blackface in college as well. his future is shaky. our chief national affairs correspondent tom llamas tracking it all from richmond. good morning, tom. >> reporter: george, good morning to you and making things even more complicated for lawmakers here, all three of those men you mention were elected. all three are democrats and though many members of that party called on governor northam to resign, now there is mass confusion with no plan forward in how they're going to lead. overnight, virginia's attorney general running into this waiting car zooming down the block to avoid reporters. this after he made a bombshell admission on wednesday that he also appeared in blackface in the 1980s. mark herring saying he went to a college party with friends dressed as rapper curtis blow. stating we dressed up and put on wigs and brown makeup. herring, a democrat, apologizing but not resigning, something he called on governor ralph northam to do after northam admitted he had once dressed in blackface as part of a michael jackson costume.

>> i had the shoes. i had a glove and i used just a little bit of shoe polish to put under my -- on my cheeks. >> reporter: all of this as a woman has now come forward to accuse the lieutenant governor of virginia justin fairfax, also a democrat of sexual assault. dr. vanessa tyson, a political science professor says he sexually assaulted her in a hotel room in 2004. tyson says she was crying during the incident. the lieutenant governor denied the accusation saying this -- >> this is one of the most blatant examples of a smear i think you can see with something uncorroborated and as i said before, the reason it's uncorroborated is because it's not true. >> reporter: later fairfax changing his tone with a new statement saying, i wish her no harm or humiliation but i cannot agree with a description of events i know is not true.

some are worried about what's going to come out next. virginia already facing a collision of scandals at the highest levels. >> i'm shocked and incredibly disappointed. this has been an awful week for virginia. >> reporter: and we have some new reporting this morning. abc news has learned that dr. tyson did tell at least one other person about that alleged sexual assault. virginia congressman bobby scott, aides to bobby scott tell us he was informed about this alleged assault about a year ago. if all three men who are in the middle of scandal resign, the next person in line is the house speaker who happens to be a republican. george. >> tom, that's why they're so reluctant to resign right now but the pressure is building and meantime, the state government is basically paralyzed. >> reporter: george, you're absolutely right. this is one of the busiest time of the legislative session. today is budget day. law makers are still coming to

the state house. clearly there's a major question over who is in charge now especially as it comes to the democratic party. there is mass confusion throughout richmond. george. >> thanks, tom. >> as we just heard awful week for virginia. now to the storm on the move right now. deadly flooding in tennessee forcing water rescues overnight. snow and ice causing accidents across the midwest. now 32 states are on alert. alex perez is in wilmington, illinois, with more. good morning, alex. >> reporter: hey, good morning, robin. i want you to take a look around me. i'm standing along the banks of the kankakee river and icebergs, everywhere, almost looks like a glazier is melting. the deep freeze followed by a warm up is causing major problems. in tennessee overnight, severe weather turning deadly. one man killed after being swept away by floodwaters. and this heavy rain pounding the nashville area, this morning icy conditions are wreaking havoc across the midwest. >> you can see my car, a lot of ice. >> reporter: wrecked vehicles

littering highways, drivers unable to keep their cars on the road. >> i was not prepared for it. i was hoping it was hyped up. >> reporter: in fargo traffic backed up for miles. missouri state police responding to more than 600 accidents in just 24 hours. in kansas city, watch as this school bus hits slick conditions and then flips over with students on board. miraculously no one was seriously injured. from wilmington, illinois, to portland, michigan, massive ice jams prompting evacuations as that ice breaks up you can see it inching closer to people's homes causing flooding and pipes to burst. >> it's scary, the first time we've watched it break up. >> reporter: beware of ice stepping out of your car. a school principal in kansas sharing this video of himself falling on ice, warning others to get home safely. and here's the good news. here in wilmington you can see,

take a look, the river is once again flowing. authorities have allowed people to return to their homes. they have say there are no roars of major damage. michael. >> all right, that's all good news that storm is on the move and we go to ginger for the latest on where it is heading and when. good morning, ginger. >> hey, good morning. a big part is the division between extreme cold and very warm air. you can see this morning we've seen tornado warnings, even severe thunderstorm warnings in the ozarks. look at these pictures out of denver, their biggest snowstorm of the season. that's not saying a ton since they've been snow starved but this morning denver public schools are closed. businesses are closed and the temperature is subzero. so that snow and ice not going anywhere once it hits the ground because the cold comes behind it. ice storm warnings in place for kansas city and flood watches in the same region. this storm will finally start to move east through today into tomorrow. it's kind of been on repeat. we'll still see a severe thunderstorm chance, but a look

