in the south bay, two people are dead after the car they were in veered off the roadway and flipped over. this was the scene on highway 87 in san jose just after 10:00 last night. the driver says he swerved to avoid hitting stopped traffic, but ended up hitting the barrier in the middle. the car rolled and ended up on its side. officials say there were four or five people inside. a man in his 30s died. a woman also in her 30s was taken to the hospital. the other people in the car were not hurt. a final goodbye for newman police corporal ronil singh. thousands of law enforcement and

cmmunity members paid tribute to him during a public funeral. this was yesterday in modesto. corporal singh was shot and killed during a traffic stop in newman the day after christmas. abc 7 news reporter has more now on his life and legacy. ♪ >> reporter: an echo of bagpipes filled the cold air, marking the start of the day no one here wanted to come. >> to the family, i want you to know, i'm sorry. and that i will always be here. >> reporter: newman police chief randy richardson's words to the family of ronil singh, killed in the line of duty the morning after christmas, just hours after this photo was taken with his 5-month-old son and wife. the suspect, mendoza, was charged with murder wednesday. corporal singh's brother opened

his eulogy thank law enforcement and went on to tell stories about his brother. >> and he used to watch "cops," watch videos, and he always wanted to become a law enforcement in america. >> reporter: corporal singh was an immigrant from fiji, living his american dream. >> not how did he die, but how did he live. not what did he gain, but what did he give? >> reporter: he gave the ultimate sacrifice. >> newman police department and newman city is where his heart and soul was. >> reporter: but his love was with his family. the rain picked up as the funeral ended. creating the most telling symbol of the mood. ♪ all of these vehicles are on their way to what would traditionally be a burial, but sikhism believes in transmigration of the soul, so his body will be cremated.

lisa will have more on today's storm coming up in her full accuweather forecast. we're learning new details about what led up to a deadly officer-involved shooting in santa clara. police say the gunman was firing into traffic, and at people at a ron robby gas station before officers responded, and they say it's amazing no one else was hurt. abc 7 news reporter katie udis has the story. >> reporter: police say this started here in kuala lumpur. you can see behind me, the boarded up kiosk. they say an employee set it on fire and took off to santa clara, where he started shooting. witness arnold sanchez recorded this cell phone video. around 5:45 in the morning, santa clara police responded to the rotten robby gas station. you can see the shattered windows and bullet holes. >> still inside the store. a shotgun in one hand and handgun in another. >> reporter: they received calls

about a man shooting at people and into traffic. several gas station employees and customers were inside when police arrived. >> it was only seconds between the arrival and the time they took action. >> reporter: officers shot and killed the man, only identified at this point as a 55-year-old san jose resident. >> we are extremely fortunate that there are no injured civilians or officers. this person was shooting indiscriminately at passing motorists, at civilians in the parking lot, as well as inside the store. >> reporter: it's unclear how many officers fired. around a dozen responded to the active shooter call. there is police body camera footage and traffic camera video in addition to the witness cell phone video. in the south bay, katie utis, abc 7 news. a uc berkeley football player has passed away after he was hospitalized for a medical emergency. bryce turner was working out near his home in southern california when the incident happened earlier this week. the cal football team tweeted

its condolences last night. turner was a defensive back and appeared in one game this season. no word yet on a cause of death. turner was just 19. an east bay family is urging prospective parents to get genetic testing. their 7-month-old twins are battling a disease. gene replacement therapy could help. melanie boudreau has the story. >> reporter: these beautiful baby twins are battling an extremely rare genetic disease. they're lacking an enzyme needed to break down a chemical in the body. without that enzyme, the chemical accumulates in the brain and is toxic. when the twins were 3 1/2 months old, mom noticed they were looking through her rather than at her. >> i was in complete shock. you don't expect anything to be wrong. >> reporter: children with this disease often don't live past 10 years old. >> they can't do anything on

their own. they can't even play. they don't -- that has to be taught. >> reporter: genetic testing prior to conception would have revealed that gabby and her husband are both carriers of the gene that causes the disease. each twin had a one in four chance of developing the disease. armed with that information, gabby says she would have chosen in vitro fertilization so the couple's embryos could have been tested. kaiser permanente e-mailed her about the testing, but didn't directly speak with her about it. an e-mail statement to abc 7 news in part reads, quote, kaiser permanente againet againetic testing. we offer testing to individuals who identify during screening they are of jewish descent. they are sharing their story to encourage everyone to get genetic testing prior to conception.

