police arrested a lyft driver accused of sexual battery. a woman called for help near shell mound and powell street. her lyft driver attacked her during her ride to the hotel. police arrested the driver, 22-year-old. the suspect has passed a background check. he's no longer allowed to drive for lyft. an east bay family wants to know why nest did not alert them when hackers got into their home security system. >> the family found out in a scary way. as ama daetz reports, fear turned to anger when they found out what the company knew all along. >> it came on like the emergency sounds of an amber alert, say. a man's voice announced that north korea had launched three intercontinental ballistic missiles toward the united states, recommended everyone take shelter. >> our media partner spoke with laura lyons.

she heard that on monday. she realized it was coming from her nest security camera. her scared 8-year-old son hid under the rug. >> right down the rabbit hole. terrifying. >> lyons called nest and found out it was a prank and her camera was likely hacked. >> we're curious why we didn't get notification. our poor 8-year-old scared to death. >> google owns nest and said nest was not breached. instead, some customer passwords were exposed through breaches on other websites. google says two verifications typically eliminates that risk. a class action lawsuit accuses the agency of pregnancy discrimination. abc 7 news spoke with nick i mcnulty, one plaintiff in the suit. she's worked at ac transit through two pregnancies. the agency denied her a voucher

to buy a larger uniform while pregnant. she was given a journey conference room to pump breast milk and not giving her enough time to do it. >> they put me on an unpaid leave of absence for asking to pump breast milk. asking for lactation accommodation that they refused to provide to me. >> they refused our request for an interview, but the agency issued a statement saying a lawsuit is an assembly of one party's allegation and by no means a confirmation of fact. we ask the public to withhold judgment as we uncover the circumstances that gave rise to the issue. the alameda county sheriff's office says jesus dickey was alone in his cell when he died. he suffered from skiz freen i can't whiime

compulsively drink water. in the 2019-2020 budget, newsom wants to create a rapid response program to give $20 million to humanitarian organizations and nonprofit entities that currently help migrants near the border. according to the l.a. times, most of the funding would likely go to the san diego rapid response network. a coalition of humans rights organizations, attorneys and community leaders. happening today, if you need a reason to eat out, we have four words for you. san francisco restaurant week. >> more than 100 restaurants in the city will offer prefixed meals. their goal is highlight the best known dishes or showcase a sample of the food the chefs love to cook. the prices range from $15 to $65 for two and three-course meals. you can find participating restaurants by clicking the explore tab in google maps.

this afternoon. we start off at 43 at 8:00. 57 at noon. nearing 60 also during the afternoon hours. dropping off to 51 at 8:00. our last stop will be the south bay. 41 this morning to near 60 from 2:00 to 4:00. back to 50 with a light jacket this evening. let's get a check of the morning commute. any hotspots, sue? >> in fact, all lanes are blocked in walnut creek. you can see the brake lights there at the top of your screen. the emergency vehicles. we had an overturn that was originally blocking one lane. now they're saying all lanes blocked. southbound just south of treat on 680 in the walnut creek area. expect big delays here as they get -- try to get it cleared out. we'll take a look at drive times. right now, not showing a tremendous amount of slowing. but that is going to change shortly on 680 from hercules and the martinez area into walnut creek. 24 is looking good once you get

past that scene of that accident, if you can. there's a slow traffic out of the central valley. we'll check back into walnut creek situation in a minute. there's a new reminder of when it's safe to turp left. yellow arrows flash signals at two intersection this is san jose. the yellow arrows slash until the signal turns green. that confirms traffic has a red light. the bay area newsgroup reports more cities are installing these across the u.s. they've cut less turn-related accidents by more than 30%. new this morning, fewer people are taking public transit because of uber and lyft. >> this is according to a study at the university of kentucky. they looked at 22 cities, including san francisco. the study finds bus ridership in san francisco has fallen 12.7% ever since uber and lyft entered the market in 2010. the city would have to increase bus service by 25% to offset the

washington, alaska and hawaii. the island came in at number 5 50. researchers compared all 50 states across what they called 30 key indicators of a positive commute. some of those factors include rush hour traffic, congestion, road quality and gas prices. california came in at 40 for highest auto maintenance cost, 42 for rush hour traffic congestion. 47 for highest car theft and 49 for the highest average gas prices. now, what is kind of interesting about this report, oregon came in at number 1. interesting, because it's surrounded by all the states that were at the bottom of this list. reporting live in san jose, jobina fortson, abc 7 news. >> i used to live in oregon and the roads weren't all that. it is day 33 of the federal government shutdown. two bills headed for a senate vote tomorrow would end the shutdown in different ways, but neither bill is expected to

