francisco. still well under an hour at 53. highway 17, 1 to los gatos still in the green now. thank you, alexis. now onto breaking news, sears is warning of going out of business. >> we've been warning of impending death for a long time. less than an hour ago it is company will ask the judge to allow it to liquidate. matt keller live in san jose. matt, a lot of us grew up with sears. this is a big change. >> yes, it certainly is an iconic brand. it filed for bankruptcy back in october. there was hope it could be saved from liquidation but that's unlikely. reuters reporting in the last hour sears holdings will ask for bankruptcy to proceed with liquidation after it could not reach an agreement with lampert. he attempted to have his hedge

fund take over hundreds of successful stores and save 50,000 of 60,000 jobs but it did not meet creditor approval. lampert expected to offer improvements to his bid today. he acquired kmart in 2003 and sears in 2005 and merged them together. if sears closes, the bankruptcy will be the second biggest ever in the retail industry. it has more than a dozen stores, appliances, outlets and auto centers here in the bay area. reporting live in san jose, matt keller, abc 7 news. matt, thank you. if sears got into liquidation, it would be the latest in the stripping of major retailers to close up shop. >> threats go topher a few of these. last year we saw a big one, toys r us and osh, they closed their stores. in 2017 sports authorities and 2011, borders closed business nationwide. >> a lot of big brands we grew up with. police in naacp crediting a

middle school student for informing them about mass shootings in two schools. the suspect attends one of those schools, river middle school. detectives said they found evidence the boy intended to target vintage high school as well. the suspect has been in custody since being arrested last week. police also say the suspect threatened to kill the boy who gave officers the tip about the deadly plot. this morning we're hearing from the attorney of the jogger who claimed another woman bit her. the story we've been following since friday. a jogger and dog owner got into spa fight at chabot park on thursday. john o'connor represents the jogger. the jogger's name is cyndi stainner. he said his client pepper sprayed alma cadwalader. >> the next bite would be skin. she did not spray directly at the dog but above the head. she has experience and knows any animal will be distracted. she said the dog owner threw

her client to the ground and bit her. the dog's attorney said the dog didn't do anything and the bite was self-defense. police arrested the dog owner. the alameda county d.a. has not made a charging decision yet. north bay, investigating a sewage leak caused by last weekend's storm. it happened sunday on broad moor avenue. 50,000 brands of sewage got into storm drains and possibly creeks. officials will report the spill to state regulators and conducting water test toss make sure water is safe. happening today oakland mayor plans to spend the first day in a day of service. she kicked off the second term by taking the oath of office. the mayor will focus on charities has help the homeless, delivering food to an encampment near the border in emeryville.

we'll start with temperatures, 50 menlo park, 57. low- to mid-50s east bay down to south bay up to 40s, low 50s in the north bay and east bay valley. it's pretty quiet outside. i've got caution if you're out and about exercising, bay play. we've got rain, breezy conditions and choppy conditions on the water, too. east bay you're pretty much cloudy all the way up until noon, then scattered showers start at 2:00 with heavier, steadier rain as we head from 7:00 on. for the north bay 8:00 this morning. a slight chance of light rain. look at the better chance of scattered showers from 10:00 to 2:00 and then heavier rain around 6:00 and 8:00 and for san francisco we're pretty quiet up until lunch. then we have a chance of scattered showers from 2:00 to 6:00 with heavier rains and

happening today former arp congresswoman gabby giffords headed back to capitol hill on the eighth anniversary of the shooting that nearly killed her and left six others dead. giffords will join nancy pelosi and california representative mike thompson to introduce a bill that would require background checks on private gun sales. the legislation is expected to pass a democrat controlled house but it is unlikely to advance in the republican controlled senate. kevin hart is apologizing again to the lgtbq community.

