it's saturday, february 16th. good morning and thanks for joining us. i'm chris nguyen. let's start with a first look at the forecast. here's meteorologist lisa argen tracking live doppler 7 for us. >> hi, chris. it's a 1 on our storm impact scale. you've heard the scattered downpours while you were sleeping. the possibility of a thunderstorm, hail, rough surf and snow on higher peaks. you can see that around mt. hamilton right now. higher elevations, snow morgan hill 101 from los gatos in closer to 280, campbell highway 17, looking at prospect road, certainly wet weather there. south city san francisco down through redwood city.

san mateo. as we get closer to san francisco, you can see on fulton and almany boulevard looking at a few showers. in the north bay from larkspur to mill valley this is heading east over to 580. our coastal flood advisory through about 10:00 is combined with high tide looking at minor flooding around the coastal trails and roadways. keep that in mind and temperatures are cool. 39 santa rosa, 45 in hayward and san francisco. and that brings our temperatures anywhere from a couple of degrees to 16 degrees cooler this morning. so prepare for more scattered showers and cool temps today. chris. >> lisa, thank you. in the north bay the westbound lanes of highway 37 of closed because of flooding and now the slowest lane on the eastbound side is shut down for construction to repair the breached levee. liz pena has the details. >> reporter: the slow traffic on 97 westbound is nonexistent.

>> the road is flooded and that's because a levee breached about a mile to our right. >> reporter: a product of the creek being at capacity due to the rain and water spilling onto the field that surrounds the highway and spilling over to the road, causing drivers to reroute to the 101. >> it time to the day. >> reporter: how much more? >> probably 20 minutes. >> reporter: we asked to see the problematic area firsthand. we went under highway 37 eastbound where the levee was breached. the saturated land gave way and the only option now is to fill the hole. >> in novato the river comes through here and the force of the water or just the weight of all that water caused the levee to breach. >> reporter: caltrans closed the slow lane of highway 37 eastbound to do the construction work. some residents tell us they're tired of quick fixes. >> upon the government at this

point to get it fixed. >> reporter: state senator for california mike mcguire tweeted a massive pumping operation will kick off on tuesday that will need to remove approximately 2,000 acre-feet of water. westbound lanes will be closed for at least another week. for a more permanent change on highway 37, caltrans officials tell us that's going to take three years and three extra years for permits. >> caltrans and tahoe law enforcement are warning drivers about hazardous conditions during this historically busy presidents' day weekend. interstate 80, highway 50 and highway 89, all of the major roads to tahoe have chain controls. multiple spinouts and accidents have made travel a mess since yesterday. right now interstate 80 is closed in the sierra because of whiteout conditions. drivers who took highway 50 instead have been sitting in stop-and-go traffic for hours including laura anthony. it look laura and her family eight hours to go 25 miles.

>> we knew darn well that we would sit in traffic for a long time and we have. right now we're showing you, this is highway 50 right above pollack pines so about 4,000 feet. we're just coming up on the chain controls now. it has taken us about two hours from placerville. it's about an hour later now and i'd say we've gone about two miles, i hate to say, but again it's stop-and-go here on highway 50. hi again, i wish i had better news but it's been pretty slow. we're not even quite to there was a big rig that was stuck. it's out of the way now. >> laura anthony said it took nearly 14 hours to get to south lake tahoe. she arrived at 2:45 this morning. live doppler 7 is one of the most popular features on our website as well as the abc 7 news app. if you want to track the storm, click the blue live bar at the

top. you can also check the conditions where you live and enable push alerts to get the latest news as it happens. the u.p.s. driver who would have been behind the wheel during thursday's wild hijacking, police chase and deadly stand-off in san jose is speaking out. amanda del castillo spoke with him on an interview you'll hear only on 7. >> reporter: sheriff's deputies and police officers by the dozens thursday chasing armed suspects through san jose. the u.p.s. driver carjacked and caught in the middle is now being hailed as a hero by the police department. >> i can't speak enough about the u.p.s. driver. he was fantastic. >> reporter: the scene was frightening to darren inman. >> when i realized he was on my route, oh, yeah, that's where i would have been. >> reporter: abc 7 news isn't identifying the driver held at gunpoint but he purposely drove over spike strips. he also made sure he didn't

