u.s. history. as more people start to feel the ripple effects, the white house has announced that tax refunds will not be delayed. >> abc's serena marshall has all the new details for us from washington. good morning. >> reporter: gio, emily, good morning to you. it is officially the second longest in government history, the longest being 21 days and right now there is no end in sight. it's day 18 of the government shutdown and now the president taking his pitch directly to the american people. with a prime time oval office address tonight where he could announce it's a national emergency. >> i may declare a national emergency depending on what's going to happen over the next few days. >> reporter: democratic leaders are demanding equal air time. if the president's past statements are any indication the speech will be full of malice and misinformation. the president says his demand for $5.7 billion for a wall which he is now calling a steel

barrier is about national security but the shutdown leading to other security risks. in the skies -- >> we're at a 30-year low in staffing. >> reporter: air traffic controllers working longer hours than ever and the air line pilots association wrote to the white house urging an end to the shutdown because it is adversely affecting the safety, security and efficiency of our national airspace system adding that the shutdown means there are fewer safety inspectors on the job. the agency is preparing for workers to call in sick. the white house has come under pfeifer recently for implying that nearly 4,000 known or suspected terrorists stopped coming into the u.s. were traveling through the southern border when, in fact, most came through the skies. the white house is now officially calling irs employees to do their job without pay as tax season is upon us and their hope is to get your tax returns back to you on time. gio, emily. >> serena marshall in washington, serena, thank you. a developing story concerning u.s. relations with

iran. "the new york times" reporting a u.s. navy veteran has been held there since last summer. 46-year-old michael white of california was detained while visiting his iranian girlfriend. that is according to his mother who says white was supposed to leave iran last july but never boarded his flight. he's being held on unspecified charges. at least three other american citizens are currently being held by iran as well. north korean leader kim jong-un has arrived in beijing for talks with china's president. the visit is viewed as an effort to coordinate ahead of an expected second summit between kim and president trump. little progress has been made on nuclear disarmament since they met last year. and, emily, there's new information about the shooting death of 7-year-old jazmine barnes in houston. prosecutors now say they believe it started with a fight in a nightclub. police say the suspects shot at the car carrying jazmine and her family believing that it belonged to the people involved in the fight. one suspect is charged with

capital murder. a second man is in custody but has not been charged. and we turn now to a woman granted clemency in tennessee after gaining support from the likes of kim kardashian and lebron james. it took documentaries and thousands of phone calls but she is finally going free after more than a decade after being convicted of murder. after serving 15 years of a life sentence, cyntoia brown is being released from prison. >> this is an action by the governor of the state of tennessee under his exclusive power to commute the sentence. >> reporter: brown who was 16 years old when she shot and killed johnny mitchell allen was granted clemency by tennessee's governor monday after he said her original punishment was too severe. brown's case gained notoriety in 2011 after a documentary described how brown was forced into a life of prostitution as a child. the man she killed had hired the teen to have sex with him. she claimed she feared for her

life and shot him. >> why would you throw me away for the rest of my life. i don't understand that. >> reporter: brown was found guilty in 2006 and sentenced to life in prison with the possibility of parole in 2057. but stars like rihanna, kim kardashian and lebron james all shared clips of her interviews and rallied behind her. >> it was so necessary to change. it wasn't so much of a choice but i had to. >> reporter: now after years of working towards bettering herself behind bars, brown will be released on parole in august. >> cyntoia's transformation is nothing short of a miracle to watch her go from where she was to where she is the most amazing thing. >> brown worked to get her ged in prison. she's now one course away from earning her bachelor's degree.

she is set to be released in august and will serve ten years on parole. supreme court justice ruth bader ginsburg is missing arguments at the high court for the first time in more than 25 years. ginsburg is recovering from cancer surgery but she's still working reading the transcripts and briefs from home. at 85, ginsburg has no apparent plans to retire. she's hired law clerks through 2020. and turning now to the weather, a mix of rain and snow is arriving in the northeast while on the west coast another pacific storm arrives today. let's take a look at your tuesday forecast. it's a mild day in the northeast with rain showers even thunderstorms but the back side of this storm system powers in a lot of cold air and brings some snow in through the day and into tomorrow night where some spots through maine will pick up 6 to 12 inches of snow. the west coast though, they have problems of their own. more rain pushing into the west coast.

