be among the special guests seated with the first lady. >> aside from immigration he will introduce a bold new initiative to stop the spread of hiv by 2030. mona kosar abdi has a preview. >> reporter: the white house says the president will focus on five key issues including, immigration, trade and national security, however, the president has also teased possibly dropping a bombshell. on the greatest political stage in front of both chambers of congress, president trump will deliver his second state of the union address. the first before the newly democratic run house. speaker pelosi sitting directly behind him. >> i probably have done more in the first two years than any president, any administration in the history of our country. >> reporter: on the heels of the longest government shutdown in u.s. history the white house says president trump will strike a conciliatory tone and call for unity in an attempt to mend the

partisan divide. >> it's going to be a speech that's going to cover a lot of territory, but part of it is going to be unity. >> reporter: but in the past few days, the president has set a different tone publicly considering to use the speech to declare a national emergency over his divisive border wall. >> i don't want to say but you'll hear the state of the union and then you'll see what happens right after the state of the union, okay? >> reporter: a move even opposed by some members of his own party. the guest list also includes a snapshot of the key political messages the president will highlight. it includes a family whose loved one was killed by an undocumented immigrant, survivors of the tree of life synagogue and a ben phan factor of trump's tack bill and democrats have chosen stacey abrams to deliver the rebuttal, the first african-american woman to do so. democrats intend to use their plus ones to send a message.

congresswoman alexandria ocasio-cortez said she'll bring a woman who kenneth, janai. >> mona, thank you. our live coverage begins at 9:00 eastern right here on abc. federal prosecutors in new york have issued a subpoena seeking documents from president trump's inaugural committee. sources say they want information on donors, vendors and guests. they're apparently looking into the benefits they may have received in exchange for donations as well as the possibility of illegal foreign contributions. the committee has been under investigation for how it raised and spent a record $107 million from the fund on inauguration events. we turn now to the blackface controversy regarding virginia governor ralph northam. nearly every politician has called on him to resign but now he's asking his cabinet for more time to consider his next move.

virginia governor ralph northam ignoring growing calls for his resignation. >> he has to come to grips with the notion he doesn't have the authority to lead anymore. >> reporter: fellow democrats now suggesting northam is staying in office out of pride rather than for the good of the state. >> this is the 400th anniversary of africans coming to virginia in chains, and the juxtaposition of that ceremony with a governor that's misled us about blackface who's been in blackface is not a picture that virginia wants to put forward to the nation or the world. >> reporter: northam's problems started after this racist photo surfaced from his medical school yearbook page. initially the governor admitted he was in the picture but then an about-face days later. >> i believe then and now that i am not either of the people in that photo. >> reporter: northam did admit he appeared in blackface at a different party that same year though dressing up as michael jackson for a dance contest. >> i used just a little bit of shoe polish on my cheeks. >> reporter: if northam were to step down next in line is lieutenant governor justin fairfax who is not calling for the governor to resign.

>> i believe that the governor has to make the decisions in the best interest of the commonwealth of virginia. >> reporter: but fairfax says he is ready to lead if he needs to. >> i'm happy to be prepared to assume our roles and responsibilities given to us by the virginia constitution. >> if northam does step down fairfax would be the second african-american governor in virginia's history. after 11 weeks and more than 50 witnesses the trial of notorious mexican drug lord el chapo is in the hands of the jury. they will decide whether he is guilty of drug trafficking, money laundering and plotting to murder his rivals. the jury issisting through pages of testimony and recorded conversations. >> their decision could come quite quickly inside the jury room, but it may take them time to work through all the charges. they have to systemically go through each count in the indictment and their verdict sheet, recordings in which mr. guzman is allegedly talking about large narcotics transactions strikes me as the most damning evidence. >> the defense wrapped up its case in just 30 minutes.

security has been unprecedented with u.s. marshals escorting jurors to court. breaking overnight, at least eight people are dead and a woman in custody after a fire ripped through this apartment building in an upscale neighborhood of central paris trapping people on their balconies. about 200 firefighters responded. police say the suspect lives in the building and they believe the fire was set on purpose, but they're not confirming why. back here in this country five states in the west are now under avalanche warnings. strong winds could make the heavy snowpack unstable in utah, idaho, montana and oregon and in california's sierra nevada. five feet of snow fell at june mountain resort which had to close monday. time now for a look at your weather forecast for this tuesday morning. good morning. we're looking at chilly winds, massive snow, particularly as

we're back with video of a small plane appearing to break apart before bursting into flames and crashing into a house in yorba linda, california. four people in the house were getting ready for a super bowl party before they were killed. the pilot who also died was a retired police officer. investigators are trying to determine if severe weather played a role in the crash. debris from the plane hit 15 homes and covers 4 blocks. a judge in kansas is under fire after he called two teenage girls aggressors during a sexual encounter with a 67-year-old man. prosecutors are considering an appeal after judge michael gibbons gave the defendant less than six years in prison. that is well below state sentencing guidelines even though the man admitted to knowing the age of one of the girls he solicited on facebook but the judge said the 13 and 14-year-olds had voluntarily taken money from the defendant and the judge questioned how much harm the girls had suffered. supreme court justice ruth bader ginsburg appeared in

