friend's backyard not far from the oakland zoo watching i fireworks just after midnight and now in the hospital. >> "abc 7 news" reporter jobina fortson joins us live. this is exactly what police worry about, jobina. >> reporter: yes. we did a story about this last night, talking about this risk, and yet here we are. we showed people this earlier and i want to bring it back to give some others some perspective here. this is a bullet that was shot into the air and came down on the ground in oakland near the coliseum. investigators at this point do not know the type of bullet that was used in this case, but something like this is in that six-year-old girl's head right now. neighbors along thermal street in east oakland had a perfect view of san francisco on new year's eve. roxanne perez says she could hear children enjoying the evening at a family's party across the street. >> you could hear the kids yelling, five, four, three, two. >> and just at the start of

2019. >> boom, boom, boom, boom. >> reporter: gunfire began to mix in with the pops of fireworks. >> it sounds like it is right in the middle of your house. >> a child was struck by a stray bullet. >> reporter: a six-year-old girl was shot in the head at the party by celebratory gunfire. the homeowner didn't want to be interviewed on camera but told us the party was in the backyard. his friend's six-year-old daughter fell to the ground right after midnight. he said she was bleeding from her head and crying and it wasn't until they got to the hospital that they realized she had been shot. >> where the wound is consistent with something that may come, let's say, from an angle of something falling. >> reporter: a stray bullet also hit a car parked outside. the bullet is still in the six-year-old girl's head and may never be removed but she is going to be okay. oakland pd's chief topped by bennie-off's children's hospital to see the family. >> these parents are precious as well. you can see -- obviously they are shaken by this. >> reporter: the department said

this case is tough. shot spotter technology recorded lots of gunfire in the area. the bullet could have come from anywhere just short of a mile away. >> put the guns down. it is fioolishness. it is unnecessary. >> reporter: police really need the community's help on this case. as you heard how difficult it is going to be for them to identify the source of this. anyone where information that can lead to an arrest is being offered a $5,000 reward. for now reporting in oakland, jobina fortson, "abc 7 news." >> all right. jobina, thank you. hopefully they can find out who is responsible. taking a live look from our "abc 7 news" roof top camera, last night we could see fireworks from this viewpoint. now there are clear skies but it is cold. "abc 7 news" weather anchor spencer christian joins us with a look at tonight's forecast. we are talking less wind though, spencer, which is a little reprieve. >> that's true. we won't have a windchill factor but we will have a chill factor, no wind. here is a look at live doppler 7. we have clear skies mainly right

now, so temperatures are dropping. you can see that the wind is really calm just about everywhere, the strongest winds we see right now, about five mils per hour in san francisco, mountain view, livermore, 7 miles per hour in fairfield. the wind is not a factor but temperatures will be dropping later tonight. right now temperatures mainly in the 40s and then we get to 10:00 p.m. and on to midnight and we will see temperatures drop into the upper 30s in many inland locations, and by 7:00 tomorrow morning at the start of the do i for most of us, temperatures will be in the low to mid 30s in most inland locations and upper 30s around the bay shoreline. i will show you just how chilly it will be where you are in a few minutes. kristen. >> spencer, thank you. the weather today certainly was clear and beautiful. it was a great excuse to get outside and enjoy what the bay area has to offer. one family found it a reason to do what our federal government currently cannot do, and that's to keep our national parks clean because of the shutdown. melendez joins us live from the embarcadero. we thought we would find trash after last night's celebrations, but not so much at the national parks. >> reporter: so did i. i have to say the city of san francisco did a good job picking up after people and cleaning up this area along the embarcadero after the celebrations. everything is pretty of compact. but, again, it is the city of san francisco. we don't have a city shutdown unlike the federal government. margo and her son jack started the new year by doing something unusual, picking up garbage at the golden gate national recreation area behind the warming hut cafe. >> jack had the idea of picking up trash because he thought maybe last night people might have left trash. >> reporter: and how is it? have found quite a bit? >> there's some, but not that of. >> i just wanted to keep it clean, maybe start the new year with a good start. >> reporter: the nearby presidio trust also has been helping to keep this national park facility

