something like this was in that 6-year-old's head right now. imagine the sight but at night, a perfectly clear sky to watch fran's new year's eve fireworks show from thermal street. >> and you could hear the kids yelling five, four, three, two -- >> reporter: then at midnight, gunfire. >> like boom, boom, boom, boom. and i told my husband, baby, we better get our butts in the house before we get hit. >> reporter: the child turned out to be a girl. directly across the street was a new year's eve party. the homeowner told us his friend's 6-year-old daughter fell to the ground right after midnight in the backyard. he says she was bleeding from her head and crying. it wasn't until they got to the hospital that they realized she had been shot. >> where the wound is consistent

with something that may come let's say from an angle of something falling. >> reporter: a stray bullet also hit a car outside the party. police are blaming it all on celebratory gunfire. amazingly the child is going to be okay. the bullet is still her head and may never be reach moved. pd chief stopped by the hospital to see the family. >> i got to see her and touch her and give her our bear from our police department to her. >> reporter: the chief says the girl's parents are shaken. >> put the guns down. it is foolishness. it is unnecessary. >> reporter: the department says that this case is tough. shot spotter technology recorded lots of gunfire in the area. the bullets could have come from anywhere within just shorts o o mile away. police watch the community's help. there is a $5,000 reward being offer offered for anyone that can give information that will lead to an

arrest. joe bee in a fort son, abc 7 news. pg and e employees spotted and reported the camp fire just moments before it wrote out. -- broke out. they have possible points of origin. and this is not the video that employees took, but yesterday was the deadline for pg&e to submit information requested by the federal judge overseeing the utility since the san bruno explosion. cal fire has not determined the cause of the camp fire. if found libel, the yu utility could possibly face criminal chan charges. the partial government shutdown is still going on. but we found some exceptions where people are chippingi into

help keep things clean. we thought we'd find trash after last night, but not so much at our national parks. >> that's right. i came prepared to do a story about all the revelers throwing out their trash, leaving it all over downtown here along the embarcadero. but i have to say, the city of san francisco has done an amazing job at collecting all the trash. i did find what i was looking for though in a very unusual place. >> reporter: those people exploring the lands and trails suddenly encountered an bankrupt reali reality, one of the many consequences of the government shutdown. the path is part of the golden gate national recreation area and therefor services like trash collection have been put on hold. people had a lot to say about who at this point should be responsible for this mess. >> wants people in washington to do it, do this too. it is your doorsteps. >> everybody should be a little

more respectful. >> no one to pick it up. >> reporter: this man thought a bear had gone through the garbage, but when we told him it was the government shutdown, he didn't hesitate to add his dog's waste to the pile. >> people should pick up their garbage. you pack it in, you pack it out. >> reporter: and a different area here where this warming hut cafe is located. it is managed by the same national park service except that the nearby because it didn't receive national support, it is never affected by the shutdown. and individual households are also helping. this morning we found volunteers picking up garbage. >> we love to be out and walking and sailing and we're so lucky to have this. >> i just wanted to keep it clean. maybe start the new year's with

a good start. >> reporter: good start. and jack who is in the eighth grade woke up up this morning thinking what can i do for my national park. and he thought of that idea. good for him. lyanne melendez, abc 7 news. the wild winds took a toll last night. a branch of a tree in front of this house came crashing down on a car. nobody was hurt, but neighbors say they have been concerned for some time about the age of the trees on their block. >> pretty old tree. we have mentioned to the city at least to try to trim it down because it is old and hits in to our house. they haven't been out here for years. >> randall says most of the dam was to the roof rack and paint on his toyota suv. neck on la-- in oakland, a tree hung above the right lane

emeryville. temperatures are near their high for the day, 59 at santa rosa, napa upper 50s and concord. 52 livermore. but things will change overnight. now how the temperatures drop off by midnight. we'll see temperatures down to about or below 40 degrees in most inland locations. 7:00 tomorrow morning, temperatures in the low to mid-30s in most inland spots. i'll give you a look at the full 7 day forecast in a few minutes. activists and neighbors joined friends and family to honor the young man who died ten years ago when a b.a.r.t. officer shot and killed him. abc 7 was at the vigil. on january 1, the 22-year-old was shot by a b.a.r.t. officer during a struggle at the station. the officer was convicted of involuntary manslaughter. his family says the death has led to real change that will be part of his legacy. >> legacy is about justice.