at what is going to happen up to 12 inches and we could see flooding rains in the ohio river valley. george? >> thank you, ginger. to washington where another shutdown deadline is looming. just over a week to go as congressional negotiators work toward an agreement on border security to keep the government open and congressional democrats defy president trump by launching multiple investigations right now. mary bruce is on capitol hill with the latest. mary, the president is already up early this morning tweeting an attack on one of the investigations. >> reporter: yeah, the president says that democrats and their committees are nuts and that it all amounts to presidential harassment. we've heard the president warn against these investigations but democrats here on the hill are not backing down. in fact, this morning they're ramping up and the house intelligence committee announced a sweeping new probe into the president, his family, his finances, russia and beyond while the chair of the house judiciary committee is preparing to subpoena the acting attorney general matthew whitaker if he fails to show up at a hearing tomorrow though there is no indication yet he is not coming. and today, george, democrats

will start laying the groundwork to secure the president's tax returns so the oversight here on the hill is really kicking into high gear and the president doesn't seem to like it. >> not at all. meanwhile, a hearing today on the family separation policy at the border as those congressional negotiators try to come to some agreement on border security. it appears the republicans and democrats on the hill are getting closer to an agreement. the big question is is it something the parking lot will sign off on? >> reporter: there is a renewed sense of optimism they are closing in on a deal and democrats appear open to more funding for new fencing along the border while republicans seem to concede they are not going to get the full $5.7 billion that the president is demanding for his wall. but the big x factor continues to be the president and whether he can get on board with it. >> if he doesn't get on board, he talked about declaring a national emergency but even republicans in the senate are warning him against that. >> reporter: absolutely. we've heard from many republicans, even some of the president's closest allies here on the hill, saying that is not a good idea and feel it would set a terrible precedent. >> 2020, presidential race,

elizabeth warren continues to be dogged by claims she continued to claim native american heritage on official forms and other forms, and she was forced to apologize. let's take a look. >> it is about an apology from the heart. an apology for not being more sensitive to tribal citizenship and tribal sovereignty, because it was based on my understanding from my family's stories, but family stories are not the same as tribal citizenship. >> reporter: george, the senator there telling us she is sorry that she was not more mindful and sensitive when labeling herself as american indian but, george, elizabeth warren is expected to formally launch her presidential campaign this weekend and she just continues to be plagued by this controversy surrounding her claims of native american heritage. >> as a lot of democrats worry she's not figured out how to shake it.

all right, mary. thank you very much. robin? we move to new developments to the grim mystery in connecticut. police are chasing multiple leads as a woman's body was discovered inside a suitcase. gio benitez is there with it latest. good morning. >> reporter: hey there, robin. good morning, investigators are working to identify that woman right now. shechs discovered inside a red suitcase. her hands and feet were bound. she was reported missing to new york state authorities and was last seen january 29th at about 9:00 a.m. police say her family was advised of the positive identification last night. authorities are sending heart felt con so lenses to them. investigators say a cause of death has not been confirmed. many pieces of possible physical evidence were collected. several agencies are involved trying to figure out who is responsible. tips are pouring in.

police are asking the public for any information concerning the victor her disa peeps. michael? >> thank you. now to new details about that deadly plane crash in california where a small plane slammed into a home. we're now learning the identity of the victims and more about the pilot's mysterious past. our chief national correspondent matt gutman is at the crash site this morning with the latest. good morning, matt. >> reporter: hey, good morning. the ntsb tells me that it has gathered plane parts from all over this neighborhood. it's taken them to a warehouse in phoenix where it's reconstructing the plane and the crash. now, the only part of the plane they do not have is the wing of the plane that smashed into the house behind me. the fire ball so enormous that house is condemned. like millions of others this past sunday, 85-year-old roy lee anderson and his wife,

68-year-old dahlia leber anderson hosted a super bowl watch party. along the guests their 48-year-old daughter stacy leber and son in law donald elliot. then the unthink able happened. that plane broke apart and exploded raining fiery debris on the neighborhood and killing the four family members, two others badly hurt. found in the wreckage of that cessna seen breaking up and exploding on so many cameras pilot tony pastini's i.d. >> the pilot of the plane has been identified as tony pastini a retired chicago police officer. >> reporter: only now the orange county sheriff's office and chicago police say pastini was never on the force. they say he carried a fake retirement card and a badge from a real cop that has been missing since 1978. however, the ntsb telling abc news there is no evidence this