drive over 50 miles an hour to help officers keep track of the truck. >> the u.p.s. guy was going maybe 25 miles an hour when he went by me. >> reporter: inman said his co-worker's action aren't taught, it's just courage is in the man's character. >> it's thinking quick. what do you do? you don't have time to think so the guy handled himself and i'm thankful that he's all right. >> reporter: the driver was taken hostage in this area. he drove eight miles north where sky 7 caught his eventual release on camera. the female suspect surrendered and was arrested on scene. the male suspect identified as mark moraski was shot and killed after he ran from the truck, gun in hand, toward officers. sjpd said the u.p.s. driver's common sense, quick thinking saved lives. >> we show up every day, do a hard job. the last thing you want to hear is somebody getting abducted and hurt d trying to do their job. >> reporter: the woman arrested

is facing several charges. in san jose, i'm amanda del castillo, abc 7 news. five people are dead and five police officers are hurt after a workplace shooting in illinois. police say this is the gunman, gary martin, an employee who was being fired. he had worked at an industrial warehouse for 15 years. police say martin shot five police officers as they responded to the plant in aurora, about 40 miles west of chicago. five employees were found dead in the building. it's unclear if the employees firing martin were among the victims. the injured officers are expected to survive. in san francisco, scary moments during last night's performance of "hamilton" at orpheum theatre. a medical emergency caused panic and forced an evacuation during the final act. that person was taken out triggering an alarm. someone yelled for help which caused panic. there weregun, but police say te

was no gun. people started running out of the theater. three people werewo oers with me injuries. a witness describes the chaotic scene. >> the people in the front of the orchestra were running out as fast as they can. something was happening, you were trapped because of how fast people were running and saw one person who lost her shoes. it was bad. >> police say the person who had the initial medical emergency possibly suffered a heart attack. she's now in the hospital and reportedly in critical condition. the time now is 5:08 on this saturday morning. as always we have lisa argen tracking the forecast for us and we are off to another chilly start across the bay area. >> and some scattered showers for sure. hopefully you dodged those coming in. today looks wetter than tomorrow. we'll time it out for you. a live look outside san

forecast from meteorologist lisa argen coming up in just a little bit. president trump has declared a national emergency. he cited what he calls an invasion at the southern border to access money for a border wall outside of the federal budget he signed yesterday. abc news white house correspondent jonathan karl was there for the announcement. >> reporter: in the rose garden, the president did what he had long threatened to do, declared a national emergency to get billions of dollars congress won give him to build his border wall. >> we're talking about an invasion of our country. >> reporter: congress only approved $1.4 billion for the wall, but the white house says the president can get an additional $6.5 billion using executive and emergency powers to shift money from other projects. most of it would come from the pentagon, money that is intended for counternarcotics efforts and emergency military construction. the president insists military leaders are onboard. >> they think this is far more important than what they were going to use it for.

i said what were you going to use it for? i won't go into details but it didn't sound too important to me. >> reporter: speaker of the house nancy pelosi called the declaration a power grab and at least ten republican senators criticized the move. marco rubio saying no crisis justifies violating the constitution. >> mr. president, what do you say to those, including some of your republican allies, who say that you are violating the constitution with this move and setting a bad precedent that will be abused by possibly democratic presidents in the future, marco rubio -- >> not too many people have said that. but the courts will determine that. >> reporter: the president made it clear he fully expects to be sued. >> we will have a national emergency and we will then we sued and they will sue us in the ninth circuit, even though it shouldn't be there. we will possibly get a bad ruling and then we'll get another bad ruling and then we'll end up in the supreme court and hopefully we'll get a fair shake. >> reporter: in court the administration will have to prove there is a real emergency,

something the president seemed to undermine with his own words. >> i could do the wall over a longer period of time. i didn't need to do this. but i'd rather do it much faster. >> reporter: jonathon karl, abc news, the white house. california is planning to sue president trump over his national emergency declaration. governor gavin newsom called it a political game that is nothing more than an attempt to satisfy the president's base. >> i don't want to be a sparring partner with president trump, we want to be a working partner. but it makes it all but impossible when he plays these games and manufactures a crisis. >> he has the power to declare a national emergency, but this is not 9/11, this is not the iran hostage crisis of 1979. >> the state attorney general did not say when the lawsuit would be filed. he did say he expected to join several other states in suing over the declaration. governor newsom has

announced that he is endorsing senator kamala harris' bid for president. harris is running in what is expected to be the most crowded democratic primary field in modern history. early eve p helpful. nearly 100 students at stanford had their sensitive personal information, including social security numbers compromised due to a flaw in a web system that the university uses. it happened on a platform that lets students view their own admission documents as well as the applications and high school transcripts of other students. the university says it's working to better protect its systems and data. former 49ers colin kaepernick and eric reed have reached a financial settlement with the nfl in their collusion case against the league. the agreement comes just days before kaepernick's case was set to go before an arbitrator. kaepernick alleged that the league conspired to keep him out af kneeling during the national anthem in 2016.

