showers, some of it heavy. this is that atmospheric river, tropical moisture going in our direction, drell developing a low pressure system to the north of that the two will produce a level three storm for san francisco overnight and late tonight through tomorrow we can can pekt one to 2 inches of rain. three to 4 inches across the north bay, that may be a conservative estimate, and wind gusties 35 to 60 miles an hour. notice by midnight tonight we'll see a strong surge of widespread moderate to heavy rain across the entire north bay. then during the overnight hours into the morning commute, beginning of the morning commute, that rain will expand to all part of the bay area, most of it moderate to heavy rain. at the beginning of the morning commute, the storm is going to rage on through the day. closer look at the time line and

the floods of '05 and catastrophic storm of '82. the waters of the creek overwhelm the town. outside town hall, this sign, which shows the water mark of the flooding. i'm 5'6" and this is how high the water would have come, almost to my chest. most of the businesses on the avenue were flooded. >> had to shut down for a month or two. some of them went out of business. it was a huge economic impact on the downtown. >> reporter: mary edwards had just opened her real estate office a month before the new year's eve flood in 2004. her building sits on the edge of the river. she lost everything. >> it went up about 4 feet into the building. so everything got swept away. >> reporter: most businesses along the avenue are ready for the coming storm. the flood gates they hope will protect them. you see the gate channels in the shops every where.

he showed us the flood gates that will go up around the town hall if the river overflows its ban baen banks. >> we have seen reports of up to 3 feet. >> reporter: up here they say the creeks will do what it does. >> getting food and sand and hunker down. and i don't know, play games, wait for the power to go out. >> reporter: that's it. well, january 6th was the last big storm here in san elsmo. the waters almost came up to the bridges but not quite sure. marin public works as you said earlier they've done all the preps that they can chlgt they've checked the levees and water pump stations and for them it is awaiting game. vic lee, "abc7 news." >> how many bags i was going to

system is struggling to modernize and expand with the growing population, as you see bart train running right there. >> today we are covering a day on bart. we have a team of riders and producers riding everyline on the system. talking to the commuters about the issues they face as well as possible solutions. >>en an our crews were tweeting and posting on social media all day today, including "abc7 news" report reporter wayne. where are you? >> reporter: good evening we are on the embarcadero. it's easy to complain about bart and appreciate bart. either will getting up close and experiencing it. so i bordered today with the still camera and tried to catch it in still seconds. i'll show you bart on the morning rush you move with the crowd. if smeone stands in your way, you become an obstacle. part of what i saw during

rush-hour, especially, is how people keep to themselves especially when forced into tight spaces. freedom is it what you do, freedom is what you do when it's been done to you, famous coat by a philosopher which is the way it feels on that train. people don't talk most. people pressed elbow to elbow. squeezed io their own space. and that's when brandon harris entered the picture. i engaged him and had a conversation about conversations. >> i think you have to be like a people's person. who wants to break the ice first and initiate the conversation. >> reporter: what's a proper conversation on bart? >> hey, how is your day going? >> reporter: that's it. so we're done? >> yeah. i mean, you have to go from there. how is your day going? good. came from work, came from school. but nowadays people think you're weird so you can't be talking to everybody. >> reporter: so that's a college student studying communications

on his way to class. next hour we'll talk about another issue. and that is about how commuters interact or try not to interact with the homeless. it's a very strange mix. live at embarcadero station, wayne free man, "abc7 news." >> did you happen to notice any police activity while you were out there today? >> reporter: well, we did, actually. we went out to san francisco airport at one point. and as the train is stopped, a bart police officer went looking car to car to car, and i'm thinking what's going on. is we followed him. he pulled a man off the car for having an open container of beer. then he pulled him off to the side, and then his friend came out, friends were angry at the cop, and angry at us for looking at the exchange. ultimately the bart policeman wrote the rider a ticket for having an open can of beer. the person got back on the train. tan that was the end of the