crash was intentional. now, george, we've done more digging on pastini. he claimed he was a marine. the pentagon says that's not true. he claimed he had flown prisoners for the state of california, also false. that plane was registered to a nonexistent company belonging to a relative of his. george? >> matt, thanks. we now move overseas to an amazing rescue in turkey. a 5-year-old was found alive. they pulled her out 18 hours after the building crumbled and it was all caught on camera there. emergency teams are on the scene and say they hear sounds suggesting people may be alive and the cause of the collapse is still under investigation. michael? >> thank you george. now to that drama that's unfolding ahead of sunday's grammy awards. ariana grande dropping out after a dispute over what song she would perform. adrienne bankert is here with more. good morning, adrienne. >> reporter: good morning. yes, it's only days before the

show. ariana has the number one song in the country and now she and the grammys have parted ways. >> the 60th grammy awards. ♪ it's show time >> reporter: music's biggest night kicks off in three days. but this morning one of the world's biggest stars is telling grammy producers -- ♪ thank you, next >> reporter: ariana grande pulling out of performing on the big stage reportedly after a dispute over which songs she would be allowed to sing. >> the grammys wanted her to do one song. she wanted to do "7 rings," her latest single. they came to a compromise where she would do a medley of "7 rings" with something else. but sources tell us the grammys were insisting they would select the second song she would do and that's when she said that's it. we're not doing this. >> reporter: grande joins other big stars who have snubbed the awards show in the past but also joins famous women critics who say that they have been disrespected by the show. ♪ come get my things

sexual assault allegation which he denies. 31 states are on alert as that storm moves east bringing snow, rain and ice. it sparked water rescues in tennessee overnight and is causing major accidents all across the midwest. take a look at this. this construction worker, lucky to be alive after a major scaffolding collapse in ft. worth, texas, that injured three people. that worker was able to hang on. make it down thanks to his safety harness. >> just his fingers, that's scary. we have an abc news exclusive. the father of the 21-year-old who kidnapped jayme closs and killed her parents is speaking out for the first time after his son appeared in court wednesday. linsey davis has the interview. good morning, linsey. >> good morning, george. >> reporter: patrick patterson says he is heartbroken for jayme closs and still struggling to make sense of just what happened saying, quote, my words can mean nothing after such a tragedy has taken place.

this morning, the father of jayme closs' alleged adbuctor is breaking his silence speaking out exclusively to abc news with this message for closs' family. >> i would like to humbly ask people to pray for a complete healing of jayme's heart, mind and soul. our hearts are broken for their family. very sorry for everything that has happened. >> reporter: patrick patterson did not want to answer questions about the investigation just hours after his son jake made his first court appearance. outfitted in an orange jumpsuit and glasses, the man accused of kidnapping closs and murdering her parents declined his right to a preliminary hearing. >> and do you understand the charges against you at this time? >> yes. >> reporter: according to court documents patterson targeted the 13-year-old girl after seeing her board a school bus near her home in october. it was then that, quote, he knew that was the girl he was going to take. allegedly continuing to say he put quite a bit of thought into

the details of how he was going to abduct her, ultimately killing jayme's parents in a late night home invasion before he allegedly taped her hands and ankles together before dragging jayme to the truck of his car. for the next 88 days patterson allegedly confessed to holding jayme captive in his home where jayme told investigators he barricaded her under his bed for up to 12 hours at a time with no food, water or bathroom breaks. police sources tell the "milwaukee journal sentinel" patterson's father and sister were just feet away from where jayme was being kept during a christmas party without their knowledge. >> i would like to thank the federal, state and local authorities for their professional and respectful manner that they have treated me and my family. >> reporter: jayme managed to escape in early january making her move after patterson allegedly told her he'd be gone five or six hours. she says that's when she put on her alleged abductor's shoes and escaped to a home nearby where

jeanne nutter called 911. >> she was walking towards me crying saying you got to help me, you got to help me. >> reporter: patrick patterson says this has been a very difficult time and, again, he is extremely apologetic to jayme. his son jake is scheduled to be arraigned next month held on a $5 million cash only bond. so the father and grandfather saying that there were no clues that he was capable of doing anything like this. >> so close by, wow. >> such a nightmare. thank you, linsey. now to the urgent manhunt for a gunman who is seen approaching and killing a woman in texas while she set up for a garage sale. police are pleading for the public's help and abc's marcus moore is there in tomball, texas with the latest. good morning, marcus. >> michael, good morning. >> reporter: the victim's family is desperate for answers this morning and so are investigators who have a critical clue. they have surveillance video showing what happened in this driveway of this home. we have that video. we're not going to show you the