public last night for the first time since her lung cancer surgery in december. there were no cameras, but the appearance at a concert in her honor in washington is being viewed as an encouraging sign of her recovery. ginsburg is not expected to attend tonight's state of the union address. new and sad details about the sudden death of soap opera star kristoff st. john at age 52. he played neil winters on "the young and the restless" for nearly three decades and was engaged to be married in september. they're treating the case as a possible alcohol overdose but the cause of death is pending additional investigation following monday's autopsy. st. john recently went public describing the grief after the death of his son four years ago. and "ocean's eleven" style bank heist has police in belgium baffled. they say the thieves emptied about 30 deposit boxes inside a vault in antwerp and did it by

digging a tunnel from a nearby home into the sewer system. after risking death moving through three-foot-wide pipes they dug another tunnel into the vault. police have not said how much cash was stolen. well, there is a new number one. chicago o'hare international is now the busiest airport in the u.s. the faa says more than 903,000 flights passed through o'hare last year. that's about 8,000 more than atlanta's airport which now ranks second.a., t.nd denver rounded out the top five. well, coming up, the explosive revelation about liam neeson. why the actor says he once thought about killing a black man and how his fans are reacting. also ahead, tom brady, the exclusive interview. how he stays grounded and the one thing most americans do on a regular basis that he says freaks him out.

bystanders freed the driver of that suv. he's okay and now johnson has been honored with an award for excellence. we turn now to actor liam neeson igniting a firestorm of controversy. >> while promoting his new movie he opened up about a revenge fantasy he had decades ago and race plays a role in it. here's abc's linsey davis. >> reporter: a brutally honest admission from actor liam neeson in an interview with "the independent" promoting his latest movie "cold pursuit" where he plays a man seeking revenge. >> i'm going to kill him. >> reporter: he says he understands the rage that can drive a person to revenge sharing his own real-life reaction to hearing that a woman close to him was raped. >> i asked, did she know who it was? no. what color were they? she said it was a black person. >> reporter: the actor says he actually carried a billyclub like weapon called a cosh. >> i went up and down areas with a cosh hoping i'd be approached by somebody. i'm ashamed to say that and i did it for maybe a week hoping some black [ bleep ] would come

out of a pub and have a go at me about something, you know, so i could kill him. >> reporter: he now says he realizes how awful his behavior was. >> it was horrible, horrible. when i think back that i did that and i've never admitted it. >> reporter: this happened 40 years ago but it's just being revealed now and online it's causing quite a bit of backlash with some calling his comments racist but liam neeson says he's hoping this can be used as a teachable moment. he'll appear on "good morning america" later this morning. linsey davis, abc news, new york. >> our thanks to linsey. new details in the jussie smollett case. the "empire" actor apparently did not want to go to police. investigators in chicago now say smollett's friend told officers the actor did not want to report the alleged attack against him, but the friend believed he should come forward. meaning while, police say they're now reviewing video from additional surveillance cameras in the area. two people of interest have still not been identified. a high school teacher from suburban atlanta is under

investigation for a video appeared to show him repeatedly hitting a student. the video shows the student first throwing a chair at the teacher. the teacher then allegedly pushed the boy to the floor and punched him. the teen's family says the man provoked the student by making fun of what -- of the hat he was wearing. the school system isn't commenting on the status of the teacher who is also a football coach. officials are confirming that a foul ball killed a longtime los angeles dodgers fan. 79 linda goldblum was sitting in the seats that she and her husband usually occupied when the ball flew over the netting hitting her in the head last summer. she was conscious when she left the ballpark in the ambulance but soon lapsed into a coma and died several days later. her family and the dodgers have reached a settlement but they have not provided details. more than a million people are expected to cheer on the new england patriots at their super bowl victory parade today in boston. tom brady and mvp julian edelman celebrated at disney world monday checking out the park and

rides. they even took turns at jedi training. snow. east bay hills getting snow, livermore, you can see it onshore through 10:00. the rain is a one. snow at the highest peaks. that's where it could stick. it could fall as low as 500 feet. let's get to the roads. >> reporter: i got reports of co-workers, there's hail between san leandro and oakland. that can be mixed in as well. we have ice, a sig alert in the sausalito area, 101 past alexander avenue. this was first reported around 12:30 overnight. chp shut down three left lanes because of that ice. it is counter-commute, 4:30, not seeing a back-up yet. i am keeping appear eye on that. bay bridge toll plaza, no

significant issues here. we do have a major commuter problem. i'll talk about that next. >> alexis, thank you. be careful out there. some of you may be driving through snow. >> looking for flights in the santa cruz mountains. what do you see? >> reporter: it's likely to be here? i was not prepared for that. this snow that been coming down for 15 minutes. i've got to tell you, i quo to the santa cruz mountains all the time. this doesn't happen vep often. we've been seeing snowplows. a few minutes ago they plowed the ground. now the snow is sticking on the highway. i'm not sure what they are going to be doing. i know they closed 17 last night or overnight. i don't know if that's going t happen again but i've never seen anything like this in the santa cruz mountains. this is a rare event.

>> i see all the snow. >> stand here and look that way. >> that's a lot of snow, that's coming down. >> that's viewer in the santa cruz mountains sent us that video. a lot of people enjoying the snow. it can cause issues. the snow started coming down on the summit. they closed 17 in both directions for 45 minutes or so. eventually they reopened when they said they had enough plows and equipment to keep the roads clear. seen the clouds coming through, chp cars with traffic, making sure drivers don't go fast. caltrans telling about icy and snowy conditions. this is going to be interesting. we all know what it's like on highway 17 when it rains but now we're going to have to deal with the snow this morning. so caltrans out here with the