no injuries reported. the fire is about 80% contained. >> good news there. prosecutors in california say they finally found the man who shot and killed a father in a tent while camping with his young daughters. anthony rauda is charged with more than ten shootings near los angeles. one of them left 35-year-old tristan beaudette dead. his daughters sleeping when he was shot in malibu state park. rauda was convicted last year. police believe he had been terrorizing the area since 2016 allegedly shooting a man sleeping in a hammock and firing shots into passing cars. he has not yet entered a plea. and staying in los angeles, teachers there are threatening to go on strike as soon as thursday. l.a. is the nation's second largest school district serving some 600,000 students. the teachers union and the district don't agree on several issues including pay, class size and charter school funding. court hearings today will determine if the teachers can strike legally. a last ditch bargaining session

is set for tomorrow. the most valuable publicly traded company in the united states is now amazon. the e-commerce giant is now worth $797 billion, that's with a "b." the previous leader was microsoft which in late november pushed apple out of the top spot. amazon has been expanding into new areas such as voice activated gadgets and streaming media. and another company making some dough at the consumer electronics show in las vegas, a baking company has unveiled the so-called bread bot which can deliver fresh baked loaves of bread every six minutes. that's up to 235 loaves per day. it starts with dry ingredients and mixes and forms the bread with no human necessary. it's intended for use in supermarkets. listen to this, pizza hut is expanding its beer delivery service hoping to get a leg up on domino's. the service will expand to 1,000

appearance in that sexual assault case. >> yeah, and on his way home from the airport he was pulled over for speeding. he got away with just a warning. now earlier he faced a crush of reporters, you see it right there, before pleading not guilty to groping a young man. abc's linsey davis has more from nantucket. >> this morning disgraced actor kevin spacey who once shined when surrounded by cameras on the red carpet now faces a different kind of attention. >> what are you feeling today, mr. spacey? >> reporter: mobbed by cameras and helicopters on his way to a massachusetts courtroom accused of groping a teenage male back in 2016. >> this complaint charges that on july 8th, 2016 -- >> reporter: standing stone-faced and silent in court the stakes are quite high for the 59-year-old actor who is now charged with felony sexual assault potentially facing up to five years in prison if convicted. his legal team entering a not guilty plea on his behalf. >> you'll be required to stay

away and have no contact direct or indirect with the alleged victim. >> reporter: spacey nodded but did not speak during the brief hearing. on monday, neither the alleged victim nor his mother, former boston news anchor heather unruh appeared in court though she has spoken publicly blasting spacey in the past. >> shame on you for what you did to my son. this was a criminal act. >> reporter: spacey's team has already begun their defense arguing in court last month that there is not sufficient evidence to charge the star and saying the alleged victim told spacey he was 23 years old, even though he was just 18. while spacey has hardly been seen publicly, on christmas eve, the same day he was charged, spacey broke his silence posting this unusual video online where he appears to defend himself while in character as frank underwood who he once portrayed on "house of cards." >> you wouldn't believe the worst without evidence, would you?

you wouldn't rush to judgments without facts, would you? did you? >> reporter: linsey davis, abc news, nantucket. >> linsey, thank you. a kentucky mother and father say they're in shock after seeing video of their autistic son being dragged through his school. take a look. they say the 9-year-old's now former teacher pulled him by the arms leaving him bruised and with sprains to both wrists. he has limited speech. his mother says she posted the video online to give her son a voice and to raise awareness. she says all schools should have cameras to protect children. >> it broke my heart when i saw the video and i saw all of his new classmates and his friends along the wall watching him being dragged down the hallway. >> reporter: the former teacher is due in court tomorrow to face an assault charge. outrage is growing over this suspension of a high school basketball star. maori davenport, a senior in alabama, was a member of team usa last summer when they won gold in mexico city. davenport got a check for nearly

$900 from usa basketball which is allowed to pay college players for summer leagues but since davenport is a high school student, she was found in violation of state rules. usa basketball admitted that sending the check was their mistake and she returned it but alabama high school athletic officials still suspended her for the season. >> i really, really, really want to play. if they can't overturn this ruling at least keep this from happening to another student athlete in alabama. >> reporter: while several basketball players are now supporting davenport, even pro players, she has already committed to play at rutgers next year. a big coaching move right now in the nfl. espn reports that the packers have offered their head coaching job to tennessee titans offensive coordinator matt lafleur, and it's nearly a done deal. of course, the big sports headline today is clemson