pass. one bill includes funding for president trump's border wall in exchange for protection for daca immigrants. the other bill, which already passed in the house would temporarily reopen the government through february 8th while negotiations continue. federal workers are set to miss their second pay czecheck n friday. a yacht club served lunch to coast guard islands. coast guards are among the employees not getting paid during the shutdown. >> i didn't eat too much this weekend. i kind of rationed it out. just trying to save as much money as i can. >> dire straits for some of wtuo it's beetough. >> at oakland horerb keller, the late co-founder. alec baldwin is heade fac a and harassment charges after a dispute over a parking space. the 60-year-old actor is accused

come. we do have another accident partially blocking the lane. this is westbound 80 nearel portal. we'll find out more in a bit. a new study finds the owners of kia and hyundai cars has filed insurance claims at a higher rate for comparable vehicles. according to the highway loss data institute, the 2011-2015 kia optima, the 2011-2014 hyundai sonata. 2011-2015 sorrento, the santa fe and the 2013 and '14 santa fe sport have doubled the noncrash fire claim rates. last week the south korean automakers announced a recall to fix fuel pipe problems that can cause fires. companies are gaming the sigs tem when it comes to attracting job applicants. a new report says firms are encouraging workers to leave

out the door. number one, the berkeley city council unanimously passed a new ordinance on single use disposal fad ware. it will put new restrictions on take out containers and utensils, including a 25 cent fee for each disposable cup. b.a.r.t.'s approval rating for riders is at an all-time low. it's plummeted to 56% from 84% in 2012. number 3, a wallet hub report says california has among of the worst roads in the country. they compared all 50 states in rush hour, traffic congestion, gas prices. teachers in los angeles headed back to the classroom this morning after a week long strike. a new agreement calls for a smaller class sizes but school nurses and counselors. grab a heavier coat this morning. you may have to scrape some ice, frost is possible in places like danville and san ramon and alamo

takeout containers and utensils. it would require people to pay for a paper cup if they don't bring their own. backers believe it would cut the amount of garbage on the streets. another part of the law would mandate that restaurants serve takeout food in containers that are biodegradable. it would require reusable plates or utensils food served inside restaurants. >> for our pockets and the small birks it's not good. it's almost triple the price. i don't understand why. it should be cheaper. >> we know for a few, it's going to be difficult. we're not trying to punish them. >> last night's vote was technically a first reading. but barring any opposition, it's expected to pass at the next council meeting. happening today, san francisco police will be holding a news conference to provide details on the arrest of a man accused of assaulting an 88-year-old grandmother. officers arrested 18-year-old keonte gathron saturday after he committed another robbery. investigators believe gathron

beat the grandmother on january 8th in a park in visitacion valley. >> she is slowly improving but still in critical condition. >> a high school spanish teacher accused of sexually abusing his student inside his classroom. he was arrested at the high school yesterday. police reported that chavarria molested the student in november and again in december. in the east bay, oakland police arrested a person of interest in a shooting that left three people dead. this happened 2 1/2 weeks ago a day after officials announced the city had the lowest homicide rate in nearly 12 years. police haven't given details about the suspect. the investigation is ongoing. also in the east bay, a woman is safe this morning thanks to a good samaritan. he pulled her from a car seconds after it slammed into a house. this happened in oakland at east 7th and lancaster streets last night. the car severed a gas line.

firefighters had to move quickly to shut off gas to the damaged house. the man who rescued the driver says she was trying to avoid hitting a bicyclist. >> i seen a dude on the bike that came through and she hit the gas and that's when she crashed into the car. i helped her out of car and picked her up. she's old, so i picked her up and took her down the street. >> the driver wasn't hurt. pg&e has until today to respond to a federal judge's proposal it reinspect its entire electric grid. the aim is to prevent damaged lines from sparking wildfires in the coming fire season. the proposal comes after the deadly wildfire that destroyed the town of paradise in november. the cause is still investigation, but pg&e reported an outage around the time and place where the fire started. the judge says he's ready to order the company to cut power to any area where wind conditions become dangerous regardless of the inconvenience to customers.

as the government shutdown enters its 33rd day, president trump is preparing his annual state of the union address. >> white house aides say there trump plans to give his speech tuesday as scheduled. but the venue may change from the capitol to somewhere outside of washington. house speaker nancy pelosi previously requested the speech be delayed because of security concerns related to the shutdown. the senate will vote on two bills tomorrow that could end the shutdown but neither bill is expected to pass. >> to breakthrough this stalemate that would reopen government swiftly -- >> no one can call this new effort a compromise. >> one bill includes funding for president trump's border wall in exchange for protections for daca immigrants. the other bill who temporarily reopen the government through february 8 pt while negotiations continue. no tuition increase for cal state university. this fall, the cost of in-state tuition will remain atnuly for
