will a class action lawsuit be filed? can people who bet on the game get their money back? also new overnight,president trump comes to the side of the high school students at the center of this viral video confronting a native american elder. plus a new way to pray. the high-tech idea blessed by and the fiji water girl who stole the show at the golden globes is back. the new gig the viral photobomber may have landed. good tuesday morning, everyone. we begin with millions waking up with an arctic blast keeping windchills far below zero in many areas. >> the national weather service is calling the conditions life-threatening. states from maine all the way down to the carolinas are in a deep freeze. >> and now another storm moving across the plains could mean a dangerous evening commute tonight from omaha to chicago to detroit. this morning, people in a dozen states facing bone-chilling temperatures.

>> how cold are you? >> i am freezing. >> reporter: this morning windchills not getting above 20 degrees as far south as columbia, south carolina. and in vermont, negative 16. one of the state's largest ski resorts, jay peak, closing monday. it was too cold to ski. but the coldest place in america, atop mt. washington in new hampshire where it felt like minus 87. in albany, new york, the freeze followed a foot of snow. >> this is cold. this is ridiculous. it's definitely, definitely some of the worst i have ever seen. >> reporter: the dangerous weather now being blamed for at least seven deaths including. esther jung, the daughter of a pastor, was building a snow fort across the street when it

collapsed. flowers now memorialize the spot where it happened. >> she often with a friend or her brother, they would carve it out and make a little snow fort. that was their thing every winter. >> reporter: in newport, rhode island, more than 7,000 customers have no heat this morning after a grid outage caused them to lose gas. the state's governor declaring a state of emergency for that county. outside boston, this driver couldn't stop sliding down a hill and a driveway turned into an ice rink for these kids. in michigan ice jams forming on the st. clair river before a break comes from the arctic air. people are doing whatever they can to stay warm. >> i have a couple of layers of pants on, a couple of socks. i have a scarf around my face for sure. we're making it. with a stiff drink. >> the drink helps. >> yes, the drink helps to warm up. >> the cold broke records in several cities in the northeast. meanwhile, as we mentioned, another storm is targeting the upper midwest today. the forecast coming up in just a few minutes. there's been another deadly avalanche in the west. authorities have confirmed a skier in colorado died after an avalanche near aspen.

meanwhile, a second skier has now died after last week's avalanche at a popular resort in taos, new mexico. he had been hospitalized since that accident. two other people have died in avalanches in the last ten days. we turn to the growing concerns about airport security as more tsa workers call out sick refusing to work without pay during the government shutdown. another missed paycheck is looming there week for federal workers as the senate plans to introduce president trump's newest proposal to end the shutdown, a proposal democrats say is dead upon arrival. abc's serena marshall has the latest. serena, good morning. >> reporter: janai, victor, good morning. the tsa says they're going into uncharted territory and as the shutdown continues to drag down it's american families that are paying the price. the shutdown showdown over border security raising questions of flight and food security for american families. >> security, stuff is getting ugh security. just unsafe to me. >> reporter: this family planned a trip to atlanta but left their kids at home worried that the s

safe. at baltimore washington interna line closed as sick-outs escalate last reported at 10% of the workforce. more than triple the normal rate. >> why would they work for free? who else would? >> my wife also is a transportation security officer so we have lost both our incomes. >> reporter: having to decide between gas money to get to work or food for their families. >> i help my family by us with a meal. >> reporter: food banks and the kind hearted stepping in to help. these women handing out gift cards. bank of america, chase, pnc and wells fargo allowing government workers to make late payments and in some cases adjust loans. >> we're going to see not only massive disruptions in the airline system in the united states but maybe a complete shutdown. >> reporter: but it's not just the tsa. 800,000 am mthy. from the coast guard still rescuing those at sea to nasa flight controllers. lawmakers are back in washington but that elusive word compromise

is still missing. mitch mcconnell plans to introduce a bill that includes the president's border initiative. but he will need 60 votes and democrats right now remain united in their desire to open the government t >> the growing impacts as the shutdown drags on, thank you. president trump is defending the teenager seen in that viral video with a native american elder at the lincoln memorial saying the teens were treated unfairly and early judgments were false. new video shows the initial instigators were a group of men known as black hebrew israelites. they were heard taunting everyone around them. the students from a catholic high school say they responded with their school chant. student nick sandman and native american elder nathan phillips who was beating a drum both say they were trying to defuse the situation. at the same time some of the teens were making what appears to be a derogatory tomahawk motion. >> they had -- they called their school chants, but they changed