little adventure. apparently, they are keeping an eye on people. they are doing the best they can to maintain order. and they don't like people drinking cans of beer on bart trains. you're warned. >> makes sense. all right. thank you so much, wayne. >> one of the other major issues that is driving rider satisfaction levels down on bart is fare evasion. too many riders not paying for their rides. "abc7 news" amy took a look at that issue this morning on midday live. >> one issue that came up a lot in the bart customer satisfaction survey is fare evaders. upset bart riders that people jump through and didn't pay. i did capture some video. take a look at a man at the station who pries open the gates. walks right on through. nothing happens to him. bart estimates that this issue cost the agency 15 to $25 million a year. people you talk to out here want to know why there isn't a crack down on this crime.

but the gates are so easy to get through without paying, it frustrates those who pay every day. officials say they are considering redesign of the gates to make it more difficult for people to get through without paying. they say they are addressing this. they have also hired more police officers but when we were at the fare gates this morning, and i was all over this system, i didn't see any officers keeping an eye out at the gates. it's a key point for a lot of riders. >> fleur, "abc7 news" producer rode bart in the east bay this morning around 10:40 caught up with fare inspectors on ts dublin pleasanton train. some have commented they have never seen fare inspectors before. according to the rapid transit system began in 1946 by a group of business leaders to east future congestion. now a year later joint army

gavin newsom had his first state of the state as governor today and already making some waves. announced plans to create commission on homeless ness and potentially some changes to high speed rail. >> reporter was there joining us from sacramento. leslie. >> reporter: well, i can tell you that some here put it, this was the most news worthy state of the state speech that they they could recall hearing. gavin newsom outlined a wide array of plans for the state of california. his vision for california. and perhaps the biggest bombshell had to do with high speed rail. . california's new governor addressed this joint session of the legislature first by drawing a deeper line in the sand between california and washington. >> it's this border emergency is nothing more than a manufactured crisis. and california will not be a part of this political theater. >> reporter: that earned him a

standing ovation. he then went on to take a startling stance on the long-term viability of high speed rail, saying it's too costly to continue as planned. but not pulling the plug on it. >> right now there simply isn't a path to get from sacramento to san diego let alone from san francisco to l.a. i wish there were. however, we do have the capacity to complete a high speed rail link between merced and bakersfield. >> reporter: republican leaders praised his plan. >> i think that was very responsible. and like i said i'm pless antsy surprised. very responsible in some of the things he brought fort. >> reporter: but fellow democrats held out hope the entire rail would be kept alive. >> i'm hoping once that leg gets done, that the fresno to san jose link comes next. it's so important. >> and the extent to which it doesn't link the two largest urban areas in the state or two

of the dwree largest urban areas in the state seems problematic. >> reporter: governor newsome emphasized housing to get am homeless necessary. he says the homeless crisis in california is quickly becoming a public health crisis. he said give me a good package on rent stability and i'm ready to sign it. back to you. >> leslie, did the governor talk about the pg&e bankruptcy? >> reporter: yeah he touched upon it he said he would have a something to unveil but no specifics what it would include. he also talked about moving some of the border, troops, national guard troops from the border up to help with fire suppression. i'm going to have a lot more on all of that in my report at 6:00. in sacramento, i'm leslie brinkly, "abc7 news." >> perfect. thanks, leslie. governor knew son also laid out priorities for tackling

homelessness stayed statewide. we played that for apportion of people struggling for homelessness in san francisco. jackie asked us not to use her last name originally from the north coast. we also showed it to tracy nixon who drew up in the city and raising her 8-year-old without secure housing. she watched in front of gavin newsom old office in city hall. >> i want to reserve my judgment on the letter grade right now. however, i see this every single day because i'm living this every single day. and i'm working with homeless people every single day. and i know more needs to be done. >> a the lo of people are getting sick. and we are scared to go to the doctor because we are scared they are going to say it's because you are on drugs. >> reporter: that's tough. the majority of the people who we spoke with both on and off camera, told us they were at least hopeful the governor understands homeless issues from his time at san francisco's mayor. >> san francisco climate in 60

