traffic alert. easy for me to say. it's in the east bay. let's get over to her. hi, sue. good morning. it's in walnut creek. sky 7 is above 680. look at the tow trucks, just pulling the cars off the freeway now. that's great news. hopefully the left lanes will be reopened shortly. it was an overturned for a time near treat boulevard. all lanes were blocked. now they're towing that vehicle, at least one of them off the scene. hopefully traffic will begin to impro improve. it's backed up on to 242 and back to highway 4 for 30-minute delays. hopefully that will begin to dissipate. still have the flares out there with the two left lanes blocked off. we'll check back in a couple of minutes. first, here's mike. >> thank you very much, sue. remember how breezy it was yesterday morning? last night, a sigh lept the dry air and lack of clouds, it's definitely colder this morning. you may need a heavier coat.

proposing a vacancy tax on residential and commercial properties. the goal is to encourage property owners to lease out their empty spaces and free up units kept off the market during our housing crisis. the details of the tax are still being worked out. new this morning, emeryville police arrested a lyft driver accused of sexual battery. a woman called for help from a hotel near shell mound and powell street on thursday. she said her lyft driver attacked her during her ride thot hotel. police arrested the driver, a 22-year-old. lyft says the suspect had passed a background check. he is no longer allowe to drive for lyft. a new class action lawsuit against ac transit accuses the agency of pregnancy discrimination. we spoke with nicki mcnulty, a plaintiff in the suit. she worked through two pregnancies there. mcnulty said the agency denied her a voucher to buy a larger uniform while pregnant. she also says she was given a

dirty conference room to pump breast milk and not given enough time to do it. >> transit made that difficult as well. to the point they put me on unpaid leave of absence for asking to pump, breast-feed, asking for lactation accommodation that they refused to provide to me. >> ac transit refused our request for an interview. but the agency issued a statement saying a lawsuit is an assembly of one party's allegations and by no means a confirmation of facts. as such, we ask the public to withhold judgment as we work to uncover the circumstances giving rise to this issue. governor gach newsom is proposing a plan to use state funds to aid migrants that enter the border. newsom wants to create what he calls an immigration rapid response program, which would give $20 million to humanitarian organizations and nonprofit ept tis that currently help migrants near the border. most of the funding would likely go to the san diego rapid

response network, a coalition of human rights organizations, attorneys and community leaders. it is day 33 of the federal government shutdown. two bills headed for the senate vote tomorrow would end it in different ways. but neither one is expected to pass. one bill includes funding for president trump's border wall in exchange for protections for daca immigrants. the other bill which passed in the house would temporarily reopen the government through february 8th while negotiations continue. federal workers are set to miss their second paycheck on friday. abc 7 news was in alameda when members of the bay yacht club served lunch to their neighbors at coast guard island. they're among the federal employees making tough choices while not getting paid during the shutdown. >> i didn't eat too much this weekend. just ration it out. just trying to save as much money as i can. >> dire straits for some of our people. i don't want to sugarcoat it. it's been tough.

take a look at the temperatures in san francisco. sunny side, 41 degrees. excelsi excelsior, marina, castro, mission, bay view, 47. some of the warmer spots. 30s from san leandro southward into the south bay. mid to upper 30s in the east bay valleys. it's definitely chilly this morning. the golden gate with a light breeze and clean air, what a great day to be outsidement check that out. it's going to get hazier into the forecast. king tides coming in about 12:41 through golden gate. everywhere else, the next hour or so, there could be bay shore flooding. 56 at noon. 50 at 8:00. peninsula, total sunshine. 42 at 8:00. upper 50s from noon to 4:00. 51 at 8:00 under the stars. you'll need the sun glasses in the south bay. 41 at 8:00. 58 at noon. near 60 in the afternoon hours. 50 at 8:00.