the amount kaepernick and reed received from the nfl was kept confidential and both parties signed comment on the case. new developments on the jesse smolett investigation. chicago police have released the two brothers they had been questioning because of new evidence. they're no longer considered suspects. police believe they are the men in this grainy surveillance photo near the area he said he was attacked last month. yosemite park rangers stumbled upon a strange phen phenome phenomena. an enormous snow roller that formed at the bottom of a hill. a snow roller is created when a small clump of snow falls from a tree branch on to a slump and creating a rare and beautiful snowball. goog to you. live doppler 7, we still have a winter storm warning in effect for the sierra nevada. i'll show you that in just a moment. right now look at all the green

on your screen. this is a progressive system that continues to show the showers moving from north to south, also across the bay here northwest to southeast. as we get in a little bit closer, you'll notice here that the pink representing the snow around the summit, highway 17 here over on mt. hamilton, and on the peninsula from east palo alto to mountain view and sunnyvale, woodside maybe a few showers here and into the south bay from foothill drive, looking at wet weather, over into redwood city and san mateo across the san mateo bridge looking at scattered showers over in oakland, 580. and back through emeryville it's wet, the shower moving across to the east bay. showers up through dillon beach so it's going to be one of those soggy days. you can see the snow from lake

county. we'll look at this throughout the weekend as the temperatures are going to be hard pressed to make it to near average readings. south lake tahoe looking at light snow and a winter storm warning all throughout the sierra nevada, 1 to 3 feet. additionally could see up to 4 theyavse jbeevle snow amounts for the season. as we go into your early morning sunday, an additional foot of snow near kirkwood. you heard about the road closures there, just a treacherous time trying to get up to the mountains. certainly pretty good snow, we can get there, but as we look at the snowpack, look at how good we're doing from the central sierra. 147% of the statewide 141%. unbelievable amounts even down through manmouth. it is 39 in santa rosa, 45 in hayward, 42 in fremont. looking live from our east bay hills camera where we do have a

little bit of fog out there, so scattered brief downpours today, even some thunderstorms, perhaps sme hail. snow over the highest peaks and a wintry mix through tomorrow. then we'll be looking at a pattern shift, so we do also have a high surf advisory. look at the waves, 16 feet bodega bay. we'll be looking at this throughout the day today. it's a 1 on our storm impact scale today so keep that in mind. you'll also see some sunshine out there. as we go through the next several hours, notice by 7:30 scattered showers around the bay into your midday. you'll see partly cloudy skies and some rain in the east bay, in the south bay. 3:30, it looks like you have a break but the rain comes back for a brief time and then we get a break into the overnight hours. some colder air again and higher elevations looking at snow around mt. hamilton. as we take you into sunday afternoon, that looks like when things will really quiet down. rainfall amounts throughout the

are robo calls driving you crazy? last year an estimated 25 billion robo calls were made in the u.s. the number is increasing. still 7 on your side's michael finney says there is room for hope. >> if you want to start a conversation with a stranger, a passionate conversation, just bring up recorded telephone sales pitches. we're doing a story on robo calls. are you getting a lot of those? >> oh, my god. i get so many robo calls. so many. five, six, seven a day. >> your vehicle reached a certain mileage. again, press 1 to be connected to a warranty specialist. >> it is an onslaught. alex heads up u-mail a visual voice mail service that offers call blocking.

>> our estimate for the last quarter was averaging about 5 billion a month. that's an astonishing number of these robo calls. about half of them are scams. >> it never ends. it never ends. >> but it may. it has for this guy. he sees robo calls letting up. >> i got a lot of robo calls but less lately now that we're talking more about it. i'm getting less of it. >> so is he lucky or on the cutting edge? as bad as things are now, things are actually on the verge of getting better. >> i think they're going to keep coming, but there's a lot of action taking place now that should ultimately start reducing them in the same way that we saw e-mail spam eventually get down to a very minor nuisance. >> how? well, u-mail and other third parties are blocking calls. so are carriers. and the government is encouraging all of this work. so itppen, i will just