in yesterday's episode of sirius xm, straight from the hart, addresses krrt tweets, homophobic slurs. hart says he's grown since the comments were made 10 years ago and hopes the lgtby community can forgive him. he backed out of hosting the oscars after the tweets surfaced. he said he will turn down the job if offered again. he addressed the tweets on ellen geenlg and will also tomorrow. pg&e will considering moving outlet of downtown san francisco. they currently own 1.7 million feet of office st. pete near beal and market. they are looking at other sites around the area. selling its san francisco headquarters could help pg&e avoid bankruptcy. it could also help the company dodge a city tax on large businesses to fund homeless services. tesla's new manufacturing plant in china is officially

always cooler than everybody else. 51 and 55. painting the north bay with a few light showers. that's where the green is. notice random showers best in the north bay until noon. a little break in the afternoon hours, clouds opens up a little bit. that gives the atmosphere more energy. look at that, yellows, oranges, reds, downpours moving onshore in the north bay 5:00 reaching neighborhoods by 9:00. after 9:00 they become more scattered during the overnight hours through tomorrow morning. then you can see as we head from 9:00, scattered showers throughout the day tomorrow. once we get to 6:00 they start to taper. so let's take a look at the rainfall totals. sorry. an inch in the north bay. that's where i think the greatest amount of damage is possible. the rest of us will get a quarter to three-quarters of an inch south bay northward. there's your break thursday. we'll get a little bit of a break saturday afternoon. before that and after that,

starting to see wet pavement. we have a disabled vehicle blocking the second lane from the right on that far side of the toll plaza. one of the cash lanes, can't see it on the camera. they are working on getting a tow truck to the scene. if i were you i'd head to the left side of the toll plaza and you should be able total through there faster. i want to check out drive times. 680, walnut creek or 101 santa rosa to san francisco. 35 minutes northbound 17 highway 1 to los gatos. not as bad as yesterday along that stretch but we had two separate collisions along that route. both have cleared so we're starting to recover. mass transit has been looking great all morning. normal service, no delays for bart, 53 in service. no delays for san francisco bay ferry. >> thanks, alexis. bike riders can breathe a little easier on one of the most dangerous streets. they cut the ribbon on a bike lane. a protected lane part of a

with eddie lampert. he wanted his hedge fund to take over more successful stores but didn't meet improve. he's expected to offer an improvement today. the judge could give him more time to improve on his bid. bankruptcy not due until monday. sears has dozens pf stores in the area. if the judge rules in favor of sears sources tell reuters the inventory of appliances, fixtures will be sold in fire sales. abc matt keller. governor newsom will spend the first day in office speeding up responses to how california responds to wildfires and other disasters. the governor will meet with safety officials in the sierra foothills. this afternoon's meeting follows a series of deadly wildfires in northern and southern california last fall. governor newsom set the tonight

the exploratorium, you can see how calm but this afternoon small craft advisory, overnight gale warnings, choppy. when that storm comes in, it's going to be a doozy. until then light random rain. the showers will taper tonight, mild lows and more chances of rain through the extended. all right. here is a look at today's temperatures. a lot of 60s out there. well warmer than it should be for this time of year. lack of sunshine, until late in the afternoon hours. north bay will have most of the cloud cover and best chance of rain in the 50s. all mild, low- to mid-50s. that's pretty close to where our highs are going to be this time of year. gives an idea how mild the air mass is. random rain out there. you see in the north bay, better chances as we head toward lunch. look at the clouds, south of the bay bridge where we may get sunshine. that's going to add energy the storm needs for yellow zones,

oranges, scattered widespread showers with scattered thunderstorms in them that will stay scattered through the morning commute tomorrow. a little more isolated as we head toward the day tomorrow. then by 6:00 they start to leave us. a quarter to a half inch of rain from the south bay up to san francisco, oakland, towards concord. north bay a half inch to an inch. that's why we have the two. plus the wind advisory starting this afternoon and we've got the dangerous surf at the coast. the next three storms, friday, saturday night and sunday not as strong. that's why they are 1s. alexis. >> thanks, mike. we haven't had a lot of issues on the board this morning but definitely some slow spots. here is one of those still in recovery mode in san jose 101 near great america parkway a crash off on the shoulder. that drive time is improving though from 286 to highway 85 down to 26 minutes. we're just over 30 minutes last time we checked. it is slow progress but at least it's progress. really have not improved much here getting out of tracy. three earlier crashes, all three