actual shooting. the footage is still disturbing to watch. this morning, police looking for the person who was caught on tape fatally shooting a woman, elizabeth barraza while she was setting up a garage sale in her driveway. in this chilling surveillance video from january 25th, someone approaches barraza in her tomball, texas, driveway at 6:55 in the morning. the two appear to talk briefly then seconds later barraza is shot four times at point blank rank. we are not showing you the actual murder. the killer is seen then running away before getting into a dark vehicle and driving off. >> we need justice for liz. i need justice for liz. i love you, liz. >> reporter: barraza's husband left for work that morning at 6:48 a.m. police say the shooter's truck can be seen pulling up to the area four minutes later. the couple was supposed to leave for a trip celebrating their fifth wedding anniversary two days after she was shot. police looking for any clues in this case shrouded in mystery. investigators not certain if the suspect is male or female. have made no arrests and have yet to determine if barraza was

targeted. authorities say she only put up signs for the sale that morning. >> our investigators were able to gather some critical surveillance from homes in the neighborhood of the vehicle. but as of today our investigators still need vital information to solve this horrible crime. >> reporter: there is a $20,000 reward for information in this case. barraza and her husband, they are huge "star wars" fans and peter mayhew who plays chewbacca in the films is now involved in helping to raise money. everyone just hoping for a break in the case. >> we're all hoping for that. marcus, thank you. coming up next that best-selling author's stunning confession and the new health alert about a certain type of breast implants and cancer. ♪ carla is living with metastatic breast cancer, which is breast cancer that has spread to other parts of her body.

and cancer-related surgeries, as well as claiming that his mother and brother were dead and they are not. one unnamed co-worker tells the magazine that mallory's gas lighting, lying and manipulation at the workplace was cruel. >> when i was 21 years old going way, way back now, i was -- >> not that far. >> well, thank you. i was diagnosed with severe clinical depression and for the next 15 years, i resorted to every treatment imaginable. >> reporter: mallory who has been open about suffering from mental illness in the past now attributes these miscontract saigss to a bipolar ii diagnosis issuing an apology telling abc news in a statement that in my distress i did or said or believed things i would never ordinarily say or do or believe, things of which in many instances i have versus no recollection. adding that on numerous occasions in the past i have stated, implied or allowed others to believe that i was

afflicted with a physical malady instead of a psychological one, cancer specifically. i was utterly terrified of what people would think of me if they knew, that they'd conclude that i was defective in a way that i should be able to correct or worse still that they wouldn't believe me. his story is so bizarre. mallory's rep wants it to be known his work is fiction. none of his published work was fabricated and this "new yorker" article is told pre-2015 before he was being treated for mental illness. the publisher is standing by him and the paperback version of "the woman in the window" released in march and if you have the time, 12,000 words, that article is fascinating. >> it is definitely worth reading. it is an incredible piece of investigative journalism showing a pattern year after year after year, lies on multiple fronts. it's really incredible. >> to industry insiders -- doesn't take away, he's still a brilliant writer, but fascinating. >> all right, thank you so much for that, paula.

tom llamas in richmond. good morning, tom. >> reporter: george, good morning to you. the top three elected officials here in virginia dealing with deepening scandals. all three are democrats, so that party is in a crisis mode as many wonder if anyone is going to resign. overnight, virginia's attorney general running into this waiting car zooming down the block to avoid reporters. this after he made a bombshell admission on wednesday, that he also appeared in blackface in the 1980s. mark herring saying he went to a college party with friends dressed as rapper curtis blow. stating, we dressed up and put on wigs and brown makeup. herring, a democrat, apologizing but not resigning, something he called on governor ralph northam to do after northam admitted he had once dressed in blackface as part of a michael jackson costume. >> i used a little shoe polish to put under my -- on my cheeks. >> reporter: all of this as a woman has now come forward to accuse the lieutenant governor

of virginia, justin fairfax, also a democrat, of sexual assault. dr. vanessa tyson, a political science professor at scripps college, saying fairfax sexually assaulted her in a hotel room during the democratic national convention in 2004. the lieutenant governor has denied the accusation, saying the encounter was consensual. >> it's completely uncorroborated and as i said before, the reason it's uncorroborated is because it's not true. >> reporter: later fairfax changing his tone with a new statement saying, i wish her no harm or humiliation but i cannot agree with a description of events that i know is not true. and to give you an idea of the accusations and the severity of all these accusations against lieutenant governor fairfax, he has retained the same law firm that supreme court justice brett kavanaugh had during his confirmation hearings, while dr. tyson has retained the same law firm that dr. christine blasey-ford had at the same time. george. >> hard to see how this will play out.