this morning, authorities are trying to find the person responsible for causing an airport scare in new jersey. it was spotted over teterboro airport last night. the drone was in the arrival path of nearby newark liberty international airport. the drone forced air traffic to be suspended at newark. one plane missed the drone by only 30 feet. the drone was flying at 3500 feet. eight times higher than 400-foot maximum for the devices. it was flying too close to an airport. drones are prohibited from coming within five miles of an airport. in the east bay, hackers are blamed for causing panic for an orinda family. they heard a terrifying message out of their nest security

camera. >> it came on like the emergency sounds of an amber alert and then a man's voice announced that north korea sent ballistic missiles to the united states. recommended everybody take shelter. >> the east bay times spoke with her and she heard the warning on sunday. she called 9-1-1 and nest. that's when she found out the camera was likely hacked. google owns nest and told the east bay times that nest's servers weren't breached. hackers probably got her password from a breach on another website. google says two factor verifications typically eliminates that risk. forget the cake. there is a new fun way to reveal your baby's gender. how does lasagna sound. villa italian kitchen is offering gender reveal lasagnas for $140. the restaurant has several bay area locations. its creation is made to order.

this happened on a train monday night. it appearsour people were fighting while others watched. no word on what started that fight. this video being revealed just as b.a.r.t. got a report card from riders. it's not great. >> this morning we're taking a closer look at that new rating, which is the worst the agency ever received. >> reporter amy hollyfield is live at the new york berkeley b.a.r.t. station. amy? >> reporter: hi alexis. despite this new survey, we're finding this morning that b.a.r.t. riders don't think that much is going to change. here is a look at the walnut creek b.a.r.t. station from sky 7 this morning. commuters head to b.a.r.t. thisy have questions about whether the board of directors will make changes after getting the survey results. the survey found that customer satisfaction is at an all-time low of 56%. people are concerned about the homeless issue.

they say b.a.r.t. is dirty, they're also worried about crime on b.a.r.t. we asked people how confident they are that b.a.r.t. officials will respond to the survey with action. >> that's kind of low, i would say. i don't know how they do it. i feel like even if they were to make changes, it would take a really, really long time. but i don't think too, too much about their process and all of that. but i don't anticipate that anything will change very rapidly. >> reporter: b.a.r.t. spokesperson says they have been focusing on quality of life issues, but they clearly need to do more. the board is set to look over the survey at a two-day long workshop to discuss it and talk about what to to next. amy hollyfield, abc 7 news. thanks, amy. that passenger didn't have a whole lot of ideas. i'm sure some of you do. we want to hear about them.

use the #better bay area. the berkeley city council taken the next step in passing the toughest new ordinance in the country on single use disposable food ware. >> the legislation would put restrictions on paper cups and u utensi utensils. you would be required to pay 25 cents when you don't bring your own cup. they believe it would cut the amount of garbage on streets. restaurants serve takeout food in containers that are biodegradable and require reusable plates and utensils for food served inside restaurants. >> for our pockets in the small business, it's not good. it's almost triple the price. i don't understand why. it should be cheaper. >> for a few we know it's going to be difficult. we're not trying to punish them. >> last night's vote was technically a first reading. barring any opposition, it's expected to pass at the next meeting.

pg&e has until today to respond to a federal judge's proposal it reinspect its entire electric grid. the aim is to prevent damaged lines from sparking wildfires in the coming fire season. the proposal comes after the deadly wildfire that destroyed the town of paradise in november. the cause is still under investigation, but pg&e reported an outage around the time and place where the fire started. the judge says he's ready to order the company to cut power to any area where wind conditions became dangerous regardless of the inconvenience to customers. happening today, san francisco police will be providing details on the arrest of the man accused of assaulting an 88-year-old grandmother. officers arrested 18-year-old keonte gathron saturday after they say he committed another robbery. investigators believe gathron beat yik oi huang at a park in visitacion valley before breaking into her home. police haven't revealed how they linked him to this attack. huang's family says she's slowly

improving but still in critical condition. a high school spanish teacher accused of sexually abusing a student inside his san jose classroom. detectives arrested ricardo chavarria yesterday at the high school. staff members alerted police. they reported that he molested the student in november and again in december. in east bay, oakland police arrested a person of interest in a shooting that left three people dead. this happened 2 1/2 weeks ago, a day after officials announced the city had the lowest homicide rate in nearly 12 years. police haven't given details about the suspect. they say the investigation is still ongoing. also in the east bay, a woman is safe this morning, thanks to a good samaritan. he pulled her from a car seconds after it slammed into a house. this happened in oakland at east 7th and lancaster streets last night. the car severed a gas line. firefighters had to move quickly to shut off gas to the damaged home. the man who rescued the driver says the driver was trying to avoid hitting a bicyclist.