this legacy is about accountability. this legacy is about people having the right to life. >> grant's uncle says that the family helped champion three recent laws designed to increase officer accountability and prevent racial profiling. in the south bay, residents of a building have to find a new place to live after a fire gutted it thrng. t this morning. the significanature damage was roof and part of the up stairs unit. everybody escaped without injury. the cause is under investigation. a fire in vallejo is has ripped three people out of their home. it was near where 80 and 780 meet. abc 7 news was on the scene.

and they believe the fire started in a rear bedroom. >> it is pretty much burned out, so i can't identify any objects except the wire from a mattress. so the investigator will try to determine the cause. >> paramedics treated two people for smoke inhalation. the red cross is assisting the three residents whose home was badly damaged. in the north bay, business came to a standstill at a sonoma county fast food restaurant. this man was found passed out behind the wheel of a taco bell drive-through just before 1:30. officers took him into custody after he refused to take a sobriety test. he was later booked on suspicion of dui. we're less than a week from the college football playoff national championship game. and new at 4:00, see how levi stadium is getting ready for the big game.

championship on espn. clemson faces alabama for the third time in four years as they face off for the title. again, that is next monday at levi stadium. it wasn't such a happy area for bay area commuters. the tolls on bridges went up by $1 today. that is the result of a ballot measure approved by voters last year. prices vary by bridge and time of day, but the regular toll is now up to $7. drivers we talked with were split on the hike. >> it is paying for other things like traffic expenses and roads. >> so much money. everything is going up. gas. everything. >> the hike affects the seven state owned toll bridges in the bay area. the golden gate bridge is not affected. starting today, private employers in san jose must pay their workers at least $15 an hour thanks to a new law.

san jose mayor pushed for the wage hike. and today he says many small businesses support paying their workers more. >> they know that it is too expensive for their workers to live here unless they are increase being the wages and they also know there are other employers willing to pay more. so i think that many businesses recognize that this is a sign of the times. it is also the case that here in the city of san jose, we have hundreds of people who are waking up in their cars and going to work each morning. >> san jose's minimum wage can automatic go up every year based upon increases in inflation. if you want to take a closer look at the laws changing with the new year, we have the list on the website abc7news.com. well, winning the mega millions jackpot could propel you into a higher tax bracket. tonight's jack spot climbing towards $425 million. abc 7 was in san jose has people bought tickets. right now the jackpot is the eighth largest in mega millions

we'll see cold mornings the next few days. rain arrives this weekend and the wet pattern will continue into next week. low temperatures tonight are going to drop into sub freezing territory for many locations. up in the north bay, look for lows of 29 at santa rosa, 31 at napa. going eastward a bit, 32 at concord. 29 will be the low at fairfield. 30 in livermore. south bay, morgan hill will bottom out at 30. so it will be chilly everywhere especially in our inland valleys. the north bay is usually our chilliest region this time of the year, so we'll use north bay as an example of the low temperature trend over the next seven days. morning lows, average this time of year about 36 degrees. next few day, we'll see lows well below average there. and notice how they bounce back up to well above average on saturday, sunday, monday and tuesday because we have clouds coming in and we'll have a little rainfall and unsettled weather those days. so we trade the cold for the

wet. highs tomorrow under sunny skies will be mainly mid-50s. chances of rain the next few days, 90% saturday, 80% saund. so let's bring in the storm impact scale. and first of these approaching storms coming in on saturday ranks 2 on the impact scale. it is expected to produce half an inch to an inch of rain. there will be brief downpours possible. and here is midnight friday night. notice how the wave of rain comes in on saturday. there will be some drenching rain for some locations. in the sierra, there will be snowfall. and then a second wave of rain will come in sunday night into monday. so several days of wet weather coming our way. and you can see that here on the accuweather 7 day forecast. so again the next couple mornings quite chilly.