they also need to raise $2 million for the twins to participate in experimental gene replacement therapy, pioneered by an east coast doctor. >> we are fund-raising for research to be translated into the clinical setting with the fda approval. >> reporter: in the meantime, they are hopeful movement therapy will help the twins reach some milestones. >> we'll do whatever it takes. >> reporter: anything to extend and improve the quality of their lives. in concord, melanie woodrow, abc 7 news. >> now your accuweather forecast. >> if you're with us earlier, you have seen how the rain has increased over time and live doppler radar 7 showing the yellows and we zoom into marin county where on the coast you've seen the rain rates pick up. how about central marin, san rafael toward sears point, highway 37, over into the richmond area and into the north, mt. st. helena and lighter towards santa rosa. into the east bay, light rain

for you in piedmont, oakland, highway 13, out toward sanders ranch road. and finally, on the peninsula, it's been raining lightly here in san francisco throughout the morning hours and lighter rain through union city, sunol and pleasanton. all the way to big sir and monterey. this is a big event today with the snow falling, and the snow rates continue to increase with that winter storm warning through 4:00 tomorrow morning over 2 feet at kirkwood. and the highest peak still on track to get over 3 feet of snow. so certainly travel is not advised here. the rain coming down at a pretty good clip in combination with the wind advisory. 10:00 a.m. to 10:00 p.m. once again, gusty southerly winds, up to about 50 miles per hour. yesterday we saw that 72 mile an hour gust. mt. diablo. so it's certainly going to be almost as breezy, but much more rain today.

winds gusting at half moon bay at 28 miles per hour. so we're in the 40s and 50s, slightly cooler this morning than yesterday. this is a three on our storm impact scale. it's been a while since we've seen a three. that means rain will be heavy at times, with the combination of winds. and this rain does support the possibility of ponding on the roadway. so if you look at noontime, look at the yellows, look at the red. but look what happens by 3:00 this afternoon. the entire bay area looking at very heavy rain and right through 5:00, 6:00, doesn't end. it's going to take until about 7:00, 8:00 in the south bay in the we see things lighten up. so a lot of activities in the south bay. it's going to be wet there for the bulk of the afternoon, and certainly into the evening. the first part of the rain today, the north bay looking at about a half inch. but then look what happens when we add in the 3:00, 4:00, 5:00 total tonight. over an inch in san francisco, an inch and a third perhaps in redwood city and the coast picking up over an inch. so you combine that with the

gusty winds, the ground is already saturated. so after this event later on tonight with the gusty winds, we do need a break, and we will get one. overnight the winds will dial back, and then by monday, much of monday is dry. that's some good news, because we've got a football game to play. the national championship with alabama and clemson. upper 50s, mostly cloudy skies. so highs today, lows in the low to mid 50s. and that's the way it's going to look at 3:00 p.m. with the heavy rain, gusty winds, the accuweather seven-day forecast, that's a 3 on our storm impact scale. and it all will quiet down overnight. monday, your morning commute, not looking bad. it's the afternoon and evening when the rain picks up again for another messy tuesday, wednesday. download our accuweather app and live doppler 7, very handy today and all week long. >> yesterday after work i went to chinatown and saw a bunch of alabama fans there. and a group literally had on hats, t-shirts and shorts. pouring rain.

scale. yesterday we had a lot of wind, some rain. today much more rain and just as much wind. so rain heavy at times. the winds will be gusting to near 40 miles per hour. we have a wind advisory from 10:00 in the morning until 10:00 tonight. could see minor flooding and ponding on the roadway. so notice the yellow, the darker shade of green. you've been particularly hard-hit in marin county, up in the north bay, sonoma and napa. hayward and pleasanton, heavier cells by our radar sweep. mt. st. helena. santa rosa, light rain and light to moderate rain through the peninsula. burlingame, sman mateo, 280, an east palo alto. you're in here too with san jose, willow glen and campbell. and further south, the santa cruz mountains enhanced rainfall. so your wind advisory throughout the entire day, the entire bay area up to 40 and 50 miles per hour. and then look what happens by 2:00, 3:00 in the afternoon.

we'll detail that for you in just a few minutes. chris? >> lisa, thanks. we have new details in the deadly shooting of a 7-year-old girl in texas. two suspects are now in custody. officials say it's a case of mistaken identity. ka kathryn marshon has the latest. >> reporter: two are in custody for the death of jasmine barnes. prosecutors say eric black was driving the car and sources say the other suspect is larry woodrove, believed to be the shooter. during the hearing, we learned the harris county sheriff's office received a tip from an anonymous source identifying the suspects. the source said they shot up jasmine's mother's car, thinking it was someone else's. homicide investigators interviewed black, and prosecutors say he admitted to taking part in the shooting. for days, the sheriff's office has been circulating this sketch of the suspect, based on how the barnes family described the gunman. but you just saw black, and according to our sources, the

shooter is larry woodruff. he wasn't identified in the hearing, but this is his mugshot from a previous arrest. and you can see neither resembled the sketch. the sheriff's office had also originally described the suspect vehicle as a red pickup truck. but in the hearing this morning, prosecutors say black was driving a dark-colored kia. the barnes attorney says the family may have confused a fleeing bystander for the actual shooter. the harris county sheriff's office says investigators still believe that barnes and her family were innocent victims. i'm kathryn marshon in houston for abc news. our sister station reports the second suspect, 24-year-old larry woodruff, also appeard in court this morning on a drug possession charge. a judge has set woodruf's bail at $100,000. he has not been charged in jasmine's death. investigators are expected to reveal more details at a press conference this afternoon. today is day 16 of the government shutdown. a new round of talks is expected