tom, thanks very much. >> what a mess. now to that winter storm moving across the country. 31 states on alert for snow, ice and flooding. ginger, there were water rescues in nashville overnight? >> unfortunately, one person was swept away and killed but, yes, many others were rescued before that happened in nashville, tennessee. they were under flood watches throughout the day yesterday and this morning and we've got more of that where it came from so go to the kankakee river in illinois just south and east of chicago and it looks like this. the ice jams have created flood issues themselves. that's all because it was so cold last week, then we get the brief warm-up. in between you get ice on the roads and that's where you're waking up in kansas city, missouri. you had a bus flipped. thankfully nobody injured there. that doesn't necessarily mean you won't get it this morning. you're still on an ice storm warning. eastern kansas up through iowa and parts of oklahoma, those flood watches in place, even blizzard warnings. so much going on in 31 states on the map here but something to note for later this afternoon, damaging wind and even tornadoes. as if we haven't had enough to talk about, this is the season

that story. >> reporter: gabrielle union went through an emotional roller coaster on her journey to parenthood. now she's revealing how she worked through those emotions and feelings of failure to build her family and to find joy. actress gabrielle union can't get enough of her 2-month-old baby daughter, kavia james, who even has her very own instagram page. now in the march issue of "women's health" magazine union is opening up about her decision to use a surrogate to carry her child. the actress saying she suffered eight or nine miscarriages and many failed ivf treatments telling "women's health" she was conflicted about the option of surrogacy saying the idea of it felt like surrendering to failure. but when she moved past those feelings, she put her focus into finding the right woman to carry her baby. for her a love of books was among her top criteria, saying some people care about the race, religion or food habits of their surrogate. i was like, i want a reader.

>> what she's been able to do by sharing her story is incredibly impactful. it's chipping away at the tabooness and the stigma and that's what we need to do so more women are talking about these issues. >> reporter: sharing her surrogacy decision with the public was also a hurdle. people want to see the bump. they want to know you're like them. going on to say she was concerned will i be embraced as a mom? it's terrifying. always candid, in 2017 she opened up to robin on "gma" about her heartbreaking challenges with infertility and miscarriages. >> i remember calling my husband when i just found out that we were pregnant and the scream of joy, it just felt like finally, finally, and then to find out that we had lost the baby and that was the first one and it just is so devastating. >> reporter: but now she's looking forward to years of motherhood saying, now i'm in the right mind-set and mental space and i'm open to being the

best mom i can be. and gabrielle says she keeps her head clear and body fit by exercising and sticking to a healthy diet. the new issue of "women's health" hits newsstands february 12th. robin? >> thank you, amy. >> now to that health alert. the fda warning women about a link between breast implants and cancer after new cases were reported and dr. jen ashton is here with what women need to know so tell us. >> robin, we're talking about the most popular plastic surgical procedure in this country, elective breast augmentation, breast implants. the fda has been tracking this since 2011. they are noticing rare cases of a certain breast implant associated lymphoma. this is a type of nonhodgkin's lymphoma. since 2011, they reported reported 457 cases, that includes, unfortunately, nine deaths. now, let's do a deeper dive on the numbers. about 300,000 implant surgeries are done in this country every year. over the last seven years that's over 2 million. right now just 457 cases. to be clear, the number should be zero but the overall risk for a woman on the high side, we're

talking about 1 in about 3,800. on the very low side, 1 in 30,000. so as we say in medicine an increased risk of a rare event is still a rare event. >> letters are being sent out to doctors. >> exactly, which is unprecedented to increase their awareness. >> what are somethings they should look for? >> the fda wants not just doctors and health care providers but women also with implants. they tend to show up about three years after the implant is put in. we're talking about things like pain, redness or swelling on one side, an asymmetry, one side looking different than the other, and a new lump or mass. we have to remember that this type of cancer, this rare type of lymphoma, is mostly seen with the gummy bear or textured implants which are used more often in reconstruction than cosmetic surgery. but again the good news, the treatment if a woman finds it and is detected removal of the implant, rarely will the woman need chemo or radiation. >> if a woman has implants right now or is considering having implants, what do you suggest? >> which is a lot of women.

[ laughter ] because it was a sales position. i knew he was going to make a ton of money. the most important thing keep your note which i think -- well, keep your note short. you should say thank you for the interview. i really want the job. a lot of people forget to say that. and what are the steps i need to do to follow up. it leaves you in the position of power so that you can follow up graciously. >> wow. >> that was good. but i have to say, i think it's a trick question. when i ask it i want to see if you're truthful so i want to hear a real weakness so it's a litmus test as to whether you're credible, all right. but i think you have to be strategic and name a weakness that you know has nothing to do with that job. so you're sincere but you've answered the question honestly. >> oh, nice.
