students at bushhill elementary in alexandria. >> we couldn't go because it was shut down. >> reporter: sixth grader recently learned the planned field trip would have to be canceled, the museum closed. >> they had 80 signatures before i found out about it. >> so carter and a friend jumped into action collecting all these signatures to petition his congressman. >> maybe he could express his concern to congress. >> reporter: in that petition, a serious introduction. the government shutdown has gotten out of hand, it says, and it has affected people getting paid and trash services and now the learning opportunities of america's youth. the two boys collected 105 signatures in three days, and the takeaway, carter says, is to never give up on your goals. was that hard work getting all those names? >> yes, it was. a lot of people said yes but some people said no, and that was hard. >> reporter: after phone calls from carter's dad, a political consultant -- >> i am impressed and proud of him for doing it.

>> i'm all for it. >> yeah, we need to learn more about that. >> yeah, all about it. yeah. all for it. that and an iv of coffee. >> whatever works to bring in the news you need in the middle of the night. we begin right here with breaking news. president trump now saying he will deliver the state of the union address when the government shutdown is over. >> the announcement came hours after nancy pelosi blocked the president from giving the speech from the house floor. he tweeted i am not looking for an alternate venue for the state of the union because there's no venue that can compete with the history, tradition and importance of the house chamber. the president went on to say, he said he looks forward to giving the speech in the near future. pelosi tweeted back, mr. president, i hope by near future you are going to vote on the house package that the senate will vote on today. >> that legislation pelosi is referring to is one of two bills the senate is taking up today. it would fund agencies for the next two weeks while they hammer out a deal.reblan i with e ano

border wall in exchange for temporary protection for dreamers. neither bill is expected to pass and house democrats are working on a new proposal to offer more money for border security but not a wall. a suspect has been taken into custody, accused of a mass shooting at a bank in florida. an armored s.w.a.t. vehicle was used to smash into the building. >> shortly afterward authorities say the 21-year-old surrendered and was taken into custody. he has been charged with five counts of first-degree murder. he worked as a prison guard in training from last november until january 9th. he had no discipline problems while he was employed. police wrapped up their work at the home he shares with his mother. one neighbor called him normal, quiet and polite. we get more now from abc's linsey davis. >> reporter: a massacre inside this flo

>> reporter: it was just after noon when the shots rang out at this suntrust bank. inside, a man who police say contacted dispatch saying he fired multiple shots. >> after assessment of the scene, we were sorry to learn that we had at least five victims, people who were senselessly murdered as a result of his act in this bank. >> reporter: after the initial negotiations to get the man to leave the bank failed the s.w.a.t. team used an armored vehicle to ram the front doors. the suspect identified as a local resident, a 21-year-old, stefan xavier and he appears to be the suspect led out in handcuffs. >> today has been a tragic day in our community and we suffered a significant loss because of a senseless crime. >> reporter: police have not yet identified the victims. at a nearby hotel, loved ones

gathering, overcome with emotion learning the news. still no word on a motive. police say it's an active and fluid situation, and the fbi is now joining the investigation. the governor of florida says the suspect needs to face very swift and exacting justice. linsey davis, abc news, new york. >> just an awful scene there. thank you. we are learning about the shooter as well. apparently, he lived a few miles from the bank. >> we are still working to learn more about the victims. law enforcement hasn't said too much about them, but we will look for that information. and a massive search is under way for a missing 3-year-old boy. he was last seen playing in his grandmother's backyard with two other kids. investigators are using volunteers, drones and helicopters to search for him. abc's steve osunsami has more.o carolina searching the thick woods for 3-year-old casey hathaway. the fbi is here and 400 neighbors are helping in the search. so far no sign of the boy. >> our number one priority right now is finding casey.

>> reporter: the 3-year-old went missing tuesday afternoon from his grandmother's home where he was playing in the backyard with two related children. by the time the other kids came inside the boy had disappeared. it was freezing cold on tuesday night and authorities are hoping the boy found shelter and are also searching nearby waters. >> i want to reiterate, the family has been extremely cooperative and we are thankful for that, so no tip is insignificant. if anybody out there has any tips, remember, casey is a small child. he's cold and hungry. >> reporter: authorities are saying this is a missing persons case but they have not ruled out that he was kidnapped. steve osunsami, abc news, newbern, north carolina. >> awful story. >> steve, thank you. and we are tracking another storm system packing rain and wind. it's affecting a third of the country. it's stretching from the gulf

closs is recovering after being held hostage for 88 days. she was held hostage by the man who killed her parents. now the company where closs' parents worked said they will donate the $25,000 they offered in her case to her. the company's president says he hopes a trust fund can be set up for jayme. as furloughed federal employees struggle to pay their bills, the tulsa oklahoma school district is offering to put them back to work right away. they are inviting government workers to apply to be substitute teachers. applicants must pass a background check. it pays up to $90 a day depending on the level of education. senator joni ernst is dealing with some explosive allegations detailed in her divorce papers. the iowa republican is denying allegations from her ex-husband that she had an affair with a soldier while she served in the military. she is accusing her ex of having his own affair. he physically assaulted her
