>> the shooting happened in newman, which is between san jose and merced. today's court hearing was in modesto where we find "abc 7 news" reporter leslie brinkley. she spent the day there. >> reporter: he was arrested as gustavo perez arriaga. that was one of many aliases the accused cop killer used when he was in the country illegally according to immigration officials, but in court it was the murder suspect's real name, paolo mendoza and his real birth date, december 28, 1986. he shuffled into the room in shackles, his eyes downcast, never looking up at family members in the front row. he waived his arraignment through an interpreter and court-appoint he attorney. the judge 'signed a value to evaluate him for competence to stand trial. he remains in custody, no bail. in court were 11 fellow officers from newman, nearly the entire police department, as well as corporal singh's family. he is accused of shooting and killing corporal singh during a

suspected dui traffic stop on december 26th in newman. surveillance video from a nearby convenience store led to his arrest 55 hours later in bakersfield. seven other accused accomplices including his girlfriend, two brothers and a co-worker were later arrested. four appeared in court today on charges related to helping him flee to mexico. bl blue ribbons adorned the courthouse in modesto as local residents rally. why come to court today? >> to support the police >> corporal singh was shot and

"abc 7 news" reporter david louie has the latest on the mayor's condition. >> reporter: the mayor appeared to be in good spirits after suffering fractures of two vertebras and his sternum. he made brief comments but took no questions as he was discharged late this afternoon from the medical center. >> i'm grateful to everybody here and the teams from er, icu, who were so supportive in helping me get back on my feet. >> reporter: earlier in the day the mayor posted this photo showing him walking in a hospital hallway, his back supported by a large brace. he said that brace will be his best friend for several weeks. the mayor reportedly broadsided an su virks that turned in front of him on mabury road on the city's east side. the driver was cited. >> when crashes happen like the mayor's, if the crash is slower there's a greater possibility the person will walk away. >> reporter: the mayor is an avid cyclist and has promoted

efforts to reduce traffic crashes. san jose had six bicycle fatalities in 2017 which was 13% of all crashes. if places where the city already has restriped the roadways to make clear where the bike lanes are, the city has already seen an improvement in safety. here in the vicinity of brannon lane and pearl avenue the city noted a reduction of 40% in crashes in the year 2017. a fellow cyclist and friend of the mayor that bikes 12400,000 miles per year believes more needs to be done to separate bicyclists from vehicles. >> if you have seen in downtown san jose where you are separating cars with physical barriers from cyclists, that's the biggest and safest step we can take. we just need to do it more. >> reporter: the mayor says doesn't need surgery but will need to do physical therapy. in san jose, david louie, "abc 7 news". new at 6:00, this is not the runway obviously.

a small plane landed in the american river in sacramento today and firefighters tweeted this picture. a man and woman were on board and both were taken to the hospital. we don't know how badly they were hurt. several emergency agencies are working together to pull the plane out of the water. apple issued a warning to investors today, saying dispointing iphone sales over the holiday will hurt revenue. the ceo made the statement after the markets closed. apple now expects revenue of $84 billion for the past quarter, down from the projected range of 89 billion to $93 billion. stock in the cupertino company dropped more than 7% after hours following that announcement. here is a live look outside from the east bay hills tower camera. it is a clear and cold evening out there. trash and bathrooms. the park service doesn't think they will reopen until the government does. san francisco is picking up the slack when it comes to trash pickup near the city. lyanne melendez joins us live from the kings end trail where the trash is piling up. >> reporter: i think it started with if mayor of washington, d.c. who promised to continue or said that her city will continue to pick up all of the trash on the national mall. now, san francisco is not going to do as of as washington, d.c., but the city is willing to help out. after "abc 7 news" showed video of a trash can overflowing on the lands end trail yesterday, someone, perhaps a good samaritan, decided to do some cleanup. this is what we found this morning. the trail is managed by the golden gate national recreation area. cleanup crews have not been working because of the government shutdown. today the trash on the otherhe s

in the east bay now sky seven flew above the oakland hills following reports of a burglary and shots being fired. officers entered a home on park ridge drive this afternoon. sky map 7 shows you the streets near where officers looked for the suspects and for clues. there are reports that the suspects drove away from this area. meantime, a six-year-old girl is still recovering after a new year's eve bullet hit her in the head on new year's day, i should say. "abc 7 news" reporter melanie woodrow talked to a doctor today about why it may be safer to leave it where it is. >> reporter: it was outside this east oakland home during a new year eve's party that a six-year-old girl was shot by a stray bullet in the head.

overnight lows. 31 degrees at lakeport and napa. 29 at fairfield. 31 at liver hill. at morgan hill, a low 31 expect. around bay shoreline, upper 30s to low 40s in most locations. the average low this time of the year in the north bay valleys is 36 degrees, and as you can see tomorrow and friday lows are expected to be a couple of degrees below that average, but we will see temperatures above that average in materially morning hours on saturday and sunday, and even higher on monday and tuesday as clouds come in and keep the overnight conditions from getting very cold. tomorrow we'll see little slivers of high clouds, mainly sunny skies. high temperatures generally in the mid to upper 50s. rain chances over the next few days, zero through friday but substantial after that. let's look at the first of the approaching storms that ranks two on the storm impact scale, expect to arrive early saturday. bringing half an inch to an inch of rain to most locations with