the words somehow, you know. we couldn't really make out the words because it was just a yell, a screaming. what i seen was the very fabric of my america being ripped apart by racism and bigotry. it just hurt me. it just to my core, you know. >> chaperones from the high school say the students did nothing wrong but the school has apologized and vowed to investigate. meanwhile, twitter has reportedly suspended the account that helped spread the original video of the confrontation. time now for a look at your weather forecast for this tuesday. good morning. well, that bitter cold sticks around at least this morning then will slowly thaw out of that. high pressure gives us more in the way of sunshine giving us a chance to thaw out but the center part of the country,

colorado ski resort. this big animal started galloping after skiers in breckenridge. take a look at that. the woman who shot this video, well, she originally planned on just getting a still picture but then the moose started moving and she started recording and then running. she dove off the trail and hid behind a tree. >> a little more than she bargained for. >> yep. well, police near chicago have been searching overnight for a gunman after a deadly mall shooting. investigators believe the shooter somehow knew the man who was killed. they're calling the shooting an isolated incident. the motive remains unclear. another person was also wounded and treated at a hospital. two pilots are dead after the crash of a world war ii vintage cargo plane in ohio. the dc-3 reportedly had trouble gaining altitude after taking off from a small airport. it came down in the front yard of a home in apple creek about 50 miles south of cleveland. the homeowner was inside.y bothr was hurt. >> there's pieces of debris up against the house and things and we're very lucky that nothing went through. very lucky that, you know, that maybe the tree stopped him from

going into the house. we count ourselves blessed. >> neither the ntsb or the faa are planning to send investigators to the scene due to the government shutdown. if you've ever wanted to pray with the pope, there's now an app just for you. pope francis has unveiled his new click to pray software. despite calling himself a tech disaster, he tried it for the faithful in st. peter's square. after you're done you can click an icon to say you've prayed with the pope. the app is available in six languages. getting to the super bowl won't be cheap this year, but the food prices just might surprise you. the atlanta falcons are this year's hosts. they say food and drink prices will be the same during the super bowl as they are during the regular season. so that means that hot dogs, 2 bucks, beer, 5 bucks, that's great. the falcons' ceo says he wants to make the experience as enjoyable as possible. last year super bowl prices were up 50% higher for food. come on. you paid enough for that ticket.

on the game, well, they want their money back. new fallout this morning as outrage grows over this play during the nfc championship. >> the pass incomplete. no flag. >> reporter: the referee failing to throw a flag despite the blatant pass interference by the rams. >> it was simple. they blue the call. should never have not been a call. >> reporter: the no call seemingly costing new orleans the game forcing at least one sports betting site to now refund all saints-related bets and spurring bookies to threaten a class action lawsuit. >> i feel like it was obvious. i mean, there it is. i mean, everybody -- everybody knows it's obvious. >> they deserve that moment to at least compete in the super bowl and we don't have that. >> reporter: right now it's impossible for teams to demand refs review pass interference calls but according to espn, that may change. >> this is on the league office because you don't have a rule in place that would allow for that call to be reviewed. >> reporter: the league will reportedly discuss this off-season whether to make pass interference penalties reviewable allowing coaches to

contest a call or noncall like sunday's. the change would require approval from at least 24 of the 32 nfl team owners. some have hesitated to make the change in the past concerned about making the game too long and interrupting the flow on the field. >> it's too late. it doesn't mean nothing to us. to admit it, don't admit it, it's too late. >> reporter: while a rule change would not change the outcome of sunday's game, roger goodell could. a little known rule says the nfl commissioner is allowed to reverse the call in this situation meaning goodell could hand the victory to the saints or even make the two teams play the game again. neither move is considered likely. >> saints fan not letting this go. one eye doctor in louisiana has a different solution here. offering free eye exams for nfl refs. meanwhile, someone has already bought some billboards near the super bowl stadium in atlanta. now these billboards say, nfl bleaux it and saints got robbed. those are the billboards.

you can tell they're saints fans. look at the way they spell bleaux, the way they go geaux saints. well, the nfl is investigating whether someone aimed a laser at tom brady during sunday's game. tv cameras captured -- you see light on brady at least twice during the fourth quarter. the league, the patriots and the chiefs say they were not aware of it. obviously didn't interrupt his game. a search is under way right now for a young woman last seen at a bar in boston. 23-year-old olivia ambrose was out with her twin sister and friends on saturday night. she was reportedly dancing with a man about her own age then he got thrown out of the bar and ambrose left with him. she has not been heard from since. her family is now reaching out to the public for help. >> just want to, you know, get -- have her get in touch with us or somebody get in touch with us. we just want to hear from her and have her home. >> police have been analyzing surveillance video from inside
