynn explains. >> she's about six months old and absolutely adorable. has a great personality. loves to dance. >> reporter: many that petco takes in. come january 1st other pet stores will have to follow suit. california becomes the first state in the country to ban sales of rabbits, cats and dogs at pet stores unless they come from shelter or rescue. marigold came from the nonprofit. >> we were thrilled that our efforts paid off. >> reporter: the law is designed to cut down on deaccept ty sales practices. the spca estimates there are more than 10,000 puppy mills across the country. the law will ease the pressure on the shelters that simply

move yesterday. volunteers built many of them at a warehouse. then they move into position about 15 miles away. you can watch the 2019 rose parade on abc 7, live coverage starts at 8:00. heavy wind in the bay area downed trees and toppled some patio furniture in some spots. abc7 news has more from alameda. >> reporter: as the winds picked up, pg&e began responding to emergency calls regarding fallen trees. >> the fire department's out here. any time fire department calls, it's priority. we ran here first. >> reporter: in this case the call came from neighbors on judy street in castro valley. a fallen tree was now leaning on some wires. one of the city's most affected by these winds was fremont, which had a few trees and branches down. >> i was like, oh, my god, it's

so windy here. >> reporter: this tree blocked several lanes on liberty street. >> the entire community was filled with dried leaves and everything, twigs and everything. but didn't expect the entire tree to get uprooted. >> reporter: many city services staffingorrgcy or the holidays. maintenance services is at a minim minimum. >> just came down from antarctica or something. it's cold wind, freezing. >> reporter: in san francisco we found garbage bins toppled by the wind. it was the waters of the bay that really showed the intensity of the winds, keeping kite surfers away from the bay shore in brisbane. the only ones riding the waves were these ducks. in alameda, leanne abc7 news. >> the water was so choppy yesterday.

i don't think i've ever seen it that choppy. i can't even imagine being on a sailboat or any boat yesterday. >> it will be much better today. everybody put off yesterday what they wanted to do, do it today because the winds will relax after about 10:00 this morning. here we are, still blowing up to 30 along the embarcadero in san francisco. you can see all of the flags on the ferry building unfurled. that's how we're starting the day. it's not going to be as brisk but just as sunny as yesterday. with the lack of winds, that allows the colder air to sink down into our neighborhoods. look for more frost the next couple of nights. in the weekend, it's looking wetter than it did this time yesterday. let's talk about our highs today. this will happen between 1:30 and 2:30 and we're hanging out about 52 to 57 degrees. pretty close to average this time of year. tonight, though, look at all of these 30s. everybody's in the 30s, except for san francisco half moon bay.

29 in morgan hill. back up, we have santa rosa and ukiah at 29 and 28. it's definitely going to be chilly. let's jump ahead to saturday at noon. always dry. as we head into the evening hours, about a quarter to a third of an inch possible. this is possible. this is still a ways out. sunday, another quarter to half inch of rain possible. sunday night into that's when the strongest part of the storm will come in. if this system comes through as planned, it will be a real soaker. right now we'll keep it at a one, light on our storm impact scale for saturday, sunday and monday. up until then you can see tomorrow morning and thursday morning will be the coolest mornings. that's when we'll have to wait for frost. will have to keep the pets in. friday is one of our calmest

calls about someone posing as a driver with a broken down car. if a driver stops, the man tries to sell them gold jewelry. some drivers have been even chased if they refused. chp says it's happened in several counties including fresno. bay area food banks are hoping for donation this is year. the second harvest food bank in santa clara county is $5 million behind its fund-raising goals. the san francisco marin food bank is $2 million short. the alameda county food bank, $273,000 behind its gold and contank>>s h shortfall and we really need the community support more than ever to help us fill this fund-raising gap so we can continue to provide critical services to the people we serve all throughout our community.