jose and morgan hill and half moon bay. this is view from mount tam looking over the bay windy up there already. in the north bay and over the east bay a bit cooler. temperatures in the mid to upper 40s at santa row say. concord, and liver moore. and the view from the east bay hills camera looking westward, cloudy skies looking all directions. these are the forecast features. strong storm arrives overnight. bringing heavy rain, gusty wind and possibly some thunderstorms true the day tomorrow. and widespread showers with winds conditions on thursday. now the storm reignings 3 on the storm impact scale, strong storm, 1 to 3 inches of rain, maybe three to five in the east bay, and coastal ranks, wind gusting. 7:00 this evening there be light rain across the north bay, maybe some snow higher elevations of lake and mendocino countys. but later tonight we'll see the storm surging on shore producing

widespread areas of moderate to heavy rain. by 5:00 tomorrow morning as the commute gets under way, no other way to describe t it's going to be a mess. talking about lots of rain, pooling on the roadways. it's going to be a slow go. this rain and wind will not let up much during the morning commute. later in the day, though p after midday or so, we'll see it losing some of its intensity. but when we think it's going to ease up, it surges right back. late tomorrow night. and that pattern will continue overnight tomorrow night, into thursday. so thursday morning commute is not likely to be much better than tomorrow morning commute. could be even worse with allstate rain continuing to fall. so we have a couple of stormy days coming our way. rainfall potential by noon thursday totals in the pence la and east bay between one and 2 inches. not bay between 2 and five and a half inches generally. and the flood treat flash flood virtually all the bay area until thursday.

after receiving a well deserved honor. placer county medal of merit th. yesterday she was riding in the car and her dad was hit by a bullet. th then isabell used her hands while he drove to the station. >> i wouldn't know to know to apply direct preach sure ssure could get him to get care. amazing. >> they say 48-year-old stanley fired the shot that hit isabell as dad. he was later killed by police falling alleged crime spree that involved a killing of an elderly women. today he is recovering and her daughter is the hero.

>> announcer: live where you live, this is "abc7 news." and here are the stories making headlines at 4:30. another powerful storm is moving toward the bay area. you can see all the green on live doppler 7. rain will be intensify overnight into a big storm tomorrow. this is storm 3 and spend sore christian warns that the commute will be very intense tomorrow morning. reporter vic lee tells us the pile of sand in the north bay keeping a close eye on the sand in the creek. meanwhile, residents in the south bay bracing for what could be problems for flooding. rising creeks particular worry. sandbags are available at 24 locations looking for extra protection. the last big storm brought rain and problems, mudslides. sometimes the best thing to do during a big storm is to stay inside. >> i'm just kind of hunkering down, reading my book. >> that's why we are out here stay inside, hit the gym, weights. that kind of stuff. >> reporter: valley waters gauge shows the reservoir is above capacity today. last week, water went over the spillway impacting mobile home bridge forcing some residents to vaukt. valley water continues to release water into coyote creek to the outlet pipe. they are trying to reduce the chance of level reaching 58% of the storage lymph set by the california safety of dam. then there is the chaos the rain causes on the road. >> other people driving, some people don't understand how to drive in the rain.

"abc7 news" news producer joins us live on the phone from premonth station. ken, how is it going? >> it's going great. much better than i expected. trains have been fairly clean. stations have been clean. i've been riding bart since 8:00 this morning from warm springs to sfo and getting off periodically to check out stations at random. at powell street though in san francisco, i found people sleeping in the hallways leading up to the train and definitely a strong smell of urine in the air. trash hasn't been big problem on the trains but definitely outside of the trains i've seen things like spilt coffee in powell street station. and lake merit station a big pile of used rubber gloves

bottles of empty liquor and beer cans close to a playground. i've also seen a lot of fare inspectors looking for people that are hitching a free ride. when they find them though, they don't tend to be very happy with the ticket that is they do end up get to ride bart. ama. >> ken, it's been interesting. over all you said it was good. but some things you pointed out a lot of people see at other stations, smell of urine, trash every where. >> it's interesting that ken noted that he saw more fare inspectors. because in some places other reporters are seeing none. >> right. >> so there is location to location. we have been getting a lot of comments from bart riders today but we wanted to share a few with you. brenda wrote when i tried to exit the train my shoes were stuck on the floor del norte. i tried to reach the floor one foot came out of the shoe, i missed my stop but managed to free myself.