clean. but three miles from there at the start of the lands and trail, there was no one to collect the garbage that has been piling up because of the government shutdown. >> that's terrible. people are pigs. >> reporter: services like trash collection have been put on hold. people had a lot to say about who at this point should be responsible for this mess. >> it is the oldest rule in nature. you pack your garbage in, you pack your garbage out. it is that simple. >> exactly. >> and you show respect for nature. >> that's it. no respect for nature. >> no one to pick it up. >> this man thought a bear had gone through the garbage. when we told him it was because of the government shutdown, he didn't hesitate to add his dog's waste to the pile. >> i think it is disgusting. i think it reflects really poorly on our city, and why we have a lot of visitors from other places here and it just looks terrible. >> reporter: we found one of those visitors today. >> hopefully they do something about it because it is not

hygenic. it doesn't make the city look very inviting. >> reporter: i hope she comes back. now, these parks are still accessible but, again, as you saw in that report the facilities are not up and running and that's becoming a big problem. i'm live along the embarcadero, lyanne melendez, "abc 7 news." >> thank you, lyanne. this year, the new year marks a somber anniversary. ten years since the death of oscar grant. he was shot by a b.a.r.t police officer who said he meant to grab his taser, not his gun. messerly was convicted of involuntary manslaughter. today grant's family, including his 14-year-old daughter, gathered the reflect on what has changed since his death. "abc 7 news" reporter leslie brinkley has the story. >> it has been ten years. i can't believe how time is flying by. >> reporter: oscar grant's mother says her son's death changed our society. >> society has changed through awareness. i believe that because of

oscar's death it began a catalyst, it began a movement. >> keep pushing! keep fighting. >> reporter: she took the stage here at the b.a.r.t station with grant's daughter, tatianna, a poised 14-year old. >> reporter: what do you think your dad was like, as you learn more about him and what happened? >> i think it is just for freedom. all of us in black lives in general, we all need support that it shouldn't happen again. >> reporter: oscar grant rode b.a.r.t back to the east bay from watching fireworks in san francisco on january 1, 2009. an encounter with police ended with an unarmed grant face down on the platform and shot in the back by a b.a.r.t officer who testified in court he thought he pulled out his taser. grant's uncle bobby carried the torch after oscar died. he spoke out about his nephew's legacy. >> because there were commuters troubled in their spirit and

pulling out cameras and recording, that story was able to be seen by us and the world and everyone fell in love with oscar. they felt that pain. >> reporter: since then, johnson says that incident has sparked a decade of scepticism about the relationship between the community and police officers. awareness was raised. dash cams and body cams on officers are the new norm. grant's family hopes to have a huge commemorative mural painted up here on the outside of the fruitvale b.a.r.t station. you can see the bright white primer up there on the wall ready to go. they are also pushing for a plaque to be put on the platform where he was shot. >> so this legacy is about justice. this legac a accountability. >> reporter: in oakland, i'm leslie brinkley, "abc 7 news". today a new law goes into effect aimed at improving police accountability and transparency in california. the law allows the public to view investigations of officer shootings and other major uses of force. people can also access records of the internal police investigations about things like

"abc 7 news" sfo liccardo earlier today before this afternoon's crash. his office confirms he is banged

up but not seriously hurt. emergency crews took him to regional medical center in san jose where his office says he will be held overnight for observation. the mayor describes himself as a, quote, cycling geek on his twitter account. take a look. this is video of him on a bike in october of 2017 when ford launched its go bike program in san jose. we'll bring you more details on the mayor's condition and the search for the driver who hit him as we get the information. >> hopefully he will be back on his bike in no time at all. in the east bay workers discovered a body at a landfill, and investigators don't think it got there by accident. the landfill's off 580 outside of livermore. "abc 7 news" reporter melanie woodrow explains what clues investigators have to work with. >> reporter: this is the waste management landfill where investigators say a heavy equipment operator discovered a body monday afternoon. >> when they moved the material, i see the leg. i'm thinking, oh, that's some -- like a toy. so i backed -- i backed up with the loader.

and i see the -- the whole body. i said, oh, my god, that's somebody. >> reporter: investigators say the body had been dumped anywhere from a week to a month ago. >> any time you have a body that ends up in a landfill, it is definitely foul play. >> reporter: they believe the victim was likely in a debris box or road side waste bin on the west side of the county that was then transferred into a truck. larger transfer station and then ultimately here to the landfill. >> how this was done was very disturbing. >> reporter: the body's decomposition may have camo flaujed apparent signs of trauma or injury. an autopsy wednesday will be critical in determining a cause of death and identifying the victim. in livermore, melanie woodrow, "abc 7 news". in the south bay fire gutted a victorian house on north fifth street near julian after 3:00 this morning. it caused significant damage to the top floor of the two-story house which was convertd into five separate apartments. crews were able to contain the five to one upstairs apartment

