be wide open to a court challenge saying, where's the emergency? you have to establish that to do this. >> reporter: they're saying the president wants the money for a steel barrier. steel is what is used for the border fence. as well as more money for border patrol agents, i.c.e. personnel, and more detention beds. >> the government shutdown will continue to get worse and worse. >> reporter: the government is trying to mitigate the fallout from the shutdown. according to "the washington post" the department of housing and urban development sent letters to 1500 landlords trying to help the people living in a program that has expired while the government shut down. alexandria owe casio cortez says she wants to fund a climate change program by hitting the wealthy with a tax increase.

a man is now under arrest in connection with the death of jasmine barnes. investigator say a tip and a missed turn cig fall led them to their suspect. this morning, a stunning twist in the shooting death of 7-year-old jasmine barnes. >> it appears to us based on the information we received, this was likely a case of mistaken identity. >> reporter: she was riding in a car are her mother and three sisters when someone opened fire. her family thought the shooting was racially motivated, initially. >> he intention mali killed my child for no reason. >> reporter: the sheriff's office now revealing it got a tip from an anonymous source identifying a suspect. 20-year-old eric black. police pulled black over for not using his turn signal and was being held on a marijuana charge when he was questioned about the shooting. >> mr. black has acknowledged his role in jasmine's murder.

we have received information that this involves a second individual as well. >> reporter: a second man is held but not charged after the shooting on december 30th, the family helped investigators draw a sketch of a suspect. authorities were looking for a red pickup truck. neither suspect matched the sketch. and eric black was driving a dark-colored kia. the family and multiple witnesses may have confused a fleeing bystander. >> the red truck heard the shots ring out and took off as a pedestrian who was this the line of fire. so everybody else watching, they saw a red truck. heard shots. saw a red truck speeding away from a shooting. >> reporter: barnes' father says the arrest gave them time to focus on remembering their young daughter. >> we have not had a chance to sit down and mourn the death of our daughter. so that's what we're going to do. >> reporter: police say they found a gun in eric black's

home, which he says was used in the shooting. jasmine's funeral is scheduled for tomorrow. two americans reportedly captured on a battlefield alongside isis fighters in syria. one of the men sought a position teaching english to islamic state students. another man believed to be an american was also captured. president trump's national security adviser john bolton now says certain conditions must be met before the u.s. troops withdraw from syria. bolton says the timing of the withdrawal depends on turkey guaranteeing the safety of kurdish fighters aligned with the u.s. his statement appears to conflict with that of president trump. crews work to restore power to thousands of homes after a powerful storm hit the pacific

we're back now with the urgent search for a woman wanted in the death of a nail salon worker in las vegas. >> we're now hearing exclusively from the family. police are in their tenth day of searching for krystal whipple. surveillance video caught her allegedly leaving the studio without paying. one of the owners was then run other and killed. >> reporter: as the hunt for a hit and run driver stretches into the ninth day, even her family says they don't know where she is. >> she's just scared right now. i'm sure she's scared. >> reporter: they say they have not been able to reach her and whoep when she sees this interview that she'll come guard. >> you can't run, baby. you cannot run.

car. the head karate instructor stepped in. within a few minutes, the suspect was on a stretcher headed to the hospital. >> he started to swing and punch at me. we got into a pushing match. an altercation. i escorted him out the door. >> escorted. now police say the suspect was on drugs. he was treated for his injuries at the hospital. before heading off to jail. >> they picked the wrong place. new concerns this morning about the sharp decline in the number of monarch butterflies. an environmental group says they counted only 30,000 on the west coast. that's a decline of 86% in just one year. scientists say the butterflies are threatened by pesticides and climate change. they're normally seen in forrests at this time of the year all along the coast. the eagles-bears game on sunday. philly scored with under 1:00 to

storm left behind. look at this tree that came down in south san francisco. they managed to clear the road, at least one lane so people could get through here. even that took a lot of time. it's a huge tree and it took them a while to get even the branches chopped off just to clear this area. we have video of what it looked like when it came down. this is on south san francisco drive. this happened during the storm yesterday. a huge tree that was ripped up by the roots and just came right down. people couldn't believe it was that windy out here. they were surprised. just relieved that no one was hurt. >> it's pretty big. the first thing i said was lucky it didn't go the other way, toward the house. it's pretty amazing. i knew it was windy. i didn't think it was that windy. >> reporter: it didn't fall on the house. that was good news. now take a look at the situation in san francisco. choppy waters there in the bay. those were crashing out along