the other passengers on the train were too busy laughing. i'm glad i didn't wind up on youtube. >> aside from rent, bart is biggest expense. so frustrating to pay for unsafe that tolerates fare evaders. i've used the app to report issues, it seldom results in action from bart police. most common response from them is would you be willing to make a citizen's arrest. so we are expected to do their job for them for free? so a lot of people making remarks. >> yeah that would be frustrating and understandable. check out the voting again. and i think is likely where the hover bart is not going to get grade grades as being the best, but we'll continue our coverage as part of our building a better bay area all evening, and special reports all throughout this week. more fallout from last month's government shutdown, the toll it's taking on the irs. >> and speaking of taxes, were

san jose today launched what it believes is the biggest initiative in the country to

close the digital divide. >> "abc7 news" david louie explains how this could spread to other cities to help them build a better area. >> reporter: those on top light poles the next generation of high speed wireless. they are paying over $2 million a year to lease the space. going to allow 50,000 san jose low income household to connect to the internet. the mayor and counsel have created a digital inclusion fund. >> those that are not collected are not just on the wrong side of the digital divide, they are on the wrong side of income and wealth in our community. >> city's light pole revenue will help kick start from foundations and companies. >> we think it's a great win-win situation between the public sector and private sector and really hope that other cities will model our success here. >> reporter: this initiative is far more than providing internet connections. they have a grand plan to help

because we are not withholding enough? or because we are paying more in tax gs? >> well, actually, so far what i found is people are actually playing less in taxes. effective tax rate is down. but they did a stealth adjustment during the year but wanted to show a big impact from the tax cut so arbitrarily reduced rate schedule. so everybody did get lower withholdings throughout the year and normally people comes as a shock, normally get $4,000 back and now you are getting 2 because less so they could tout bigger tax cut. >> so felt like bigger tax cut than it was. >> yes. >> so are people being caught frat fooded because they owe money? >> so far, no. right now we are at the beginning of the tax season. so most people comin in now are simple w-2 employees.

we haven't gotten to the business side yet. or a people with lot of investments. >> i know this is good news bad news. before i get to that. california, we were especially hard hit by this, right? >> definitely. because they capped state and local, which means your property tax and your state income tax deduction of 10,000 zz. >> you no he what let's get to that in an expedition is. i probably did this out of order. let's start with standard deductions. what are they changed to now? they are better, right? that's the good news. >> right. standard deductions were approximately double to 12,000 to single, 24,000 for filing joint. >> head of households 18,000? >> yes. >> child tax credits. there ha there is a lot going on there. >> right. when they took away the personal exem exemptions, so no more

exemptions for the children, but did double the tax credit up to $400,000 of income you are able to get the child tax credit. so people that receive possibly $2,000 last year, this year will receive $4,000. so that's mitigating other factors in tax returns. >> let's talk about mortgage. the deduction has changed, right? >> well, you are grandfathered in from last year if you had a million outstanding last year, 2017, you'll still be able to deduct it in 2018. the 750 cap is related to new mortgages. so new acquisitions. >> oh. >> yeah. >> so the mortgages that people have right now, they'll be able to keep writing those off? >> exactly. >> wow. >> yeah. >> that's great news. i never heard that before. >> the one thing that is different is on the federal level, you can no longer deduct that $100,000 heloc. so you are capped. in other words it used to be up to 1.1 million now it's capped