at the white house today. president trump spoke this morning on the possibility of declaring a national emergency ahead of the meeting. >> i think we're going to have some very serious talks come monday, tuesday, wednesday. we have to have border security. if we don't have border security, we're going to be crime-ridden and it's going to get worse and worse. >> sources tell abc news, democrats want specific details about how the money for border security would be spent. abc news white house correspondent, tara paulmeri has more. >> reporter: on the shutdown, the republicans and democrats still far apart. after this roughly two-hour meeting between the vice president, jared kushner, kirstjen nielsen and senior congressional staffers from both sides of the white house, the president tweeting, not much headway made today. second meeting set for tomorrow. >> i thought we had come in to talk about terms we could agree on. we recognize that things like technology and border crossings

are important, but certainly a barrier is important. >> reporter: the democrats say they won't continue negotiations until the white house presents a formal breakdown on how the $5.7 billion for border security funding will be spent. while the majority of the talk saturday focused on plans for security rather than a budget, weeks ago mulvaney signaled the president would be willing to take less than half of his original asking price of $5.7 billion. >> if you're at $5 billion on something, and i'm at 1. 3 and we're talking about money, maybe there is a place in between. >> reporter: despite losing leverage when the democrats took control of the house, trump not backing down from his initial demand. democrats insisting, it's not needed. >> it's a wall between reality and his constituents. his supporters. >> reporter: the shutdown affecting 800,000 federal employees, either working without pay or furloughed. but the president claiming they support his fight for a wall. a battle he warns could last for months or even years. >> i think if you ever really looked at those people, i think

given his final television interview in office. it was in sacramento at the governor's mansion. he sat down with adrian alpert from our sister station in los angeles. >> reporter: california's 39th governor chose to conduct his final interviews in the governor's mansion, a 142-year-old three-story sacramento victorian. admin g. brown jr. is contemplating his place in the state's history. he leaves office at age 80, the oldest governor re-elected in 2011, nearly 30 years after his first two terms starting in 1975. he has seen the state double in size. the budget grow ten times. governing in a style both pragmatic and practical. >> president trump versus congress, the partial government shutdown over his demand for the $5 billion for a border wall, saying now that he could declare a national emergency at the border and get it done under presidential edict. you as still the governor today

of california, is there a national emergency at our border? >> no, no. and that is very dangerous to declare a national emergency if there isn't one. i think we ought to have a good border security and patrol. we have got to work on how to deal with these refugees. and that's something we've got to work with mexico and latin america. but just this tall, ugly wall becomes a symbol that does not show america at its best. i think mr. trump to shut down government and then to threaten a virtual dictatorial power is ominous and totally unacceptable. >> reporter: jerry brown and his wife ann are moving to a remote ranch house inca loosa county, north of san francisco. but he's retiring with a $15 million war chest of unspent campaign funds. and he's not saying just yet what he'll do with it. >> i'm going to judge carefully, consult with people. but i think whether it's climate or prison reform or candidates,

despite the best efforts of ellen degeneres, it does not appear kevin hart will be hosting the oscars. hart did reconsider hosting and the academy would have been open to it, but hart was concerned he would be a distraction and would not have enough time to prepare. he backed out in december after old homophobic tweets came to light. this past week, he made an appearance on the "ellen" show, and she urged him to host. we do know the oscars are on february 24th and you don't want to miss them. abc 7 is the only place you can watch. 9:41 is the time and this is what it looks like up in the sierra. the first hit of a series of storms. mountain passes expected to get 2 to 3 feet of new snow. chains required on all vehicles from baxter to the nevada state line. skiers and snowboarders are

10 to 17 inches from donner to tahoe city. and looking at the wind advisory, 10:00 this morning until 10:00 tonight, another day with winds up to 50 miles per hour. current wind gusts, 33 miles per hour. half moon bay up to 50 miles per hour, mt. diablo. 40s and 50s right now. this is a level three at our storm impact scale. rain, heavy at times. ponding on the roadways. and with the gusty winds, the ground is already saturated. so those on ramps, the exit ramps, do be careful out there for the hydroplaning and perhaps we already have the tree limbs down. more to come with wind gusts in the higher elevations of over 40 miles per hour. i don't think we're going to see that 72 mile an hour gust like we had yesterday, but still, it is going to be a wild day out there, as the rain continues to increase. look what happens by about 3:00, 4:00 in the afternoon. this is noon. we've got some impressive cells. but more moisture, and the area of low pressure moving over the bay area by the late afternoon

and early evening hours. so not only do we have the heavy rain, we've got the gusty winds, and it's going to last right until about 7:00, 8:00. so we are going to see a concentrated time line of very heavy rain and gusty wind. so that first half of our morning into the afternoon, 2:00, about a half inch to a third of an inch of rain. and then we're going to add on the second half. look where our totals are. an inch and a quarter in san francisco. look at redwood city. the peninsula. even from 10:00 to the noon hour, 30 mile an hour wind gusts. san rafael, how about 25 in livermore valley. look at this. this is 6:00 tonight, where we get the most intense rain and wind, i think, in the southern half of the viewing area. and that's when we're going to see perhaps some issues around here. but they'll be short-lived. because by overnight tonight, the rain is going to taper off, and we've got dry conditions on tap for the game tomorrow,