take a while. i'm michael finney, 7 on your side. in san francisco, new developments on edna, the fire station cat. workers at station 49 adopted edna four years ago but were recently forced to give her up after an anonymous complaint. workers say they received a cease and desist order instructing them not to talk about the identity of the person who filed the complaint. at least one fire commissioner says employees should be entitled to express their opinions about edna but not target one individual. state health experts are zeroing in on a chemical found in many types of nail care products. the department of toxic substances announced -- control announced a campaign to phase out toluene in nail products in california. experts say it poses a serious health threat to salon workers who breathe in the fumes on a daily basis. >> so it is known, it's

researched, it's validated that it can cause memory loss. we know that it can cause developmental delays in children if you're exposed to that. it can cause miscarriages and other reproductive harms. >> they say proposed regulation would force manufacturers to research an alternative to replace the chemical in their products. they also launched a certification program for salon owners to let customers and employees know that they only use toxin-free products. general motors is getting into the bike business. gm has introduced the arrive, an e-bike with an electric motor that gm says can be charged in 3.5 hours. one charge can provide 40 miles of motorized riding. gm says the arrive will first be available in europe. it will cost around $2,500.

good morning and thanks for being with us. i'm chris nguyen. we're starting this half hour with a quick look at the weather. lisa argen is tracking the conditions where you live. >> hey, chris, it's a 1 on our storm impact scale. more scattered downpours, the possibility of some hail and some snow in the higher elevations. looking at rough surf as well and the possibility of thunderstorms. so as we go in closer to the south bay, you can see the pink around mt. hamilton. scott's valley, santa cruz looking at the wet weather. also around pen grove and cupertino looking at wet weather. redwood city from san carlos, lakeview way, some scattered showers for you and over into san leandro. skyline boulevard, also around 580 some showers and into the north bay some dry areas and it's wet again out through point reyes. so coastal advisory right through 10:00 this morning right

along the shoreline in combination with high tide. 46 in concord, 39 in santa rosa right now. so with the cooler weather, we're looking at not only scattered showers, maybe some brief heavy downpours and looking at this pattern to last throughout the day. but then we'll get a break the second half of your weekend. chris. in the south bay santa clara county officials have expanded shelter services during the continuing rain and cold weather. three overnight warming locations will be open through tuesday morning. they'll be at the bascom, leninger a leninger in san jose. there are daytime warming centers at libraries and other community and senior centers throughout the county. as the rain came down here, snow has been falling at lake tahoe. it's a big draw for sdkiers and snowboarders. caltrans reopened interstate 80 last night just after 6:00 as long as you have chains. the traffic wasn't too bad

there, but look at highway 50 where the backup was enormous. abc 7 news reporter laura anthony said it took her nearly 14 hours to get to south lake tahoe. leslie brinkley has more on what is one of the biggest ski weekends of the season. >> reporter: nothing like walking your dogs in a blizzard, a whiteout, as evident in this video shot by kevin cooper with kirkwood mountain resort. >> with the wind and the snow, it makes for very challenging driving conditions right now. >> reporter: so it's like a whiteout as you look out your car window right now? >> it looks like a snow globe. >> reporter: a snow globe. the communications manager of south lake tahoe, chris fiori explained it the same way. >> to me it's like the inside of a snow globe. the snow is thick and this morning it was snowing sideways essentially, just trying to get around was really tough. >> he's got some skis.

>> reporter: but despite the road closures and chp and caltrans warnings, avid snow lovers were still lining up at sports basement to pick up their rental gear. the most popular item, snow shoes are flying out the door. how better to walk through powdery six-foot drifts. >> many are watching and waiting. many are going to other areas or taking alternative routes. many are still enthusiastic that the highway will open. >> we were supposed to leave this morning but now we're leaving tomorrow morning. >> i was just up there and my car spun around three times. i learned how to steer going backwards sliding down a mountain. >> reporter: she is waiting for the all-clear on sunday and monday before attempting to go. for 50 years dennis roland has been going skiing in the sierras. >> this season has been wonderful. we've had snow that you normally think of going to colorado or utah to enjoy. thessive, but they have also been cold,d

normally call sierra cement. >> reporter: up at squaw valley, they expect to break their all-time february snowfall record by saturday. >> right now most of our lifts are on hold either due to high winds or high avalanche danger. so our teams are currently out there clearing lifts, working on avalanche control. so yeah, it's definitely a dynamic weather situation when we're getting snow totals like this. >> reporter: so heed the warnings, check the caltrans website before heading off. it's going to be a rough drive up there before you can start having fun. still stuck in walnut creek, i'm leslie brinkley, abc 7 news. in the north bay napa has received a lot of rain, but as abc 7 news reporter waynefrdmang