thousands gathered to ring in the new year in san francisco and all over the bay area. this is video of the midnight fireworks along the water front. we're also tracking breaking news this morning. here's a live picture of two overnight fires. one in vallejo. the other in san jose. we have crews at both. we'll check in with matt keller and amy hollyfield in just a moment and get you an update on those fires. first, good morning to you. it's tuesday, january 1st. it's 2019. we've made it. >> hi. >> hi. happy new year. >> happy new year to you. you look festive. >> a little sparkle to start off the new year. >> i like that. i forgot mine. >> well, next year. there's always next year. >> i seem to work every new year's day. people were driving really well. almost too well this morning. >> that's because no one's up. there's only like five cars on the road. >> when i was up there were a lot.

i was glad to see everyone driving so carefully. i appreciate that. so does my family. here's a look at what's going on as far as our weather. until 10:00 we have the high wind advisory for areas above 1,000 feet. already have trees and with the winds starting to taper off, hopefully there's no more damage from that. you can see our winds from 16 to 36 miles per hour. still pretty noisy above 1,000 feet. we're gusting to nearly 30 in tam. this is how i think the first day of 2019 will unfold. look at the mid-30s to mid-40s. 50 to 54 with sunshine. you'll notice the breezes relaxing around noon. some high clouds and stars and dress for the 40s if you're heading out this evening. that's a look at the accuweather planner. let's get to jessica for the news. breaking news in vallejo. crews are battling a house fire. abc7 news reporter amy hollyfield just spoke with firefighters at the sxaen she joins us with the latest.

amy? >> reporter: hi, jessica. they did get the fire out but they did get the fire out but fire bedroom ofme they got the call around 3:00 this morning. firefighters say when they got here, they checked for people >> residents were notified by a smoke detector. they found smoke in the home and exited the structure. there were two residents at home who were able to exit before the firefighters' arrival. there were three occupants that lived in the home and now displaced. >> reporter: the two people who were home were treated on the scene for smoke inhalation. they have been released from care. they're doing okay. all of the firefighters are okay. they say they got the fire out in about 20 minutes. investigators are on the scene now looking for a cause.

reporting live in vallejo, amy hollyfield, abc7 news. >> thank you. to a very similar scene in san jose. more breaking news we're following. abc7 news reporter matt keller is at a fire at an apartment. he's joining us live. matt? >> reporter: good morning, jessica. still a very active scene. you can see firefighters are working on the building here, making sure there's going to be no flareups. they're attacking into the wood there to make sure there's no fire burning inside. they did have knockdown on this at about 4:20. first call came in as report of smoke at 3:20 at this two-story victori victorian. when firefighters arrived, they discovered the flames and quickly escalated to a full first alarm. because of the number of people inside, the type of building and how close it was to adjacent building, firefighters called for a second alarm. firefighters found that heavy fire on the second floor.

they had knockdown in about 20 minutes. the flames spread to the attic. six to eight people are displaced. the red cross is here. we're told two of the people here will need their services. a fire captain says no cause has been determined yet. as my photographer pans down here, arson investigators will be coming out to the scene. you can see on the ground evidence of fireworks. the fire captain says that's one of the things they'll be looking at as a possibility. reporting live in san jose, matt keller, abc7 news. >> thank you. clean-up is aunder way in san francisco after a long night of new year's celebrations. hundreds lined the embarcadero to get a good look at the fireworks. many made the trek despite the chilly temperatures. in the east bay a wide range of ways to ring in 2019. abc7 news reporter was on board

the "uss hornet" in alameda where they celebrated by going decades back in time. ♪ >> reporter: flashback to the 1930s before ringing in 2019. >> the '30s were a great era and i love the whole theme. i love dressing up like this, too. it's great. >> reporter: this gala aboard the "uss hornet" brought out hundreds for dancing and music. a fund-raiser for the museum's education department. >> we've been having a lot of fun dancing. we just went up to the fly deck, which is really cool. we hung out up there. >> reporter: at the oakland buddist church, it was a more somber tradition. dozens of gathered for a ceremony to ring the temple's bell. in some buddhist traditions it's believed to release buddhists of passions, including greed and passion. >> it resonates internally with