and part of the attic. everyone in the building escaped without injury. the calls of the fire is not yet known. on the peninsula, the wild winds last night took a real toll along the daly city border but the only casualty was an unlucky toyota. a tree branch broke off in the wind and came crashing down overnight. the hernandez family shared photos with "abc 7 news" taken before daly city responders arrived on the scene. the branch itself was nearly as long as the car and a rude welcome to 2019. >> just woke up and found out, my sister call me, rang my door and said, hey, a tree fell on your car. i was like, great, new year and stuff. >> randall hernandez says most of the damage was to the roof rack and the paint. neighbors say they'veomaine to past about the aging trees on the block. the first baby born in the bay area this year came into the world at 12:25 a.m. at the north bay medical center in fairfield. she is the youngest of ten kids.

the mom says she will be her last. "abc 7 news" reporter anser hutson has the story from fairfield. >> reporter: welcome, baby, first baby area born in 2019, write the family considers a sign of good luck. >> i think she will have a lot of good luck. my sister should have a lot of good luck from here on out hopefully. i want nothing but the best for my sister and her babies. >> it is great sign considering she is healthy and she's amazing. >> reporter: alicia matty says she came to the hospital around 8:00 a.m. on monday and was induced around 11:00 a.m., and then had to wait another 13 hours before giving birth. >> oh, my goodness. i still haven't had her yet. and then my contractions picked up. >> reporter: ten minutes to midnight things started to get exciting as the mom in the next room was ready to give birth as well. >> we had two mlabor. we weren't sure which one was going to do it. >> reporter: the race was on for who would become baby new year. nerss started to place bets.

half moon bay. it is getting a bit chilly. this is the view of emeryville looking west word along the bay bridge. 49 in santa rosa. mid to upper 40s in napa, petaluma. fair ffld, 43. concord, 49. and the lowest of them right now, 42 at livermore. along the embarcadero from the roof top camera here at abc 7, here are the forecast features. cold mornings for the next few days. rain will arrive this weekend and temperatures will not be as low them and the wet pattern continues through next week. overnight, 27 farther north in ukiah. 32 in concord. 30 at livermore. 33 at san jose. along the bay shoreline mainly mid to upper 40s. 41 at half moon bay. tomorrow, a nice sunny and pleasant day. high temperatures in the seasonal range, 55 to 57 degrees in most locations. maybe a little milder in the

south bay where we will see highs of 58 at san jose and 58 at morgan hill. on we go to rain chances over the next seven days. it is about a zero chance of day through friday, but we have a 90% of rain on saturday, 80% chance on sunday and as you can see we will have rain or expecting rain into the middle of next week. now, the first approaching storm ranks two on the storm impact scale, a storm of moderate intensity. it will come in on saturday, producing half an inch to an inch of rain for most areas, perhaps more along the coastal ranges. there will be brief downpours and gusty winds of about 30 miles per hour. notice on saturday it will be a wet day all day. rain here and snow over on the sierra. another storm comes in sunday night into monday, and it will be a good rain maker. we have more rain coming after that one also. let's look at the accuweather seven-day forecast. once again, frigid conditions tomorrow morning in inland areas and another cold morning on

before democrats take drol contf the senate. with nancy pelosi as speaker, they say first order of business will be two bills to open the government. it will be first year long for all agencies currently closed except department of homeland security. second would reopen and fund dhs unless february 8th. neither includes funding for a border wall. dhs keeps border security at the current level of 1.3 billion. it is unclear whether the republican-led senate will consider the house bill. majority leader mitch mcconnell said it is simple, the senate is not going to consider something the president won't sign. he told "fox news" he is willing to negotiate. >> we are not giving you have. we have to have border security, and the wall is a big part of border security, the biggest part. >> reporter: with the government shut down, the national park service has attempted to keep

attractions accessible but without staffing garbage is piling up. 800,000 federal workers are furloughed or working without pay. aaron katersky, abc news, new york. california is one of 20 states that raised its minimum wage to start the new year, and in san jose employers must now pay their workers of more than the state minimum, at least $15 per hour. now, san jose is not alone. workers must also get paid at least that of in cupertino, los altos, palo alto and santa clara. the mayor believes a higher minimum wage will help people cope with the bay area's high cost of living. >> we've got hundreds of people who are waking up in their cars and going to work each morning. we can't continue to be a city where work does not enable people to be able to have an affordable place to live. >> san jose has included automatic increases in its minimum wage based on the rate of inflation.