here are the stories making headlines at 4:30. all signs of new year's festivities are gone as far as strash conce trash is concerned, but most national park staff workers are furloughed because of the government shutdown. one mother and her son actually came to pick up trash near the warming hut as part of their new year's resolution. good for them. and welcome baby new year. look at that cutie. this is baby keani, believed to be the first baby born in the bay area in 2019. we'll hear from her mother at 5:00. north korea's leader is ready for more talks with president trump. world news tonight tweeted kim jung-un says that he hopes to

extend his high stakes nuclear summit with mr. trump. it is day 11 of the partial government shutdown and today house democrats released their plan to reopen the government without approving money for a border wall. >> reporter: first sign of a break in the impasse between the white house and congress, top hill leaders from both parties have been summoned to meet with president trump tomorrow for briefings on border security, a day before democrats take control of the house of representatives. with nancy pelosi as speaker, they say their first order of business will be to vote on two bills to reopen the government. the first would include year long funding for all government agencies currently closed except the department of homeland security. the second would reopen and fund dhs, but only until february 8th. neither house bill includes funding for a border wall. the dhs bill keeps border security funding at its current level of $1.3 billion, but it is unclear whether the republican led senate would even consider

the house bill. the majority lead mitch mcconnell says it is simple, the senate is not going to send something to the president that he won't sign. and president trump told fox news that he is willing to negotiate, but still insists on a border wall. >> we are not giving up. we have to have border security and the wall is the biggest part. >> reporter: the national park service has been attempting to keep tourist attractions accessible during the holidays, but without staffing, visitors are finding many restrooms either closed or overflowing and garbage piling up. >> there are 800,000 federal workers either furloughed or working without pay. the free visits will stop tomorrow for campers at joshua tree national park. jsh with a tree is technically closed due to the federal government shutdown, however people have been able to enter the park anyway without paying the usual admission fee. now national park service will shut down two camp grounds for

overnight use. the park service says it has no choice, the restrooms are about to floeoverflow. a two-year-old girl was in the hospital after falling into a rhino exhibit at a zoo in florida today. the girl was taking part in the rhino encounter when guests are allowed to view the large animals up close from behind a barrier, but the girl somehow fell through a gap and landed inside the enclosure. and that is when at least one of the rhinos made contact with her. we just got word though that the girl is doing well. >> good to hear. now to that deadly lion attack at a north carolina zoological center. for the first time we're hearing the delramatic 911 call. natalie brunell tells us what the call reveals. reveals. reve.

>> reporter: just released the frantic 911 call for help a newly hired sbefintern was ma by the lion. al alexandra black was killed while cleaning the facility. >> we've lost a person, we've lost an animal, we have lost our faith in ourselves a little bit today. >> reporter: as black's family mourns, releasing a statement saying she died following her passion, neighbors of the center are now raising concerns. this isn't the first time a lion has escaped. >> at the time i had two foster children, two kids staying with us and we were scared to death because the footprints were in our yard. >> reporter: the lion was shot and killed so deputies could retrieve black's body and the center is now shut down indefinitely while authorities investigate the attack.

natalie brunell, abc news, los angeles. the twin brother of an american detained while traveling in russia insists his brother is plot a spy. russian security agents arrested paul whalen of michigan last friday on suspicion of carrying out an kt a of he act of espion. he is a retired marine and in moscow for a wedding and his brother's innocence is undoubted and that he is deeply concerned about his safety. police in an oregon suburb were left scratching their heads over this one. the police department released this surveillance video of a man outside the building on sunday night. he calmly walks up to a locked bicycle and gets out his bolt cutters unaware that officers are watching him on their security camera. seconds later an officer strolls outside where the would-be thief seems surprised to see him