people, in general people who are here, but with all beings. >> reporter: in berkeley the night started off earlier. this time for families and kids. at the bay area children's theater in berkeley, it was a night of food, music and games that's become an annual tradition for some families. >> it's a great kid-friendly way for you to get out and celebrate the new year with your kids. i think there's not a lot of places to do that. this is definitely one of those places. >> reporter: abc7 news. four, three, two, >> the crowd in new york city erupted in cheers. people packed into times square to ring in the new year, the biggest party in the celebration. after the celebration clean-up crews and trucks were brought in to sweep away trash this morning. a lot of work to do. if you missed the fireworks last

their decorations down. sunny and cool. for the bay, it will be breezy this morning. south bay, 30s at 8:00. 40s at 10:00. by 6:00 we're back in the 40s. how about the peninsula. 40s through 10:00. low 50s from noon to 4:00. back in the mid-40s by 8:00. you need a coat there. san francisco we have 40s here through 10:00. low to mid-50s noon to 6:00 down to 49 degrees at 8:00. looks like the weekend could be a soaker. i'll show you the big changes coming up. as the partial government shutdown stretches into the new year, democrats have released their plan to end it. some federal workers are also taking action. abc7 news reporter linda lopez is live in new york with details. >> reporter: no real progress over the holiday, at least before new year's eve toward any deal to end the shutdown. then house democrats submitted two funding bills which they say

they'll be ready to vote on when they're back in session thursday. president trump continuing to feud with democrats over funding for a border wall. the two sides still at a stalemate on a sticking point that would end the shutdown. president trump telling fox news -- >> i'm in washington, i'm ready, willing and able. i'm in the white house. they can come over right now. we're not giving up. we have to have border security and the wall is a big part of border security. the biggest part. >> reporter: house democrats released a plan on monday to fund and reopen the government, preparing two bills. the first bill would include year long funding for all government agencies still closed, except the department of homeland security. the second would reopen and fund dhs but only until february 8th. neither house bill includes funding for a boreder wall. the dhs bill keeping funding at its current level. lindsey graham indicated over the weekend the president might

be open to negotiating. >> i think he's receptive to making a deal if it achieves his goals of securing our border. and i think we can get there if everybody will start talking to each other. likely to support the house bills. tweeting new year's eve that the democrats will probably submit a bill being cute as always that would give nothing to border security. senate majority leader mitch mcconnell's office also releasing a statement saying, it's simple. the senate is not going to send something to the president that he won't sign. meanwhile, federal -- meanwhile federal workers are suing the administration over the shutdown. one of the largest unions representing federal workers has hired a d.c. law firm to protest the fact that an estimated 420,000 government employees are being required to work without pay. linda lopez, abc7 news. jessica? >> thank you and happy new year to you. president trump has set some new year's resolutions for the u.s. >> doing so well as a country.

the rain rolls in and hang in the upper 50s with the wet rolling in. the alameda county sheriff's office is trying to figure out how a body ended up in a landfill. it was found at the altamont landfill near livermore yesterday afternoon. officials say the death is suspicious. it's possible the body was thrown out in another city and transferred to the landfill. the search is on this morning for this minimum security inmate. he walked away from the conservation camp in lake county. nicholas dunning was discovered missing before 8:00 yesterday morning. prison officers scoured the camp buildings and the grounds without success. cal fire, the chp and local law enforcement officers are helping in the search. dunning has been at the lake county facility since april. he was serving a five-year sentence for assault with a deadly weapon. happening today, minimum wage is going up for workers in 20 states, including in california. california businesses with more than 25 employees must pay at

least businees with 25 or fewer employees must pay $11 an hour. there are even bigger increases in some bay area cities. starting today the minimum wage in san jose, cupertino, los altos, palo alto is $15 an hour. another new law taking effect today is aimed at protecting you from dangerous chemicals. retailers in san francisco are banned from selling any furniture containing risky fire. any furniture will have a tag indicating no retardants used. it became popular with manufacturers decades ago but they contain dangers. >> we passed the law to protect consumers in their homes. a lot of the flame retardant chemicals are harmful to our health. 24e can cause cancer, lower iq. we know they're toxic and not