to plan. >> reporter: it used to be napa's dirty little secret, the one they don't talk about anymore because they don't have to. >> was this city put in the right place? >> for boat traffic, yeah. for flooding, no. it's flooded 22 times in its history. >> reporter: a statistic that deputy flood control director phil miller worries about less and less, and here's why, the ox bow bypass. video from sky 7 adds context. while napa looked inundated, we're seeing the river water flowing around and away from trouble. >> so this area here? >> was flowing about 2 feet deep. >> reporter: it is phase two of a $600 million project. in 1997 voters approved a 20-year, half percent sales tax to divert overflows. bernard one of those with a vision. >> look at downtown napa as a place t go to, to build, to invest. >> reporter: they were tired of scenes like this. >> afraid to go in. >> reporter: it was the last

time the river overran parts of downtown causing $13 million damage because they hadn't built enough bypass yet. >> huge trees, logs, rocks, stuff just tumbled. this was like the colorado river. >> reporter: but that was then. john recalled giving customers one beer for every sandbag they filled. >> you don't worry about the river anymore? >> don't worry about it at all. >> reporter: because while we did find mud at napa, it was exactly where expected and designed. this is good mud. it could be much, much worse. it is worth noting that the bypass project still is not finished. in napa, some 2,000 properties remain vulnerable to flooding. at this point it's a matter of getting enough money to finish the job. in napa, wayne freedman, abc 7 news. a section of highway 37 in marin county remains closed because of flooding. the closure impacts the westbound lanes from the lakeville highway to highway 101. the chp says it will be closed

into the foreseeable future. the slow lane in the eastbound direction was also closed last night so construction crews can make emergency repairs to a levee. you can track the rain and check the conditions where you live with the abc 7 news app. you can also get the most up-to-date forecast and check out live doppler 7. don't forget to enable push alerts to get notifications about weather warnings or hazards. in the east bay, oakland teachers could announce plans for a strike today. they had been waiting for a key report from the state that came out yesterday. abc 7 news reporter has the story. >> reporter: it's saturday's announcement about a possible teacher's strike that's on her mind. >> my concern one thing is for the kids because now they'll be out of school. >> reporter: the oakland education association is planning a big announcement for saturday, whether or not they will strike. their facebook page warning parents to be ready with the slogan #strikeready.

the three main points they're fighting for, smaller class size, more counselors and nurses for students, and a 12% raise over the next three years. johnson says smaller class size is important for parents too. that's why she's supporting the teachers. >> if this is what they have to do to get the word across, i think it's good. >> reporter: the district says they don't have the money and that they have to shut schools. they're offering only a 5% raise. many in the community like taylor memorial church in oakland are rallying behind teachers and students. the church will open its doors to students so they have a place to go if teachers go on strike. >> the meeting is set for 1:30 this afternoon at the oakland education association office. if teachers do go on strike, they will give parents a 48-hour notice. download the abc 7 news app and enable breaking news alerts. as soon as the announcement is made, we'll send out a push alert right to your phone. still ahead on "abc 7

this week's oscars is just eight days away and it appears the complaining has paid off. yesterday the producers of the 91st academy awards reversed course and announced the winners of all categories will be announced live on the oscars telecast. earlier this week producers created some controversy when they said the winners in four lower profile categories would be announced during commercial breaks. criticism was immediate. directors martin scorsese blasted it. russell control called it fundamentally stupid. you can watch the oscars only on abc 7. awards will be handed out sunday february 24th at 5:00 p.m. dion lim will be there starting friday, february 22nd, bringing you coverage as all the preparations get under way. she'll give us a behind-the-scenes look both on air and on social media. she's great at that. weatherwise we are looking at wet roads out there and cool temperatures as well.

min mindi bach has the details in this morning's sports. >> good morning, everyone. the first day of the nba all-star weekend in charlotte is in the books. the warriors all-stars, especially stephen curry, were very busy. steph and his brother seth coached kids at a basketball clinic. look at klay thompson, he helped test a refurbished playground for kids. yep, the slide works fine. he also did some painting as well, getting those wrist movements down. the curries grew up playing on all the courts in charlotte so this weekend holds special meaning. >> this is where i learned how to play the game. a community that supported me and my family growing up. obviously what my dad was able to do here, playing for ten years for the hornets. so it all comes back full circle. >> charlotte is an amazing host city. being back here for the nba all-star game is a great feeling. we're very recognized with people around town, so just a good base community. doing whatever we can to help
